HomeMy WebLinkAboutReso 2839-1959RESOLUTION NO. 2839 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AGREEING TO THE TERMS OF THE SMALL CRAFT HARBOR COMMISSION RESOLUTION GRANTING PLANNING LOAN TO THE CITY OF SOUTH SAN FRANCISCO WHEREAS, the Division of Small Craft Harbors of the State of California has heretofore by resolution authorized the grant of a loan to the City of South San Francisco for planning of a harbor development project at South San Francisco, and WHEREAS, the City Council of the City of South San Francisco desires to, by resolution, accept the terms of the resolution of the Division of Small Craft Harbors in its entirety; NOW, THEREFORE BE IT RESOLVED by the City Council of the City of South San Francisco that the terms of the resolution adopted by the Small Craft Harbor Commis- sion at a meeting held in Oceanside, California on June 15, 1959, whereby the Division of Small Craft Harbors granted a loan to the City of South San Francisco in the sum of NINE THOUSAND SEVEN HUNDRED FIFTY DOLLARS ($9,750.00), payable from the Small Craft Harbors Revolving Fund, are hereby agreed to and accepted in their entirety; said resolution being in form and substance as that attached hereto as Exhibit "A", re- ferred to and made a part hereof as if set forth herein verbatim. I hereby certify that the foregoing resolution was regularly in- troduced and adopted by the City Council of the City of South San Fran- cisco at a regular meeting held on the 20th day of July, 1959, by the following vote: AYES, NOES, ABSENT, Councilmen Andrew Rocca, G. RODONDI CITY CLERK RESOLUTION NO. 2839 (CONTINUED) EXHIBIT "A" WHEREAS, the City of South San Francisco, California, on May 18, 1959, filed with the Small Craft Harbors Commission a request for a loan from the Division of Small Craft Harbors under the provisions of the Small Craft Harbors Law, also known as Section 5801, et seq, of the Public Resources Code, said loan to be used for engineering and economic study in the planning of a harbor development project at South San Francisco; and WHEREAS, at a meeting held in Oceanside, California, on June 15, 1959, said Commission recommended the proposed project as being eligible for financial assistance in the amount of nine thousand seven hundred fifty dollars ($9,750); and WHEREAS, on June 15, 1959, the Division of Small Craft Harbors received an application and the recommendation of said Small Craft Harbors Commission; and WHEREAS, the Division of Small Craft Harbors, having reviewed pre- liminary economic and engineering studies of the proposed project, has de- termined, prior to recommending said project to the Small Craft Harbors Commission, that the project is feasible as provided in said law; and WHEREAS, adequate monies are available for the making of this loan out of the unobligated balance in the Small Craft Harbors Revolving Fund; and WHEREAS, the Small Craft Harbors Commission has, and does hereby approve the findings of the Division of Small Craft Harbors; and WHEREAS, this project has been determined to serve a statewide purpose and is of statewide significance for the benefit of the people of the State of California; now, therefore, be it RESOLVED, that, the Division of Small Craft Harbors make a loan to the City of South San Francisco in the sum of nine thousand seven hundred fifty dollars ($9,750) payable from the Small Craft Harbors Revolving Fund, for the planning purposes as set forth in the application of the City of South San Francisco on file with this Division; said loan to be repaid in 'accordance with a final plan of repayment (not to exceed ten (10) years) to be submitted by the City of South San Francisco and to include a charge fixed by the Pooled Money Investment Board as provided in Section 6499.5 of the Public Resources Code; written acceptance of the terms of this resol- ution by the Governing Body of the City of South San Francisco shall con- stitute evidence of the City of South San Francisco's obligation to pay said principal and interest in the manner herein prescribed; and, be it further RESOLVED, that upon: (a) receipt of a feasible, final plan for repayment of said loan, subject to approval of the Chief of the Division of Small Craft Harbors; (b) full compliance with all planning loan regulations adopted by the Small Craft Harbors Commission under Sections 5827 and 5861 of the Public Resources Code and Section 11421 of the Government Code; (c) written acceptance of the terms of this resolution by the Governing Body of the City of South San Francisco; (d) approval of the loan by the Director of the Department of Natural Resources and the Chief of the Division of Small Craft Harbors; the Chief of the Division of Small Craft Harbors shall thereupon cause a claim to be filed with the State Controller for the issuance of a warrant drawn upon the Small Craft Harbors Revolving Fund paYable to the City of South San Francisco in the amount of nine thousand seven hundred fifty dollars ($9,750); and, be it further RESOLVED, that the Chief of the Division of Small Craft Harbors be authorized and directed to do and perform all acts necessary or convenient 'to accomplish the purposes aforesaid. Stevens, Secretary to the Small Craft Harbors Commission, do hereby certify that the foregoing is a full, true and correct copy of a resolution adopted by the Small Craft Harbors Commission, at a meeting held in Oceanside, California, on June 15, 1959.
