A RESOLUTION CREATING SAN BRUNO BOULEVARD AREA
GRADING MAINTENANCE DISTRICT - PERSON AND SWANSON
INDUSTRIAL TRACT
RESOLVED, by the City Council of the City of South San Francisco, Calif-
ornia, that
WHEREAS, on the 6th day of April, 1959, said Council adopted its Resolu-
tion of Intention No. 2771 to acquire and construct the improvements hereinafter
described;
WHEREAS, it was provided in said resolution that said Council intended to
order a Grading Maintenance District formed in the area therein set forth for the
purpose of maintaining and operating the grading, including sloping for the proper
drainage of the area of the assessment district and for the protection of the
streets to be constructed from overflow by water, and any improvements which may
thereafter be constructed therein;
WHEREAS, notice of said proposed improvements and of the formation of
said Grading Maintenance District was given in the time, form and manner provided
by law, all as appear from affidavits on file in the office of the City Clerk;
WHEREAS, at the time and place specified in said notice, --- protests
or objections were made or presented to the forming of said Grading Maintenance
District, and said Council has adopted a resolution ordering the work and acquisi-
tions and confirming the assessment;
WHEREAS, said acquisitions and improvements are described, as follows:
(a) The acquisi,tion of a right of way 60 feet Wide, being the northerly
extension of San Bruno Road as re-routed on the former City and County of San Fran-
cisco right of way on the 27.69 acre Person and Swanson Tract, from the junction
therewith of the Colma Creek Canal easterly, on a curve to the right with a 500 foot
radius, to Airport Boulevard, together with the additional areas at its junction with
Airport Boulevard for corner radiii together with excess acquisition on the westerly
side thereof of the triangular parcel with a maximum width of about 60 feet'in order
to avoid severance; and the construction in said 60-foot right of way of grading,
8-inch untreated rock base pavement with 3-inch plant mix surfacing and Portland
cement concrete curbs, and gutters.
(b) The acquisition of a right of way of irregular width for the widening
and realignment of Airport Boulevard from its junction with the easterly end of the
right of way described in subdivision (a) above, easterly to the underpass of the
Bayshore Freeway, and the construction therein of grading, 8-inch untreated rock base
pavement with 3-inch plant mix surfacing and Portland cement concrete curbs, gutters
and traffic islands.
(c) The acquisition of an easement 100 feet wide for the extension and
widening of Colma Creek, along the northerly boundary of the 27.69 acre Person and
Swanson Tract, for drainage and drainage access road purposes.
(d) The acquisition of an easement 10 feet wide lying on either side of
a center line which commences in the easterly line of the 27.69 acre Person and
Swanson Tract, at the juncture therewith of the center line of the existing culvert~
in the Southern Pacific Company right of way, thence North 58° 55' West 522.123 feet
to the westerly line of said Tract, and the construction therein of Portland cement
concrete pipe storm drains, and inlet and outlet structures and appurtenances, known
as San Bruno Slough.
(e) The grading of the 27.69 acre Person and Swanson Tract, including
slopes and site and slope planting, for the proper drainage of the area and for the
protection of the streets to be constructed therein from overflow by water.

Easements are hereby granted to the City of South San Francisco for
said purposes for the period of construction, at th~ expiration of which time they
shall terminate without further action by either party..
(f) The improving of San Bruno Road from its junction with South Linden
Avenue at Shaw Road, northerly to Airport Boulevard, by grading and the construction
therein of untreated rock base pavement with plant mix surfacing; Portland cement
concrete curbs, gutters and sidewalks; storm drain pipes, culverts, catch basins and
manholes; sanitary sewer mains, wye branches, laterals and manholes; and standard
water mains, hydrants, valves and fittings.
(g) The construction of a bridge across Colma Creek opposite the northerly
end of San Bruno Avenue.
(h) The acquisition and construction of all lands, easements, facilities
and works auxiliary to any of the above and necessary to complete same.
NOW, THEREFORE, IT IS ORDERED, as follows:
1. That all written protests and other written communications were publicly
read at said hearing and all persons desiring to be heard were fully heard, and that
all prOtests be, and each of them are hereby, overruled.
2. That a Grading Maintenance District is hereby formed to be entitled "San
Bruno Boulevard Area Grading Maintenance District", and that the expenses of maintaining
and operating all grading, including sloping for the proper drainage of the area of
the assessment district and for the protection of the streets to be constructed from
overflow by water, or any such improvements which may hereafter be constructed, includ-
ing the cost of necessarylrepairs, replacements, fuel, power, electrical current, care,
supervision,~ and any and all other items necessary for the proper maintenance and oper-
ation thereof, to be assessed wholly upon the lands lying within the district benefited
by and to pay the costs and expenses of said improvements, which is the district hereby
determined will be benfited by said improvements pursuant to Chapter 26 of Part 3 of
Division 7 of the Streets and Highways Code.
3. The City Councflshall hereafter maintain and operate said improvements in
the manner provided in said Maintenance District Law, and shall in each year prior to
the time of fixing the City tax rate, estimate the cost of maintaining and operating
said improvements during the ensuing year, and decide whether or not the cost of the
same shall be borne wholly or partially by the maintenance district, and shall in ad-
dition to all other taxes, fix a special tax rate for the real property (land and im-
provements) within said maintenance district sufficient to raise an amount of money to
cover the expense of maintaining and operating said improvements during the ensuing year
or such portion of said amount as the City Council shall determine shall be borne by
said district.
4. The City Council shall annually levy a special assessment upon the real
property in such district sufficient to pay such expenses or portion thereof which
must be paid by the district, which special assessment tax shall be levied and col-
lected at the same time and in the same manner as the general tax levy for City pur-
poses, and when collected shall be paid into the City Treasury to the credit of the
fund of the Maintenance District and to be used for the payment of the expenses of
said District, and Said Council shall control and order.the expenditure thereof for
such purposes.
5. The City Council may temporarily transfer moneys to the Maintenance Dis-
trict fund from other funds in which are moneys as are not immediately needed, and
such moneys so transferred shall be used for the purposes provided in said Maintenance
District Law and be retransferred from the Maintenance District fund out of the first
available receipts.
6. The City Council shall include in the first budget of said District and
in the first tax levy a sum sufficient to repay the City the amount so transferred to
the Dlstrict during the period of time in which no levy of taxes was made for that
purpose, and the amounts so transferred shall be retransferred to the City Treasury
from the Maintenance District out of the first available receipts of such tax levy.
7. The exterior boundaries of said Maintenance District are the composite
and consolidated area consisting of the 27.69 acre Person and'Swanson Tract.
8. The City Clerk shall cause certified copies of this resolution together
with metes and bounds descriptions and maps showing the boundaries of the Grading Main-
tenance District to be filed with the City Assessor of the City of South San Francisco
and with the State Board of Equalization prior to the first day of February, 1961.
I hereby certify that the foregoing resolution was regularly
.introduced and adopted by the City Council of the City of South San
Francisco at a regular meeting held this 20th day of June, 1960' by
the following vote:
