The meeting was called to order by Mayor Rozzi at 8:02 p.m.
Pledge of Allegiance to the Flag was recited after which invocation was given by
the Reverend Lloyd Burdett of the Immanuel Baptis~ Church.

At this time Mayor Rozzi asked if there was a motion approving the minutes of the
regular meeting of August 21, 1961.
CounciLman Aheru moved, seconded by Councilman Rocca and regularly carried, that
the minutes of the regular meeting of August 21, 1961 be approved as submitted.
Mayor Rozzi then asked if there was a motion approving the regular claims as
submitted for payment. Councilman Rocca moved, seconded by Councilman Aheru and
regularly carried, that the regular claims totaling $24,190.99 be approved for pay-
meut.

California Water Service Claims dated August 2, 1961 and August 4, 1961 in
the amounts of $2.90 and $3.70 for service.
Owen D. McCue Claim dated August 22, 1961 in the amount of $345.00 for
removing foundations, etc. Lot 23 - Block 124, per contract.
Flora Crane Service Claim dated August 2, 1962 in the amount of $991.00 for
wrecking and removing from site building located at 325 Grand Avenue.

Councilman Rocca moved, seconded by Councilman Ahern and regularly carried, that

payment.
Councilman Ryan appeared present at 8:06 p.m. amd remained for the duration of
the meeting.
Although shown as item No. 1 under unfinished business, Mayor Rozzi at this time
took up the continued public hearing of Harry H. Hilp (Union Oil Company) --
Planning Commission Resolution No. 1405 recommending denial of the amendment
petition for Lot 10-355-1 on assessor's map, Junipero Serra Boulevard and Arroyo
Drive, from R-1 and "U" district to a C-1 distr~ct. The Mayor asked if any written
protests had been received, to which the City Clerk replied that a letter of pro-
test had been received from Mrs. Gladys Otto. At the request of Mayor Rozzi the
City ~Lerk read the letter in full:
Dear Sirs:
August 30, 1961
I am writing in regards to Mr. Rilp's request for permit to build a gas
s~ation at Arroyo Drive and Junipero Serra entrance into Country Club
Estates. I do not feel a gas station is necessary and I doubt very much
that it would be a profitable adventure for him. Nearly all the people
in this direct area are not protesting as ~hey want only a public tele-
phone booth placed there. They feel the gas station will produce this,
so they are not thinking of a gas station as a convenience for their
a~tomobiles. If he is allowed the permit, you will find that a traffic
light will be required there as the traffic on this side of the highway
is heavy and there is no limit of speed (only the 65 mile limit) so it
will produce a hazard to people entering Country Club Estates from the
highway and also people continuing towards Duly City. I request he be
turned down at this site at least. Thank you.

