A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO
RESCINDING A FORMER RESOLUTION AND AGREEI/ENT AND AUTHORIZING THE
EXECUTION OF A NEW AGREEMENT REGARDING WINSTON MANOR #1 SANITARY SEWER
WHERE~S, Fred Bertetta has submitted an amended engineering plan for the Winston
Manor Interceptor Sewer, which in the opinion of the Director of Public Works will cure the
deficiences in the Wind. on Manor #1 Sanitary Sewer, and
WHEREAS, City desires to approve said amended engineering plan and the agreement
for its installation dated the 3rd day of January 19 58.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of South San Fran-
cisco that Resolution No. 2509 and the agreement authorized by it, are hereby rescinded,
consent of the other party to the agreement, Fred Bertetta, having been obtained.
BE IT FURTHER RESOLVED that upon settlement of the claims of the Winston Manor
Home Owner's Association, Russell Stroud and Lois Stroud, his wife, asserted through their
attorney, Antonio J. Gaud/o, in the matters Stroud vs. the City of South San Francisco et al,
and Stroud vs. Stoneson Development Company and the City of South San Francisco, and the
claims of A. Peyton and Mrs. Warren A. Steinkamp, and reimbursement in whole or part as de-
termined by the City Council of the charges for clean out and other services rendered dur-
ing the period that the Winston Manor #1 Sewer line functioned improperly and caused ex-
penditures.of City .labor and materials, the total of settlement of said claim and reimburse-
ment to the City being within the limits of the balance of monies over ~IX THOUSAND DOLLARS
($6,000.00) referred to in Paragraph #l-B, page 2, of the new agreement hereinafter auth-
orized and upon repair or adequate undertaking to repair by Stoneson Development Company
of that section of the sanitary sewer line in the vicinity of 43 Duval that is generally
located adjacent or near the Warren A. Steinkamp premises, should the deficiencies of said
sewer line be now responsibility of Stoneson Development Company, that the amended engineer-
ing plan and agreement submitted by Fred Bertetta dated the 3rd day of January 19 58 ,
for the installation of the Winston Manor Interceptor Sewer should be approved and the a~r
be, and he hereby is, authorized to execute said agreement on behalf of the City of South
San Francisco and the City Clerk is instructed to affix thereof the corporate seal of the
City.
I hereby certify that the foregoing resolution was regularly introduced
and adopted by the City Council of the City of South San FranciSco at a
regular meeting held on the 3rd day of February, 1958, by the following vote:
AYES: Councilmen G. J. Rozzi, Andrew Rocca, Emilio Cortesi and Leo J. Ryan.
NOES: None
ABSENT: Councilman Francis Lucchio
