The regular meeting of the City Council of the City of South San Francisco was held in the city hall, Tuesday evening, September 7. 1943, at 8:00 o'clock p. m. -The meeting was called to order at 8~00 o'cioc~ p. m. by Mayor D. W. Ratto Roll call found~ the following member of the council present: Councilmen V. D. W. Ratto~ M. Minucciani and Ceo. W. Holston - Absent, ~ouncilme~ Reese Lloyd. The minUteu of the t~o previous meetings were read. There being no errors or omissions there were approved as read. A communication was received from the State Board of Equalization acknowledging receipt of a letter from the City of South San Francisco, dated August 25, 1943, in which the city council protested the transfer of alcoholic beverage licenses to Carmen Salcedo, 733 Bayshore High~ay, stating the communication was forwarded to their San ~ancisco office for attention. Communication ordered filed. A communication was received from Henry W..Kneese asking for a 30 day leave of absence from his'duties at the City Hall; due to sickness. On motion by CounciLman Min~cciani, seconded, by Councilman Holston and duly carried the request was granted. A communication was received from the State of California Department of Finance out-. lining tt~e type of State aid that will be exterded to local civilain defense control. center o~erations and askir~ the city to submit certain information if financial assi~ance was desired. The matter was referred to A. J. Welte. ~,~r. Welte advise~ the council that the information had already been sent and that a request for telephone and radio expense had been asked for. A communication was received from the So. San f~ancisco Recreation Co~.~is si on advising the counc~il ttmt it had recommeded that Floyd M. Hunter be employed as Recreation Director on a part-time basis from September 15, 1943 to June 15, 1944 at a salar~ sf $100.0~0 per month ~r a minimum of 80 hours of service, plus a maximum allowance ~f 5.00 per. month for car expenses incurred in connection with recreation business. Councilman Holston moved the appointment be made. the motion was seconded by Councilman Minucciani and duly carried. An applic'ation for a business license was re. ceived from John Ashley to take over the Bayshore 'Cafe at 206 ~Grand Avenue and to operate the restaurant from ll A. M. to 8. Rodondi in which he quoted a letter from the Peninsula'Title Guar~anty Companyin which they ask that certain lots locsted in the Town of 'Baden be released from the lien of that~ certain judgment .entitled "South San Francis c.( vs. Santa Clara Valley Land Company, recorded September 10, 1926. In.this.connection Councilma~ Minucciani introduced a resolution of the City of South San Francisco authorizing the City Attorr~y to release from the above mentioned judgment the followi_~ng lots situated in ~the Town of Baden. In this connection Councilman Holston introduced resolution of the City of South San Francisco authorizing the City Attorney to co~-m~nce action in the Superior Court against Barrett & Hilp to abate the nuisance caused by them in interf~ring with the flow of waters in streams and channels in South San ~ancisco, The resolution was adopted by all members of the council present as follows: Councilmen V. RESOLUTION FIXING TAX RATE FOR FISCAL YEAR 1943-44 No. 914. Councilman Minucciani introduced a resolution of the .City of So.uth San Francisco fixing the tax ra~e for the fiscal year 1943-44. A rate of $1.49 was set~ on all propez~y ~ith- in the original corporate boundaries and a rate of $1,4V on all property annexed in 1916 an increase of 3~ over last year's rate. Councilman Boido.~objected to She raise of 3~. ~ He said the rate should go down at least six or seven cents instead of.up; that the city needed less money this year than last. He said he is a heavy taxpayer and should.have been consulted on the proposed raise; that he would .vote no for any raise in the ta~ ra Councilmau-Holston said he was of the same opinion as Councilman Boido and would also vote no for any raise in the tax'rate, but was advised by the City Attorney that the ci 1'404 would be without funds unless the rate was set on the date prescribed by law; for that reason he would vote yes.. Mayor Ratto said the salaries of the city employees had been raised; that additior~l firemen and policemen would be needed, and that the city would have to be on the safe side and provide for any emergency; also that $5000.00 would be ~e~ttt~d for cleaning' the C01ma Creek. He said in addition to the 3~ raise in the tax rate it would be necessary to raise money on the $1.00 pay roll tax. Councilman Boido said the city pays the engineer about$600.00 per month. Works