A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH
SAN FRANCISCO RESCINDING RESOLUTION NO. 2524 AND CANCELING
THE DEED THEREBY AUTHORIZED AND FURTHER AUTHORIZING A NEW
DEED ON THE SAME TERMS EXCEPT FOR TIME OF PERFORMANCE,
WHICH SH~T.T. BE A REASONABLE TIME
WHEREAS, the City of South San Francisco has met the requirements of the
Govermaent Code for the location of a Department of the Superior Court, and
WHEREAS, the County of San Mateo desires to locate in South San Francisco
the first Department of the Superior Court to be located in the northern part of
San Mateo County, and
WHEREAS, the City of South San Francisco is the owner in fee of certain
real property, hereinafter particularly described, which is suitable as a site for
said Department of the Superior Court, and
WHEREAS, it is deemed advantageous to and in the best interest of the
citizens of South San Francisco and for the common benefit to have said Department of
the Superior Court located within the confines of said City, and
WHEREAS, the terms set forth, in Resolution No.'2524 required revision,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South
San Francisco that Resolution No. 2524 is hereby rescinded.
BE IT FURTHER RESOLVED by the City Council of the City of South San Fran-
cisco that said City shall enter into an Indenture with the County of San Marco for
the purpose of transferring to said County, in consideration for its location of
suitable quarters or facilities for the first branch of the Superior Court located in
the northern part of San Marco County, the following described real property:
BEGINNING at a point on the Northeasterly line of Mission Road,
said point being the most Southerly corner of Lot 8 Block 2 Map
of Regli Tract, filed A~ril 7, 1924, in Book 11 of Maps at page 63;
running thence North 10v 21' 36" East on and along the Easterly
line of said L~t 8, 151.42 feet; thence South 74° 07' 22" East
208.49 feet; thence South 14° 32' West 321.43 feet to a point on
the said Northeasterly line of Mission Road, thence Nerth 33° 52' 56"
West on and along the said Northeasterly line of Mission Road 264.03
feet to the point of beginning. CONTAINING 1.09 acres of land.

BE IT ALSO FURTHER RESOLVED that the conveyance of said property shall
be upon the express condition that if said Grantee, the County of San Marco, shall
within a reasonable time from the date of said cenveyance not provide suitable
quarters or facilities for the first branch of the Superior Court located in the
northern part of San Marco County by using said parcel te accommodate the suitable
quarters or facilities of the said branch of the Superior Court, then the estate
hereby conveyed shall revert te and revest in the said Grantor, City of South San
Francisco, its successors or assigns and it shall be lawful for the City er them to
reenter upon the premises hereby conveyed. Grantee, Ceunty of San Matee, should
the administration of justice and public good require it, may elect to establish
the suitable quarters or facilities for the said branch of the Superior Court in
some other more suitable area ef said City, in which event the right of reversion
and reentry contained in this paragraph shall terminate and have ne further effect.
BE IT ALSO FURTHER RESOLVED that {he conveyance of said property shall
be upon the express condition that if Grantee, Ceunty of San Mateo, shall at any
time abandon, terminate or cease to use said parcel hereby conveyed er the site
selected by the County of San Matee in some ether area of South San Francisco,
as hereinbefore provided, for quarters or facilities er to accemmodat e the quar-
ters or facilities of the branch of the Superior Court whether said abandonment,
termination, or cessation of use is caused by operation of law, act of the County
of San Marco or otherwise then the estate hereby conveyed shall revert te and re-
vest in the Grantor, South San Francisco, its successors or assigns and it shall
be lawful for City or them to reenter upon the premises hereby conveyed.
BE IT ALSO FURTHER RESOLVED that the Mayor of said City be, and he
hereby is, authorized to execute the aforementioned Indenture on behalf of said
City, and that the City Clerk be, and he hereby is, instructed to attest to the
same and to affix thereto the corporate seal of said City. After said Indenture
shall be so executed, it shall be forwarded to the Board of Supervisors of the
County of San Marco by the City Clerk, together with two (2) certified copies of
this resolution.
I hereby certify that the foregoing resolution was regularly
introduced and adopted by the City Council of the City of South San
Francisco at a regular meeting held this 4th day of November 1957, by
the following vote:
