CATJ, TO ORDER: The meeting w~s called to order at 8:09 p. m. by ~ayor Smith. PT.~GE OF ALLEGIANCE & INVOCATION: After the pledge of allegiance, the invocation w~s given by Rev. Theodore Wall of St. Paul's Community ~ethodist Church. ROLL CAT,L: Present: Councilmen Francis Lucchio, Emilio Cortesi, Telford Smith Absent: .~one Mayor Smit~ asked if there were any errors or omissions to the minutes of the previous meeting. Councilman Lucchio moved, seconded by Coumcilsem Cort~si and regularly carried, that the min- utes of the previous meetings be approved. APPO~ OF COUNCILMEN ROCCA GAMLEN: The first item of business w~s the appointments of new councilmen to fill the vacancies. Coun- cilman Luechio moved, seconded by Councilman Cortesi and regularly carried, that Mr. Andrew Rocca be a~ointed to the position of cuuncilm~n for the City to fill the vacancy created by the resignation of George Bosworth, the date of termination to be April 1958. Councilman Lucchio then moved, seconded by Councilman Cortesi and regularly carried, that Mr. Richard Gamlen be ~pointed to the position of councilman for the City to fill the vacancy created by the resignation of John Noonan, the date of termination to be April 1956. After the new council members had been sworn into office by the City Clerk, Mayor Smith called on Mr. Rocca and Mr. Gaalen for a few words. Words of welc~ne were also expressed by Councilmen Cortesi, Lucchio and Mayor Smith. Mayor Smith then went on to the next item of business which w~s the approval of cla~m~. Coun- cilman Luccmio moved, seconded by Councilman C~tesi and regularly carried, that all claims as submitted be approved. Total amount of claims - $55,427.88. POLICE DEPT. MONTHLY .REPORT; OFFICER OLIVOT, ffI rLT.~ESS; SPEOIAL OFFICER _APP O~: BUTLDING INSPECTOR & REALTH DEPT. MOI~Y On motion of Councilman Rocca, seconded by Councilman Lucchio, and regularly carried, co~nuni- cations from the Police Department concerning their monthly report, illness of Officer Olivotti, and appointmmnt of Special Officer Bell were ordered placed on file. Reports as received from the Building Inspector and the Health Department, on motion of Coun- cilman Cort~si~ seconded by Councilman Lucchio, and regularly carried, were ordered placed on file. PROTEST HEARING VICTORY AVE. I~P: The next item of business w~s the matter of public hearings on the Victory Avenue Improvement Proceedings. C~mnunication was received from Mr. William W. Lyon, which the Mayor requested the City Cl~rk to read. After the letter of protest had been read, Mayor Smith asked if there were any ot~er written protests. None had been received. Mayor Smith then asked if there ~e~a~'.~aw~*~tS from the audience. None were registered. Mayor Smith then asked if there w~s a motion that the hearing be closed. Councilman Lucchio so moved, seconded by Councilman Cortesi and regularly carried. After a brief explanation by City Attorney Lyons relative to the proced~_~e in overruling a protest and the fact that Mr. Lyon's property w~s benefiting from the work, Councilman Lucchio moved, seconded by Councilman Cortesi and regularly carried, that the lmrotest of Mr. Lyons Be overruled. RESOLUTION NO. 2059 CO~~G ASSESSMENT VICTORY AVEI~YE IMP: City Attorney Lyons then remarked that a resolution had been prepared confirming the assess- sent of Victory Avenue. After the City Attormey had read the title of the resolution, Council- m~n Cortesi introduced a resolution confirming assessment for improvement work performed under Resolm~tion of Intention No. 1966, adopted January 11, 1954. Roll call vote w~s as fol- lows: Ayes, Councilmen Rocca, Lucchio, ~nith, Cortesi, Gemlen. RESOLUTION NO. 2O6O FIXING TAX RATE 195 - 5 F SCA YEA : ~-/~ ~ RESOLUTION NO. 2061 SPERRY & CO. AGt~mm~tT: ~ESOL~TION NO. 2O62 DESIGNATING TREASURER TO C~ ASSESSmentS Mayor Smit~ then asked if there were any other resolutions to which City Attorney Lyons stated not in co,section with Victory Avenue, but with other city matters, the next being the reso- lution relative to the tax rate for the fiscal year lC~54-55. After the Cit~y Attorney had read the re~olution, Councilman Cortesi introduced a resolution of the City Oouncil of the City of Soath San Francisco fixing the tax rate for the fiscal year 1954-55. Roll call vote was as follm~s: Ayes, Councilmen