Lundy of St. Paul's Methodist Church. Councilmen Andrew Rocca, Patrick E. Ahern, Emilio Cortesi, G. J. Rozzi, and Leo J. Ryan. None. At this time Mayor Rocca asked if there was a motion approving the minutes of the regular meeting of March 20, 1961 and the adjourned regular meeting of March 27, 1961 as submitted. Councilaau Ryan moved, seconded by Councilman Aher~. and regularly carried, that the minutes of the regular meeting of March 20, 1961 a~,d the adjourned regular meeting of March 27, 1961 be approved as submitted. Mayor Rocca then asked if there was a motion approving the regular claims as submitted for payment. Councilman Ahem moved, seconded by Councilman Rozzi and regularly carried, that the regular claims totaling $32,738.50 be approved for pay- ment. Parking District No. 1 Claims: Penna's Hardware Claim dated March 22, 1961 in the amount of $1.06 for lock, letters and numbers. F. Hoffma, Inc. Claim dated March 27, 1961 in the amount of $30.00 for repairs to block planter. City of South San Francisco (Public Works) Claim dated March 23, 1961 in the amount of $70.96 for guard pipes along planter boxes in parking lot No. 5. Traffic Appliance Corp. Claim dated March 13, 1961 in the amount of $799.44 for 30 rebuilt Model "50" meters. Councilmar. Rozzi moved, seconded by Councilman Ahern and regularly carried, that the claims as submitted for Parking District No. 1 be ~pproved for payment. South San Francisco Industrial Park Imp. District ~o. 1: A. Carlisle & Company Claim dated March 15, 1961 in the amount of $10.40 for regi~-~rpages Bond Series S-1. Councilman Ahern moved, seconded by Councilman Rozzi and regularly carried, that the claim be approved for payment as submitted. There being no public hearings, Council proceeded to resolutions and proclamations. The City Attorney stated that written consent had b~en received and filed with the City today for Callan Park Homes to assume the City's bonded indebtedness. Then City Attorney Noonan explained the agreement Which had been executed by the Callan interests for the installation of sanitary sewer lines and the method by which payments are to be made to the City as the wo ~k progresses. The las~ remaining agreement was then explained by the City Attorney which had to do with si'tes to be obtained for Recreation, Fire S~ation, and Library. After the ~ity Attorney had concluded his explanation of the three agreements Mayor Rocca asked if anyone present had comments they wished to make. The follow- ing spoke concerning the subject matter: CALT,AN PARK ANNEXATION COMMENTS: RESOLUTION NO. 3153 APPROVING CONSENT CAT.TAN PARK HOM~S TO ASSUME CITY'S BONDED INDEBTEDNESS: RESOLUTION NO. 3154 APPROVING AGREEMENT CAT3.&NPARK HOMES FOR SEWER LINES: RESOLUTION NO. 3155 APPROVING AGREEMENT CAT~.ANPARKHOMES FOR RECREATION, FIRE STATION, & LIBRARY SITES: RESOLUTION NO. 3156 AUTHORIZING TRANSFER FUNDS TO FIRE STATION CONSTRUCTIONACCOUNT: 2nd READING/ADOPTION ORDINANCE AMENDING ORD.NO. 353 HELD OVER: Theodore Everson, Hillside Boulevard, asked if the Callans are paying interest to the City ~long with their installment payments for the installation of sewers. Mayor Rocgamentioned that no interest is to be paid as this is not a loan but the Callans a~e paying for work as it is being done. D. W. Ratto, 319 Grand Avenue, at this time read to Council and those present his letter of protest, dated April 3, 1961, registering opposition to the annexation -- suggesting the annexation be decided by a vote cf the people. At the 'request of Mayor Rocca, William Spangle explained the method by which they had prepared their report on the matter of annexation, after which he called on his associate, William Zion, who made a further detailed report on the costs and other information which appeared in the report. After Mr. Zion concluded his remarks Mr. Ratio requested permission to file with the City his letter of protest. Councilman Ryan asked the City Attorney if such a filing could be done, to which he (the City Attorney) replied in the affirmative that this was a citizen's objection even thg'Agh the public hearing had been closed. The letter of protest was accepted at this ~ime. Mr. Everson then mentioned the present school bond issue before the voters, stating as a result of the development of this area the Ci~ywill have further obligations to meet in this re~ard. Mention was made that whether or not the area is annexed to the City, it will have to bear