OF INT, TO VACATE ANCHORAGE & PUBLIC SERVICE EASE- MENTS, SSF IND.PARK UNIT 2-C, ZONES 1 & 2: 8:,)~ p.m. Council Chambers, City Hall The neeting was called to order by Mayor Rocca at 8:04 p.m. Pledge of Allegiance to the Flag was recited, after which invocation was given by the Reverend Barber of St. Elizabeth's Episcopal Church. Present: Absent: Councilmen Andrew Rocca, G. ~. Rozzi, Emilio Cortesi, Leo J. Ryan and Patrick E. Ahern None Mayor Rocca asked if there was a motion approving the minutes of the regular mee=ing of October 5, 1959, and the special meeting of October 9, 1959, as submitted. Councilman Ryan moved, seconded by Councilman Rozzi and regu- larly carried, that the minutes of the meetings be approved as submitted. Mayor Rocca then asked if there was a ~otion approving the regular claims as submitted for payment in the amount of $13,756.17. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the regular cltgns as submitted be approved for payment. Council next took separate action on claims, payment for which was to be made from certain funds. These claims were as follows: The claim of Bragato Paving Company dated September 30, 1959, in the amount of $3,917.33 for work performed on the Comnur Street extension. Councilman Ryan moved, seconded by Councilman Rozzi and regularly carried, that the claln be approved for payment. Claln of Enterprise Journal dated October 1, 1959, in the amount of $36.00 for advertising notice of sealed proposals - South San Francisco Industrial Park Unit No. 2-C, Zone 1. Councilman Ahern moved, seconded by Councilman RozzL and regularly carried, that the claim be approved for payment. Clara of Enterprise Journal dated September 30, 1959, in the amount of $37.00 for advertising notice invitinl sealed proposals - South San Francisc Industrial Park Unit No. 2-C, Zone 2. Councilman Rozzi moved, seconded by Councilman Ahem and regularly .carried, that the claim be approved for pa.vnent. Cla:m of A. Carlisle & Co. dated September 28, 1959, in the amount of $507.0 for printing improvement bonds, Series 57 - South San Francisco Industrial Park Unit No. 2-C, Zone 3. Councilman Ahem moved, seconded by Councilman Rozzi and regularly carried, that the claim be approved for payment. Proceeding on to public hearings, Council first took up the continued public hearing on the Person and Swanson Industrial Tract. There being no ob/ections, Mayor Rocca continued the hearing to November 2, 1959. Council then took up the public hearing on the vacation of a portion of Utah Aven~e in South San Francisco Industrial Park Unit 2-C, Zone 2, this hear- ing having been continued from the meeting of October 5, 1959. Mayor Rocca aske~ if there had been any written protests received, to which the Clerk replied that none had been received. H~ then asked if anyone in the audienc~ wis,.ed to offer a protest. None were r®gistered and Mayor Rocca closed the ~ublic hearing. Mayor Rocca then opened the public hearing on the rezoning application of Joseph Marenco, asking if any written protests had been received, to which the City Clerk replied that none had been received by his office. Mayor Rocc~ then asked if anyone in the audience wished to register an oral protest. None were registered. Mayor Rocca then declared the public hearing closed. Proceeding on to resolutions, City Attorney Noonan briefly explained the first which was ready for Council action, after which Councilman Ahern in- troduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRAN- CISCG AUTHORIZING THE EXECUTION OF AN A~REEMENT ~ITH PACIFIC PLASTIC PRODt'CTS". Roll call vote was as follows: Ayes, Councilmen Rocca, Rozzi, Cortesi, Ryan and Ahern. The next resolution was then explained by the City Attorney, after which Cocncilman Ryan introduced: "A RESOLUTI.)N OF THE CITY COUNCIL OF THE CITY OF SCUTH SAN FRANCISCO CALLING UPON THE RESIDENTS TO CELEBRATE UNITED NATICNS DAY ~ITH APPROPRIATE ACTIVITIES~. Roll call vote was as follows: Ayes, Councilmen Rocca, Rozzi, Cortest, Ryan and Ahern. Mayor Rocca then stated that he wished =o proclaim the month of November as National Muscular Dystrophy Month, after which