A RESOLUTION APPOINTING ENGINEER AND ATTORNEYS

RESOLVED, by the City Council of the City of South San Francisco, California,
that
WHEREAS, this Council has determined to undertake proceedings pursuant to
appropriate assessment and assessment bond acts for the construction and financing of
public improvements in said City;
WHEREAS, the public interest and general welfare will be served by appointing
and employing engineers and attorneys for the preparation and conduct of said proceed-
ings and work in connection with said improvements;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That James J. Breen, Millbrae, California, be, and he is hereby, appointed
as Engineer of Work and employed to do and perform all engineering work necessary in and
for said proceedings, including all preliminary surveying, preparation of report, plans,
profiles, specifications, estimate of costs, diagram, assessment, setting grade stakes,
inspection and supervision and preparation of the diagram and assessment in the report,
and that his fees be, and they are hereby, fixed at one percent (1%) of the cost of said
work for the preparation of the diagram and assessme~ , two percent (2%) of the cost of
said work for inspection and supervision, and $19,600 for all other engineering work
herein provided, one-half of said fee to be paid from the proceeds of the sale of the
first sale of bonds in said proceedings, and the balance to be paid monthly in accord-
ance with progress statements of the work to be provided by said Engineer so that all
of said engineering fees will be paid at the time of acceptance of the work, to be
assessed as an incidental expense of said proceedings.
2. That the law firm of Kirkbride, Wilson, Harzfeld & Wallace, San Mateo,
California, be, and they are hereby, appointed and employed to do and perform all legal
services required in the conduct of said proceedings, including the preparation of all
papers not required to be prepared by the Engineer, examining and approving the engin-
eering documents and advising the Engineer in the preparation of his work, advising all
City officials on all matters relating thereto when called upon, and furnishing their
legal opinion on the validity of said proceedings and bonds, and that their compensation
be, and it is hereby, fixed at two percent (2%) of the cost of the acquisitions and im-
provements, exclusive of incidentals, together with reasonable fees for services in ac-
quiring easements or in eminent domain or other suits, to be assessed as an incidental
expense of said proceedings.
I hereby certify that the foregoing resolution was adopted at
an Adjourned Regular Meeting of the City Council of the City of South San Francisco
California, duly held on the 21st day of March, 1958, by the following vote:

Emilio Cortesi, Francis Lucchio and Leo J. Ryan
