OF THE CITY OF SOUTH SAN FRANCISCO HELD MONDAY,
FEBRUARY 18,19~.~.
The regular meeting of the city council of the City of South San Francisco was held in the
City Hall Monday evening, ~ebruary 15,194~.
The meeting was called to order at 8 o'clock P.M. by ~ayor D.W.Ratto.
ROLL CALL.
Roll call found all members of the council present, as follows;-
Councilmen,V.Boido,George W.Holston,Reese Lloyd,M.Minucciani, D.W.Ratto.
The minutes of the previous meeting were read. There being no errors or omissions they~
were approved as read.
Mayor Hatto received a communication from Mr. George D.Mengola, stating he had again
taken over the Growers Rice ~Milling Company, was overhauling the place and would lease his
premises for the duration of the war for warehouse purposes,would operate the rice mill as socn
as machines co. uld be secured,which would be about ~anuary, 194~ and asked that the road leading i
into the establishment be placed in repair by the city. The city clerk informed the council th
that there is about $700 back taxes due the city from the v~rious ownere of the enterprise for
several years. The clerk was instructed to so inform Mr. Mengola before any action could be
taken by the city council.
The Italian American Citizens' Club,through Secretary Pete Menicucci, requested that the
American Flag be placed at the statue of George Washington on his birthday,Monday,~ebruary 22,
19~3/The request was ordered granted and Inspector Welte was instructed to comply with the
request.
The Three Ciies Mosquito Abetement Association wished to know if South San Francisco
wanted oil distributed again this year,as is usual, on the mosquito breeding spots iu the city,
the city to pay for the oil only.' The city council accepted t~e offer and the clerk was instru
cted to reply accordingly.
Frank Sylvestri & Mike Polzoni were granted a~.~lfcense to operate a fountain and light
lunch at 315 Grand Avenue,in a~cordance with the inspection and health laws.
Lucinda Dias requested that the license of Virginia Newray,the Steel Bowl~68 Grand Avenue,
be transferred to her. ~.Request granted. Carl Johnson was granted a license to operate a gas-
oline station on the Ruggiero property,IR*6 ~ayshore Highway.
A communication from the Pacific Oas & Electric Company requested permission to replace
900 feet of gas main in Butler Avenue which is in poor condition.Heferred to the street depart~-~
ment.
A reply was received from the Pacific *as & Electric Company to the city's request for
the installation~ of six new street light units at various locations in the city,stating that
under War Production. Board?Orders, as explained to Councilman ~iinucciani,they ar unable to make
the mecessary extensions of their street light circuits for the installation of the six street
light units during the war emergency~ the only exception being where property or traffic safety
is involved. Theu will keep a list of the city's requests and if materials are available they

Polzoni and Silvestri made application for permiss.~.on to make alterations to their new Fount-
ain and Lunch parlors at ~l~ Grand Avenue, in the amount of $829.00/ Councilman Mtn~cciant
moved the desired permit be granted. The motion was seconded by councilman Holston and regularly
carried.
Notice was received from the State Board of Equalization of a transfer of on sale beer from
Dress & Pronos to J.Pronos, from Virginia ~ewray to Lucinda Dias,to Eugene Milani and Pietro
Malfetti from Eugene Milant, and on sale distilled spirits to Eugene $ilani and Pietro Malfetti
from Eugene Milani. There were no objections by the city council to the transfers.
A report from the State ~epartment of Public Works showed South San Francisco's share of
the apportionment of the January 19~ quarterly payment of the ¼ cent gas tax allocation to be
$14~0.12. A~cepted and filed.
Mayor Hatto received a communication from Hartford Accident & Indemnity Company stating
that in accordance with a conversation had with Mrs. Helen Siebecker the company is extending
policy LBX 91~ to cover all the recreational activities which the city is planning to undertake
at the Grand Ave, Martin achool and South San Francisco High Schools,the playgrounds atthe
Northwest corner of Linden & Pine Aves and l~V Braden Avenue now being covered. Accepted &
filed.
A communication from San mateo County Civilian Defense Council was received by Mayor Ratto
advising that an advanced staff course for heads of local Civilian Defense Councila is to be
hel~ at Stanford University from ~ebr~ary ~9 to 28, and asked that~ Fire Chie~ AZ Welte be sent
as this city's representative. Councilman Holston moved that ~r. Welte be sent for this city.
The motion was seconded by councilman Minucciani and regularly carried.
Aayor Ratto received a ~eply from the Federad Works Agency to his letter indicating that
this city is willing to contribute the preliminary engineering,right ~f way and maintenance in ~.
connection with a proposed improvement of Industrial Way, stating the information was forwarded
?to Mt.McCoy,State Highway Engineer.
........ A communication from the Improvement Committee of Southwood requested the city to place som~ structure at Orange Avenue and Fairway Dr.t. ve for the convenience and protection of children
~rom wind and rain in that vicinity. It was dec~'~ that ~he city'would~fur~i~h the lumber and material
and~ the men of~ Seuthwo0d agreed to furnish the
Dr. Chas.C.Gans, Count2 health Director, offered to place a representative of his department
at the city council meetin~:s of this city for the city's information in health matters. Dr.Gar_s
stated one officer could not discuss competently all phases of the county's ac~.ivities, but if the
city would advise him of what imortant problem might be on the agenda he would furnish a special-
ist for the occasion, if notice was received by him sufficiently in advance. Accepted,and the
clerk requested to send word to the doctor if any' health problem developed.
The city council,city engineer and city attorney were invited to attend a meeting of the
Board of Supervisors at their chambers in the court house,WedneSday February, l~,19%~,at V;~0 P.M.
to further discuss the Colma Creek and the Possibility of securing Federal and State aid in
controlling the course of the stream, from city and county lands. It was agreed that all invited
should attend,and the communication accepted. ,
Works Engineer Klassen submitted a communication and map concerning the boundary lines of
ma~ of that annexed territory for the State ~oard of Equalization.

