An adjourned regular meeting of the city council of the City of South aan Francisco wa.. held in the city hall, ~2onday evening,September ~8,19~. T?is meeting was called to order at 8 o'clock P.~. by mayor D.W.Ratto. ROLL CALL. Roll call found all the members of the city council present, as follows~- Councilmen,V.Boido,George ~.Holston,Reese Lloyd,~.I~'!inucciani,D.W.Ratto. The minutes of the three previous meeting were read. ~ihere being no errors or omissions they were approved as read. A communication was received from the State Ooard of Equalization notifying the city that ~.~errill H.~ubbard had applied for an on sale beer license. There were no objeCtions to the gentleman's request. ~he Enterprise Press sub.~itted a request for the city to take an ad for one week in the Enterprise advertisind -. : the JD]YK RALLY, sponsored by the South San ~¥ancisco Schools as th~ junk collection agency, the EnSerprise donating one week's advertising and requesting the cit~ to donate the sum of ~$56 for ome week's advertising, in the effort to, secure the limit of scr~ in the War Pro~.iuction program. Councilman ~iinucciani and ~¥.ayor Ratto believed a half a page at ,i~8 was sufficient for the city to pay. Councilman Ooido believed the cit~ able to pay for full page and Councilman Holston m:~ved that the full page be ordereR. The motion was seconded councilman ~oido and regularly carried. ~ernard ~;cCaffrey Post #355 submitted a communication stating i hat as a war time measur~ the city might donate the two cannon owned by the city to the War S<-;rap pile, for war effort gouncilman Lloyd move the t~o cannon be donated to the ~overnmen$ through the American Legion. The motion was seconded by councilman Boi,do and regularly carried. A communication was received from County Engineer Grant in reply to the city's request improve the piece of road west of the Grand Avenue terminus to the Dnited Railroads tracks, announcing that he would take care of the road before the winter rains set in. Accepted and The South San ~k~ancisco Land & Improvement Co. submitted a communication in regard to tt city's use of the company's tracto~ stating the city could have the use of it at the rate Of ~$1.50 per hour, the city to exempt the land co from any damages to prooerty and persons wh~ in the city's service,the city to pay all costs of repair which may be necessary to restore t] tractor in f~:_ood condition in the event that repairs ~re nece~'sary through damage to' the equip~ while being used by the city. Coun~.ilman Boiao asked t; ~en~ineer as to th~ use of the tractor by the city, the location of the work to be done and if it was in connection with the contrac~ let to L.C.Smith to clear Coima Crook. The city en[~ineer explained it was for other work not connected with the Colma Creek project,and would be required onl~ at intervals. Councilman ~i~ moved that the offer of the ].and company be accepted. Some doubt was expressed that the Clifford co!npany would take care of th.e waters. &i,e wot] engineer believed the waters would pass on without interruption down to the regular channels no further action was taken. I venture to say that practically all" of the objectors to the abandornnent plan are under the impreesion that the majority of this board, who are in rawer of abandonment due prohibitive cost-,of putting the properties in shape, intended to railroad it through, regardle~ the lagality of the action. Such is not 'the .ase. You have undoubtedly secured your information thru ',the local paper' or hearsay. There is another side.-here are a few hi~hlights. Again at the meeting of September q,le{1, page e~0, we fin~ that City Attorney C~leberd was ~nstructed to prepare the necessary papers,etc. }~r Coleberd stated that he would confer with. ~..~ ~ity ~ngineer ~{arshall and secure legal description of all items effected. %hen on ~lay 17,1e%1, Page ~56,A resolution of Intention to Abandon and ~iscontinue Park Land was passed. Ayes, Councilmen,Holston,Lloyd and Natto. Absent; Tibbetts, Not voting; Boido. On Se~te~ber le,~%q, at an informa~ meeting with }{r. Shaw, which meeting was attended by Llo}d, N~iinucctani,~atto,Eng.Klassen and City Attorney Coleberd, Mr. Shaw was willing to go through with the agreement to trade as agreed to in the meeting held }~lay ~3,.