The neeting was called to order by Mayor Rozzi at 5:41 p.m.
Present: Councilmen G. J. Rozzi, Andrew Rocca, Patrick E. Ahem.
Absent: Councilmen Leo J. Ryan and Emilio Cortesi.
At time request of Mayor Rozzi, City Attorney Noonan gave an explanation
of t~e proposals for maintenance and repair as well as relieving the City
of liability against any claims in the matter of the development of South
San Francisco Industrial Park Unit No. 2-C and Person & Swanson Industrial
Tract Subdivision. He likewise mentioned the agreement which could be
executed, after which he remarked that a motion could be adopted approv-
ing the proceedings upon the submissio~ of a subdivision contract con-
taining the provision concerning liability, repair and maintenance. At
Council request, City Attorney Noonan stated the motion as follows:
"Move that the proceedings as amended adding a maintenance and repair
district be approved for presentation and passage by the Council with the
ad&itional approval that the developers, Person & Swanson, and Utah
Construction Company, agree to indemniYy City, its officers and employees,
for claims." Councilman Rocca so movefl, seconded by Councilman Ahern and
regularly carried. Brief discussion followed concerning the length of
time that the indemnity was to run, after which it was agreed to be half
the time of the bond issue, or ten yea~s.
Mr. William Rus of Utah Construction C~mpany then briefly discussed wish
Council an amended grading plan proposed for South San Francisco Industrial
Patak Unit No. 3. After discussion, Mayor RozZi requeated that Director of
P~blic Works Goss have this matter scheduled for the next regular Council
meeting.
Director of Public Works Goss then brought up the matter of the request
as ~.ade by Utah Construction Company for payment of $49,000.00 for acquis-
ition of excavation and earth work for streets within South San Francisco
Industrial Park Unit No. 3. Councilman Rocca moved, seconded by Councilman
Ah,~rn and regularly carried, that Uta~ be paid $49,000.00 acquisition costs
w~h the understanding that the City has a letter guaranteeing payment if
the district requires more money.
Next,ken up was the claim as filed by Paul Friedman, attorney at law, in
behalf of his client, Michele Tedd Perna, in the amount of $250,000.00, fo~
injuries alleged to have been receive& as a result of a train-car accident
on December 23, 1958, at the Grand Avenue railroad crossing. Councilman
Rocca moved, seconded by Councilman Ahem and regularly carried, that the
claim be denied and referred to the C~ty's insurance carrier in the usual
manner.
City Attorney Noonan brought to Council attention next a resolution which
had been prepared, authorizing an agreement with Mae Collins regarding the
removal of rubbish, trash and refuse ~rom the premises located at 210 Bade~
Avemue. After brief explanation, Councilman Ahern introduced: "A RESOLUTI¢
OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING EXECUTI¢
OF AN AGREEMENT WITH MAE COLLINS". Re11 call vote was as follows: Ayes,
Councilmen Rozzi, Rocca and Ahern. Noes, None. Absent, Councilmen Cortes~
and Ryan.
Mayor Rozzi then stated that because of the absence of the City Manager,
~ho was to explain the matter of the selection of an engineer for the
~evelopment of the small craft harbor, this matter would be continued to
an adjourned meeting for March 30, 1959, at 7:30 p.m., at which time, Coun.
cil action would be taken. He reques';ed the Clerk to send notification to
all councilmen.
There being nothing further, Mayor Rozzi adjourned the meeting at 6:10 p.m
~ntil March 30, 1959, at 7:30 p.m.
