PLACE: Council Chambers. PLEDGE OF ALLEGIENCE A~ Pledge of Allegience was recited, after which Invocation was given by Rev. Father I~WOCATIOI'~: Paul Coleman, of St. Veronica's Catholic Church. ROLL CALL: Present: Councilmen Andrew Rocca, Francis Lucchio, Emilio Cortesi, Richard Garden, and Telford Smith. Absent: None. MI .%~'TE S: Mayor Smith asked if there were any errors or corrections to the minutes of the Regular Adjourned meeting of March 14, 1955, Regular Meeting of March 21, 1955 and Regular Adjourned meeting of March 22, 1955. He then asked if there was a motion to approve the minutes. Councilman Rocca so moved, seconded by Councilman Gamlen and regularly carried. CLAMS: ~--D I 3 Mayor Smith asked if there was a motion that the ~laims be approved for payment. RW~ENT: 6'06-0 The first item under old business vas the Variance application of Joe Boniuo to erect a home at the rear of his property located at 470 Commercial Avenue. Commissioner Breed, having been appointed by the Planning Commission to speak on the subject at this time, gave a detailed explanation as to the reasons for the denial of this application by the Planning Co~ission. Discussion took~place by members of the City Council, Commissioner Breed, and Carlo Bouino, representing his father ~hovas the Applicant. After lengthy discussion, Councilman Lucchio moved, seconded by Douncilman Cortesi and regularly carried that the request of Mr. Bouiuo be granted; granting the Variance so that he could build his home in the rear portion of his lot. SUESHI}~ GARDenS AREA D~INAGE DISTRICT: 5/7o Communication dated March 29, 1955 was received from the office of the City Manager, acoompauied by a cost estimate dated March 14, 1955 as prepared by the Director of Public Works; also accompanied by a communication dated March 15, 1955 from the Director of Public Works, a communication dated March 24, 1955 from the Garden Development Company, and a communication dated March 17, 1955 from the Sunshine Gardens Improvement Club, all of which pertain to the Sunshine Gardens area drainage district. Mayor Smith remarked that the City. had received from the Garden~De~;elc~ment Co., a firm proposal and also the matter of funds which bad been promised by the Stouesou Development Co. to contribute toward this project. He further remarked that it appeared to be a matter for the Director of Public Works and the City Manager to proceed in getting more information for the Council° CounciLman Rocca then moved, seconded by Councilman Gamlen and regularly carried that this matter be referred to the City Manager and the Dirgctor of Public Works for their study, reccmmeudation, and report back for the next meeting. AIRPORT BOULEVARD DETECTOR SIGNALS: o77 Communications were received from the office of the City Manager dated March 29, 1955 and the Director of Public Works dated March 24, 1~55, regarding the Airport Boulevard Detector Signals. After brief discussion,COuncilman Lucchio moved, seconded by Councilman Rocca and regularly carried that the Council approve the plans and specifications as sub- mitted by the Director of Public Works and also that he be authorized to call for bids for the project. FRE~AY MAIETENANCE AGRE~4E~: ~--/~, / Communication was received from the Planning Commission dated March 16, 1955, concerning a rep~t on Freeway Maintenance Agreement. Mayor Smith remarked that some question existed at the previous meeting as to the acceptance of the street. However~ the records indicated that the streets were accepted iu November 1954; Mayor Smith further remarking that, if there were uo objections, the report would be filed. No objections were registered and the re~rt ordered filed. BRET~v,~OD LETTER TO COU~CILMA~ LUCCHI0: Communication was received from the Brentwood NewsLetter dated March 9, 1955, concerning an article which appeared iu their publication. The ccmmunication was addressed to Council- man Lucchio. After brief discussion by Councilman Lucchio, he moved that the letter be filed. Councilman Gamleu seconded the motion, followed by a brief discussion by Mayor Smith as to his feelings iu the matter, concurred in by Councilman Rocca. Motion as made and seconded was regularly carried. ST. VERONICA' S LE~fTER OF THAN~B: o--~l/~/ Communication dated March 20, 1955 vas received from Father Paul Coleman, Pastor of Saint Veronica's Church, expressing his thanks for the agreement authorizing fire protection to Saint Veronica's Church buildings. Mayor Smith remarked that if there were no objections the letter would be filed. No objections were registered. STATE PUBLIC~iLITIES CO~4ISSIONADJOU~NED ~3mING: 6~i/~- Notice of adjourned hearing ~as received from the Public Utilities Commission in regard to the matter of the application of the