A I?~SOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH
SAN FRANCISCO DKTKRMINING'AND'DECI;ARXNG THK NECESSITY
OF REQUESTING' AID ~FROM THE 'UNITED'STATES OF AMERICA IN
DRKI~ING PORTIONS OF COLMA CREEK IN ORDER TO ELIMINATE
A SERIOUS FLOOD HAZARD, AND INSTRUCTING THE CITY MANAGER
TO EXECUTE A FORMAL WRITTEN REQUleST IN THAT REGARD
WHEREAS, due to siltinKcaused by/the run-off of storm waters resulting
from recent heavy rainfall, lares portions of the channel of Colma.Creek, within the
confines of theCity of South San Francisco, have become filled with sand, dirt, and
various kinds of debris, thus resulting in I very serious flood hazard in the event
of further heavy rainfall; and
WHEREAS there is a great likelihood of considerable more rainfall' within
the'next several weeks, rendering it imperative that the filled portionm Of the
above-designated creek be dredged so that there will be adequate capacity to carry
away any end'all run-off storm waters; and
WHEREAS the city has spent considerable sums for dred~in/g and is without
adequate fundm to finance further dredging operations to eliminate the flood hazard
above referred~to;'and
WHEREAS'it has been le~rnedby the Director'of Public Works of said city
that, under appropriate prOvisionm of'Federal law, the San Franctsco*District of the
United States Corps of Engineers.may, upon proper application being made and upon the
giving of certain:assurances, render emergency.assistance to the City of SOuth San
Francisco in the emmrwmn~y restoration hereinabove recited by dredging silt from
portions of the aforementioned creek to restore adequate channel section to safely
carry flood flows.
NOW,-THEREFORK','BE 'IT RESOLVED'bythe City Council of the City of South
San Francisco that said City CoUncil does'findand 'dst'ermine, and'does therefore
declare, that, upon the~basia of~the premises hereto and for other good and Oufficient
reason, an emergency does exist in said city due to a very serious flood hazard and
that said city does not have sufficient funds to eliminate such hazard. Said City
Councildoes further find and determine that it is necessary to make application to
the San Francisco District of the United States Army Corps of Engineers for assistance
in dr~g'portiQ~ of tho channel or Colma Creek within said city, in particular said
portions being from the intersection thereof with Orange Avenue to a point approx-
imately five hun,dred (500)feet east of'South Airport Boulevard.
BE IT FURTHER RESOLVED~that the City Manager of said city be, and he hereby
is, authorized and instructed to execute',~ without delay, and immediately file with
the San Francisco District of the United States Army Corps of Engineers a written request
for aosimtan~e to perform the dredging operations defined in the paragraph immediately
precedtng..~
BE IT ~'I~naRESOLVED by said City Council that, in connection with such
request for assistance, said city shall, and it hereby does, give assurance of its
cooperation in the following matters:
(a) The city will provide without cost to the United States all lands,
easements, and rights-of-way-necessary fOr construction of the project.
(b)
The city will hold and save the United States free from damages due
to the construction work.
(c)
The city will maintain the works after completion'in accordance with
regulations prescribed by the Chief of Engineers.
I hereby certify that'the 'foregoing resolution was regularly
introduced and adopted by the City Council of the City of South San Fran-
cisco at a special meeting held on the ~d of April, 1958, by the following
vote:
