HomeMy WebLinkAboutMinutes 1960-05-02REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HELD MONDAY, MAY 2, 1960 TIME: PLACE: 8:00 p.m. Council Chambers, City Hall CALL TO ORDER: PLEDGE OF ALLEGIANCE & INVOCATION: The meeting was called to order bY Mayor Rocca at 8 p.m. PLEDGE OF ALLEGIANCE TO THE FLAG was recited, after which invocation was git by Reverend Irvin Tweet of Our Redeemer's Lutheran 'Church. ROLL CALL: Present: Absent:- Councilmen Andrew Rocca, G. J. Rozzi, Emilio Cortesi, Leo J. Ryan and Patrick E. Ahem None MINUTES: Mayor Rocca asked if there was a motiOn approving the minutes of the regulal meeting held April 18, 1960 and the adjourned regular meeting of April 19, 1960. Councilman Ryan moved, seconded by Councilman Rozzi and regularly cai Tied, that the minutes of the regular meeting of-April 18 and the adjourned regular meeting of April 19 be approved as submitted. CLAIMS: Mayor Rocca then asked if there was a motion approving the regular claims submitted for payment in the amount of $5,202.71. Councilman Ahem moved, seconded by Councilman Rozzi and regularly carried, that.the regular claims be approved ~or payment as submitted. PARKING DISTRICT NO. I CLAIMS:~01~ CITY OF SOoS.F. CLAIMS: Council then took action on the following series of claims to be charged to the Parking District: City of So. S. F. claim dated 4/15/60 in amount of $412.30, for labor, materials and equipment for installing parking meters on Grand Avenue. City of So. S. F. claim dated 4/26/60 in amount of $37.35 for painting meter poles. FLORA CRANE SERVICE CLAIM: Crane Service, Inc. invoice dated 4/20/60 in amount of $2,680.00 for demolition of buildings. Councilman Ryan moved, seconded by Councilman Rozzi and regularly carried, the above claims be approved for payment. DALE WILLIAMS CLAIM - SO.S.F. IND. PARK 2-D, ZONE 2: ENTERPRI SE-JOURNAL CLAIM - PONDEROSA ROAD ]/PROVEMENT PROJECT PERSON & SWANSON PUBLIC HEARINGS: Although not appearing as an item on the agenda, Council next took action o the claim of Dale Williams, Inc. dated May 2, 1960 for 1st Progress Billing in Industrial Park 2-D, Zone 2 in amount of $15,520.19. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the claim a submitted be approved for payment. The last claims concerned the claim of Enterprise-Journal dated April 19, 1 in amount of $108.70 for publication of legal advertising in the Ponderosa Road Improvement Project. Councilman Ahem moved, seconded by Councilman Rozzi and regularly carried, that the claim be approved for payment as subm Proceeding on to public hearings, Council next took up the matter of the Pe son and Swanson Industrial Tract and the modifications and changes to the Assessment District, both having been continued from the meeting of April 1 1960. There being no objections~ both public hearings were continued to th next regular meeting of May 16, 1960. BID OPENING SALE OF BONDS PONDEROSA ROAD IMPROVEMENT PROJECT:. AWARD OF SALE TO J.B.HANAUER & CO.: 550 RESOLUTION NO. 3001 DESTRUCTION OF VETERAN EXEMPTION AFFIDAVITS: ~ ! ~'~ Proceeding on to bid openings, Mayor Rocca requested that the bids received for the sale of bonds for Ponderosa Road Improvement Project be opened and declared, which the City Clerk did. After they had been read and declared, Mr. Wilson of the firm of Kirkbride, Wilson, Harzfeld and Wallace, recomme~ that the award be made to J. B. Hanauer & Company who submitted the lowest bid. He further stated that Council could take official action by adoptio~ of a resolution later in the meeting which appeared on the agenda. Proceeding on to resolutions, City Attorney Noonan explained the first whic had been prepared, after which Councilman Rozzi introduced: "A RESOLUTION THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING THE DESTRU( OF VETERAN EXEMPTION AFFIDAVITS MORE THAN FIVE (5) YEARS OLF'. RESOLUTION NO. 3002 RELEASE OF CLAIMS FOR DAMAGE TO CITY PROPERTY: (KEMPER INSURANCE COMPAq) RESOLUTION NO. 3003 CORRECTING ERROaS IN SEWER RENTAL CHARGES: City Attorney Noonan then explained the second resolution ready for Council action, after which Councilman Rozzi introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING RECEIPT OF PAYMENT ] DAMAGE TO CITY PROPERTY AND EXECUTION OF RELEASE OF ALL CLAIMS". Roll call vote was as follows: AYes, Councilmen Andrew Rocca, G. J. Rozzi, Emilio Cortesi, Leo J. Ryan and Patrick E. Ahern. There being no ordinances or unfinished business, Council then proceeded on t the matter of new business. Communications dated November 19, 1959, from Carlo Regalia and April 22, 1960, from Andrew Nicolini, were received request ing sewer rental refunds. This matter having been taken care of earlier und~ resolutiona, no further action was taken at this time. Communication dated April 21, 1960, was received from the County Clerk notif~ lng of a meeting of the City Selection Committee for the Bay Area Air Pollutt Control District