California Wa~er Service Company dated March 17, 1955. Mayor Smith stated that if there were no objections the notice would be filed. No objections were registered. SCHOOLS IN R-1 AREAS: ~--/o/ Communication dated March 16, 1955 was received from the office of the City Attorney concerning an answer to the City Attorney of Piedmont regarding private schools in single family residential '~ Mayor Smith stated that if there were no objections the report would be filed. No objections were registered. F. ESERINI - ELECTED CHAIRM~ OF PERSONNEL BOARD: ~- OO O Communication dated March 17, 1955 was received from the Personnel Board concerning the election of Frank Eserini as Chairman of that Board. Mayor Smith remarked that if there were no objections the report would be filed. No objections were registered. He, then, tendered the best wishes from the Council for Mr. Eserini's success. TAX COLLECTOR'S REPORT JAAVJARY & FEBRUARY: Communication dated March 17, 1955 was received from the office of the Tax Collector for the months of January and February 1955. Councilnan Gamlen moved, seconded by Councilman Rocca and regularly carried that the report be filed. BUSI~SS LICenSES ISSU~ FOR MONTH OF MARCH: ~S~N ~P 0~~ Communication dated March 29, 1955 was received from the office of the City Clerk concerning Business Licenses issued during the month of March. Councilman Rocca moved, seconded by Councilman Gamlen and regularly carried that the report be accepted and ordered filed. Applications for the appointment of Arthur Ellsworth Heth and Charles Warner Johnston as special police officers for Swift and Company %~re received from the office of the SPECIAL POLICE OFFICERS: Chief of Police. Mayor Smith remarked that they were to serve without cost to the City. ~/o3 Councilman Lucchio moved, seconded by Councilman Cortesi and regularly carried that the recommendation of the Police Chief be accepted. Councilman Gamlen moved, seconded by Councilman Rocca and regularly carried that the reports, as submitted, be filed. SERVICE CLUB SIGNS: -of? Communication dated March 31, 1955 %~s received from the office of the Plannin~ Co~mission regarding Service Club Signs. Mayor Smith remarked that the report called for the exact location to be~ determined by the Director of Public Works. He asked if there was a motion that this project be carried out under the Director of Public Works as reported by the Planning Commission. Councilman Cortesi so moved, seconded by Councilman Gamleu and regularly carried. Mayor Smith, then, opened the protest hearing for the public hearing on the vacation of public streets, ways and easements of Buri-Buri No. 3 A, asking if auy written protests had been received, it was reported that no written protests had been received. Mayor Smith, then, asked if there were any protests from the audience. None were registered. Since uo protests were registered, Mayor Smith asked if there was a motion that the hearing be closed. Councilman Gamlen so moved, seconded by Councilman Rocca and regularly carried. RESOLUTION NO. 2130 .,~o '72, ~-.%7 7 City AttorneyLyons stated that an appropriate Resolution had been prepared concerning the matter. Councilman Gamlen then introduced: "A Resolution ordering the vacation of all public streets, ways, and easements which were dedicated to the City of South Sar. Francisco and which are delineated on a particular portion of that certain m~p entitled "Rancho Buri Buri Map No. 3, South San Francisco, San Marco County, California," Recorded iu volume 40, official records of San Mateo County, Pages 7 and 8. Roll call vote ~as as follows: Ayes: Councilmen Andrew Rocca, Richard Gamleu, Francis~Lucchio, Emilio Cortesi, and Telford Smith. Noes: None. Absent: None. FOOD 0RDtNANCE: AIRPORT BOULEVARD The next public hearing concerned Airport Boulevard Sanitary Sewer District, which was S~2~ITD_RY SEWER DISTRICT: set for April ll, 1955. It was an item ou the agenda for reference only, at this time. Mayor Smith then went on to the matter of Ordlroances, taking up first a communication from the ~ouuty Manager under date of March 21, 1955 regarding regulations of Food Establishment: Mayor Smith asked if there was a motion that the CityManager and the City Attorney proceed ou this matter, submit the details and recommendations to the Council. City Attorney Lyon~ remarked that this could be prepared for the meeting .~.~.~_~__~D~.I~.D .