Councilman Rozzi moved, seconded by Councilman Ryan and regularly carried, that the Mayor's proclam- ation be confirmed. Although not appearing as an item on the agenda, City Attorney Noonan briefly explained the next resolution W~ich had been received for Council action, after which Councilman Rozzi ln=roduced: "A RESOLUTION OF INTENTION TO VACATE ANCHORAGE EASEMENTS AND PUBLIC SERVICE EASEMENT - XNDUSTRIAL PARK UNIT NO. 2-C, ZONES i AND 2". Roll ca12 vote was as follows: Ayes, Councilmen Rocca, Rozzi, Ryan and Ahern. No, Councilman Cortesi. RESOLUTION NO. 2887 MARENCO REZONING: City Attorney Noonan briefly explained the next. resolution which likewise did not appear on the agenda, as concerned the Marenco rezoning, after which CouncLlman Rozzi introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO APPROVING RECOI~ENDATIONS AND REPORT OF THE PLANNING COMMISSION REZONING CERTAIN P~RCELS R-3 RESTRICTED ]COLTIPLE RESIDENTIAL DISTRICT AND ORDERING ENDORSEMENTS FIXED TO SAID REPORT AND RECOI~ENDATIONS". RESOLUTION NO. 2888 AMENDMENT TO HARDENBERG AGREEMENT PARK HAVEN DRAINAGE STRUCTURE: The Last resolution for Council attention concerned an amendment to the agreement with James Hardenberg, dba B & D Trucking Company, for drainage corrective work in the Park Haven Subdivision. TO VACATE PORTION OF LITTLEFIELD AVE. & SERVICE ROAD SSF IND.PARK UNIT 2-C ZONES 1 & 2: REIMBURSEMENT OF FEE TO GARY GOUVEA FOR ~IVERSITY EXTENSION ~SE ON the ordinance, giving a brief explanatio~ of its purpose, as follows: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING AN A~I~NDMENT TO THE CONTRACT BETWEEN THE CITY COUNCIL AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA STATE EMPLOYEES' RETIREIiENT SYSTE~', after which he stated that a motion could be adopted that it have its second reac:ng and adoption by the reading of title. Councilman Ahern so moved, seooL~ed by Councilman Rozzi and regularly carried. Althongh not listed as an item on the agenda, City Attorney Noonan briefly ~ explained the ordinance of intention which had been received to vacate a portLcn of Littlefield Avenue and Service Road - Industrial Park Unit 2-C, Zones I and 2, which after introduction would become effective. Councilman Rozz: then introduced the ordinance for adoption at this time as follows: "AN C~DINANCE OF INTENTION TO VACATE PORTION OF LITTLEFIELD AVENUE AND SERVIC ROAD - INDUSTRIAL PARK UNIT NO. 2-C, ZONES I AND 2". Roll call vote was as follows: Ayes, Councilmen Rocca, Rozzi, Ryan and Ahern. No, Councilman Cortesi. Proceeding on to unfinished business, Coincil took up first the matter of the request for reimbursement to Gary Goivea, Planning Officer, for a $25.00 fee paid for a University extension course on City and Regional Planning. Letter dated October 13, 1959, was received from the City Manager recom- mending the reimbursement of the fee paid. Councilman Ryan moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the City Fanager be followed. RELOCATION OF SERVICE BOAD - SSF IND. PA K UNIT 1 & 2-c. The next item under unfinished business concerned the letter dated September 30, 1959, as received from Utah Construc~ion and Mining Company for re- location of the service road in South Sas Francisco Industrial Park Units I a~d 2-C, this matter having been continued from the meeting of October 5, 1959. Mayor Rocca remarked that if there were no objections this matter woul~ be taken up along with Item 4 (a) under Planning Commission items whic~ concerned the revised tentative map of Industrial Park Unit 2-C. No objections were registered. WILLOW AVE. I~PR. PETITION OF PROPERTY O~NERS: 5 p-o DISABLED A~ERICAN VETERANS REQUEST TO CONDUCT SALE: Petition for the improvement of Willow Avenue was received from various property owners in the mentioned area. ~ayor Rocca remarked that if there were no objections, this petition would be ordered filed. No objections were registered. Comm~nication dated October 5, 1959, was received from the Disabled American Veterans, requesting permission to conduct a sale of Forget-Me-Not flowers fromNovember ~_$~rg~gh 10, 1959, proceeds of which go toward the a i,d and benefit