Rocca, Lucahio, Smith, Cortesi, Gamlen. City Attorney Lyons then explained the next resolution which was relative to the acceptance of an agreement from ~perry & Nntchinson Co. re~arding spur track. After the title of the resolution ~ad been read b2Oity Attorney Lyons, Councilman Lucchio introduced a resolution of the City Council of the City of South San Francisco a~cepting from the Sperry & Nmtchinson Co. em a~A-~e ~ ~, establishing a covenant running with the land owned by said ccs~ny in the vicin- ity of the intersection of Dubuque Avenue and Butler R~ad in said City. Roll call vote was as follows: Ayes, Co~mcilmen Rocca, Lucchio, Smith, ~; Noes, Councilman Cortesi; ABsent, none. The next resolution was concerning the matter of desi~a~ating the City Treasurer as the official to collect and receive assessment monies on industrial sewers and pu~ping stations assessment district. After City Attorney Lyons had explained the resolution, Comnci~en introduced a resolution of the City Council of the Oity of South San Francisco designating the Treasurer of said Ci,-y as the official to collect and receive the assessment moneys to Be paid by the property owners in connection with the industrial ~ and pumping stations assessment dis- trier i~provement proceedings. After City Attorney ~-~ns had read the resolution, Councilman Cor-~si introduced a resolution of the City Council of ~hm City of South San Francisco acknowledging meritorious services rendered to said City by Elbert Garrett while serving as a member of the Fire Department of said City. After City Attorney Lyons had rea~ the agreement and given a brief ex- planati~., Councilman Lmcchio introduced a resolutiom of the City Council of the City of South Sa~ Francisco granting a franchise to Western Advertising System, Inc. to install and maintain ~blic bus stop benches and to ~ee the same for advertising pmr~s. Mayor ~a~th then proceeded on to the item of new bus,ness, taking up first the c~mmmnication from the City Manager re~m~ing a back hoe attac~n~ for the city tractor. After a brief explanation by City Manager Mc~l~ re~aa~ing the s~-wey that was ma~e ~y himself and Director of Public Wo~k~ Goss and the quotatio~ which had ~e,.n received relative to this attachment, he a~k~ that council a~roval be given. Councilman L~cckio then moved, seconded by Council- man Cortesi and regularly carried that the reccmmend~tioa of the City Mamager and Director of Public Works, be accepted. Communication w~s received from Petrocchi Bros. regarding the dedication to the City of a parcel of _~ro~erty for road purposes at the intersection of Chestnut Avenue amd E1 Casino Real. City ~ama~lr MeOlu~g ex~lai~ed that this matter had been before t~ Planning Commission and that there was a need for this particular piece of property. Director of Public Works Goss remmrke~ treat since the State rewired the Petr~ochi Bros. to put in ~avement between their property ~nd the State pavement, he felt it wo~ be in or~er that the City also have the same reqmiremem~s which was for the Petrocchi Bros. to pave that area between their improvements and Chesl~amt Avenue. After a discussio~ between mushers of the City Council and Petrocchi Bros., at ~kich time Councilman Lucchio asked the Petrocchi ~ if they w~re agreeable to putting i~ the i~provements and paving am sug~estea ~ Mr. Goss, they replied that if this was the w~y it was to be, they ware. agreeable. Councilm~n Lmcchio then moved, seconded by Coun- cilman Ce~-~si aad regularly carried, that the dee~ t~o the pro~rty be accepted pending receipt of a lett~er stating that the Petrocchi Bros. wo~ld carry thro~ and make t~ improvements aa specified by the Director of Public Works. The next i-~m was a communication from the City Mawr concerning the acceptance of bids on traffic signals. City M~r MeClung explained that the~e were the signals ~hat the Council directed -~he 9irector of Public Works to pre~a~e plans and s~ecificatio~ on quite sc~e time ago. After a brief discussion, Councilman Cortesi moved, seconded by Councilman L~cchio and regularly carried, that the recommendation of the Citer Manor be accepted. Councl]man Lucchio then moved, seconded by Councilman Cortesi and regularly carried that the Director of Public Works be authorized to sign the contract with the spe:ifications as outlined in the call for bids. C~m~unicaoion w~s received from the office ~f 1~ Oit~ Manager regarding the Avalon area hold- ing basin which was to protect Francisco Terrace i~e~.flOed drainage. City Manager McClung explained ~hat an earthen dam was to be constructed to hold back t~e water and sand to forstall any flood conditions. A request was being made for ~ermission to w~rk oat any details with the prope.