the burden of the school taxes because of the fact the area is within the City's Unified School District. Mayor Rocca at this time read a letter received by the cities and counties through- out the nation from President Kennedy, urging agencies of the government to step up building %~thin their Jurisdiction in an effort to ~void unemployment. Richard Lyons, present in the audience, suggested i~aediate action by the City on the mat~er since the City is in the process of growing and can continue to grow. He also urged annexation of the area. Further brief discussion followed, after which Mayo~ Rocca stated it is his feeling that the Council had thoroughly aired the matter, everyone had had an opportunity to speak, and Council should proceed. The last resolution for Council's attention then was explained by the City Attorney, after w~ich Councilman Ahem introduced: "A RESOLU~_IONOF THE CITY COUNCIL OF TEE CITY OF SO'3TH SAN FRANCISCO AUTHORIZING TRANSFER OF FUNDS FROM TEE WORKING CAPITAL RESERVE ~ THE GENERAL FUND TO THE FIRE STATION CONSTRUCTION ACCOUNT". Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, Patrick E. Ahern, Emilio Cortesi, G. J. Rozzi, and Leo J. Ryan. Proceeding on to ordinances, City Attorney Noonan requested that the second reading and adoption of: "AN ORDINANCE AMENDING ORDINANCE NO. 353, AS AMENDED, ENTITLED 'ZONING ORDINANCE 0FTHE CITY OF SOUTH SAN FRANCISCO PASSED AND ADOPTED AUGUST iO, 195~'" be held over to the next regular neeting in order that a correction in the resolution number of the Planning Co~ission could be made. There bein~ no objections, Mayor Rocca so ordered. ORDINANCE NO. 46O CAT.T~N PARK ANNEXATION: 2nd READING/ADOPTION: 1st READING -- ORDINANCE AMENDING ORD. NO. NO. 1372: City Attorney Noonan then proceeded on to the next ordinance which concerned the Callan Park annexation, requesting a motion that the ordinance entitled: "AN ORDI~td~CE APPROVING THE ANNEXATION OF CERTAIN ~IINHABITED TERRITORY DESIGNATED 'CAT:LAN PARK' TO THE CITY OF SOUTH SAN FRANCISCO" be read for the second time in its entirety and be passed as read. Councilman Ryan so moved, seconded by Council- man Aheru. Roll callivote was as follows: Ayes, Councilmen Ar_drew Rocca, Patrick E. Aheru, and Leo J. Ryan. Noes, CounciLman Emilio Cortesi. Councilman G. J. Rozzt abstained from voti~.g, stating he did so for the same reasons previously stated at the meeting of March 20, 1961. Absent, none. At this t'_me the City Attorney stated that with the Mayor's permission the entire reading of the ordinance, because of its length, wculd be done by him, the City Clerk, and the City Manager. There being no objections, Mayor Rocca so ordered after Which the ordinance was read in its entirety by the City Attorney, the City Clerk, and the City Manager. After the ordinance had been read the City Attorney suggested a motion be made that the ordinance entitled: "AN ORDINANCE APPROVING TEE ANNEXATION OF CERTAIN UNINNABITED TERRITORY DESIGNATED 'CALT.AN PARK' TO ~tE CITY OF SOUTH SAN FRANCISCO" as read for the second time in its entirety be adol)ted. Councilman Ry~n so moved, seconded by Councilman Ahem. Roll caL'_ vote was as follows: Ayes, Councilmen Andrew Rocca, Patrick E. Ahem, and Leo J. Ryan. Noes, Counci!~u Emilio Cortesi. Councilman G, .J. Rozzi abstained from vo~!r.g because of the same reasons previously ~iven at the March 20 meeting. At this ~ime Councilman Ryan briefly commented on t~e matter of petitions which had been mentioned earlier, advising those present that the City could stand to lose more by ~he filing of such petitions as done this evening than by the annexation. Although not appearing as an item on the agenda, Ciby Attorney Noonan stated that at the request of the City Manager an ordinance had been prepared amending the ORDINANCE ~N TRUCK ROUTES throughout the City so as to eliminate certain streets as truck routes. He then explained the ordinance, after which he stated that a motion could be adopted by Council that reading of the ordinance in its entirety be waived and tha~ it have its first reading and introduction by the reading of title only. Councilman Rozzi so moved, seconded by Councilman Ahern and regularly carried. City Attorney Noonan then stated that a motion could be adopted that an ordinance entitled: "AN ORDINANCE OF THE CITY OF SOUTH SAN F?JhNCISCO AMENDING ORDINANCE NO. 412 ENTIT~.