which was to be held May 9, 1960, at 10 a.m. in the Chambers of the Board of Supervisors. There being no objections, Mayor Rocca requests that the communication be filed and the City Manager forward a letter to the Committee expressing the City's desires in the matter. Communication dated April 22, 1960, was received from the law office of Saul Ross, foA~w,~rding a Notice of Claim of Injury in behalf of Lillian M. Finney, alleging injuries as the result of a fall on the Alta Loma School grounds ro2 Councilman Ryan moved, seconded by Councilman Rozzi and regularly carried, tt the claim be denied and referred to the City's insurance carrier. Communication dated April 20, 1960, was received from the San Mateo County Fs Association, inviting the City to send a candidate to the 8th Annual "Dream Girl" contest to be held July 21, 1960, at the County Fair Grounds. There b~ ing no objections, Mayor Rocca referred this invitation to the South San Fra~ cisco Junior Chamber of Commerce as has been done in the past. Communication dated April 27, 1960,was received from the American Federation of State, County and Municipal Employees, requesting a proclamation for "Pub] Employees Week" for the first week of June. Mayor Rocca so proclaimed, in- structing the City Attorney to prepare the necessary proclamation. Planning Commission Variance Application, Resolution No. 1246, as applied fo~ by Hugh Robertson, was received recommending that permission be granted for s 7-foot encroachment into the required 10-foot sideyard at the corner of Pecks Lane and Lewis Avenue, subject to certain conditions. Councilman Rozzi move¢ seconded by Councilman Ahern and regularly carried, that the recommendation ¢ the Planning Commission be approved and accepted. Use Permit Resolution No. 1247, as applied for by Sunset Factory Service, In¢ was received from the Planning Co~ission, recommending that per~ission be granted for construction of a 36" x 72" illuminated wall sign at 1160 ~ld Mission Road, subject to the condition that sign be non-flashing and non-sci~ tillating. Councilman Rozzi moved, seconded by Councilman Ahern and regular] carried, that the recommendation of the Planning Commission be approved and accepted. Use Permit Resolution No. 1248, as applied for by Harold Schackman, was re- ceived from the Planning Commission, recommending denial of the request for construction of a trampoline center at the southwest corner of Arroyo Drive E1Camino Real. Councilman Rozzi moved, seconded by Councilman Ahem and regularly carried, that the recommendation of the Planning Commission be ap- proved and accepted. Use Permit Resolution No. 1249, as applied for by Scampoline, Inc. was recei~ from the Planning Commission, recom~ending denial of the request for insta11~ tion and ~peration of an outdoor tra~poline center at the southwest corner E1Cami~e-4~al and Country Club Drive. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Plann: C~ission be approved and accepted. Use Permit Resolution No. 1250, as applied for by The Cleveland Cap Screw Company, was received from the Planning Commission, recommending that permis, be granted to maintain existing sign, tn accordance with P.C. Res. #1067, fo: an indefinite period, at the northwest corner of East Grand Avenue and Eccle, Avenue, subject to the condition that the Planning Commission shall have the right to rev. oke this permit at such time-that they deem said sign unnecessar: or undesirable. Inter office memorandum dated April 27, 1960, was received from Planning Com. mission Secretary Gary Gouvea advising that the Planning Commission recommew granting the resubdivision request of Donald Kenison for Lot 14, Block 15, Avalon park No. 4, to divide the lot into two parcels in order to combine th, southerly portion of Lot 14 with Lot 13 to form one building site. Councilm~ Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Planning Commission be approved and accepted. Inter office memorandum dated April 27, 1960, was received from the City Man: ger recommending the purchase of a Vehicle for collection of parking meter monies. Councilman Ryan moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the City Manager be approved and the pur chase made as recommended, with the purchase price to be paid out of the parl lng district funds. Monthly reports for March were received from the City Clerk's office and the Sanitation Section of the San Marco County Health Department, also City Gara work schedule for May, June, July and August. There being no objections, Mayor Rocca requested that the reports be placed on file. DEVELOPMENT AND LETTER TO SCHOOL BOARD RE RE- DI STRI CTI NG THIS LAND: There being nothing further, Mayor Rocca asked if any member of the Council had anything they wished to offer under Good and Welfare. Councilman Ryan brought up the matter of the recent annexation of the Callan Subdivision to Daly City, briefly explaining the