of n~~llies. There being ~o objections, Mayor Rocca approved the requeet a~ received. FOREST HO~E PARK TRAILER PARK VIOLATIONS OF ORDINANCE AND HEALTH & SAFETY CODE ~9-0 B 7 APPROVAL OF REVISED TENTATIVE ~AP - UTAH CONSTRUC. IND.PARK UNIT 2-C: Communication dated October 13, 1959, was received from the Department of Public Health and Welfare of the County of San Marco, recommending the revocation of the license for trailer park of Theodore Mulkey as a result of violations and non compliance. There being no objections, Mayor Rocca referrLd this item to the City Attorney flor action. Inter office memorandum dated October 14, 1959, was received from the Plan- ning Com~ission, recommending the approval of the revised tentative map of Utaa Construction and Mining Company ~ndustrial Park Unit 2-C Drawing 59-4105, Sheets I and 2. City Attorney Noonan at this time read the motion which ~e had prepared on the instructions of Council, which was as follows: "~ove that the tentative map be approved and prior to approving the final map, title to the parcel of land upon whLch the service road is to be con- structed be established in the City. ThLt further said service road be con- structed and installed by Utah Construction Company comparable to the exist- ing service road." USE PERMIT H~SOLUTION #1043-A: Use Permit Resolution No. 1043-A, as applied for by Foster and Kleiser Division, W. R. Grace Company, was received from the Planning Commission, recommending that permission be granted for an increase of 10 feet to original sign to make a total of 55 feet from ground (Resolution #1043 of Feb. 24, 1959), at 373 Shaw Road. Councilman Rozzi moved, seconded by Councilman Ryan and regularly carried, that the recommendation of the Pla nine Commission be approved and accepted. DAYTON TIRE COMPANY USE PERMIT RESOLUTION #1154: Use Permit Resolution No. 1154, as applied for by Dayton Tire Company, wa received from the Planning Commission, recommending that permission be granted for erection of a roof sign, 17'7" x 16'3", to be non-flashing au non-scl'ntlllating, at 130 East Grand Avenue, subject to the con~n tha barrier be placed below immediate structure at minimum of 3 fee of elevatio~ and structural supports be placed at a minimum of 6 feet apart as stated in the sign ordinance. Councilman Rozzi moved, seconded by Councilman Ryan and regularly carried, that the recommendation of the nine Commission be accepted and approved. MORRIS SKULSKY VARIANCE APPLICATION RESOLUTION #1155: 5-o50 Variance Permit Resolution No. 1155, as applied for by Morris Skulsky, wa received from the Planning Commission, recommending permission be grantei for a 4 ft. encroachment into the required 20 ft. rear yard on the northe 40 feet of Lots I and 2, N/E 20 ft. x 40 ft. Lot 3, Block 79 (807 Second Lane~ subject to the condition that proposed carport align itself with rear building line. Councilman Rozzi moved, seconded by Councilman Ryan and regularly carried, that the recommendation of the Planning Commissior be approved and accepted. JOHN GHIOZZI VARIANCE PERMIT RESOLTUION #1156: Variance Permit Resolution No. 1156, as applied for by John Ghiozzi, was received from the Planning Co~ission, recommending that permission be granted for a 4 ft. encroachment into the required 10 ft. rear yard to permit the addition of two units to existing four-unit, located on Lot 2: Block 101. Councilman Rozzi moved, seconded by Councilman Ryan and regu- larly carried, that the recommendation of the Planning Commission be approved and accepted. ELDWIN L. McCUNE VARIANCE PERMIT RESOLUTION #1157: Variance Permit Resolution No. 1157, as applied for by Eldwin L. McCune, was received from the Planning Commission, recommending that permission I granted for an encroachment of 10 feet into the required 20 ft. rear yarc to permit 49% lot coverage instead of 40% on Lot 13, Block 7, Mayfair Village (125 Cherry Avenue). Councilman Rozzi moved, seconded by Council Ryan and regularly carried, that the recommendatiQn of the Planning Com- mission be approved and accepted. COMPILATION OF BIDS CHAINS & SPROCKETS 'SEWAGE TREATMENT PLANT - AWARD OF CONTRACT TO