~y owners. After diacnssion ha~ taken place between me, rs of the City Council re- gardimg ~ responsibility on the matter and an expla~tion by City Attorney Lyons regarding the work -~t had to be dons by the State, Councilman Rocca moved that the recommendation of the Dept. of Public Works be accepted but that efforts be made by the City to recover whatever monies are spent and place the blame where it belongs. Councilman Lmcchio seconded the motion which was regularly carried. Co~unicat;ion was received from the Building Inspector requesting permission to leave the State during th~, annual business meeting. Councilman Cortesi moved, seconded by Councilman Lucchio and regularly carried, that permission as requested be granted. Oommunica;ion was received from Mark Senaldi relative to the South Airport Blvd. drainage problem. After discussion had taken place, Mayor Smith asked if there was a motion that the matter be referred to the Director of Public Works. Oouncilman Lucchio so moved, seconded by Comnci~an Cortesi. After further discussion, Co~ci~-~n Lucchio withdrew his motion. Councilm~u Rocca suggested that a study be made of ail the area and that a meeting be held relative to fimding out what the problem is. After f~rther discussion had taken place at which time City Attorney Lyons had been asked concerning the legal requirements, City Attorney Lyons sm~sted a written statement from the property ow~er~ holding the city safe and harm- less from -ny results of changing the water's course. Councilman Rocca then moved that the City insta~ct the Director of Public Works to make a study of this problem, that the property owner~ be given permission whereby they ass,~,~ all re~ibility of every nature and hold the City e~tirely non-responsible for any damage ~r m~ que8tion that there~r might arise. Councilman Cortesi seconded the motion which ~s regularly carried. Councilman Rocca then asked City Attorney Lyons to ~ave written approval as mentioned above. Communication was received from the Planning 0ommissi~n regarding plan lines for the extension of Gra~ )rive, School Street and the Widening of Sylvester Street. After Mayor Smith read the cc ar. tcation, 0ouncilman Cortesi moved, seconded by Councilman Lucchio and regularly carried, t~at the reccm~endatio~ of the Planning Co~tssion be accepted. C~maunication was received from the Planning Commission concerning the resignation of Victor Rosa, Jr. as a mam~er of the Planning Co~mission. ~r the communication h~d been read by the City Clerk, Councilman Cortesi moved, seconded by Councilman Rocca and regularly carried, that the re~ignation of Mr. Rosa be accepted and that the proper resolution and certificate be pas~e~ mad sent to him thanking him for his services to the City. A brief re. ess was declared at 9:55 P. m. and the meeting recalled to ~rder at 10:06 p. m. T~ acetic, u~ being called back to or~er, Mayor S~ith proceeded on to permits and applica- tions. T~ first was a use permit for the Line Material Co. After Mayor Smith had read the condition~ of the use permit, Councilman Luechio move&, ~eco~ by Comnci~ Rocca and reg- ularly carried, that the recommendation of the Planning C~sion he accepted and the use Use Permit as applied for by Roy and Ardis Morton and received from the Planning Co-,~ission ~s next ta2mn xp by Mayor Smith. After Mayor Smith had read t~ comdi~iou~ contained in the Planning Commission resolution, Councilman Lacchio asMed the Fire Chief if he c~ncurred with the a~rov~l of the fire wall. ~e replied that it w~m very good. Councilman Lacchio then moved, sec0~ded by Councilman Cortesi and regularly c~rried, that the reclamation of the Planning C mmission be approved. Mayor Smith then went on to Good and Welfare. At this time Mr. Lloyd Thacker spoke on the problem of drainage in Sunshine Gardens. After a discussion had taken place, Mayor Smith asked Mr. Thacker if he could attend a meeting one u~ek fr~n this evening with the City