~ Gamlen so moved, seconded by Councilman Rocca. Councilman/recommended that a copy of the proposed Ordinance be made available to the Council Members. Motion as made and seconded was regularly carried. CYPRESS AYEI'~IIE T1T~FIC: ~ne next item under Ordinance concerned the regulation of traffie~ou Cypress Avenue. City Attorney Lyons explained the ordinance prepared concerned this matter. After reading the title of the Ordinance, City Attorney Lyons remarked that there could be a motlou made introducing the 0rdiuance by title only. CounciLman Cortesi so moved, seconded by Councilman Rocca and regularly carried. ~W~s. DeMarchi briefly remarked on the traffic hazard to children on that street, requesting to k~¢ whether or not it co~ld~be sign posted. After discussion, Mayor Smith asked if it was the ~,ish of the Council to refer this matter to the Police Chief. Councilman Rocca so moved, seconded by Councilman Gamleu and reg~lsrly carried. PROPOSED SEWER ~REGULA- Communication dated March 31, 1955 was received from the office of the ' TIONS - I~USTRIAL AREA City Manager regarding proposed sewer regulaticms, accompanied by a letter from ox~f~ ' ~ and SEWER A~ PUMPING STATIONS: Company, dated March ~9, 1955 with an attached memorandum, dated March ~8, 1955 ~/~7 concerning the same subject matter. Mayor Smith read the communication as received from Swif~ and Company, after which brief discussion followed. Mayor Smith then asked if there was a motion to accept or reject the City Mauag~.r's recommendation. Councilman Gamlen moved, seconded by Councilman Rocca, that the recommendation of the City Manager be accepted. Brief discussion took~ place regardiuE the ordinance regulating the matter which was ~o be drafted. Olty Attorney Lyons remarked that he hoped to have the first reading of Vhe ordinance for the meeting of April 18, 1955, the second reading being one week later; with the adoption being as an emergency measure. Motion as made and seconded w~s regularly carried. SF~W ROAD GRADE C 0SSING: 6'/ Mayor Smith then proceeded on to the matter of Resolutions, taking up first the matter of S~w Road Grade Crossing. He remarked that for sometime this question was before the City Council. He asked if there was a motion -~hat the City Attorney notify the Southern Pacific Company that the City of South San Francisco would not assume responsibility regard- ing the crp~siug. Councilman Cortesi so moved, seconded by Councilman Rocca and regularly carried. COU~I~RY CLUB MANOR: At this time, M~.'Francis Brown Sub-divider of the Country Club Manor asked the Council if they would consider his subdivision, since it was a matter that b~d been put over from the last meeting, and was supposed ts have been heard tonight; but did not appear on the agenda. City Attorney Lyons mentioned the problem of the Avalon Park Outfall Sewer Assessment regarding the distribution of costs assumed by the City to be re~m~, as development such as this took place. Mr. Goss remarked that his office had checked over the plans and did not, a~ this time,see any reason for holding back the approval of the subdivision. He also mentioned that he had had a discussion with the City Attorney re- garding a policy for sewage charges on the Avalon Park Outfall Sewer. Brief discussion took' place regarding the ordinance regulating the matter whicl was to be drafted. Mr. Brewn then asked if any action could be taken on the grading permit. Director of Public Works Goss stated that his office had also checked the grading maps in detail, and that he had ~ecGm~ended that the Subdivider be granted a permit for grading. Councilman Lucchio then moved, seconded by CounciLman Gamleu and regularly carried that the rec~mmendation of the Director of Public Works be accepted. Communication dated March 21, 1955 was received from the office of the City Manager, accompanied by a communication dated March 12, 1955 from the Woman's Club of Burl-Burl, and a communication dated March 21, 1955, addressed to the Woman's Club of Burl Burl, from the City Manager. All of the c~m~anications mentioned concerned th matter of Buri-Bnri Park Development, a request having been made to utilize buildings to be removed from Palau Village Naval Housing Project. Mayor Smith asked if there was a motion that this matter be referred to the Recreation Commission for study and report to the Council as to thenaed for buildings i~ that area and also as to the facilities ~ presently have. Councilman Rocca So moved, seconded by Councilman Gamlen. Councilman Gamlen mentioned, relative to the buildings in question, tl~t previous Council action determined that they were not %o be used within the City. Motion as made and seconded was regularly carried. Con~nunfication dated March 22, 1955 was received from the South San Francisco Junior Chamber of Comnerce, acccmpanied by a memorandum from the office of the City Manager, dated March 28, 1955~ and a memorandum from the office of the Police Chief dated March 29, 1955 regarding the request of the Junior Chamber of Comnerce for a pe~t to hold an Industrial Fair, to be held on July l~ through ~uly 17. Councilman