ADAM-HILL COMPANY: Inter office memorandu~ dated October 19, 1959, was received from the Director of Public Works, submitting a compilation of bids for the purch{ of chains and sprockets for the Primary Sedimentation Tank at the Sewage Treatment Plant, together with recommendation that the contract be award, to the low bidder, Adam-Hill Company. Councilman Rozzi moved, seconded bY Councilman Ahern and regularly carried, that the recommendation of th, Director of Public Works be approved and accepted and the contract award, to Adam-Hill Company. COIIPILATION OF BIDS DRAGLINE EqUIPmENT COLILt CREEK - AWARD OF CONTRACT TO BERGER COASTWlDE Inter office memorandum dated October 14, 1959, was received from the Director of Public Works submitting a compilation of bids on dragline eq~ ment for the dredging of Colma Creek for fiscal year 1959,1960, recommen ding the award of contract to Berger Coastwide Construction Company. SEWER LINE NEAR HOXES ON SOUTH SIDE OF CIRCLE COURT: The next item under reports concerned a communication which had been re- ceived from Mrs. Philip Scanne11 dated September 25, 1959, which concern the sewer line near the homes on the south side of Circle Court. Discus sion followed, during which time Mrs. Scanne11 presented to Council ale dated February of 1956 as received from City Manager McClung, together w · ~rpts of the minutes of the meeting of the City Council held October 3 1938 and which concerned the subject matter. She further stated that th e~eerpt from the minutes of the mentioned meeting would sa~.i~fy the loan agency concerning this sewer line. She further asked if the City would make available to the property owners certified copies of these~erpts, after which Mayor Rocca instructed the Clerk to so prepare these excerpts No further action was taken. ~ FRANK S. Brown as Police Officer t commence his probationary appointment on October 16, 1959. SEI~ER LINE NEAR HOMES ON SOUTH SIDE OF CIRCLE COURT: The next item under reports concerned a communication which had been re ceived from Mrs. Philip Scannell dated September 25, 1959, which concer the sewer line near the homes on the south side of Circle Court. Discu sion followed, during which time Mrs. Scannell presented to Council a 1, dated February of 1956 as received from City Manager McClung, together ' ~arpts of the minutes of the meeting of the City Council held October : 1938 and which concerned the subject matter. She further stated that tl e~erpt from the minutes of the mentioned meeting would satisfy the 1ca: agency concerning this sewer line. GOOD AND WELFARE: REMARKS OF BETTY HAIOION RE TRAFFIC SAFETY PROGRAM IN SERRA HIGHLANDS: There being nothing further, Mayor Rocca asked if any member of the CouncJ had anything he wished to offer under Good and Welfare. There being none, Mayor Rocca asked if anyone in the audience had anything they wished to offer. Mrs. Betty Hammon of the Serra Highlandm Improvement Association brought to Council attention the recent auto-bicycle accident which occurl in their subdivision last week. She mentioned to Council that a large vacant lot was available in the area and that it was their feeling that this would be made available by the property owner in which to conduct a traffic safety program on Saturdays by having some member of the Police Department present to instruct the children in the subdivision. After di~ cussion, Mayor Rocca referred this item to the Police Department with a request that a study be made, with recommendations to be made to the City Manager for submission to the City Council at the next regular meeting. VIOLATIONS IN CIRCLE COURT (CITY PARK): Mrs. Adler, a resident of Circle Court, brought to Council attention the violations existing on the one-way street in her subdivision, requesting enforcement. Nayor Rocca likewise referred this matter to the Police De- partment. GRAND & EUCALYPTUS SCHOOL CROSSING - REQUEST FOR SPECIAL OFFICER: ADJOURNMENT: Mr. Morris Skulsky brought to Council attention the need for a special police officer at the Grand and Eucalyptus intersection which was used by school children going to and from the Parkway School.