Mayor Rozzi then asked if anyone wished to register an oral protest. There being
none, ~he Mayor asked if anyone present wished to speak on the matter.
Rober~ Newell, representing the Union Oil Company, present in the audience then
spoke:
"My name is Robert Newell, and I'm representing the Union Oil Company and to assist
the Council in visualizing this particular piece of property I would like to
distribute, if I may, some folders which contain an aerial photo of the neighbor-
hood, also photographs of the site itself, and a photograph rendering of the type
of service station which is proposed for this location, and a diagram showing the
effec~ of the State highway change in relation to this particular site.
"At the Planning Commission hearing on this matter the Planning Director offered
two objections to the rezoning and the Commissioner who moved denial offered two
objections. I'd like to answer those four objections tonight, if I may; also the
one letter of protest, and to give you briefly th~ reasons why we think this
particular piece of property should properly be rezoned for commercial use.
"One of the objections stated was that this would constitute 'spot zoning' and
would Lead to the encroachment of further commercial zoning on Junipero Serra.
I'd like to point out that that is hardly possible because this is the only piece
of property on this entire stretch of Juuipero Serra Boulevard that is not now
being used. All of the rest of the right-of-way is owned by the State, all of the
privately-owned property is already developed for residential use. This particular
piece of property has never been developed for residential use because it is
unsuited for it. I think in fairness to the owner of the property and to the City
that each application for rezoning should be considered on its individual merits
and no~ denied on the basis that this would constitute 'spot zoning', which is
generally objected~o.
"A second objection submitted at the Planning Commission hearing was that a
service station had been approved for Mobile in the same general neighborhood,
which station has not been successful and for that reason this location would not
be a 3~ccessful service station.
"Well, I'd like to point out without offering any criticism to a competitor for
the jAdgment used in selecting that site that by Union Oil standards that location
has not one of the essential elements for a successful service station. It is
built on streets that are curving in nature and by the terrain has practically no
visibility; consequently its presence would be k~own only by a few dozen residents
that live in the vicinity. It has no transient traffic going by it whatsoever;
it is not on a through street; no one except the residents that live within a
radius of four blocks would ever go by that location. It is not comparable iu any
way to t~e location ou Junipero Serra and Arroyo.
"An objection was also stated that we have service stations at E1 Camino and
Chestnu~ and therefore additional stations are not necessary. It is true that a
large percentage of the residents in this area would continue to go to E1 Camino
and Chestnut to buy gasoline but the location on Junipero Serra is designed to
serve traffic on Junipero Serra and those residents who exit from the residential
distric~ byway of Arroyo Drive onto Junipero Serra; it serves entirely different
traffic patterns. The two locations are more than one mile apart.
"It was also pointed out that there is a proposed commercial development on the
west side of Junipero Serra; consequently that would take care of any service
station needs. Well, I'd like to point out that there is no convenient cross-over
to go from the east side of Juuipero Serra to the west side to any service station
that might be located there.
"This particular piece of property is not suitable for residential use, and the
owner has not been able to interest anyone in purchasing it for that purpose. It
faces only to the freeway itself, and with the completion of the new freeway it
will face 14 parallel lanes of traffic. It has, unlike all of the rest of the
property, it has no view to the east. Any home built there would look only onto
the freeway itself and onto the 14 lanes of traffic that will be going by it.
When the freeway is put in, the present plans are to relocate Junipero Serra slightly
affecting this property and move it closer to it; the State owns the right-of-way
there now. That would put Junipero Serra butting against this particular site and
make it less desirable for residential use.
"It ~s pointed out by the person who wrote in to object that a service station
might create some kind of a hazard here and require a traffic signal. That is not
true because this property has uo access to Juuipero Serra; the only driveways
that could be used would be ou Arroyo Drive. Thus does not abut against Junipero
Serra i~self; it's separated by a State highway Landscaping strip°
"At the Planning Commission hearing there were no protests -- either oral or
written -- to the rezoning of this property. It is not true that the rezoning
would depreciate surrounding residential property because of the topography. Iu
here there are only four and possibly five homes that would even be able to see
the service station from their own homes. This site is over the crown of the hill,
ou the freeway side. The homes that are in that neighborhood, with the exception
of four or five, are over the crown of the hill un the opposite direction and are
so blocked that they could not see the service s~ation and could hardly be
considered objectionable from that standpoint.

"Also, if you will notice from the picture in the folder of the type of station
proposed, it is not a typical steel service station building. It is of redwood
construction, similar to a home. It is low in its building line. It would have
no ueou lighting whatsoever, uo neon signs; it would have no flood lights whatso-
ever. It would be entirely fenced. It would be properly landscaped and it is,
accordiuE to our analysis, not what we would consider a really busy service
station. We don't consider this a location that would justify long hours of
operanion; it would be a relatively small station from the gallouage standpoint.
There would be no mechanical work whatsoever -- s~rictly the serving of gasoline,
lubricants, and lubrication service.
"We feel that this type of service station would actually improve the neighbor-
hood iu comparison with what is there right now, and I think you will agree from
the p~ctures that it is presently an eyesore in a nice neighborhood. It would
provide a public convenience for motorists on Junipero Serra. Right now the
entire stretch of over 8 miles of ~untpero Serra has no service station whatso-
ever -- no place where a motorist in trouble could go for assistance with tire
trouble, being out of gasoline, or for emergency ~elephone service and with the
completion of the Juuipero Serra freeway the nearest service stations which are on
that side of Junipero Serra which are now 8 miles away will also be eliminated.
"We feel that there is a need for a service station not only for the residents iu
that area but for the public traveling ou Junipero Serra. This is undoubtedly
the highest and best use of the land. It would mean an increase in tax revenue
to the City of approximately $1,900.00 per year ~;er the taxes which the property
is now producing. The present zoning means that ~he laud is useless, is a
liability to the owner, it produces almost uo tax revenue to the City and it's
an eyesore iu the neighborhood. The rezoning for service station use would
enable the property to be developed to its highes~ and best use. It would mean
increased tax revenue to the City. It would improve the appearance of the
neighborhood and provide a convenience both for residents in the area and also
the trax~ling public.
"I feel sure that on due consideration you will agree that this rezoning would
not in any way be detrimental to health, welfare, safety, peace, morals, comfort,
or the general property values of the City. I'd appreciate your favorable
consideration. If you have any questions in connection with our plans there, I
would be happy to answer them".
Discussion followed after which, there being nothing further concerning the matter,
City Attorney Noonan suggested for the completion of the record that two orders be
made from the chair as follows:
Let the minutes show that Robert Newell, representing applicant, submitted a set
of 5 photographs and a map titled "Union Oil Company Service Station ~48B5 -
dated 8/B1/61", bound in a folder entitled, "S.E. Junipero Serra Boulevard and
Arroyo Drive, South San Francisco", for consideration by the Council in support
of applicant's appeal. There being no objections, Mayor Rozzi so ordered.
City Attorney Noonan then stated that the second could be: Let the minutes show
that Council considered Resolution No. 1405 of the Planning Commission, City of
South San Francisco, dated the 10th day of July, 1961, and attached thereto being
the s,~nmary of hearings before the Planning Commission and the report from the
secretary, marked "Exhibit 3".
There being uo objections, Mayor Rozzi so ordered. The two orders having been
made, Mayor Rozzi closed the public hearing ou the appeal to the Planning
Commi~sion's denial for amendment petition on Lot 10-355-1 assessor's map,
Junipero Serra Boulevard and Arroyo Drive, from R-1 and "U" to a C-1 district...