Lucchio moved, seconded by Council~,an Cortesi and regularly carried that the permit be gTanted, and the Business License ~ee be waived. Councilman Lucchio likeWise expressed his commendations to the Junior Chamber of Commerce for it's efforts in promoting our City's Industrial area. · Communication was received from the California Blind Products (undated) requesting permission to demonstrate, show, and take orders for blind made products. Councilmau Gamlen moved, seconded by Councilman Rocca, and regularly carried that permission be granted; subject to the payment of a regular business license ~ee. Communication dated March 17, 1955 was received fr~n the Northerngalifornia Outdoor Advertising Council requesting City support in proposals submitted bythem to the Board of Supervisors for the install atiou of advertising structures along Bayshore Freeway. ~yor Snmth remarked that the Council had previously gone on record supporting the stand of the California Roadside Council, re~desting to know if there was a motion that the City Manager inform the NorthemOaliforula Outdoor Advertising Council of our policy. Councilman Rocca so moved~ seconded by Councilman Cortesi and regularly carried. Communication was received from the office of the PLanning Commission dated March 31~ 1955, together with a communication from the Garden Development Company dated March S0, 1955 accompanied by a map concerning Sunshine Gardens Subdivision No. 8. Mayor Smith corrected the agenda, remarking that the first line appeared, "their final map"~ which should read "tentative map." Councilman Gamlen asked Director of Public Works Goss if he was satisfied with the arrangements, to which he replied, "Yes." Director of Public Works Goss also recommen2d, at this time, that the tentative map be approved with the provision that complete plans and specifications for drainage facilities be submitted with the final map. CouucilmanRocca then moved, seconded by Councilman Cortesi and regularly carried that it be approved and that the final map have all the necessary specifications on it. Also the tentative map should have all the specifications on it as we~ Mr. Sch.,' hauser of the Garden Development Company, then, asked if the grading permit could be considered at this time. M~yur Smith read the letter submitted by the Garden Development Company regarding the matter of grading. Director of Public Works Goss recommended that it be granted, after which Councilman Gamlen moved, secOnded by Councilman Rocca and regularly carried that the recommendation of the City Engineer be accepted. Communication dated March 31, 1955 was received from the office of the City Manager accompanied by Co~mnunications dated March 29, 1955 and April 4~ L955 from the Loma Linda Construction Company regarding a request for grading permit. Mayer Smith r~marked that the .s$.enda be , corrected ou the line where it read "the Company has Couucil.~t~'~'~ho~ readU- ~e~'' Company smeks Council approval". Director of Public Works Goss explained the grading problems that existed, one b~ing with the California Water Service, the other a matter of a high bank, one with San Francisco Water Department and the other being a question of p~oced~e~. After discussion b~d taken place, Mayor 6mith remarked that, if there were no objections, this matter would be placed ou the agenda for next Monday Night, April ll, 1955o No objections were registered. It was so ordered. CGEnunica~ion dated March 25, 1955 x~s received from Mc Guire and Hester requesting pa~ent on work they had done on the Industrial Sewers and Pumping Stations. Mayor Smith remarked that in the study session, the Director of Public Works had remarked to the Council that Mc Guire and Hester be paid the sum of $2~,578.48 and that the balance remain. ADJUS~V~YTTS: Communication dated March 28, 1955 was received from the office of the Director of Public Works~ accompanied by a conm~unication dated March 30~ 1955 from the office of the City Manager regarding Serra Highlands Subdivision bond release. Mayor Smith remarked that it had been requested that the Serra Highlands bond release be over until next Monday night's meeting of April 11, 1955. No objections were registered~ and it was so ordered. A communication was received from the office cf the Director of Public Works dated March 24, 1955 and from the office of the City Manager dated March 29, 1955 regarding Baden Avenue improvement plan. A brief explar, ation ,~as given by City Manager Mc Clung, after which Mayor Smith asked if there was a motion that the plans and specifications submitted by the Director of Public Works be adopted. City Attorny Lyons then ex-p. lained the resolution he had prepared to be adopted wu ~n the agreement from the De-~e~t of Highways.
