YY REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO HELD MONDAY, MARCH 6, 1961 TIME: PLACE: CALL TO ORDER: PLEDGE OF ALLEGIANCE AND INVOCATION: ROLL CALL: MINUTES: CLAIMS: PARKING DISTRICT CLAIMS: PONDEROSA HILLS CLAIM: PUBLIC HEARING -- CALLAN PARK ANNEXATION: 8:00 p.m. Council Chambers, City Hall The meeting was called to order by Mayor Rocca at 8:00 p.m. Pledge of Allegiance to the Flag was recited after which invocation was given by the Reverend Lloyd Burdett of the Immanuel Baptist Church -- in the absence of the Reverend Allen L. Lewis of the Burl Buri Methodist Church. Present: Absent: Councilmen Andrew Rocca, Patrick E. Ahern, Emilio Cortesi, G. J. Rozzi, and Leo J. Ryan. None. Before proceeding on to the approval of tt.e minutes Mayor Rocca recog- nized and welcomed Mayor Feyge of the City of Pacifica, present in the audieuce. At this time Mayor Rocca asked if there was a motion approving the minutes of the regular meeting of February 20, 1961 as submitted. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the minutes of the regular neeting of February 20, 1961 be approved as submitted. Mayor Rocca then asked if there was a mot±on approving the regular claims as submitted for payment. Councilnan Ahem moved, seconded by Councilman Rozzi and regularly carried, that the regular claims totaling $11,659.28 be approved for payment. Parki.~g District No. 1 Claims: Penna's Hardware Claim dated February L7, 1961 in the amount of $1.76 for brush and Allen wrench. Sciandri Bros. Hardware Claim dated February 10, 1961 in the amount of $.94 for paint. Duncan Parking Meter Claims dated February 9 and 16, 1961 in the amount of $4.83 for combination lock and key sets. City of South San Francisco (Street Dept.) Claim dated Feb. 15, 1961 in tine amount of $81.52 for labor and naterials to remove poles for parallel parking and reinstall poles for diagonal parking on Airport Boulevard from Miller to Grand. F. D. Sperry Co. Claim dated February L5, 1961 in the amount of $788.11 for final retention payment on construction of Parking Lots Nos. 6 and 8. Councilman Rozzi moved, seconded by Councilman Ryan and regularly carried, that ~he claims as submitted for Parking District No. 1 be approved for payment. Ponderosa Hills Claim: A. Carlisle & Co. Claim dated February 14, 1961 in the amount of $129.91 for bond and coupon book for Ponderosa Road improvement bonds. Councilman Ahern moved, seconded by Councklman Rozzi and regularly carried, that the claim be approved for payment as submitted. Proceeding on to public hearings, Mayor Rocca opened the public hearing on the matter of the Callan Park Annexation. He remarked that it appeared this ~atter would have to be continued for some time until all details have been attended to and this hearing was to get an expression of feel- ing. He further remarked that today a proposed form of agreement had been received by the Council from the CalLan interests. Councilman Ryan then aS{ed if the Clerk could read this in its entirety. At the request of Ma~or Rocca and Council, City Clerk Rodondi read the agreement in full as received from the Callan interests. Brief discussion followed at which time Mayor Rocca explained the consider- able work that had gone into this matter and the study made by Mr. Spangle. He further remarked that the final decision would come after all things had been worked out. Then he said if there was anyone present who wished to speak on the matter they could do so a5 this time. Lengthy discussion followed, during which time the following persons spoke: PUBLIC HEAR!NG -- CALLAN PARK ANNEXATION (CONTINUED): ORDINANCE ESTABLISHING A PARKING PLACE COMMISSION: Roberc Cameron opposed lots less than 50 feet wide as well as the con- struc~ion of Town Houses or row houses. He feels the City should stand on its regulations. Mrs. Ethel Hernan, speaking for the South San Francisco Woman's Club, stated ~hat both this organization and the Southwood Women's Club oppose the row houses and the smaller-sized lots. Don Preston, 432 Railroad Avenue, stated that he opposes the subdivision as proposed. Mrs. ~erlini asked if the City allowed smaller lots in the Callan sub- division, would they be allowable in the remainder of the City, to which Mayor ~occa replied in the negative. Theodore Everson, Hillside Boulevard, expressed concern regarding recrea- tional facilities and opposed the smaller lot size. John Canepa went on record on behalf of the Winston Manor Home