~, 'AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO _REGULATING TRAFFIC UPON THE PUBLIC STREETS AND THOROUGHFARES OF SAID CITY AND ESTABLISHING TRUCK ROUTES'" be introduced, reading in its entirety having been duly wa'_ved. Councilman Rozzi so moved, seconded by Councilman Ahem and regularly carried. Roll call vote was as follows: Ayes, Councilmen Andrew Rocca, Patrick E. Ahem, Emilio Cor-~si, G. J. Rozzi, and Leo J. Ryan. Noes, none. Absent, none. There being no unfinished business, Council then proceeded on to the matter of new business. Claim against the City in the amount of $250,000.00 was received from the law office of Shirley, Saroyan, Cartwright & Peterson on behalf of Joseph Gomes and Philomena Gomes. Councilman Ahern moved, seconded by Councilnan Rozzi and regularly carried, that the claim be denied and referred to the City's insurance carrier. Franchise payments for the calendar year 1960 were received from the Pacific Gas & Electric Company in the amounts of $13,366.00 (electric) and $24,456.46 (gas). There bei.~g no objections, Mayor Rocca ordered the remittances accepted and placed on deposit + USE PERMIT 'Resolution No. 1370 was received from the Planning Commission, recommend- ing permission be granted for the request of Eugene V. Culbertson to establish an auto repair garage on E1 Camino Real between 1st and 2nd Streets -- Lots 23, 25, and 27, Town of Baden, subject to certain conditions. Councilman~Rozzi moved, seconded by Councilman Ahem and regularly carried, that the reco~uenda~.ion of the Planning Commission be approved and accepted. Council~ Rozzi moved, seconded by Councilman Ahem and regularly carried, that the recommendation of the Planning Commission be approved and accepted. USE PEET Resolution No. 1374 was received from the Planning Commission recommend- ing permission be granted for the request of Robert J. Vago to erect a 14-unit motel, '_ manager's apartment and 1 office at 800 E1 Camino Real (corner of Second) -- Lots L, 3, and 5 -- Block 5, Town of Baden, subj.=ct to certain conditions. Councilna~ Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recomme~-nda~ion of the Planning Commission be approved and accepted. USE PERMIT Resolution No. 1375 was received from the Planning Commission recommend- ing pern'_ssion be granted for the request of Associated Pipeline, Inc. for an addition,el two-story building, the second story to be used for office space, at 509 Mayfair Avenue, subject to certain conditions. Councilman~Rozzi moved, seconded by Councilman Ahem and regularly carried, that the recommendation of the Planning Commission be approved and accepted. Inter-office memorandum dated March 21, 1961 was received from the City Manager recommending transfer of funds from the working capital reserve of the General Fund to a specified "Fire Station Construction Account", estimated to be $75,000.00. This matter having earlier been taken care of under resolutions, no further Council action ~as taken at this time. Memorandum!dated March 21, 1961 was received from the Director of Public Works recommending approval of the agreement for engineering services, Joint Sewage Treat- ment Plant Expansion. There being no objections, Mayor Rocca requested that this matter be held for the adjourned meeting on Monday, April 10, 1961. Memorandx~ !dated March 28, 1961 from the Personnel ~oard requests extension of eligible l~sts for Library Clerk and Plant Operator, due to expire on April 13, 1961. Councilman !Ryan moved, seconded by Councilman Ahern and regularly carried, that the request fo~ the extension of eligible lists as made by the Personnel Board be approved a~d granted. Memorandum Idated March 23, 1961 was received from th~_ Fire Department, recommending purchase o2 fire hose, with notation of concurrence from the City Manager. Councilman Ryan moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of Fire Chief Welte as concurred by the City Manager be approved and the fire hose be purchased from the American Rubber ,~ompany. There belrg~no objections, Mayor Rocca requested thau the monthly report for February, 1~961 from the Peninsula Hum~/e Society be accepted and placed on file. There being nothing further, Mayor Rocca asked if any member of the Council or any- one in the audience had something to offer under Gooc and Welfare. There being none, Councilman Rozzi moved, seconded by Councilman Ryan and regularly carried, that the meeting be adjourned to Monday, April 10, 1961 at 7:30 p.m. Time of adjournment - 9:42 p.m. City Clerk