Engineer Klassen asked him to rbfe~ to the bills for recent months. The motion was seconded by Councilman Holston and regularly carried. Under the head of unfinished business Police Chief Belloni reported that Carlo Bonino dropped the matter of the application for permission to sell vegetables on lots 15 & 16 Block 147. Works Engineer Klassen reported on the property owned by the School District~ He Said he could not see how the rats could gather in the concrete, but it was possible they we in the rubbish that had acctnnulated on the property. B.J. Rodondi spoke before the board and said he would like to have the council and the school board get tog,ether wit2~ a view of cleaning up the lot. After discussion Councilman Holston moved that Klassen get a bulldozer in and also sufficient sand to straighten out the property. The motion was seconded by Councilman Minucciani and regularly carried. Works En~gineer Klassen reported on the Growers Rice Milling Company's request to contro sewer waters near their premises. He said he was unable to contact Mr. ~lendoza but suggested that their attorney get in touch with Mr. Coleberd regarding the suit against Barrett & Hilp. He was of the opinion that the old structures on the Rice ~.~ill propert were responsible for the rats. City Attorney Coleberd reported he did not have sufficient time to study the resolution to move the Ba~shore Hig~mvay 2400' westerly. City Attorney ,$oleb~~e reported he was not ready with the new business ordinance. Under the head or-new business Councilman Boido said t~e fire department needed 500' of l~" hose. The Fire Chief was given permission to purchase same. Councilman Minucciani said La Mr. DeTomasi would like permission from the city to use its manure thrashing machine. Mayor Ratto said it would be a bad precedent to start loaning city equipment, so the council agreed 'not to loan the machine to Mr. DeTomasi. Councilman Minucciani said that poundmaster Monetini has trouble with the gas situation that he would like to get his gas from the city pump instead of having to bother with stamps. Fire chief Welte said that the city would have to have stamps to reimburse the gasoline supply for the city, so it would be impossible to give l,!onetini gas withou gas stamps. No further action was taken. Mayor Ratio asked City Attorney Coleberd in w~at way t~e city was protected in case Monetini is sued in~?any way by reason of his using his own truck on city business. Mr. Coleberd said tl~e blanket insurance p~licy should cover him. The clerk was instr~cted to find out if this policy covers Monetini's truck. Councilman Minucciani said that it had been brought to his attention by ~r. B. J. Rodon that there is a ditch south of Orange Avenue between B and C Streets, Town of Baden, that should be taken care of. ~r. Rodondi said that the owners of the property would be willing to give the city a right of way for about 200' over their property so that t city could lay a pipe to carry off the storm waters. He said the cost to the city woul be about $400.00. City Attorney Coleberd~ adivsed that this ~i~.s a private project and should be borne by the property ~vners; also that this is a n~ural water way. ~Ir. Rodondi said t~t the property owners are going to fill in the ditch regardless as to whether the city is interested in the situation or not. He said that the matter involve the city as well as the owners of this property; that there is no culvert to take care of the water. Works E~tneer Etassen said it should be ascertained if the property is to be sold, so that ~ the property is sold in the summer time and floods in the winter~ the records would show the controversy in the matter. Councilman Doido said it would be an easy matter to put a pipe through the property and suggested that Klassen go over and look into the situation~ aud to ascertain if th~ pipe is large enough to'carry the water. Ma~op Ratto told Rodondi that the owners of the property knew this mituation existed before they bo ~ught the property and thoug~ht the matter should be corrected by them. Works Encineer Klassen was asked to look into the matter. Works Engineer Klassen brought up the matter of taking out the deposit in the slough west of Bays~ore and the storm sewer leading to Tanforan Avenue. He said it would cost approximately $140.00 for two days to clean out the sanitary sewer and about $900. to open up the slough. Councilman Boido said ~mt when the gaps were at Tanforan the government was going to pay for opening up the sanitary sewer. 