discussed the matter with city attorney ColeberA and both agreed the matter should be definitely
cleared up as soon as possible. Referred to Mr. Cole~erd and the engineer.
Pbl~c~ Chief Louis Oelloni asked the city council to cancel the names of the following :-

RESOLUTION N0.890.
Councilman Lloyd introduced a RESOLUTION OF THE CITY COUNCIL OF T~E
CITY OF SOUTH SAN FRANCISCO ESTABLISHING RULES
AND REGULATIONS FOR THE CITY.
The a~option of the resolution stirred the ire of Councilmen,Holston and Boido. Counctm~
Holston stated he did not wish to vote on the resolution until the city attorney made a~
recommendation on it. City attorney Coleberd stated he was not requested to make a study
the rules and would not be responsible for them. Councilman Holston stated it was a waste
public money to be hiring an outside attorney when the city already had a city attorney who
was paid a salary for rendering legal advise to the cit~ council, and the payment of $150
an outside attorney t~ draw up the resolution was unnecessary and he would vote against it.
Councilman Boido stated it w~s an attempt to break up the civil service law, that there
no reason for hiring two attorneys, that Mr. Coleberd has been the city's attorney for 25
and had always kept the city properly advised on legal matters,that the majority councilmen
were in ~ hurry to break to destroy civil service and not willing to trust Mr. Coleberd wit~
the wri't~ng of the resolution. Mayor ~atto stated Mr. Boido was talking too fast when
the majority members of the board wanted to destroy the civil service ordinance,that it is
reflection on City Attorney Coleberd, but because he migl~t be affected by the resolution
deemed desirable to hire an outside attorney to draw it up. City attorney Coleberd replied~
stating,"No reason was ever given mc.Could I not be trusted to give an unbiased and uninflu~
opinion and attention to this work? I am a public employee.Would I not be fair with the publ
which is my employe~?I have always made suggestions for the benefit of the city at l~rge,an(
not let m~ position a~fect my duty to the citizens.I have an obligation, and if I cannot
that ob~gation,I am worse than useless".

A HESOLUTION ORDERING THE SUSPENSION WITHOUT PAY
OF U.S.MARSHAL ,CITY ENGINEER AND SUPERINTENDENT
OF STREETS,AND FURTHER ORDERING DELIVERY OF
STATEMENT OF INTENTION TO DISCHARGE,
was introduced by councilman Minucciani. This resolution Started another uproar. Counci~
Boido started opposition to the move by stating that the difference between the salary of M~
Marshall~$2§0 per, month and $800 paid engineer Klassen was quite sore d~ference..He stated
when Klassen was needed he was somewhere else,~edwood City, or God kn~ws~hs~e,and never to
found' whOn needed~ then Mr.Klassen's charges for so many hours here and there and transpor'
to various places,~.~i where'Marshall's $250 per month covered it all. Councilman Holston
declared'Engineer Marshall did his duty and was a!wsys on hand, lived and spent his money he~

a chance of a hearing before the civil service board,is the kind of thing we are fighting

Improvement Company in the matter of ~ balance of ~500 due the city on an agreement made
the city to pay the sum of $V800 towS~'i~the construction of a storm and sanitary sewer in
South Industrial Area in 193~, draining partly th~0ugh the company's acreage. Mt.Shaw
contended in his reply that the city owes his company the $7800 for alleged breaking of the
contract in not having the work finished on time. The tangle was referred to City attorney
Coleberd for advice.

Referring to the G.Ghiozzi suit against the city for alleged damages to his crops and
buildings in the sum of $924~, city attorney Coleberd gave as his opinion the City of South

In the matter of the application of A.H.Albright for permission to rent trailer space for
three autos and trailers at the Vict,~r Lonatt gasoline station,Armour & Linden Avenue, City
Attorney rendered a written opinion to the effect that under Ordinance No.195,entitled "An
0r~inance Be~ulating tie Sanitation and Conduct of Camp Cars and Trailers in the City of South
San Francisco",the application cannot be granted without strict compliance with the provisions
of the ordinance. The communtcation~opinion'w~'s accepted and ordered filed.
Mro i~rnes of Southwood reported a depression in the g~ound~where muct~ water lays, near
the~Golf~.link and E1 Camino Real. Engineer Klasses reported the~C0.placed some material at the
spot mentioned, to raise the level,and would further attend to it~ by calling the attention of
Mr. Holbrook to it.