Owners' Assoc:ia~ion as being opposed to the development of small lots and stated the City should stand on its present regulations. Bob Cavasio of the Burl Burl Subdivision opposed the smaller lot size; said all areas should be explored before condemning or approving. Bob Whitehead, 5 Sonora, asked concerning any commitments made to the Callans by the City. F~ank ~ortenberg asked how long it would be before this subdivision would be an asset to the City and not a Inability. Lester Xelting expressed concern over the increase of taxes and addi- tional schools to accommodate the increased number of children. Louis Poletti mentioned that regardless of whether or not the subdivision is added to the City or remains in the County, it still will be in the City's school district and the City will have to bear the taxes. Clarence Smith, 82 Calvert Drive, asked concerning the amount of revenue it will take to provide the increased City services to the area; also sales tax revenues vs. costs to the City. Recess was declared at 9:37 p.m. and the neeting recalled to order at 9:50 p.m. VictOr Boido opposed the smaller lot size. Mrs. Cooper of Park Haven asked for an explanation of developments from the Planning Commission, which was given by Cliff Wells. Mr. S~lsky stated that it appeared no one knew what was going on tonight or was being discussed. Brief recess was declared at 10:55 p.m. to change tape on recorder and then recalled to order. Upon ;he meeting being recalled to order Councilman Ryan commented that tonight's meeting was for an expression of opinion and then suggested a meeting at a later date at which time the Callans, together with their engineer, architect, and staff could be present to explain the whole plan of development to anyone who wished to be present. Councilman Ryan then moved, seconded by Councilman Rozzi and regularly carried,that the City Manager be asked to contact the Callans aLd discuss the matter of an agreea'~Le date for a public meeting, at which time they cd uld fully ex- plain their development and, upon agreemeLt as to date, the Council chambers be made available. Also, if the Council chambers are not large enough ~hat permission for the use of some school be obtained -- the place and date of the hearing published i~ the newspapers with an invi- tation extended to all those interested to attend. Further discussion followed, at which time William Amabile, Councilman Ryan, and Adolph Sani commented on the previous attempts of the City to change school boundaries. Marlo Bregante of Miller Avenue asked concerning whether or not a law could 'se changed if it became a burden on the people and also the matter of the acceptance of public improvements after they had been in- stalled. Michael Kack of Magnolia Avenue commended the members of the City Council for their fine work and deliberations. In addision, the members of the Council along with Mr. Spangle at various times spoke on the subject matter and answered questions as well. There being no objections, Mayor Rocca continued the public hearing until the next regular meeting of March 20, 1961. There '~eing no resolutions or proclamations, Council next proceeded on to ord£nances -- taking up the first reading and introduction of the ordinance establishing a "Parking Place Commission", which was explained by the City Attorney. Then City Attorney Noonan stated if Council desired, a motion could be adopted that reading of the ordinance in its ORDINANCE ESTABLISHING A PARKING PLACE COMMISSION: (CONTINUED) /'51 COMMENDATION J. Councilman Ryan so moved, seconded by Councilman Rozzi and regularly carried. City Attorney Noonan then stated that a motion could be adopted that an ordknance entitled: "AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO PURSUANT TO SECTION 35550.1 OF THE STREETS AND HIGHWAYS CODE PROVIDING FOR THE APPOINTMENT , REMOVAL, QUALIFICATIONS, TERM OF OFFICE AND NUMBER OF MEMBERS OF THE PARKING PLACE COMMISSIDN FOR SOUTH SAN FRANCISCO" be introduced, reading in its entirety having been duly waived. Councilman Rozzi so moved, seconded by Council- man Ryan and regularly carried. There being no unfinished business, Council then proceeded to the matter of new business. Communication dated February 15, 1961 was received from J. K. Leonard, submitting his resignation (effective imme4iately) as a member of the Recreation and Parks Commission. There being no objections, Mayor Rocca requested that the resignation be