Attorney, City Manager, City Engineer and himself relative to thia problem. CALL TO ORDER: The meeting was called to order at 8:0~ p. m. by Mayor Smith. ROLL CALL: RESIGNATIONS OF OFFICERS OLIVOTTI & HARPER AND ENGINEER CLEGG: Present: ~ouncilmen Andrew Rocca, Francis Lucchio, Telford Smith, Emilio Cortesi Absent: ~"0mncilman Richard Gamleu Councll_w~n ~mmlen appeare~ at 8:10 p. m. and was present for the duration of the meeting. Mayor Smith explained that the council had a~journed from its last regular meeting to this even- lng lu the event that there were some matters to be taken care of. First item was the resigna- tions of Lawrence Olivotti and William Harper from the Police Department, and John C. R. Clegg from the E~gineering Department. Councilman Cortest moved, seconded by Councilman Rocca and regularly carried, that the resignation of Lawrence Olivotti be accepted as of September 15, 1954. Councilman Lucchio then moved, seconded by Councilman Cortesi and regularly carried, that the resignation of William Harper be accepted effective as of September 20, 1954. Council- man Rocca ~hen moved, seconded by Councilman Cortesi a~d regularly carried, that the resignation of John C..R. Clegg be accepted effective as of Septemoer 24, 1954. TEMPO~ ASST. ENGINEER,Co~aunicatlon as received from Louis H. Goss concerning the resignation of John Clegg and the CALL FOR EXAMINATION: request tha~ he be given authority to employ an assistant engineer on a temporary basis at a ~-O~ salary of S395.00 per month was next taken up. It was also the recommendation of Mr. Goss that an examination be given for Assistant Engineer at salary range ~17 ($395 to $481). Councilman Lucchio moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Directed' of Public Works be accepted. CALL FOR VARIOUS EXAMINATIONS: Communication w~s received from the office of the City Manager regarding personnel examinations for the positions of Staff Librarian, Heavy Equipment )perator and Assistant Engineer. Council- man Rocca moved, seconded by Councilman Lucchio and regularly carried, that the recommendation of the City Manager be accepted. ASSOCIATED CONST. CO. AUGUST MONTHLY INVOICE: The matter of an invoice from the Associated Construction and Engineering Co. concerning their August monthly billing in the amount of $14,164.69 for work done on industrial sewage pumping stations wm~ next discussed. After discussion had taken place relative to this invoice, Coun- cilman Cortesi moved, seconded by Councilman Rocca and regularly carried, that the claim be allowed subject to the approval of the auditor, Mr. Le~_witho Counci~_-~u Rocca then moved, seconded by Councilman Lucchio and regularly carried, -~at the fund be immediately reimbursed upon receipt of any monies from the industrial sewer a~sessment district. McGUIRE & EESTER BLASTING OPERATIONS: I~DUSTRIAL SEWER JOB: Director of Public Works Goss then brought to the councils' attention a letter from McGuire & Hester in %Imich they re. quested permission to conduct blasting operations in connection with their work o~ the industrial sewers. Mayor Smith aske& Director of Public Works Goss if he rec~ended m~proval to which he stated that he did, that the bond was still in effect not having expired. City Attorney Lyons suggested holding the bond as security. Councilman Lucchio mentioned it would be well to also have the approval of the Fire Chief in this request. M~yor Smith remarked that the Director of Public Works had the power to grant this request. Council- man Rocca teen moved, seconded by Councilman Lmcchio, that permission be grante~ subject to the approval of the Director of Public Works, that the Job be bonded and that the blasting be done by qualified personnel. Under the question, Councilman Cortesi brought up the matter of blasting da~s and dangers that might be encountered. Mayor Smith asked Mr. Goss if in his opinion he ~s satisfied that it would be done safely to which he replied he w~s. Mr. Goss then read the letter from Mc~ire and Hester and s~ated that he would check with the City Attorney before granting the permit. Motion as made and ~econded w~s regularly carried. There being no further business, on motion of Councilman 0ortesi, seconded by Councilman Gamlen and regmlarXy carried, the meeting w~s adjourned to Monday, September 20, 1954 at 8 p. m.
