P~TEST HEARING ERDLANE~~: RESOLUTION NO. 1924 IS,%WJ.~ICE OF B0~DS INDUSTRLtL ACRES FIRE PROTECT!ON~ ~YST~~: Mayor Cortesi for the first order of business asked if there %~re any protests to the issuance of bonds for Third Lane. Hubert Rosetti speaking in behalf of his mother, a property owner in the assessment area,, stated he Fas curious as to why bonds were issued when payment had been made in full. Councilman Sani remarked that possibly City Manager McClung could explain this. City Manager McClung stated that this Fas a question that should be answered by the City Attor- ney but stated that those who wish to pay in full still sh~re in the cost of the issuance of bonds. Mr. Rosetti stated that his mother is a landowner and that the improvement was made wJ. tl out her approval, however the improvement had been made with the approval of the remainder of the property owners. He also remarked that the original cost Fas less than the final cost. Mr Conrad Reiscb, associate of City Attorney Lyons and acting in the place of the absent City Atto~ ney stated that the ans%~r to the problem is contained iu the resolution, reading from page ii~ of the resolution prepared for p~ssage this evening. He further remarked that the unpaid asses~ merits are those paying for the bonds not those who have already paid. Mr. Rosettl stated that pa?~neut was made in advance for the pasnnent of the issuance of the bonds. CounciLma.~ Smith sai( that payment should have been made in a certain time limit, tie further remarked that the claim made by Mrs. Rosetti Fas that si. nee payment had been made, no charge should bare been made for the issuance of bonds. %~orks Engineer Raudlett stated that the issuance of bonds are part of the incidental expenses spread over al! the property owners. City Manager McClun~ said that Mrs. Rosetti's question was who '~¢ou!d get the money if no bOnds were issued. Councilman Smith stated that the field of municipal !a~? is sometimes complex and felt that the question should be answered by the City Attorney. Councilman Saul asked Mayor Cortesi to ascertain if there ~;~re any other protests. Mayor Cortesi asked if there were any other protests to which there · ~as no reply. Councilman ~aui asked, if the protest comld be overruled, proceed with the issuan( of bonds and then the matter looked into. Mr. Reisch stated that the protest could be over- ruled and then the matter looked into. Councilm~u Bracco suggested that the m~..tter be held over to the ~ext meeting. Mrs. Rosetti requested that she be furnished ~th a full statement of expenses and also the number of people who are still unpaid. Mayor Cortesi ordered the mott~ held over to the next regular meeting. Mayor Cortesi asked if there were any protests to the issuance of bonds on Industrial Acres Fir~ Protection System. No protests were made. Councilman Bracco introduced a resolution providing for the issuance of improvement bonds, Industrial Acres Fire Protection Sys%em. DRAINAGE Con~nunication was received from the South San Francisco Land and Improvement C~pany regarding PROBL~EAST GRAND AI~: the drainage at East Craud Avenue and the Southern Pacific Railroad tracks. Also received were ASSOCIATED CONSTRUCTION two letters from the Associated ~oustructiou and Engineering Company, one regarding the draiu- COMPANY BUILDING PERi, IT: age problem as mentioned by the letter of the South San Francisco Land and Improvement Company ~-/~ and the other requesting permissio~ to erect a building ou this location. Mr. McClung stated that Mr. Kauffmann was bringing to the attention of the City Council the matter regarding the spur track that is being constructed. He also explained regarding the future water that ~s to be emptied that wo~ld create a pool of water when it backed up. Counci!mau Bracco suggested that the matter be referred to the new Public Works Department to which City Manager McClung stated that this cOUld not ~it that long but must be referred to someone. Councilman Bracco moved, seconded by Councilman Saul and regularly carried, that the Works Engineer and City Man- ager be instructed to contact ~he Souther~ Pacific Company and clear the matter up. City ~.~nager McClung then brought up the .matter of the second letter from the Associated Con- structiou Company explaining that some action should be undertaken to correct the problem of the standing water. Councilman Bracco stated that possibly both problems could be handled at once. Counci~,~n Bracco the~ moved that the Uorks Engineer and City Manager correct the situa- tion. Councilman Smith asked Councilman Bracco what was meant by correcting the situation to which he replied that they bring in plans and a report. CounciLman Smith then asked if the motion was to bring in a report to which CounciLman Bracco stated yes. Councilma~ Smith seconde the motion which was regularly carried. _aPPEARANcE OF COUNC IL~£&N NOONAN: Mr. John Chapman, a member of the Associated Construction and Engineering Co., spoke from the audience regarding their letter of request to build on property they purchased ou the south side of East Craud Avenue, east ~of the Bayshore Free~ay. Me further stated that the procedure was taken to clarify any objections. He said that prelimiuary plans were presently under?ay. They ~shed to get info~nation as to the feeling of the council and then ~et detailed plans pre- pared. City Manager McCluug cited the problem of sewage disposal that would occur. He stated that presently sewage is being dumped in the open bay. He further remarked that he was informed of a right of ~my that the Division of Highways had in the area for the construction of au under pass. He was asked by the Division of Hig~ys to advise the City Council and the proposed builder of ±~is. City Manager McClung stated that the underpass %~s possibly a long way off the future but that they wished to retain the right of x~y. At this point, a discussion held on the map ~th members of the City Council and the Associated Construction Company. Councilman Noonan appeared present at the council meeting at 8:55 p. m. and was present for the duration. Councilman Bracco moved that this matter be referred to the Planning Commission for street and plot plan. Motion as made ~s secoude8 by Councilman Saul and regularly carried. Councilman Smith asked if this area woul~ come iDto our se~r plan to which Works Engineer Raudlett stated that it would. Communication was received from H. A. Loebensteeu & Co. regarding their request for a spur track to cross D~uque Avenue. Couuci]~au Bracco moved that the matter be held up for fur- ther study and referred to the Plaoniug Commission to be studied and a report submitted at the next meeting. Mayor Cortes~ likewise stated that he felt the matter should have been re- ferred to the Planning Commission. City Manager McCluug stated that the State had not ~iveu a clear cut definition of this matter. Councilman Saui seconded the motion as m~de. Councilman Smith stated that this had heeu studied at the adjourned meeting and that a reply should have been had~ at this time. Councilman Bracco stated he ~s sorry but that he was not present at the last meeting and that this ~,~s the first he had heard of it. Councilman Noonau stated that the question of limiting railroad crossings should be taken up. He further remarked that although industry was welcome, he would like to see if the City Attoruey could establish a mean whereby we could legally work this out, and the spur track of Mutual Engineering Co. could be used. If Mutual Engineering did not ~*ish to cooperate, then a new one be established and the Mutual Engineering Company would be out. Motion as made and seconded was regularly carried. Mr. Loebeusteen asked when could this be brought up again to which City Manager McClung stated that the Planning Commission was presently having a meeting in the next room and that he would ask them although he felt that they could not consider this until October 14, 1953. Councilma~ Noouau said that we ask the Planning Commission to have au answer by September 91. Mr. Loeben- steeu stated that au auction was to be held ou September 15 which involved this deal and he had hoped that au answer woul~ be forthcoming before then. City Manager McCluug reported that after having spoken to the PlauninS Commission, they stated that an answer would be submitted to the City Council by October 5th as there ~re others ahead of it. Councilman Smith said that at the last meeting it ~ms promised that regulations Mould be made in the switching of .freight cars. Again at this polut~ Councilman Noouau cited the sharing of one crossing at the Mutual Engineeriug Company. ~ELOCATION OF HOLLY AVE~ P~SOLUTION N0. 1~25: Communication was received from the law office of Young, Rabinowitz & Chouteau concerning the relocation of Holly Avenue. City Manager McClung stated that this letter dealt with the aban- donment of the present line and to make it conform. City Manager McClung further expSained the procedure necessary and that the cost would be borne by the Stoneson Company. Councilman Sani moved, seconded by Councilman Bracco, that the letter be referred to the City Manager for action. Councilman Smith asked what ~s the City Mauager supposed to answer to, to which City Manager McClung stated he assumed that the City would accept the maps. Motion as made ~,as regularly carried. Acting City Attorney Reisch stated that be had a resolution prepared for this matter. Council- man Sani introduced a resolution of the City Council of the City of South San Francisco declar- ing its intention to sell or transfer certain public property owned by said. City to-wit: a portion of ~olly Avenue~ a public street lying within said city. Roll call vote was as follo~ Ayes, Councilmen Noonan~ Saul, Cortesi, Bracco, Smith; Noes, none; Absent, none. RESOLUTION NO. 1926 ACCEPTING STONESOM DEED RELOCATION OW HOLLY A~: ~-/l~ Acting City Attorney Reisch stated he had a resolution prepared accepting a deed from the Stone Development Company regarding the same thing. Councilman Bracco introduced a resolution of the City Council of the City of South San Francisco accepting a deed from the Stoneson Development Corporation to certain real property lying within said City for the purpose of relocating acros said property Holly Avenue. Roll call vote was as follows: Ayes, Councilmen Noonan, Saui, Cortesi, Bracco, Smith; Noes, none; Absent, none. SUNSHINE S ~ET PROBL_~4: Communication was received from the office of the City Manager regarding the street problem thc has developed in Sunshine Gardens at the end of ~illow Avenue. Mayor Cortes! suggested that this be referred to the City Manager, the Works Engineer, Mr. Parsons developer of Sunshine Oar dens, and J/n~ny Brusco, adjacent property owner. Jimmy Brusco who was present iu the audience stated that this ~eas of uo use to him and he could not see why he should have to pay. He furth remarked that the subdivider had excavated all the dirt out. After a discussion by Jimmy Brusc and members of the qity Council,the matter remained as suggested by the Mayor. S. ?. Assistant Building Inspector Ghilard~ stated that movers are insured bnt that they should have a street bond. Councilman Voouan then amended his motion that proper bonds be presented. Acting Fire Chief Brauns asked that arrangements be made for the proper raisiu~ of the fire alarm C~.ty Manager McCluug stated that the motion could be made to grant permission provided that per. mission of the Fire Chief and Police Chief be obtained and proper bonds be provided.