accepted, filed and a certificate of merit be prepared for Mr. Leonard. Communication dated February 18, 1961 was received from the South San Francisco Rod & Gun Club, requesting permission to hold their annual trap shoot on Sunday, April 9, and extending an invitation to members of the Council to attend. Councilman Ryan moved, seconded by Council:nan Rozzi and regularly carried, that permission as requested be granted -- conditioned to the posting of the required insurance certificates, the execution of a "hold-harmless" agreement with the City an~, further, that no alcoholic beversges be allowed or sold on the premises. Communication dated February 24, 1961 was received from Mrs. L. Merlini, requesting commencement of proceedings for the improvement of Willow Avenue. Mrs. Merlini, present in the audience, presented to Council the petition and map which had been prepared for the formation of the assessnent district for the improvement of Willow Avenue and requested that notification of any hearings be forwarded to the interested prop- erty owners. Mayor Rocca received the petition, referencing it to the City cepartments with the request they prozeed in the matter. Communication dated February 21, 1961 was received from the Downtown Merchants' Association of South San Francisco over the signature of Miltor. Bronstein, requesting re-examination of the older structures in the downtown area and recommending the initiation of proceedings if such are found unsafe or unsound. There being no objections, Mayor Rocca referre~ this communication to the office of the Building Inspector with the request for a survey and report to be submitted to Council; further that the procedure of the survey be checked with the City Manager and the Ci:y Attorney. Commun:cation dated February 15, 1961 was received from the Bay Area Air Pollu~:on Control District, requesting local agencies to adopt policies of conpLiance with Air Pollution Control regulations -- together with a copy of their resolution No. 202. Councilman Ryan moved, seconded by CouncLLnan Ahem and regular carried, that the policies of the Bay Area Air PoLLution Control District be accepted and approved. The request of Hart & Hynding to resubdivide existing Lots 9 to 13, inclusive, from a depth of 250 feet to a depth of 125 feet from Spruce Ave. creatLng two new lots fronting on Starlite Street -- each 62~ feet x 260 feet, 3Lock 1, Starlite Industrial Subdivision, was received from the Planning Commission with a recommendation for approval and acceptance with ~ne suggestion preparation be made for the dedication of a 10-foot public utility easement to the rear of the newly-created Lots 9 to 13, inclusive -- also with the oral amendment of the Planning Commission that -;acre be installed by the subdivider 75 feet of 8-inch line and manholes with wyes and laterals. CouncLlman Ahern moved, seconded by Councilman Ryan and regularly carried, that the recommendation of the Planning Commission as amended orally be approved and accepted. The PLanning Commission recommended the approval of the tentative map, subdivision of Bothin property, subject to the filing of a letter from the Pacific Gas & Electric Company regarding their ability to supply services and their satisfaction of the public utility easements -- also with :~e oral amendment of the Planning Commission that the approval of the tentative map be conditioned that the subdivider comply to the recommendations of the Director of Public Works as contained in his January 16 memorandum to the Planning Co~ission. Councilman Ryan moved, seconded by CounciLman Rozzi and regularly carried, that the recommendation of the PLanning Commission as amended orally '~e approved and accepted. RES, NO. 1361 GRANTING AMENDMENT REQUEST KARL PETTERSON: The Planning Commission recommended permission be granted for the illu- mination of the Serra Highlands tract sign. Letter of February 13, 1961 from the Serra Highlands Improvement Association requests the cost of lighting'and maintenance after dedication be assumed by the City. There l~eing no objections, Mayor Rocca referred this matter to the City Manager-to make a survey of all existing scbdivision signs with the re- quest that a report be submitted~to the Council at their next regular meeting regarding the cost of lighting and maintenance. Councilman Ryan so moved, seconded by Councilman Ahern and regularly carried. The Planuing Commission recommended approval of the request