Mayor Rozzi asked the City Attorney as to what the next course of action was, to
which he replied that the next action would be a resolution finding the facts in
the hearing and making a decision one way or the other. City Attorney Noonan
further stated that the action could be taken this evening or at a later meeting
-- as nuch as 60 days away, if Council wished to ~hink about it, but they would
have ~o have a resolution determining the facts in the case° Mayor Rozzi then
instructed the City Attorney to prepare this resolution and present it for Council
action at the next regular meeting.
CounciLman Ryan at this time brought to Council's attention the home located on
Arroyo Drive and Alta Mesa, which is in a state o~ deterioration. He remarked
that he noted a portion of the sidewalk had sunk and the garage also had settled,
suggesoing the City Manager check with the Building Department and ask that the
Building Department go out and make a thorough inspection of the entire building
-- wi~h a subsequent report as to what, if anything, can be done or should be
done ~o improve the condition of the lot. There being no objections, Mayor Rozzi
so ordered.
Although appearing as item No. 4 under New Business, Mayor Rozzi at this time
took up the public hearing on the notice of the BAilding Inspector to abate the
nuisance of a dilapidated building at BO8 "A" Street, declaring the public hearing
opened. The Mayor asked if any written protests had been received, to which the
City CLerk replied that none had been received by his office. He then asked if
anyone present wished to register an oral protest. None were registered.
City A~torney Noonan suggested that the record show in this case the notice was
prepared and mailed in accordance with Ordinance ~o. 405 and affidavit of mail-
ing filed with the City Clerk together with the other documents required by the
ordinance; also that the minutes show that this would be an order from the chair
that Nello Certiberi, representing the Building D~partment, attended for the
purpose of giving testimony and the hearing be coatinued to the next meeting.
Mayor Rozzi so ordered, and the hearing was coutiuued to the next regular meeting.

The City Attorney then explained the next resolution, after which Councilman Rocca

City Attorney Noonan stated that before the introduction and first reading of the

Inspector in item No. 5 under new business, a motion would be in order setting a
notice of hearing for
Monday - October 2, 1961 8:00 p.m.

stated that a motion could be adopted by Council that reading of the ordinance in
its entirety be waived and that it have its first reading and introduction by the

Proceeding on to unfinished business, Council took up the appeal by the Union 0il
Company on behalf of Harry H. Hilp for rezoning of Lot 10-355-1 on assessor's
map (Junipero Serra Boulevard & Arroyo Drive) from R-1 and "U" to a C-1 district,
as denied by Planning Commission Resolution No. 1405 .... which resolution was
accompanied by summary of hearings on the Harry Hilp amendment petition to rezone
and report from the secretary, marked "Exhibit 3'.
This ~matter having been taken care of earlier un, er public hearings and there being
no Objections, uo further action was taken.
Com~mnication d~ted August 24, 1961 was received from Carl E. Kirker (engineer)
recommending that bids for the Industrial Sewage Pumping Station No. h be rejected
and worked be deferred until spring, 1962.
Councilman Rocca moved, seconded by Councilman Byan and regularly carried, that
the recommendations of Mr. Kirker be accepted a~d the Work deferred until the
spring of 1962.
The next matter for discussion was the Use Permit No. 1407 for the West Coast
Advertising Company which was held OVer from the meeting of July 17, 1961 for
further study (one standard 12' x 25' unilluminated poster panel at 302 Airport
Boulevard).
Mayor Rozzi asked if there was anyone present who wished to speak on the matter.
No one spoke on the matter. City Manager Aiello remarked that this item was
scheduled for this time at the request of Mr. McNear of West Coast Advertising.
There being uo objections, Mayor Rozzi coutiuuec this matter to the next regular
meeting and instructed the City Manager to so advise the applicant iu the mean-
time.

