RESOLUTION NO. 2671
RESOLUTION OF INTENTION
· HEREAS, in accordance with the provisions of Section 2804 of the Calif-
ornia Streets and Highways Code, the owner of all the property to be subject to
assessment for the proposed acquisitions and improvements hereinafter described has
signed and filed with the City Clerk of.the City of South San Francisco a written
petitton for said acquisitions and improvements in proceedings to be taken by the
City Council pursuant to the Municipal Improvement Act of 1913 and for the issuance
of bonds in said proceedings under the Improvement Bond Act of 1915, and by said
petition waived all proceedings required by the provisions of D~vision 4 of said
Streets and Highways Code (being the Special Assessment Investigation, Limitation
and Majority Protest Act of 1931, Streets and Highways Code Sections 2800-3012);
and
~IEREAS, said City Council by its resolution entitled "Resolution Appoint-
lng Engineers" adopted July 21, 1958, appointed Wilsey & Hms, Engineers, San Mateo
County, California, as Engineers to do and perform all engineering work necessary
in and for said proceedings, including all preliminary surveying, preparation of
plans, profiles, specifications, estimate of costs, diagram, assessment, setting
grade stakes and supervision work; and
WHEREAS, the public interest and convenience require said proposed acquis-
itiOns and improvements;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTH SAN
FRANCISCO, STATE OF CALIFORNIA, as follows:
1. The foregoing recitals are true and correct and the City Council so
finds and determines.
2. The City Council hereby, f~nd~ that said petition has been signed by
the owner of all the property to be subject to assessment for the proposed acquisitions
and improvements hereinafter describ~d, and hereby grants said petition and hereby
determines that the situation described in clause (3) of Section 2804 of the Streets

and Highways Code exists and that Division 4 of the Streets and Highways Code shall
notapply to the proceedings hereinafter provided for.
3. The public interest and convenience require the proposed acquisitions
and improvements hereinafter described.
4. It is the intention of the City Council of the City of South San Fran-
cisco to order the following work to be done and acquisitions and improvements to be
made in the City of South San Francisco in an assessment district (hereinafter pro-
vided for) designated "Industrial Park Improvement District No. 3", the exterior
boundaries of which are hereinafter specified and described in paragraph 6 hereof,
said work to be done and said acquisitions and improvements to be made being briefly
described as follows, to wit:
1. The acquisition of the cost of relocating power poles along Sperry Avenue
between East Grand Avenue and the northwesterly boundary line of South San Francisco
Industrial Park Unit No. 3, and thence along the common boundary of Unit No. 3 and
the Bethlehem Pacific Coast Steel Company toButler Avenue, a distance of about 3200
feet.
2. The acquisition of the cost of relocating power poles through the north-
easterly portion of Unit No. 3 between the lands of Merck Inc. and Butler Avenue, a
distance of about 1100 feet.
3. The acquisition of the cost of relocating a water supply valve vault,
valves and waterlines in Sperry Avenue of the intersection of East Grand Avenue.
4. The acquisition of a 24" R.C.C.P. storm drain line with appurtenances in
Sperry' Avenue, a length of about 480 feet with inlet and outlet on the lands at Beth-
lehem Pacific Coast Steel Company.
5. The acquisition of excavation and earthwork for certain roads and streets
Within the subdivision boundaries, namely, Sperry Avenue, Eccles Avenue, and Christen-
sen Avenue.
6. Improvements comprising the construction of grading ,and paving for roads
and streets with 8 inches of untreated base and 3 inches of plant mixed surfacing;
sidewalks, concrete curbs and gutters; storm drain lines with manholes, catch basins
and field inlets; sanitary sewer lines with manholes; monument boxes; headwalls and
retaining walls; slope planting for drainage and e~osion control; a fire alarm system;
street ~igns; and appurtenances for the above works, all on Sperry Avenue from East
Grand Avenue northeasterly and easterly about 2,483 feet; Eccles-Avenue from Sperry
Avenue to Butler Avenue; Christensen Avenue from Butler Avenue to a point about 1,020
feet southwesterly; curbs and gutters to be on both sides of said streets; sidewalks
on one side only. Butler Avenue from Eccles Avenue to Christensen Avenue to have
curb, gutter and sidewalk and 8 inch untreated base and 1-1/2 inches of plant mixed
surfacing on the south side of the street only and a storm drainline with appurtenances.
A storm drain to be constructed from the most easterly point on Sperry Avenue to a
point about 804 feet Bortheasterly on the lands of Merck Inc.; a storm drainline from
Christensen Avenue at Butler Avenue southeasterly and easterly about 739 feet to an
outlet on the lands of the City of South San Francisco.
Except as in this resolution otherwise specifically provided, all of said work .and
acquisitions and improvements shall be made and done pursuant to the Municipal Im-
provement Act of 1913.
5. NOtice is hereby given of the fact that in certain cases the work of
grading and surfacing of streets will bring the finished surfaces of the improved
streets to grades different from the surfaces of such streets as they now exist or
as formally established by the City Council. Said City Council does hereby adopt and
establish as the official grades for said work the grades and elevations shown on
report of the Engineers hereinafter directed to be made and filed as hereafter adopted,
confirmed and approved by this City. Council, to which report reference is hereby made
for a description of said grades and elevations.
6. Said City Council hereby declares that the' territory within the boun-
daries hereinafter specified and described is the district to be~benefited by Said
work and acquisitions and improvements and to be assessed to pay the cost and ex-
penses thereof; and that the expense of said work and acquisitions ~nd improvements
is hereby made'chargeable upon said district. The exterior boundaries of said assess-
ment district are hereby spe~tfied and described to be as shown upon that certain map
entitled "Assessment Diagram, Industrial Park Unit No. 3, South San Francisao. man

is hereby madechargeable upon said district. The exterior boundaries ofsaid assess-
ment district are hereby specified and described to bess shown upon that certain map
entitled "Assessment Diagram, Industrial Park Unit No. 3, South San Francisco, San
Mateo County, Californi~' now on file in the office of the City Clerk of the City
of South San Francisco, which said map indicates by a boundary line the extent of
the territory included in said assessment district and shall govern for all details
as to the extent of said assessment district. A copy of said map is attached hereto
marked "Exhibit A" and made a part hereof.
7. All public streets, alleys, easements and ways and all publicly owned
property in said assessment district in use in the performance of a public function
ehall be omitted from said assessment hereafter to be made to pay the cost and ex-
penses of said work and acquisitions and improvements.
8. The City Council hereby declares and notice is hereby given that serial
bonds to represent unpaid assessments and to bear~terest at a maximum rate of not
to exceed 6% per annum payable semiannually will be issued hereunder in the manner
provided by Division 10 of the Streets and Highways Code, the Improvement Bond Act
of 1915, and the last installment of said bonds shall mature fourteen (14) years from
the 2nd day of July next succeeding ten (10) mQnths from their date.
9. The City Council hereby finds and determines that if the assessment
herein proposed results in a surplus in the improvement fUnd to be provided in the pro-
ceedings hereafter to be taken pursuant to this resolution, after the work, acquis-
itions and improvements are completed, said surplus shall be refunded or credited
pro rata to the party assessed, all in accordance with the provisions of Section 10427
of the Streets and Highways Code.
10. The City Council hereby refers said proposed work and acquisitions and
improvements' to said Wilsey & Ham, Engineers of Work for Industrial Park Improvement
District No. 3 and hereby directs said Engineers to make and file with the City Clerk
of the City of South San Francisco a report in writing containing the matters specified
in Section 10204 of the Streets and Highways Code.