of I. Aprile to resabdivide portions of Lots 21 and 22, Block 135. Councilman Ryan moved, Councilman Ahern seconded and regularly carried, that the recommendation of the Planning Conmission be approved and accepted. The Planning Commission recommended approval of the request of Joseph De Luca to resubdivide three lots in Block 82 in the following manner: 25' x 14~' of Lot 10 be added to Lot 9; 25' x 140' of Lot 10 be added to Lot 11, creating two large lots instead of one large and two sub- standard lots. Councilman Ryan moved, Councilman Ahern seconded and regularly carried, that tie recommendation of the Planning Commission be approved and accepted. Variance Permit Application No. 135~ was received from the Planning Commission recommending approval of the request of W. L. La Fona for permission to exceed the required maximum of 5% slope in rear yard, Lots 44 and 46, Block "Q", Peck's Subdivis:on, 200 Alta Vista Drive, subject to certain conditions. Councilman Ryan moved, Councilman Ahern seconded and regularly carried, that the recommendation of the Planning Co:mission be approved and accepted. Variance Permit Application No. 1357 was received from the Planning Commission recommending approval of the request of Helen C. Huffman for permission for a 5-foot encroachment into ~he required 15-foot front yard and a 3-foot encroachment into the required 3-foot side yard on right side, Lot 38, Block "Q", Peck's Subdivision, subject to,certain conditions. COuncil~an Ryan moved, CoUncilman Ahem seconded and regularly carried, that the recommendation of the Planning Commission be approved and accepte~. Use Permit Resolution No. 1358 was received from the Planning Commission, recommending permission be granted for the request of the South San Francisco Boys' Club to build a boys' club and temporary sign (5' x 12', "V"-shaped) to remain on the site at Orange Avenue and "D" Street until the b~ilding is completed, subject to certain conditions. CounciLman Ryan moved, Councilman Ahem seconded and regularly carried, that tie recommendation of the Planning Commission be approved and accepted. Use Permit Resolution No. 1359 was receivet from the Planning Commission, recomn.ending permission be granted for the request of Park Lane Apart- ments for a directional sign on Southern P~cific property 17' from the curb of Orange Avenue and 30' from center line of the railroad tracks at the Southwest corner of Memorial Drive & Orange Avenue, subject to cer- tain conditions. CounciLman Ryan moved, Councilman Ahern seconded and regularly carried, that the recommendation of the Planning Coumission be approved and accepted. Resolution No. 1360 was received from the ?lanning Commission amending ZONING ORDINANCE NO. 353, repealing existing section 4.2 entitled: "Plannec Community District or P-C District" -- adding a new section 4.2 "Planned Community District or P-C District" and other sections relating therel;o. There being no objections, Mayor Rocca requested that a public hearing be se~. Resolt[~:on No. 1361 was received from the Planning Commission granting the anendment request of Karl Petterson to amend section 3.9 Of the South San Francisco ZONING ORDINANCE NO. 353 regarding property having frontage of 275 feet on E1Camino Real by a depth of 270.17 feet and being 280 feet North of Country Club Drive and E1Camino Real and adjacent to Kinney Shoe Store from a "U" to a "C-I" district. There 'being no objections, Mayor Rocca re.cuested that a public hearing be se~. ALTA LOMA SCHOOL RETAINING WALL: Proceeding on to reports, Council first took up memorandum of Febru- ary 2~, 1961 from the Director of Public W~rks recommending Council approval and award of contract to the Lowrie Paving Company as already author±zed by the South San Francisco Unified School District at their February 21 meeting, with further recommendation of reimbursement to the School District of one-half the cost of construction which is esti- mated at approximately $3,790.00. CounciLman Ryan moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Director of Public Works be approvec and accepted and the contract between the school and the con- tractor carry provisions indemnifying the City, its officers and employees, holding them harmless, and further referencing maintenance and repair of defects caused by defective materials and workmanship. WINSTON MANOR #1 CONVENIENCE STATION -- CHANGE ORDER: Memorandum of February 16, 1961 from the S~perintendent of