HomeMy WebLinkAboutReso 2564-1958RESOLUTION NO. 2564 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING THAT INVESTIGATION PROCEEDINGS ARE NOT RE(~UIRED IN CONNECTION WITH THE II~ROVEMENT OF HARBOR WAY FROM ITS NORTHERLY TERMINUS AT EAST GRAND AVENUE, IN SAID CITY, AND EXTENDING SOUTHERLY THEREFROM TO THE IMPROVED PORTION OF SAID HARBOR WAY AT THE NORTHERLY EDGE OF THE SUBDIVISION KNOI~N AS "SOUTH SAN FRANCISCO INDUSTRIAL PARK" BE IT RESOLVED by the City Council of the City of South San Francisco, California, that: WHEREAS it is the intention of said City Council to make the following improvements in and for said city, to-wit, the improvement of the proposed extension of Harbor Way from the northerly terminus thereof, at East Grand Avenue in said City, and extending southerly therefrom to'the improved portion of said Harbor Way at the northerly edge of that certain subdivision known as "South San Francisco Industrial Park", such work of improvement to consist of all the following:. 1. (a) The grading and preparation of the subgrade for pavement; (b) The construction and installation of standard curb and gutter; (c) The construction and installation of concrete sidewalks; (d) The construction and installation of reinforced concrete pipe storm drains; (e) The construction and installation of standard storm water catch basins; (f) The construction and installation of pavement consisting of an eight (8)-inch crusher-run base with plant-mixed surface; and 2. The performing of all work auxiliary to any of the above which may be necessary to complete the same; and 3. The acquisition of such lands, or rights-of-way, or such existing improvements as shall be necessary; and WHEREAS the owners of more than sixty percent (60%) of all the property within the area proposed to be established as a special assessment district for the performance of the foregoing described work of improvement, which district shall be known as "Harbor Way Assessment District'', have signed and filed with this City Council a written petition for the doing of said work and waiver of proceedings under the "Special Assessment, Investigation, Limitation and Majority Protest Act of 1931"; and WHEREAS the City of South San Francisco is the owner of a parcel of prop- erty lying within the area of the proposed special assessment district, NOW, THEREFORE, IT IS ORDERED, FOUND, AND DETERMINED AS FOLLOWS: 1. In view of the filing of the aforementioned written petition and waiver, which has been signed by the owners of more than sixty percent (60%) of all the property within the proposed assessment district, no investigation pro- ceedings are required by law to be had under the Special Assessment, Investigation, Limitation and Majority ProteSt Act of 1931. Accordingly, this City Council shall proceed under the provisions of the Municipal Improvement Act of 1913, as amended, and the Improvement Bond Act of 1915 to carry through the contemplated proceedings without any further restrictions whatsoever by reason of the terms and provisions of said Special Assessment Investigation, Limitation and Majority Protest Act of 1931. 2. The boundaries of the lands and of the districts of lands proposed to be specially assessed to pay the costs and expenses of such work and proposed provement are generally described in "Exhibit A", hereto attached and by this refer- ence,made a part hereof. 3. With respect to the parcel of land owned by the City of South San Fran- cisco, as in the premises hereto mentioned, said City shall, just as in the case of any private party owner and in the same manner, bear a proportionate share of the burden of paying for the proposed work of improvement, with the amount of said City's assessment being fixed in accordance with the benefits deriving to its said property. 4. The statute under which it is proposed to conduct' proceedings for the proposed ~aprovement is the "Municipal Improvement Act of 1913", as amended, and it is proposed to pay for said improvements by special assessment upon adjacent property upon an area basis with bonds to be issued as authorized under the "Improvement Bond Act of 1915". I hereby certify that the foregoing resolution was regularly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting thereof held on the 6th day of January, 1958, by the fol- lowing vote: AYES, Councilmen G.