FACILITIES:
Inter-office memorandum dated August 25, 1961 was received from the Director of
Publi2 Works with plans and specifications for approval to advertise for bids
ou the Burl Burl residential street lighting.
The City Attorney explained the resolution which had been prepared, after which
Councilman Ahern introduced: "A RESOLUTION OF TEE CITY COUNCIL OF THE CITY OF
SOUTH SAN FRANCISCO APPROVING PLANS AND SPECIFICATIONS AUTHORIZING THE WORKAND
CALLING FOR BIDS ON THE IMPROVEMENT OF STREET LIGHTING IN BURI BURI".
Roll ~aL1 vote was as follows: Ayes, Councilmen G. J. Rozzi, Patrick E. Ahern,
Emilio Cortesi, Andrew Rocca, and Leo J. Ryan. 5oes, none. Absent, none.
Inter-office memorandum dated August 28, 1961 was received from the Director of
Public Vorks with compilation of bids received or the left-turn signal at
Airport Boulevard and Baden Avenue.
City Attorney Noonau remarked that the bids received first should be declared.
Director of Public Works Goss stated that bids h~d been received~fr~Q~ the

after which he recommended the award to Kennedy Electric Company.
The City Attorney then explained the resolution %%ich had been prepared, after
which Councilman Ahern introduced: "A RESOLUTIOE OF AWARD OF CONTRACT AIRPORT
BOULEVARD AND BADEN AVENUE INTERSECTION - LEFT TL~N SIGNAL INSTALLATION".
Roll call vote was as follows: Ayes, Councilmen G. J. Rozzi, Patrick E. Ahern,
Emilio Cortesi, Andrew Rocca, and Leo J. Ryau. Noes, none. Absent, none.
Monthly reports for July, 1961 were received from:
San Mateo County Health & Welfare (Sanitation Section)
Police Department.
There being no objections, Mayor Rozzi requested the reports be accepted and
placed on file.
There being nothing further, Mayor Rozzi asked if any member of the Council had
anything they wished to offer under Good and Welfare.
Councilman Ryan briefly commented on the performance of duties by the Fire Depart-
ment and the Police Department at the recent fire which occurred at the Sorich
Bucket & Drum Company, Spruce and Railroad Avenues, in the control of the fire and
traffic.
He then moved, seconded by Councilman Ahern and regularly carried, that the 'City
Council forward letters of commendation to the Chiefs of the Fire Department and
the Police Department and their men - congratulating them for their conduct in
such a najor happening and wishing them well iu their future work; further, that
a letter of thanks be forwarded to those neighboring departments assisting in
combating the fire.
The City Manager was instructed by Mayor Rozzi to forward such letters.
Councilnan Ryan then commented on the threat of Communism to this country, re-
marking that not enough emphasis is being placed on what we stand for. In detail
he commented on suggestions that he felt would be beneficial toward the combating
of the nenace -- presenting to Council framed copies of
The Declaration of Independence
The Bill of Rights
and Abraham Lincoln's letter to Mrs. Bixby, which he read to those present.
It wa~ requested by Councilman Ryan that the City Manager appropriately place the
three framed documents in the City Hall for public viewing. Mayor Rozzi so
instrActed the City Manager and thanked Councilman Ryan for his comments and the
documents which he presented to the City.
There being nothing further, Mayor Rozzi asked if any member of the audience had
something to offer.
Mr. Victor Boido brought up the matter of garden trimmings pick-up service and
remarked that new notices were being sent out by the Scavenger Company as to the
amoun~ %~ich would be picked up. City Manager Aiello briefly commented on the
contract which was executed with the Scavenger Company and that the forwarding of
notices was a matter they were required to do. FArther discussion followed
concerning additional service to the residents.
Mr. Bo!do then brought to Council's attention that debris is collecting in the
City Park and present daytime watering should be reserved for the evening or
latter part of the day when the park is not in us~ because the daytime watering
makes ~he park unusable.

City ~nager Aiello stated that they are aware of the problems, that the park
has to be watered during the day because the City cannot obtain personnel to do
it during the night. He further commented that the City already is aware of the
problems and has plans for taking care of them.
Mr. YoAng Han Choo of the SerraHighlands Improvement Association commended
CounciLman Ryan for his comments on Americanism snd suggested a more active pro-
gram of teaching Americanism to our school children.
There being nothing further, Mayor Rozzi adjourned the meeting until Monday,
September 18, 1961 at 8:00 p.m.
