HomeMy WebLinkAboutMinutes 1959-09-21REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HELD MONDAY, SEPTEMBER 21, 1959 TIME: PLACE: 8:00 p.m. Council Chambers, City Hall CALL TO ORDER: The neeting was called to order by Mayor Rocca at 8:00 p.m. PLEDGE OF ALLEGIANCE AND INVOCATION: Pledge of Allegiance to the Flag was recited, after which, due to the absenc of =he Reverend Rolph Conrad of the Parkwood Methodist Church, no invocation was rendered. ROLL CALL: Present: Absent: Councilmen Andrew Rocca, G. J. Rozzi, Emilio Cortesi, and Patrick E. Ahem Councilman Leo J. Ryan MINUTES: Mayor Rocca asked if there was a motion approving the minutes of the regular mee=ing of September 8, 1959, as submitted. Councilman Rozzi moved, seconde by Councilman Ahern and regularly carried, that the minutes of the regular mee=ing of September 8, 1959, be approved as submitted. CLAIMS: Mayor Rozzi then asked if there was a motion approving the regular claims as submltt&d. Councilman Ahern moved, seconded by Councilman Rozzi and regu- larly carried, that the regular claims as submitted be approved for payment. DOLWIG & MILLER CLAIM - HARBOR WAY ASSESSMENT DISTRICT: Council next took up the claim of Dolwig and Miller in the amount of $957.34 for ].egal services performed in connection with the Harbor Way Assessment Dis=rict, payment of these monies to be made from the special assessment proceedings funds. Councilman Ahern moved, seconded by Councilman Rozzi and regularly carried, that the claim of Dolwig and Miller be approved for payment. PUBLIC HEARING SAN BRUNO BLVD. AREA GRADING MAINTENANCE DISTRICT: (PERSON & SWANSON) Proceeding on to the matter of public hearings, Mayor Rocca opened the publi hearing for the proposed acquisitions and improvements and formation of the San Bruno Boulevard Area Grading Maintenance District, asking if any written proDests had been received, to which the Clerk replied one had been received from Ken Royce, Inc. and the other from the firm of Lyons and Bocci, rep- resenting Stewart Warner Corporation; Raymond K. Jacobsen of Alemite Company anc Milprint, Inc. Mr. Wilson of the firm of Kirkbride, Wilson, Harzfeld and Wallace, requested that the public hearing be continued to October 5, 1959, and that also the sealed proposals received f~the work be returned to the bidders unopened. Councilman Rozzi moved, seconded by Councilman Ahern that the public hearing be continued to the next regular Council meeting of October 5, 1959. Under the question, Mr. Wilson remarked that he did not intend at this time, by requesting the continuance of the public hear- ing, to deter anyone from addressing the Council. Mr. Lyons briefly spoke in behalf of the clients he was representing, after which he suggested that possibly an informal meeting could be held between the interested persons in advance.of the regular Council meeting in the event that the problem could be resolved. Mr. Lyons then called on the following property owners whom he represented, who voiced their oral objections to the assessment dis- trict in the manner in which it was presently formed. They were: Mr. Simpso of Milprint, Inc. and Mr. Jacobsen of t~e Alemite Company. Mr. Lyons then remarked that the representative of Stewart Warner Corporation, although present, did not wish to take up any further time but also orally voiced similar objections. Mr. Ellis, represeyting Ken Royce Company, likewise in behalf of his client orally voiced objections to the present formation of the assessment district. There being no further protests, motion as made and seconded was regularly carried~ RETURN OF BIDS TO PIOMBO CORP. & ROYAL CORP.: (PERSON & SWANSON) PERSON & SWANSON RESOLUTIONS CONTINUED: PARKING DISTRICT #1 RESOLUTION CONTINUED: RESOLUTION NO. 2878 GRANT OF PUBLIC SERVICE EASEMENT Councilman Cortesi then moved, seconded by Councilman Rozzi and regularly carried, that all bids received be rejected and returned to the bidders unopened. The only bids received were ';hose from Piombo & Company and the Royal Corporation. Mr. Siri of Piombo and Mr. Marlowe of Royal, both pres- ent in the audience, then were returned the bids