Recreation and Parks recommended change order in the amount of $147.40 -- Winston Manor No. 1 convenience station. CounciLman Ahem moved, seconded by Councilman Ryan and regularly carriec, that the change order recommended be approved. SPRUCE AVE. IMPROVEMENT: Memorandum of February 16, 1961 from the Director of Public Works regarding See's Candies' request on the Sp::uce Avenue improvement pro- ject accompanied letter of February 14, 1961 from David Rubenstein, attorney at law for See's Candies. At the request of Counc±l, City Attorney Noonan prepared the following motion: "Move that the inter-office memorandum of the Director of Public Works dated February 16, 1961, subject: See's Candies requests reference - Spruce Avenue Assessme~ , be communicated to the attorneys for See's Candies Company with a forwarding letter from the City Clerk advising that the City Council has approved same as a statement of the City's position in the matter and authorized transmittal of the memoran- dum to the See's Candies Company". Councilgan Ryan so moved, seconded by Councilman Ahern and regularly carried. PERSON & SWANSON EASEMENT: City Attorney Noonan at this time submitted an oral report concerning the easement in the Person & Swanson property, explaining the slough which is to be abandoned in exchange for the easement. Further detailed explanation followed by the City Attorney, after which he stated that a motion could be adopted "that the City Attorney be authorized to file the required proceedings in the matter Person ~ Swanson vs. City and to advise the attorneys for Person & Swanson of the City's agreement to accept the easement as improved in exchange for any rights City may have in that part of the slough which has been abandoned". Councilman Ryan so moved, seconded by Councilman Ahern and regularly carried. SEWER PROBLEM -- COMER SUBDIVISION- PONDEROSA HILLS SUBDIVISION: Although not appearing as an item on the agenda, City Attorney Noonan state~ that a solution to the Rasnick sewer problem has been worked out, remarking the subcivider, Mr. Comer, has agreed to pay $150.00 for the material and miscellaneous expenses and Mission Plumbing has agreed to install and connect the pipe if the City o~ens and closes the trench. Further, he remarked that since this is to cure w~at might be a hazard to the public sewer it would be in order for the Council, if they so desired, to adopt the following motion in ;he interest of the City: "Move that the City, in the interest of curing what might be a hazard to a p~blic sewer, open and close the trench provided that L. H. Comer, developer, deposit $150.00 with City for materials and Mission Plumbing agrees to lay and connect the pipe to service 11 Dana Court". Councilman Ryan so moved, seconded by Councilman Rozzi and regularly carried. MONTHLY REPORTS: There being no objections, Mayor Rocca requested that the monthly reports for January-1961 from the City Clerk and for February-1961 from tke Building Inspection Department be accepted and placed on file. APPOINTMENTS -- At this time Mayor Rocca stated he would l£ke to appoint Mrs. Clarence RECREATION COMMISSION/ Kuskie as a member of the Recreation Commission to fill the vacancy PLANNING COMMISSION: created by the resignation of Mr. Leonard, and to appoint Mr. James Christensen as a member of the Planning Commission. Councilman Rozzi moved, seconded by CounciLman Ryan and regularly carried, that the appointments of the Mayor be confirmed. Councilman Rozzi mentioned that Mrs. Kuskie is chairlady for the tree planting program now being carried on and is quite ~ctive in this regard. PUBLIC HEARING -- RAY CATTANEO USE PERMIT - LOT 18 BLOCK 140, SSF: o There being no objections, Mayor ~occa requested that the public hear- ing on the matter of the Use Permit application of Ray Cattaneo to erect a 16-unit hotel to the rear of 249 Grand Avenue and applicant's appeal to the Planning Commission's denial of application and permit in accordance with the request of his attorney, Thomas L. Bocci, be set for the meeting of April 17, 1961. PROCLAMATION: 50 7 WILD IRIS DISPLAY ACKNOWLEDGMENT GOOD AND WELFARE: ADJOURNMENT: Mayor 3occa at this time proclaimed the week of March 7 to 14, 1961 as the 27TH CALIFORNIA CONSERVATION WEEK. At this time Mayor Rocca requested the City Clerk to send a letter to the Sol~h San Francisco Woman's Club, tharking them for the bouquet of WiLd Iris that they had placed in the Council chambers this evening.