0n~ motion by Councilms Mi~ucciani seconded by Councilman Holston and regularly carried Works Engineer Klassen .'instructed to proceed with the work as outline~ above. There appearing no further business before the council, Councilman Holston moved to ad- Journ to Monday evening, September 20, 194J, ~.t 8 o'clock p. m. Works Engineer Klassen reported on the property owned by the Scnool District~: He saic he could not see how the rats could gather in the concrete, but it was possible they in the rubbish that had accumulated on the property. B.J. Bodondi spoke before the board and said he would like to have the council and the school board get tog,ether wit a ?iOw of cleaning up the lot. After discussion Councilman Holston moved that Klasser. get a bulldozer in and also sufficient sand to straighten out the property. The tactic was seconded by Councilman Minucciani and regularly carried. Works Engineer Klassen reported on the Growers Rice Milling Company's request to contz sewer waters near their premises. He said he was unable to contact Mr. Mendoza but suggested that their attorney get in touch with Mr. Coleberd regarding the suit agains Barrett & Hilp. He was of the opinion that the old structures on the Rice ~m~ill proper were responsible for the rats. City Attorney Coleberd reported he did not have sufficient time to study the resolutio to move the Ba~shore HighWay 2400' westerly. City Attorney ~oleb~~e reported he was not ready with the new business ordinance. Under the head of-new business Councilman Boido said the fire department needed 500' of l~" hose. The Fire Chief was given permission to purchase same. Councilman Minucciani said ~a Mr. DeTomasi would like permission from the city to use its manure thrashing machine. Mayor Ratto said it would be a bad precedent to start loaning city equipment, so the council agreed not to loan the machine to Mr. DeTomasi. Councilman Minucoiani said that poundmaster Monetini has trouble with the gas situatiol that he would like to get his gas from the city pump instead of having to bother with stamps. Fire Chief Welte said that the city would have to have stamps to reimburse the gasoline supply for the city, so it would be impossible to give Monetini gas witho~ gas stamps. No further action was taken. Mayor Rat$o asked City Attorney Colsberd in w~at way t~e city was protected in case Monetini is sued in..~any way by reason of his using his o~n truck on city business. Mr. Coleberd said ti~e blanket insuranc® p~licy should cover him. The clerk was instr~cted to find out if this policy covers ~Monetini's truck. Councilman Minucciani said that it had been brought to his attention by Mr. B. J. Rodor that there is a ditch south of Orange Avenue between B and C Streets, Town of Baden, that should be taken care of. Mr. Rodondi said that the owners of the property would be willing to give the city a right of way for about 200' over their property so that t city could lay a pipe to carry off the storm waters. He said the cost to the city wou~l be about $400.00. City Attorney Coleberd' adivsed that this is a private project and should be borne by the property owners; also that this is a n~%ural water way. Mr. Rodondi said t~at the property owners are going to fill in the ditch regardless as to whether the city is interested in the situation or not. He said that the ~atter involve the city as well as the owners of this property; that there is no culvert to take care of the water. Works E~ineer Etassen said it should be ascertained if the property is to be sold, so that ~ the property is sold in the sum. met time and floods in the winter~ the records would show the controversy in the matter. CounciLman Boido said it would be an easy mat~er to put a pipe through the property snd suggested that Klassen go over and look into the situation~ ~nd to ascertain if the pipe is large enough to'carry the water. Ma2op Ratto told Rodondi that the owners of the property knew this mituation existed before they bought the property and thought the matter should be corrected by them. Works En6ineer Klassen was asked to look into the matter. Works Engineer Klassen brought up the matter of taking out the deposit in the slough west of Baysl~ore and the storm sewer leading to Tanforan Avenue. He said it would cost approximately $140.00 for two days to clean out the sanitary sewer and about $900.. to open up the slough. Councilman Boido said ~at when the gaps were at Tanforan the government was going to pay for opening up the sanitary sewer. 0n. motion by Councilm~ Mimucciani seconded by Councilman Holston and regularly carried Works Engineer Klassen ~.-ins~uc~ed to proceed with the work as outline~ above. There appearing no further business before the council, Councilman Holston moved to ad- Journ to Monday evening, September 20, 194~, at 8 o'clock p. m.
