TORRE: CALLAN PARK -- REQUEST REVOCATION COUNCIL ACTION: 7:30 p.n. Council Chambers, City Hall The meeting was called to order by Mayor Rozzi at 7:45 p.m. Present: :?ouncilmeu G. J. Rozzi, Patrick E. Ahern, Emilio Cortesi, and Andrew Rocca. Absent: Councilman Leo J. Ryan. The first item taken up by Council was the claim dated May 10, 1961 from the P & S Construction Company in the amount of $37,539.00 to provide water service to the Person & S-~anson Industrial Tract. City Attorney Noonan remarked that sufficient infornation had not been received con- cerning the water service in the subdivision and requested the adoption by Council of a resolution authorizing the City to negotiate with the California Water Service and the P & S Construction Company, bringing the findings back to Council. After explanation by the City Attorney, Councilman Ahern introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO AUTHORIZING NEGOTIATION TO PROVIDE MATER SERVICE FOR THE PERSON AND SWANSON INDUSTRIAL TRACT". Roll call vote ~as as follows: Ayes, Councilmen G. J. Rozzi, Patrick E. Ahern, Emilio Ccr~esi, and Andrew Rocca. Noes, none. Absent, Councilman Leo J. Ryan. At this time City Attorney Noouan explained the resolution which had been prepared concerning the execution of an amended agreement with the P & S Construction Com- pany which required an additional two years for guaranteeing work performed in the subdivision known as "Person and Swanson" for a total of four years. After discussion and there being no objections, this matter was held over for Council's action at a later meeting. Claim was received from Ledwith, Hemming & Chagaris dated April 27, 1961 in the amount of 8425.00 for examination of financial records in Parking District No. 1. Councilwan Rocca moved, seconded by Councilman Aheru and regularly carried, that the claim be approved for payment. Claim dated May 17, 1961 was received for the U. S. Postmaster in the amount of $30.00 for bulk mailing permit fee for the special election to be held on August 8, 1961. Councilman Aheru moved, seconded by Councilman Rocca and regularly carried, that pay- ment be approved. Councilman Ryau appeared present at 7:54 p.m. and remained for the duration of the meeting. There bein$ no objections, the resolution regarding wages scheduled for this time was continued to the next regular meeting. The reques% for the appropriation of $7,500.00 for use in conducting the special election ,~s the next matter taken up. Councilman Ahern moved, seconded by Councilman Ryan and regularly carried, that the funds be appropriated from the Contingency Fund. The claims for personal injuries as filed by Peggy E. Torre in the amount of $38,500.00 for alleged injuries as the result of an accident involving a City-ow-ned vehicle ~ud the one filed by David C. Torre, father and natural guardian of Valerie Torre, in the amount of $2,025.00 for alleged injuries received in the same acci- dent were received from the law office of Nevo F. Capitina, 716 Dana Street, Mountain View. Councilman Rocca moved, seconded by Councilman Ryan and regularly carried, that both claims be denied and referred to the insurance carrier for the City. Bert Willies of Callan Park Homes, present in the ~udience, asked permission to submit a~d have read a letter dated May 23, 1961 addressed to the City Council from Callan Park Homes over his signature as co-partner. The letter was a request that they be re].ieved of annexation to the City by the adoption of a resolution rescind- ing the one adopted calling for a special election and, further, an ordinance rescinding the annexation ordinance. Councilman Rocca then stated that the motion previously adopted by Council appro- priating funds for the special election therefore wculd not be made at this time. City Attorney Noonan stated that if it was the desire and wish of Council, a resolution could be adopted rescinding the resoluticu calling for the election and that at the next Council meeting an ordinance could be introduced rescinding the previously-adopted annexation ordinance. Mayor Rozz{ stated that it appeared Council had no choice in the matter but to comply wich the request. RESOLUTION NO. 3195 RESCINDING RES.#3178 SPECIAL ELECTION: DISCUSSION -- BULK MAILING PERMIT FEE: REVOCATION SPECIAL ELECTION FUNDS: DRAINAGE PROBLEM -- BURI BURI: Mr. ~mll:ams remarked that the delay involved would create a considerable hardship on his f~rm. ~rief disicussion followed, after which City Attorney Noonan stated a resolution first could be adopted rescinding the special election; then a motion could be made rescinding the previous motion appropriating monies for the special election; then one ~escinding the motion for the bulk mailing permit fee. City Attorney Noonan next explained the resolution which could be introduced, after %-hi.:h Councilman Ahern introduced: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF S~)UTH SAN FRANCISCO RESCINDING RESOLUTION NO. 3178 ENTITLED 'A RESOLUTION OF THE CI!~ COUNCIL OF THE CITY OF SOUTH SAN FRANCISCO SETTING A SPECIAL ELECTION'". Roll call vote was as follows: Ayes, Councilman G. J. Rozzi, Patrick E. Ahern, ~Imi!io ~o:.tesi, Andrew Rocca, and Leo J. Ryan. Noes, none. Absent, none. Brief dis¢:ussion followed concerning the bulk mailing permit fee during which time the City Clerk remarked that, if Council was agreeable, in the event the permit fee number of 138 would be lost by not obtaining the permit at this time the fee could be paid since the permit would be used for the next municipal election in April, 1962. Council was agreeable to the City Clerk obtaining the permit in the event there was question of the permit fee number not being available for the next election. Councilman Ryan moved, seconded by Councilman Ahern and regularly carried, that the previous m~tion approving the bulk mailing permit fee be rescinded if the same per- mit number could not be obtained for the next municipal election in April, 1962. Council~n Ryan then moved, seconded by Councilman Ahern and regularly carried, that the p~'evious motion adopted by Council appropriating $7,500.00 from the Contin- gency Fund for the special election be rescinded. There bein~ nothing further, Mayor Rozzi asked if arymember of the Council or audience h~d any matter they wished to take up at this time. Councilman Ryan brought to Council's attention an existing drainage matter on the slope area iof Escanyo and Cuesta Drive in Burl Bnri -- suggesting that a depart- mental meeting be held concerning control and that 'those affected by the problem be informed Council intends to s~pport and do whatever legally possible to help them out. ~ouncilman Ryan then moved that the City forward a letter to all the residents of the area informing them of the interest of the City in the matter, explaining ~o them what the City can and will do to help them. ~n answer t~ Councilman Cortesi's inquiry, Councilman Ryan further explained the matter afte~ which Mayor Rozzi suggested that Council_man Ryan meet with the City Manager and the departments concerned to take whatever action is necessary. After brief discus.sion Councilman Ryan accepted the suggestion of Mayor Rozzi as an amendment t¢ his motion, which was seconded by Councilman Ahern and regularly carried.