}@~1, but stated that his company could not release the park restriction clause and bid for the land, due to the fact tha~ his company owned the land surrounding the property, and if the property was purchased by someone other tha~ his company, a chicken ranch or other objectionable enterprise could be operated on she land, with no way of restricting tie operation,-this would naturall} tend to lessen adjoining sub- division property values. ~r. Coleoerd then stated that a trade could not legally be made. Se ~ad been proceeding throughout this matter under the impression that inasmuch as there w~s no mention of a question of legality raised by our Cit} Attorney at the prior abandonment proceedings,' there certainly could be no question as to the same proceedings a year later. IN Regards to the voting in this matter, you will note that Mr. Holston ~Oted first to abandon the park sites,than agreed to trade, and then later in the course of a recent meeting stated that he would vote against. Mr. Boido did not vote on the abandonment; then agreed to trade;and later in the course of a'recent meeting stated that he would vote ajainst. Dates and page numbers of the Clerk's }.{inute Book aregiven so that these statements may easily be checked. Your city council is elected to ~ffice on promise to exercise their best business jud&ment, -s--they then proceed to shuttle back and forth with votes. ~any of you were taken in b~ a newspaper which never has presented unbiased articles on the doing of this board. All of our actiOns as to legality are based upon opinions given us by our City Attorney. We are not aO.ioogizi~ for any of our actions,because they need no apology In view of the technicalities involved , this board has decided not to abandon the park sites, and to proceed upon the purchase of the beach property,the improvements in mind to consist of toilets,planting of trees, and water lines, and to that end the chair will entertain a motion to instruct the City Attorney to prepare agreement with the South San Francisco Land and Improvement Company for t~e ourchase of ~ acres of beach property ~ ~1380 per acre, and ~9.7 acres of tidelands ~D ~.50 per acre, a total of ~9,500, ~escription of land to be furnished by engineer, on terms of .iilSO0 cash ~nd the balance in yearly installments of ~000 or more on the second day of ~anuary of each year, until fully paid,commencing Oanuary ~nd,19~,with int.~rest at3~ per annum~ tn Order that there will be no misquoting of statements, i ask that t~e newspaper publish this statement in full"~k~ouncilman ~oido said any ~tatements attributed to informal ~eetings~ot reliable Logan Fran~t~ih,editor of the Enterprise,arose and challenged the st'atement of the mayor ~hat tis paper never ~resented an unbiased article on t~e doings of the board. ~r . ~ranklin stated vhat ~ince he took Sver the r~nagemen~ of ihe oaper all articles presented by ~ayor Ratto were printed. Eayor ~atto stated they were not,and , .~ dishonet statements were published . mr Franklin defied the ~ayor , 'io specify one'inaccurate or ~isi~onest state~ent of 1he Enterprise newspaper since ~e became the editor. ~j~ Eolston took issue with the manor's statement that he had been willing to trade park property for the beach ~aying he woula~ be~willing to trade the ~artin School Park property for adjoining Paradise Valley level land propert,y,but not for the beach, kr.~[olston reiterated that the United States Government is counseling~all city, county and state governments to refrain fron making investments in any but absolute requirements a~d needs of the peope on account of the war time efforts to help the country. ~m~[ayor Ratto stated~will be .~ recreation pla,~.e for oeople and ~%~ c~ildren on account of the shorta~?e of gasoline and rubber, that the~ are~.izoing there now. Councilman ~oido declared the purchase of the beach was poor business,not worth the money, and under wartime conditions v~as opposed to the plan and would vote against the purchase. Councilman Lloyd was of t)~e opinion the purchase was a good buy for t~e city, was afair price and wou]~ uever be any clLeaper. ~e moved the city attorney be instructed to draw up ~ocyments to proceed with ~he purchase of the besch ~roperty. City Attorney Coleberd stated he would be unable to draw up the necessary :.~ .... ~.~ proceedings until the engineer furnished the required Sescription of the property affected.