unopened. Council then proceeded on to ~esolutions and proclamations. The first reso- lutions as concerned the Person & Swanson Industrial Tract were continued to the regular meeting of October 5, 1959. The next resolution which ooncerned the issuance of bonds for Parking Dis- trict No. 1 was likewise continued to the meeting of October 5, 1959, at the request of Mr. Scampini, attorney for the District. Although not appearing as an item on the agenda, City Attorney Noonan briefl~ explained a resolution accepting a Grand of Public Service Easement from the Utah Construction & Mining Company. RESOLUTION NO. 2879 GRANT OF PERMIT TO CROSS CITY PROPERTY, SO.S.F.IND.PARK UNIT 2-C, ZONE 1: The next resolution concerned the granting of a permit to cross City propert~ in South San Francisco Industrial Park Unit No. 2-C, Zone 1. After explan- ation, Councilman Ahern introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING THE ISSUANCE OF A LICENSE OR PERMIT TO CROSS A CITY STREET - INDUSTRZAL PARK UNIT NO. 2-C, ZONE 1". Roll call vote was as follows: Ayes, CounciLmen Andrew Rocca, G. J. Rozzi, Emilio Cortesi and Patrick E. Ahern. Absent: Councilman Leo J. Ryan. ORDINANCE REGULATING JUNK COLLECTORS: Council next proceeded on to ordinances, taking up the ordinance regulating junk collectors, providing for revocation of permits and penalty for violation City Attorney Noonan briefly explained the ordinance, after which he remarked tha~ a motion could be introduced that the ordinance have its first reading and introduction by title and that the detailed reading of the ordinance be waived. Councilman Ahem so moved, seconded by Councilman Cortesi and reg- ularly carried. City Attorney Noonan then read the title of the ordinance as follows: "AN ORDINANCE OF THE CITY O~ SOUTH SAN FRANCISCO REGULATING JUNK COLLECTORS, PROVIDING FOR REVOCATION OF PERMITS, AND P~NALTY FOR VIOLATION", after which he suggested a motion be adopted that the ordinance be intro- duced by the reading of title. Councilman Cortesi so moved, seconded by Councilman Rozzi and regularly carried. RESOLUTION NO. 2880 GRADING PERMIT - PONDEROSA HILLS : S BDIVISION ¢ There being no unfinished business, Council proceeded to the item of new business, taking up first a communication which had been received from Edmund T. Dady dated June 17, 1959, regarding the proposed grading plan for Ponder- osa Hills Subdivision and requesting approval. Also received was an inter Office memorandum from the Director of Public Works dated September 17, 1959, reconnending approval, subject to certain conditions. City Attorney Noonan staied that a resolution would be necessary for compliance with the recom- mendations of the Director of Public Works and that instead of a guarantee bond, the City could be added as assured along with the other property owners He ~hen explained the resolution, after which he read its title. Councilman Rozz£ then introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING THE ISSUANCE OF A GRADING PERMIT - PONDEROSA HILLS". WEST COAST ADVERTISING Inter office memorandum dated September 18, 1959, was received from the City CO. P.S.A. JET AND Attorney concerning two Use Permits previously granted to the West Coast LUCKY LAGER SIGNS: Advertising Company. The first had to do with the P.S.A. jet sign and the (USE PERMITS) second the Lucky Lager sign. It was the desire of the applicant to have ~.2-~ the Letters and clock transferred from the existing Lucky Lager sign to a ' new sign and to install on top of the jet sign the letters: "Fly P.S.A. Jet". Councilman Rozzi moved, seconded by Councilman Cortesi and regularly carried tha~ the approval be granted for the relocation of the Lucky Lager letters and clock and the installation of the P.S.A. letters. UTAH CONSTRUCTION CO. REQUEST FOR RESUBDIVISION OF LOT 2-A, SO.S.F. IND.PARK UNIT 2-A: PLANNING COMMISSION RESOLUTION #1136 - JOS. MARENCO RE- ZONING REQUEST - ASHTON AVE. LOTS: Inter office memorandum dated September 15, 1959, was received from the Plan- ning Commission, recommending the resubdivision of Lot 2-A, Block 8, into two p&rts - parcels 2-A1 and 2-A2. This resubdivision was in South San Francisco Industrial Park Unit No. 2-A. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Planning Commission be accepted and approved. ResoLution No. 1136 was received from tke Planning Commission, recommending the approval of the application of Joseph Marenco of 233 Willow Avenue for the rezoning of Lots 1 through 9 of Ashton Avenue Lots from R-2 to R-3. City Attorney Noonan stated that this required a motion that it be set for public hearing with the publication of a notice by the City Clerk as re- quired by law. Councilman Ahern so moved, seconded by Councilman Rozzi and regularly carried. ROBERT J. LORENZINI VARIANCE PERMIT RESOLUTION NO. 1137: VarL&nce Permit Resolution No. 1137, as applied for by Robert J. Lorenzini, was received from the Planning Commission, recommending that permission be grar.~ed for a 2 ft. encroachment into the required 5 ft. sideyard at 327 Camzritas Avenue. Councilman Rozzi moved, seconded by Councilman Ahern and reguLmrly carried, that the recommendation of the Planning Commission be accepted and approved. JOHN L. KERNAN VARIANCE PERMIT RESOLUTION NO. 1138 · Variance Permit Resolution No. 1138, as applied for by Mr. John L. Kernan, was received from the Planning Commission, recommending that permission be denied for a 13 ft. 6 in. encroachment into the required 20 ft. rear yard to erect carpert at 2 Serena Court. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Plan- ning Commission be accepted and approved. VALWYN G. FLETCHER VARIANCE PERMIT RESOLUTION NO. 1139: Variance Permit Resolution No. 1139, as applied for by Valwyn G. Fletcher, was received from the Planning Commission, recommending that permission be granted for a 5 ft. encroachment into th~ required 15 ft. front yard and 15 ft. encroachment into required 20 ft. rear yard on Lot 1, Block F, Peck's Subdivision No. 1. Councilman Rozzi moved, seconded by Councilman Ahern and reg~].arly carried, that the recommendation of the Planning Commission be accepted and approved. JACK J. BUTLER USE PERMIT RESOLUTION NO. 1140: Use Permit Resolution No. 1140, as applied for by Jack J. Butler, was re- ceived from the Planning Commission, recommending that the proposed rezoning of Lots 13 and 14 in Block "T" of Peck's Subdivision No. 1 be denied. Brief discussion followed concerning this application, after which, there being no objections, Mayor Rocca requested tha~ it be held over to the next regular meeting of October 5, 1959. ROBERT CAVALI ERI USE PERMIT RESOLUTION NO. 1141: Use Permit Resolution No. 1141, as applied for by Robert Cavalieri, was received from the Planning Commission, recommending that permission for the erection of a duplex on the rear of Lot 117, Block 96, be denied. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Planning Commission be accepted and approved. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Planning Com- mission be accepted and approved. Use Permit Resolution No. 1145, as applied for by Fred Ferrando (Ray-Lite Neon Corp.-Lessee), was received from ~he Planning Commission, recommending that permission be d:enied to erect an illuminated single faced sign with overall dimensions of 57 feet in length by 57 feet in height per drawings submitted, for Parcel 5, South San Francisco Map 27, Acreage. Councilman Rozzi moved, seconded by Councilman Ahem and regularly carried, that the reconnnendation of the Planning CommissLon be accepted and approved. Use Permit Resolution No. 1146, as applied for by Guido De Luca, was re- ceived from the Planning Commission, recommending that permission be grantee for the erection of a 3-bedroom home and attached garages facing Railroad Avenue on front of Lot 5, Block 98. Coumilman Rozzi moved, seconded by Coancilman Ahem and regularly carried, that the recommendation of the Planning Commission be accepted and approved. Use Permit Resolution No. 1147, as applied for by Picker Van Vloten, was received from the Planning Commission, recommending that permission be granted to operate a printing and publishing business at 308 Alida Way. Councilman Rozzi moved, seconded by Councilman Ahem and regularly carried, that the