HomeMy WebLinkAboutReso 2567-1958RESOLUTION OF INTENTION NO. 2567 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO DECLARING ITS INTENTION TO IMPROVE HARBOR WAY FROM ITS NORTHERLY TERMINUS AT EAST GRAND AVENUE IN SAID CITY, AND EXTENDING SOUTHERLY THEREFROM TO THE IMPROVED PORTION OF SAID HARBOR WAY AT THE NORTHERLY EDGE OF THE SUBDIVISION KNOWN AS "SOUTH SAN FRANCISCO INDUSTRIAL PARK" BE IT RESOLVED by the City Council of the City of South San Francisco, California, that in its opinion the public interest and convenience require, and that it is the intention of'said City Council to order, the improvement of the proposed extension of Harbor Way from the northerly terminus thereof, at East Grand Avenue in said City, and extending southerly therefrom to the im- proved portion of said Harbor Way at the northerly edge of that certain subdiv- ision known as "South San Francisco Industrial Park", such work of improvement to consist of all the following: 1. (a) The grading and preparation of the subgrade for pavement; (b) The construction and installation of standard curb and gutter; (c) The construction and installation of concrete sidewalks; (d) The construction and installation of reinforced concrete pipe storm drains; (e) The construction and installation of standard storm water catch basins; (f) The construction and installation of temporary curbs; and (g) The construction and installation of pavement consisting of an eight (8)-inch crusher-run base with plant-mixed surface. 2. The performing of all work auxiliary to any of the above which may be necessary to complete the same. 3. The acquisition of such lands, or rights-of-way, or such existing im- provements as shall be necessary. 4. All said work and improvements are to be constructed at the places and in the particular locations, of the forms, sizes, and dimensions and materials, and at the lines, grades and elevations, as shown and delineated upon the plans, profiles, and specifications to be made therefor, as hereinafter provided.~ 5. There is to be excepted from the work above described any of such work already done to line and grade, and marked excepted or shown not to be done on said plans, profiles, and specifications. 6. Said City Council does hereby adopt and establish as the official grades for said work the grades and elevations to be shown upon said plans, profiles, and specifications. All such grades and elevations are to be in feet and decimals thereof with reference to the datum plane of the City of South San Francisco. 7. Notice is hereby given of the fact that in many cases said work and provement will bring the finished grade to a grade different from that formerly existing, and that to said extent said grades are hereby changed and that said work will be done to said changed grades. 8. Said contemplated work, acquisitions, and improvements, in the opinion of said City Council, are of more than local or ordinary public benefit, and said City Council does hereby make the expenses of acquiSitions and improvements charge- able upon a district benefited thereby, which district lies wholly within the City of South San Francisco, County of San Marco, State of California, and is particu- larly described on Exhibit A, hereto attached and made a part hereof by this refer- ence. 9. Notice is hereby given that serial bonds to represent unpaid assess- ments and to bear interest at a rate not to exceed six percent (6%) per annum will be issued hereunder in the manner provided by Division 10 of the Streets and Highways Code in the Improvement Bond Act of 1915, and the last installment of such bonds shall mature fourteen (14) years from the 2nd day of July next succeeding ten (10) months from their date. 10. Except as herein otherwise provided for the issuance of bonds, all the work above mentioned shall be done pursuant to the provisions of the Municipal Improvement Act of 1913, as amended. 11. Reference is here made to that certain resolution of said City Council which is numbered 2564 and which was adopted on the 6th day of January , 1958, wherein said City Council made findings and determined that proceedings pur- suant to Division 4 of the Streets and Highways Code of the 'State of California are, in so far as this improvement project is concerned, unnecessa'ry. 12. Said proposed improvements are hereby referred to WlLSEY & HA~, duly provements as shall be necessary. 4. Said proposed improvements are hereby referred to WILSEY & HAM, duly licensed civil engineers employed by the City of South San Francisco as the engineers for the instant improvement project, and who have been designated by the said City Council as the persons having charge and control of the construction of public im- provements in and for said City of the kind described herein, they being competent persons employed by said City for that purpose; and said WILSEY & HAM are hereby directed to make and file with the City Clerk of said City a report in writing, pre- senting the following: (a) Plans and specifications of the'proposed improvements to be made pursuant to this Resolution of Intention; (b) Engineers' statement of the itemized and total estimated costs and expenses of said improvements and of the incidental expenses in con- nection therewith; (c) Diagram showing the assessment district above referred to, and also the boundaries and dimensions of the respective subdivisions of land within said district as the same existed at the time of the passage of this Resolution of Intention, each of which subdivisions shall be given a separate number upon said diagram; and (d) 13. A proposed assessment of the total amount of the costs and expenses of the proposed improvements upon the several subdivisions of land in said district in proportion to the estimated benefits to be re- ceived by such subdivisions, respectively, from said improvements, and of the expenses incidental thereto. If any excess shall be realized from the assessment, it shall be spent for the maintenance of said improvements, unless said City Council.shall hereafter determine that said amount, or any part thereof, shall be applied as a credit to each assessment herein. I hereby certify that the foregoing resolution was regu- larly introduced and adopted by the City Council of the City of South San Francisco at a regular meeting held this~6th day of January, 1958, by the following vote: AYES, Councilmen G.
