The meeting was called to order at 4:13 p. m. by Mayor Cortesi.
Present: Councilmen John Noonan, Adolph Sani, Telford Smith, Joseph Bracco, Emilio
C ortesi.
Minutes of the previous meeting were dispensed with.
'A co-~uniCation was received from the office of the Works Engineer relative to the
pipe line that is to be installed by the South San Francisco Land Company on their own
PrOl~erty. After the letter had been read, Works Engineer Randlett gave an explanation
relative to the problem and the box presently in, stating that it might be sufficient
to 'carry .the flow of water. Councilman Sani stated that this should be corrected and
.to-~have the work done correct, having it done once and for all. This he felt involved
an easement, that if the easement were relieved, the property would then be left open
for buildiD4~ purposes encouraging industry to come into the city and bring added rev-
Mr. Kauffmann explained the progress already made in digging the ditch and what was
found explaining the problem in placing the pipe. He further stated to dig 5 or 6
feet meant the necessity of cribbing the ditch which was expensive. He felt that the
63 inch pipe to be installed would be sufficient, with a ditch on top of the pipe to
also carry off the flow of water. WorEs Engineer Randlett stated he did not think a
63 inch pipe would create a bottleneck at this time as there are smaller pipes under
Grand Avenue presently. Councilman NOonan stated he could not see anything wrong with
this as he could not see where it concerned the city. City Manager McClung stated
that it did concern the city as it goes to the storm drain System. Councilman Noonan
stated that as long as it takes away the flow of water it should be sufficient.
City Manager McClung stated that proper drainage should be provided for so that a
washing action would be obtained to keep the sewers clean so that later we would not
have to go and put in another pipe where one already is. He further stated that he
and Randlett had done what they thought the council wished them to do. Councilman
Smith stated the Land Company is primarily concerned with replacing natural drainage.
If larger pipe was put in,for the future additional size pipe would be the cities
project and come in under the assessment district. Councilman Sani stated he was in
favor of putting in a larger pipe and the city payin~ its share. Mr. Kauffmann stated
that the city could not ccme in and do the work on private property. City Attorney
Lyons stated if the natural flow of water was blocked off the city could come in and
do the work. Councilman Sani asked Works Engineer Randlett if the Land Company did
put in the pipe, later would Mr. Randlett be in a position to recommend acceptance of
the pipe. Works Engineer Randlett stated that if it was in good shape it could be
accepted.
Councilman Noonan asked Mr. Kauffmann if this was going to cost the city anything to
which he replied that it was not. Councilman Smith stated that the city could serve
notice on the Land Company to restore the natural drainage. Mr. Kauffmann stated that
he was in agreeance with this. Councilman Bracco moved that the Land Company be allowed
to lay a 63" pipe. Councilman Sani stated that Mr. Smith had the right idea to send a
letter. Councilman Smith stated that notice be served to the effect that adequate
drainage be provided for. City Attorney Lyons asked Mr. Kauffmann if he would object
to giving the city an easement to later come in to lay pipe or make whatever install-
ation they may want, to which he replied"no". Councilman Noonan asked suppose the
63" pipe did not work out. City Attorney Lyons stated the city could come in and do
whatever work they wish, also that if the council were to o.k. the 63" pipe, they
should get an o.k. of easement at this time so that. later if a larger pipe is needed,
it can be put in. City Attorney Lyons further stated that anyone that blocks the
natural drain should provide for an adequate substitute. If the Land Company would
give the city an easement alongside the pipe or including the pipe the City is not
liable for the maintenance of the line. It is a non exclusive easement. Councilman
Sani asked Works Engineer how big an easement would he recommend to which he replied
about 15 feet at least.
Councilman Bracco moved that all drainage be taken care of from Industrial Way and
Grand Avenue. The motion was seconded by Councilman Sani and regularly carried.
Councilman Bracco moved, seconded by Councilma~ Sani and regularly carried, that City
Manager McClung ask for an easement.
City Attorney Lyons brought up the matter of a resolution for the northwest drainage
work to be done under the 1911 Improvement Act to speed up the work. Councilman Smith
asked if it could notbe bidded two ways, one for the whole bid, another for the back
fill and excavation, also if the city could purchase the pipe. This would encourage
more contractors bids and may make considerable offers. Works Engineer Randlett asked
City Attorney Lyons if bids could be taken this way. He replied that they are usually
let out to one contractor. The City could agree to buy certain materialS.
Councilman Sani introduced a resolution for preliminary determination of legislative
body under "Special Assessment Investigation Limitation and Majority Protest Act of
1931." Roll call vote was as follows: Ayes, Councilman John Noonan, Adolph Sani,

Councilman Bracco introduced a resolution determing initial view of legislative
body that debt limitatiou will not be exceeded. Roll call vote was as follows:
Ayes, Councilmen John Noouan, Adolph Sani, Joseph Bracco, Telford Smith and Emilio
Cortesi.
Councilman Bracco introduced a resolution of the City Council of the City of South
San Francisco adopting plans and specifications for northwest drainage district
improvement proceedings. Councilman Smith asked Works Engineer Randlett if he had
exhausted all methods of checking. Works Engineer Randlett stated he tried every-
thingpo~sible to try to get to ColmaCreek as soon as possible. Roll call vote
was as follows: Ayes, Councilmen John Noouau, Adolph Sani, Joseph Bracco, Telford
Smith and Emilio Cortesi.
City Attoruey Lyons then brought up a resolution employing bfm~elf as attorney for
the Northwest Drainage Proceedings. Councilman Sani felt that an outside attorney
should be employed to pass on the proceedings before bonds are issued, mentioning
that Mr. Wtlsou should be employed. He further stated that if there were no holdup
iu the project it would be o.k. Councilman Smith introduced a resolution employing
attorney for Northwest Drainage District Proceedings. Roll call vote was as fol-
lows: Ayes, Councilmen John Noouau, Adolph Sani, Joseph Bracco, Telford Smith and
Rm~lio Cortesi.
A communication w~s read from the Arco Building Company relative to an alleyway
iu the BrentwoodDistrict. This involved Benetti Brothers property. This matter
was to be referred to the Planning Commission for action. Councilman Sani stated
that probably that body would like to get our opinion. Councilman Bracco stated
to have a meeting with them. Councilman Smith suggested the Planning Commission
get the facts and submit them to the City Council to act cu.
Three actions of complaint for damages on property were received, having been
filed by Armando Richard Barri and Catherine Carrol Barri, his wife, Frederick
William Keil Jr. a~ Dorothy Ada Keil, his wife, Anthony Ignatius Davi, and Avis
Joanne Davi, his wife, against the Sterling Building Company a corporation, City
of South San Francisco, San Mateo County, Charles E. Randlett, Black & White Co.,
a corporation, Red and Blue Co., a co-partnership, Doe One, Doe Two, Doe Three,
Doe ~our. It was moved by Councilman Sani, seconded by Councilman Bracco and reg-
ularly carried, that the City Attorney be instructed to take whatever action neces-
sary.
City Manager ~ Clung then brought up the matter of a meeting in Sacramento on a
two lane bridge from Richmond to San Rafael, requesting a protest against it.
Councilman Noonan moved, seconded by Councilman Sani and regularly carried, that a
protest be submitted against this.
Letter was received from Ward Van Sant submitting his resignation as Assistant of
Civil Defense and Chief Warden, also submitting a bill for office expense and mis-
cellaneous secretarial work totaling $94.72. Councilman Sani asked if the secre-
tarialworkwas his ~wnwork. City Manager McClung stated that the supplies coUld
be paid for but his secretarial duties were no, be paid and no claim should be
honored until proof were shown. Councilman Sani moved, seconded by Councilman Noonan
and regularly carried, that the resignation be accepted and the claim be referred
to the City Manager.
Meeting was adjourned to Monday, Sept. 29, 1952 at 3 P. m.
