ADJOURNED MEETING OF THE CITY COUNCIL OF THE CITY

The meeting was called to order at 3:16 p. m. by Mayor Cortesi.
Present: CouncitmenAdolph Sani, Joseph Bracco, Telford Smith, Emilio Cortesi
Absent: John Noonan
Communication was received from the office of the Planning Commission.relative to
the alleyway in the rear of the Benetti Bros. SuperMarket. Councilman Bracco
called upon City Manager McClung for an explanation relative to this problem.
City Mans~er McClung explained this by drawing a diagram of the area. On motion
of Councilman Sani, seconded by Councilman Bracco and regularly carried, the
recommendation as submitted by the Planning Commission was adcepted.
Com~unicationwas received from the office of the Planning Commission relative
to Sunshine Gardens Subdivision approving the final map provided the conditions
iu subdivision ordinance ~297 be complied with. Councilman Smith asked what sub-
division 0rdinauce~297 referred to aud was iuformed by City Attoruey Lyons that
this was the subdivision ordinance. Councilman Smith then asked if it mentioned
lot sizes. City AttorneyLyons informed Councilman Smith how lot sizes are men-
tioned in the ordinance but that the master plan prevails. On motion of Councilman
Bracco, seconded by Councilman Saul and regularly carried, the recommendation of
the Planning Commission was accepted.
Application for business license was received from Thomas Kay to operate the busin-
ess of a tavern under the firm name of Kaymar located at 257 Grand Avenue. On
motion of Councilman Sani, seconded by Councilman Bracco and regularly carried,
application was granted.
Mayor Cortesi next brought up the matter of Park Haven. Councilman Smith asked
relative to the inspection of the subdivision. City Clerk Rodoudi was absent at
this time to obtain the minutes of the last meeting. Councilman Saul stated that
the work should be allowed to proceed under the Works Engineer, since so much
work already has bean done, about 50~ or better. If the City wtshes to make changes
later it can be the pleasure of the Council at that time to decide what they wish
done.
Mayor Cortesl stated since they were iu the process of doing the work what would
be the need for holding the work back. Councilman Bracco asked Works Engineer
Randlett what his fee was to which he replied 2~. Works Engineer Randlett at
this time stated that Mr. Smith appeared to be under the impression of a contest
between the city and the subdivision. There is uo such contest existing. Council-
man Smith stated that he felt an independent engineer could provide better inspec-
tions felt that a better bond would exist between the city and the subdivider.
Councilman Sant stated he was confident with Works Engineer Randlett and moved
that Works Engineer Raudlett be allowed to go ahead with the work and be allowed
to engineer and inspect the work. Mayor Cortest asked Councilman Smith if another
Engineer could be hired to take this work now that it involves such a small amount
of money. Councilman Bracco asked Works Engineer Randlett how long it would take
to do the work to which he replied about four mouths. Councilman Smith remarked
he felt no strong attempt was made by the Council for another Engineer.
City Attorney Lyons stated that au Inspector does not inspect the Engineer's work
but he checks the contractors work to see that proper qualities are goi~ into
coustruction..Councilman Smith remarked that his stand was that there should not
be one person serving two masters, as three of you will vote in favor of Randlett.
Works Engineer Randlett expressed cooperation to have his Inspector work with In-
spector Vol~k~__n and to report to him. Councilman Bracco felt that since it was
such a small job to allow it to proceed. Councilman Smith asked how much time w~m
spent by the Engineer. Works Engineer Randlett stated that in the pauriug of the
concrete or asphalt he was present all the time. At the other times he made in-
spections about twice daily. Councilman Bracco seconded the motion of Councilman
Sani and was regularly carried. Councilman Smith voted uo on this motion.
City AttorueyLyons stated that on the matter of the drainage district the council
adjourn until Wednesday afternoon as the w~ver to Debt Limitation Act might be
in time for Thursdays' publication of Resolution of Intention calling for bids.
City Mauager McClung gave an explanation relative to the petition being circulated'
for signatures which would cut down the time by not having to send cards of noti-
fication out. City Mauager McClung suggested that Mayor Cortesi, Health Inspector
Lingeman and himself talk to Reichardt as he owns a major portion of the area to
be taken care of by the Northwest drainage. Mayor Cortesi consented to this.
City Attorney Lyons stated that regarding the meeting of Wednesday, notification
could be made Wednesday morning iu the event that there would be no meeting on
Wednesday afternoon. The City Clerk could adjourn the meeting to the regular time
of 8 p. m. Nonday,-0ctober 6. It could be tentatively set for Wednesday at 4 p.m.
Cancellation would be made to Monday in the event not enough signatures were ob-
tained on the petition.
Mayor Cortesi then brought up the matter of the condition east of Mayfair. He
stated the pipe that connects with the Drive Iu Theatre broke creatio~ a condition
serious for this winter. He further stated that temporary measures should be
taken regarding the rocking of the street for temporary use. Also that the levee
could be leveled. Councilman Smith stated he felt that the levee should not be

disturbed because if a flood was to later exist due to this action, the city would
be liable. Mayor Cortesi remarked that the levee was low already. Mayor Cortesi
asked if it would not be well to instruct the City Manager to have the temporary
work done. Mayor Cortesi then remarked that the City Manager be instructed to
cou+~act the Laud Company or the proper persons relative to the street.
City Manager McClung stated that he had been contacted by the Pyromet Company on
the improvement of the street that goes alongside South Canal. Last year the city
did dO some work ou this roadway during the flood period.
Mayor Cortesi spoke relative to the improvement of Madrone Avenue between Randolph
and Lewis Avenue. Mr. Whelan was the largest property Owner and asked him to in-
struct the City Attorney to draw up a petition for the improvement of this street.
Meetiug was adjourned to Wednesday at 4 p. m.
