HomeMy WebLinkAboutReso 2543-1957RESOLUTION NO. 2543 CITY OF SOUTH SAN FRANCISCO LINDENVlLLE INDUSTRIAL PARK IMPROVEMENT DISTRICT RESOLUTION OF INTENTION WHEREAS, in accordance with the provisions of Section 2804 of the California Streets and Highways Code, the owner of more than sixty (60)per cent in area of the property to be subject to assessment for the proposed improvements hereinaft~ described has signed and filed with the City Clerk of the City of South San Francisco a written petition for said improvements in proceedings to be. taken by the City Council pursuant to the Municipal Improvement Act of 1913 and for the issuance of bonds in s~ d proceed- ings under'the Improvement Bond Act of 1915, and by said petition waived all proceedings required by the provisions of Division 4 of said Streets and Highways Code (being the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, Streets and Highways Code Sections 2800-3012); and WHEREAS, said City Council by its resolution entitled "Resolution Appointing Engineers" adopted November 18, 1957, appointed Wilsey & Ham, Engineers, Millbrae, San Mateo County, California, as Engineers to do and perform all engineering work necessary in and for said proceedings, including all preliminary surveying, preparation of plans profiles, specifications, estimate of costs, diagram, assessment, setting grade stakes and supervision work; and WHEREAS, the public interest and convenience require the construction and in- stallation of said proposed improvements; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA, as follows: 1. The foregoing recitals are true and correct and the City Council so finds and determines. 2. The City Council hereby finds that said petition has been signed by the owner of all the property to be subject to assessment for the proposed improvements here- inafter described, and hereby grants said petition and hereby determines that the situa- tion described in clause (3) of Section 2804 of the Streets and Highways Code exists and that Division 4 of the Streets and Highways Code shall not apply to the proceedings here- inafter provided for. 172 3. The public interest and convenience require the construction and in stallation of the proposed improvements hereinafter described. 4. It is the intention of the City Council of the City of South San Francisco to order the following work to be done and improvements to be made in the City of South San Francisco in an assessment district (hereinafter provided for) designated "Lindenville Industrial Park Improvement District", the exterior bound- aries of which are hereinafter specified and described in paragraph 6 hereof, said work to be done and said improvements to be made being briefly described as~follows, to wit: Improvements comprising the construction of paving and grading for streets with 8 inch untreated base and 3 inch plant mix surfacing, concrete curbs and gutters, sidewalks, sanitary sewer facilities~ storm drain lines, a storm water pump station, manholes and catchbasins, monuments, fire alarm system, street signs and the appurtenances for above work all on Victory Avenue between Spruce Avenue and South Maple AVenue, Ryan Way from a point on Victory Avenue to about 570 feet south, South Maple Avenue frOm Victory Avenue to the intersection at Hungtinton Avenue east at the most southerly boundary of the subdivision, Browning Way from South Maple Avenue to a point about'212 feet west, and a san- itary sewer on Spruce Avenue from Victory Avenue to a point about 440 feet south. Except as in this resolution otherwise specifically provided, all of said work and improvements shall be made and done pursuant to the Municipal Improvement Act of 1913. 5. Notice is hereby given of the fact that in certain cases the work of grading and surfacing of streets will bring the finished.surfaces of the improved streets to grades different from the surfaces of such streets as they now exist or as formally established by the City Council. Said City Council does hereby adopt and establish as the official grades for said work the grades and elevations shown on report of the Engineers hereinafter directed to be made and filed as hereafter adopted, confirmed and approved by this City Council, to which report reference is hereby made for a description of said grades and elevations. 6. Said City Council hereby declares that the territory within the boun- daries hereinafter specified and described is the district to be benefited by said work and improvements and to be assessed to pay the cost and expenses thereof; and that the expense of said work and improvements is hereby made chargeable upon said district. The exterior boundaries of said assessment district are hereby specified and described to be as shown upon that certain map entitled."Assessment Diagram, Lindenville Industrial Park, South San Francisco, San Marco County, California" now on file in the office of the City Clerk of the City of South San Francisco, which said map indicates by a boundary line the extent of the territory included in said assessment district and shall govern for all details as to the extent of said assess- ment district. A copy of said map is attached hereto marked "Exhibit A" and made a part hereof. 7. All public streets, alleys, easements and ways and all publicly owned property in said assessment district in use in the performance of a public function shall be omitted from said assessment hereafter to be made to pay the cost and ex- penses of said work and improvements. 8. The City Council hereby declares and notice is hereby given that serial bonds to represent unpaid assessments and to bear interest at a maximum rate of not to exceed 6% per annum payable semi-annually will be issued hereunder in the manner provided by DiviSion 10 of the Streets and Highways Code, the Improvement Bond Act of 1915, and the last installment of said bonds shall mature fourteen (14) years from the 2nd day of July next succeeding ten (10) months from their date. 9. The City Council hereby finds and determines that if the assessment herein proposed results in a surplus in the improvement fund to be provided in the proceedings hereafter to be taken pursuant to this resolution, after the improvement is completed, said surplus shall be refunded or credited pro rata to the parties assessed, all in accordance with the provisions of Section 10427 of the Streets and Highways Code. ~ 10.
