RESOLUTION NO. 2804
CITY COUNCIL, CITY OF SOUTH SAN F~N~O, STATE OF CALIFORNIA
A RESOLUTION DIRECTING CONVEYANCE OF LOMALINDA LOTS 3 AND 4,
BLOCK 1, LOMALINDA TERRACE UNIT NO. 1, SOUTH SAN FRANCISCO, CALIFORNIA
RESOLVED, by the City Council of the City of South San Francisco, County of
San Mateo, State of California, that
WHEREAS, the City of South San Francisco and the San Mateo County Title Insurance
Company have heretofore entered into an Holding Agreement dated the 3rd day of February
1958 wherein it was agreed that title to Lots 3 and 4 in Block I as shown on that certain
map, "Loma Linda Terrace Unit No. 1, South San Francisco, San Mateo County, Ca~lifornia,''
filed in the County Recorder's Office of San Mateo County on June 1, !955, in Book 42 of
Maps at pages 35 and 36, be held for said C~y and said title company agreed to convey
said lots as it may be directed by resolution 'of the City Council of the City of South
San Francisco, and
WHEREAS, the City Council of the City of South San Francisco has heretofore on
the 4th day of May, 1959, duly passed Resolution No, 2781 authorizing the sale of said

WHEREAS, said City Council desires to approve, ratify and effect said sales and
direct the San Mateo County Title Insurance Company to convey said lots as provided for in
the Holding Agreement hereinbefore referred to, and
WHEREAS, the buyers of said lots desire to complete an escrow and have title
insurance pOlicies issued through City Title Insurance Company, 601 Hamilton Street,
Redwood City, California, and City and San Mateo County Title Insurance Company agrees
to except from the Holding Agreement the p~ovision that San Mateo County Title Insurance
Company shall issue the title insurance policies upon conveyance of said lots, said ex-
ception being upon the assumption of the obligation to issue said title insurance by City
Title Insurance Company as in said Holding Agreement provided.
NOW, THEREFORE, IT IS HEREBY ORDERED AND DET~MINED as follows:
1. That the sale of Lot 3, Block 1, to Alfred Kopfmann and Isobel Kopfmann, his
wife; and Robert A. Gomez and Beverly E. Gomez, his wife, for a net price of THREE THOUSAND
DOLLARS ($3,000.00) to Alfred Kopfmann and Isobel Kopfmann, his wife; and Robert A. Gomez
and Beverly E. Gomez, his wife, said lots being those shown on that certain map entitled,
"Loma Linda Terrace Unit No. 1, South San Francisco, San Mateo County, California," filed
in the office of the County Recorder of San Mateo County on June 1, 1955, in Book 42 of
Maps at pages 35 and 36, be approved and ratified, th~ same having been made as authorized

by Resolution No. 2781 duly passed the 4th day of MaY, 1959.
2. That upon City Title Insurance Company assuming the obligation to issue
title insurance policies to buyers, as provided for in the Holding Agreement entered into
between the City of South San Francisco and San MateO County Title Insurance Company
dated the 3rd day of February, 1958, San Mateo County Title Insurance Company shall hereby
be directed to execute a conveyance to Alfred Kopfmann and Isobel Kopfmann, his wife;
and Robert A. Gomez and Beverly E. Gomez, his wife, for Lot 3, Block 1, Loma Linda Terrace,
and execute a conveyance to Alfred Kopfmann and Isobel Kopfmann, his wife; and Robert A.
Oomez and Beverly E. Gomez, his wife, for Lot 4, Block 1, Loma Linda~Terrace, as shown ~n
that certain map entitled, "Loma Linda Terrace Unit No. 1, South San Francisco, San Mateo
County, California," filed in the office of the County Recorder of San Mateo County on
June 1, 1955, in Book 42 of Maps at pages 35 and 36, said conveyances to be deposited in
escrow #94312, City Title Insurance Company, 601 Hamilton Street, Redwood City, Calif-
ornia, to be held in said escrow pending instructions of said City to said escrow holders
as the conditions upon which the conveyances are to be delivered to said buyers.
3. That City agrees to the excepting from the Holding Agreement the provision
that said San Mateo County Title Insurance Company shall issue the title insurance pol-
icies upon conveyance of said lots upon the assumption of the obligation to issue said
title insurance policies as in said Holding Agreement provided by City Title Insurance
Company and consent in writing filed with City by San Mateo County Title Insurance Company
and further the undertaking by either San Mateo County Title Insurance Company or City
Title Insurance Company to indemnify against the exception set forth in City Title Insur-
ance Company's Preliminary Report dated April 30, 1959, said exception being #5, #6, #7,
#8, #9 and #10.
I hereby certify that the foregoing resolution was regularly intro-
duced and adopted by the City Council of the City of South San Francisco at a
regular meeting held on the 1st day of June, 1959, by the following vote:
