He remarked on the bids that the State wished to call for for the work on tke pillars. At 2:47 p. m. Mr. ~oas them e~plai~ the needed improvements of the streets in West~iew Terrace. Councilman Noenan stmted that a eompl~ picture in the subdi- vision shoald be obtained before acceptance. City Atto~ Lyens ex~lainad that this was the acceptance of an e~s~-.--;ut caxly ms the city ~ aoee~i~g title to the land. Councilman ~mith asked Direeter of Public Works Goss if when the street had been pat in,s.treet levels had-been eha~, was this easement on the high si~e of the street. Mr. Goss replied that it was not a~ it was e~ the east side or' level side of the street, explaining how the five foot emaement ea~e into being. 0o~ncilman Noonan then a~ked Mr. Ooss if he suggested the city follow this resolution to which he replied, yes. Oou~ilman Noenan introduced a reso-' lution of the City C~ucil of thru City of South San Francisco accepting a deed from Teresa Uccelli to certain proparty located in Westview Terre~e Sub. ~1 for the installation of storm drainage facilities in said City of South San Pr~ncisco. Roll call vote was as follows: Ayes, Councilman Noonan, ~ani, Cortesi, Smith; Noes, none$ Absent, Councilman Bracco. RESOLUTION NO. 1994 ACCEPTING LYONS DRRD VICTORY AVE. IMP: VD, RESOLUTION NO. 1995 GRANTING D~ TO CALIF. WATER 8~VICE VICTORY AVE. IMP: INDUSTRIAL S~ERS: City Attorney Lyons next explained the resolution for an easement in the Victory Avenue Improvement of storm drain work. Councilman Suni iutr~ed a resolution of the City Council of the City of South San Francisco accepting a deed from William W. Lyons whereby said City is granted, in conjunction with the Housing Authority of the City of South San Francisco, a subsurface easement for the installation of storm drains~e facilities in connection with the improvement of Victory Avenue iu said City. CoUncilman Smith asked regarding the Joint deed between the city and the Liu~euville Housing Authority, if provisos had. been made as to who would be responsible for the maintenance. City Attorney Ly~as explained the pipe that was already in place and the survey which was made regarding the increase of width. He further remarked that the m~iutema~ce ~ to ~e taken care of by the persons who had their respective pipes in the easement. Councilman Nooman then remar]m~ re~a~ding a resolution which was supposed to have been pre,eared for b~m~ sales in ~ industrial sewmr area, remarking relative to the engineer's fees o~ the work to be d~ae. 0o~ncilman Suni stated that t2~ meetings had been scheduled at 2:~0, 3:~0, a~d 4:~0 p. m. to take mp the~e matter~ an~ that the meeting should not be delay. Councilman Noouan then re- qmeste~ to k~o~ if the manufacturers h~d agree~ to ~ this amount to w~ich City Attorney Ly~ re~aa~e~ that they had agreed to 2~ of t~e contract ~riee. After a discussion between the City A ~toruey a~d members of the co~il regarding ~a2ment of the attormey fees and the seriousness of the project, Councilman Noo~an moved that this matter be called to the atten- t-ion of the mamufaet~arers re~mA~Ling pa2ment of 2~ of the contract price for attorney fees, also .informing them t~at ~y had no obligatieu to ~ ~he ~ fee but that it could be subject to e~il ~eelelom. 0ouncilmaa Smith seeonde~ the .motion. Councilman ~ami remarked that this di~e~sieu w~ only a l~oli~ical move, asking Mr. G~ss if this w~a the usual procedure follY. Mr. Go~s replied regardimg ~he sehadule~ ehaa~s as c~rged by the engineers and that it w~e msmally c~etcmary for the attermey to receive ~. City Attorney Lyons again re- m~rked regarding the liability of the a~toruey om this project. Councilman Suni stated that ha felt t~m fees due ~o the l~er~ons doing the work ~re Just. Motion as ms~e and seconded warn r~a~ly carried. C~ilman ~ am~ ~r Cortesi did no~ cast their vote.