recommendation of the Planning Commission be accepted and approved. Memorandum dated September 16, 1959, was received from Fire Chief A. J. Welt recommending that Fireman Hommo Zylker receive an additional 12 days sick leave. Councilman Cortesi moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Fire Chief, as concurred in by the City Manager, be accepted and approved. Memorandum dated September 16, 1959, was received from the Police Chief, wit: recommendation that Laurence Lewis Ross receive his probationary appointment as Radio-Clerk Dispatcher effective Sept. 21, 1959, his name having been taken from the eligibility list submitted by the Personnel Board. Councilma Ahem moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Police Chief as concurred in by the City Manager be accepted and approved. Le~er datedSeptember 9, 1959, was received from Erwin K. Ross, tendering his resignation as Dispatcher Clerk, effective Sept. 26, 1959. Mayor Rocca remarked that if there were no objections, the resignation would be accepted and ordered filed. No objections were registered. Memorandum dated September 16, 1959, was received from the Librarian, Lauretta Hussar, recommending the probationary appointment of Sandra Ander- son and Marilyn Hanes as Library Clerk, their names having been taken from the eligibility list as submitted by the Personnel Board. Councilman Rozzi move([, seconded by Councilman Ahern ani regularly carried, that the recom- mendation of the Librarian, as concurred in by the City Manager, be accepted and approved. Recommendation was received fr~m the Chief of Police that Fred Ival Mullen be appointed Special Police Officer, effective September 11, 1959, for the Sou~h San Francisco Patrol Service. Councilman Ahern moved, seconded by Councilman Cortesi and regularly carried, that the recommendation of the Chief of Police be accepted and approved. Reports for the month of August 1959 were received from the following departments: Police Department Poundkeeper San Mateo County Dept. of Public Health, Sanitation Section There being no objections, Mayor Rocca ~rdered the reports placed on file. There being nothing further, Mayor Rocca asked if any of the Council members wished to offer anything under Good and Welfare. There being nothing, Mayor Rocca requested the City Manager to check the alleyway behind the fire station which needed repair because of muddy conditions as the result of recent rains. Mayor Rocca then asked if anyone in the audience had anything to offer under Good and Welfare. Dante Batteli of 222 Rockwood Drive protested the flights of jet aircraft, asking as to what they could do to help. Mayor Rocca briefly explained to Mr. Batteli what action the City had already taken. He also explained the action taken with Congressman Younger and the results achieved as far as the training flights and jet aircraft flights were concerned. He also commented on the need of help from all within the com- munity. Mrs. Bose of Burl Burl commented on the Garbel Report concerning the jet aircraft. Also she stated that she had some 500 protesting letters in her possession awaiting dispatch to Congressman Younger. Mrs. Scannell of Circle Court remarked that they wished relief from the jet aircraft noises. She suggested the formation through legislation of a regional office to hear complaints on a 7-day 24-hour basis. She also suggested the preparation of petitions by the City for circulation by the residents. Mayor Rocca then instructed the City Attorney to prepare the petitions for circulation. Betty Hammon related the course of action which some of the neighbors in hex su'~division followed regarding low flylng jet aircraft. She suggested that residents call Mr. Belford Brown of the Airport, giving the flight time and date that the annoyance was received. City Attorney Noonan briefly explained the article which appeared in the pu'~llcation "Aviation Week" concerning people bothered by jet aircraft in the region of New York. Mr. Skulsky of Circle Court remarked that although we were presently bosnered by a few planes at this time, within a very short time, we would have some 152 per day.