Council's concern regarding this developmer He at this time moved that a letter be directed to the members of our School Board expressing the concern of the City Council and requesting that approp- riate action be taken to do everything possible to re-district that land so that it would no longer be in the City of South San Francisco School Districl He further remarked that it was not the duty of the City to interest itself in School District affairs but the desire to keep down_taxes within the City. Discussion~followed concerning this matter and the Council's desire to work with the School Board, after which motion as made was seconded by Councilman Rozzi. Further discussion followed, after which motion as made and seconded' was regularly carried. COUNCILMAN CORTESI REMARKS RE DRAINAGE PROBLEMS IN CALLAN SUB: Councilman Cortesi then suggested the City contact the County Boundary Commi~ sion in an effort to prevent what is being &ne in that area. He further sug. gested that the City obtain some form of agreement for any damages the City might suffer as a result of drainage problems in the area. Councilman Ryan briefly explained the functions of the Boundary Co~mission approving the request of the City to change legally established boundaries. Mayor Rocca stated that the matter had been of concern to the City for some time, remarking that the boundary of the schools should be re-districted for fairness. REQUEST THAT DIRECTOR OF PUBLIC WORKS OBTAIN MAPS AND GRADING PLANS OF CALLAN DEVELOPMENT: f City Attorney Noonan briefly went through the steps of the functions as they concerned the School District, Boundary Com~ission and Sanitary District. H further remarked that it would be well if the City were aware of the grading plans, further suggesting that some department in the City obtain the men- tioned plans. Aiter discussion, the Director of Pub1 Works was requested to obtain maps and grading plans of the area so that he would then be in a position to comment to Council concerning the development of this area. REMARKS RE FLOOD CONTROL DISTRICT & COLMA CREEK DRAINAGE WORK BY WILSEY & HAM: At this time, discussion took place concerning drainage problems which would be created, suggestions being made that a Flood Control District be instltut before serious problems arose. City ManagerAiello remarked that it was his understanding that the district had been formed and a contract let to Wilsey and Ham, Enginee~ for the Colma Creek drainage work and that this work was under way. OF PUBLIC WORKS RE MEETING WITH ENGINEERS AND CITY MANAGERS FOR CHECKING OF PLANS FOR SILTING BASINS: C~ty Attorney Noonan then remarked it had been mentioned that Mr. Callan did not intend to develop all of the area which he bought but that some had bee~ sold to others, further remarking that ~t was urgent for the City to appriz~ itself of the grading and how it would affect our City. The Director of Pu~ Works at this time explained to Council the procedure which was followed in development of St. Francis Heights by Mr. McKeon, stating that the engineers of both cities and the developer's engineer met concerning checking of plan~ on the silting basins which were to handle drainage problems. DISCUSSION RE BOND ISSUES FOR SEWAGE PLANTS & SCHOOLS: Councilman Ryan requested that the record show that the City was concerned : two items - one being the high cost of sewage treatment planets in the Callan development which, as remarked, would require eight or nine pumping statiom and the heavy density of school children which would bring about increased taxes for school development. He further stated that if the area had to go to bond issue for a sewage system, it might endanger the bonding capacity f~ schools and would then affect the City of South San Francisco, since they ml have to bear the cost of school development. COMPLAINT OF MRS. BAGUSIN OF PROPERTY DAMAGE IN BUR1 BUR1 NEAR PLAYGROUND: FREEWAY HEARING: Councilman Cortesi at this time stated that Mrs. Bagusin of Arroyo Drive, a resident near the Buri Burl playground, was having continual trouble by bal throwing and broken windows, as well a~ people going into the park during t late evening and early morning hours. He suggested that some form of chain be placed across the entrance and secured at night to prevent people from going'in and out of the park. He further stated that it was Mrs. Bagusin's desire that she be paid for the damaged windows. City ManagerAlello stated that the baseball backstop was to be relocated and that the request for dam ages had been referred to the City's insurance carrier. At this time, Mayor Rocca brought to the attention of those gathered that t Highway Commission had consented to the City's wishes for another hearing o the matter of the Junipero Serra Freeway development. He said that the reason the holding of the parade was to publicize the play which was to be given the students entitled "Oklahoma".
