Prior to proceedin~ with the roll call, Mayor Rozzi announced uhat the City Council wished to honor a man in the audience who had distinguished himself nationally as well as in the City, callin~ on Thomas Teshara of 500 Lassen Street, South San Francisco. He remarked that because of the efforts of Mr. Teshara, he w~s successful in havin~ the Poe Wee Baseball League of the G~eater San Francisco Area sanctioned by the National Baseball C~n~ress. He then read the Resolution in full which had been prepared, commendin~ Mr. Teshara, after which he conveyed to him the Council's personal congratulations and commendations, and requestin~ that the Resolution b~ adopted and made a part of the City's record. Ccuncilman Ahem then introduced a r~solution entitled "A R~SOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN FRAN- CISCO COMMENDING THOMAS TESHARA", after which roll call vote w~s as follows: Ayes, Councilmen G. Councilman Rocca mo!ved, seconded by Councilman Aborn and regularly carried, that the minutes of the regular meetin~ of March 19, 1962, bel approved as submitted. Mayor Rozzi then asked if there was a motion approvin~ the regular claims as submitted for payment. Councilman Aborn moved, seconded by Councilman Ryan and regularly carried, that the regular claims totaling $24,733.~2 be approved for payment. RESOLUTION NO. 341e COPS]ENDING THOMAS TESHARA -- PEE WEE BASEBALL LEAGUE: He remarked that because of the efforts of Mr. Teshara, he was successful in havin~ the Pee Wee Baseball League of the Greater San Francisco Area sanctioned by the National Baseball Con~ress. He then read the Resolution in full which had been prepared, commendin~ Mr. Teshara, after which he conveyed to him the Council's personal congratulations and commendations, and requestin{ that the Resolution be adopted and made a part of the City's record. T~ere bein~ no objections, Mayor Rozzi continued the Public Hear~n~ on the Use Permit Applicatiou No. 1470 of the Shell 0il Conpany to construct a service station at Spruce and Grand Ave- nues to the next regular meetin~ of April 16, 1962; this hearin~ havin~ been continued from the previcus meeting. Ma}~or Rozzi at this time opened the Public Hearin~ on the An- nexation of the Lands of Dabney, after which Councilman Rocca renarked that he understood that it ~as the desire to continue vhis Public Hearin~ to the next regular meeting. City Attorney Noonan stated that it ~i~ht be well to have a neetin~ with Mr. Dabney and the Plan~in~ Commission over }the development of the land since there appeared to be some misun- derstandin~ concernin~ this development. He further remarked vhat Mr. Dabney was present in the a~dience and if this was a~reeable to him, Council could so direct continuance if it so wished. Mr. Dabney stated that Council could proceed with the annexa- vion tonight since ~t was his intent to annex to the City any- way. Ma}or Rozzi then asked if any written protests had been received ~o which the City Clerk replied none had been received by his office. He then asked if anyone present wished to offer any oral protest. There bein{ none, Mayer Rozzi then closed the P~blic Hearin~ on the Dabney annexation and instructed the City Attorney to prepare the necessary documents for the next regu- lar Council meetln~. VARIANCE Resolution No. 1475 was received from the Plannine Com- mission recommendin~ permission be ~ranted for the r~qu~st for a 7 foot encroachment into required 20 foot rear yard at 231 "A" Street, Lot 17, Block 7, Town of Baden. Councilman Rocca moved, seconded by Councilman Ryan and regular- ly carried, that the recommendation of the Plannin~ Commission be approved and accepted. VARIANCE Resolution No. 1~76 was received from the Plannine Com- mission recommendin~ permission be _.anted for the request to oonstruct and operate a private parkin~ lot at 523-521 Grand AMenue, subject to the followin~ conditions: (1) that proper- t~es at 525 and 519 Grand Avenue be vrotected; (2) that areas be landscaped as shown on the plans submitted by the Plannin~ 0ffmcer; that the exit ramp be ~loped to a maximum of zm~ and rounded to a maxlmum of 6~ at toe and bottom for minimum of 12 feet; (4) that the parkin~ stalls be rearranged to allow for line of sight as shown on the plot s~bmitted by the Plannin~ Officer in such a way as to allow for the 20 foot line of sight from the street as recommended by the Police Chief; and (5) that the lights in the parkin~ lot be placed on the lot if the Police Chief so recommends. VARIANCE Resolution No. 1880 was received from the Plannin~ Commission recommending permission be granted for the request for an 8 foot encroachment into required side yard, a 10 foot encroachment into required rear yard, and to allow a 57~ lot coverage on Lot !0, Block 1, Peck~s Subdivision No. 1, subject to the agreement by the applicant to the installation of curbs, ~utters and sidewalks on Lewis Avenue in the event the assess- nent district is not formed. Further conditions are: (1) the tree on the corner of Lewis and Green is to remain, and(2) that a bumper curb be installed on the driveway to the garages. GOOD AND WELFARE: JET NOISE: There being nothing further, Mayor Rozzi proceeded to Good and Welfare, commenting that the City Council by the adoption of its Resolution No. 3298 and Resolution No. 3299, which were adopted at a previous meeting, authorized the Mayor and the City Attorney to make separate requests to the United States Conference of Mayors and the National Institute of Municipal Law Officers regardin~ Jet noise. He then read the resolutions menti©ned, remarking on the requests which had been made to both the United States Conference of Mayors and the National Institute of Municipal Law Officers. He stated that about one week previously he had received a letter from John Gunther, Executive Director of the United States Conference of Mayors, regarding the MaNor's participation on the Committee. He fur- ther remarked that the City Attorney was likewise appointed to the National Institute of Municipal Law Officers Airport Com- mittee. He at this time commended Councilman Ryan, the City Council, City officials and many interested people of South San FranciSco for moving this to a point of decision. Councilman Ryan then added his commendations and thanks to the people of the City for their patience and cooperation in the matter. There being nothing further, Mayor Rozzi asked if any member of the Council had anything they wished to offer under Good and Welfare. RESOLUTION NO. 3423 PERSONNEL -- APPROVINg/ CLASSIFICATION MAINTENANCE MAN II: Councilman Ryan at this time made mention of the discussion con- cernin~ a position chan~e in the Personnel Ordinance, moving that the City Attorney be instructed to prepare an amending or- dinanne change to the Personnel Ordinance to provlde for a main- tenance man in II position as recommended by the Personnel Board. Councilman Ahem seconded the motion, which was regularly car- ried. City Manager Aiello then remarked that this did not re- quire an amendin~ ordinance but could be done by resolution adoption, as provided for, since it was not a civil service position Councilman Ahem then rescinded his second to earlier motion, after which Councilman Ryan rescinded his motion. M[EMOR IAL DR !~]E: Mro Victor Boido, present in the audience, brought up the matter of Memorial Drive, stating that he had learned that this street had ~ e s~n dedicated in 1947 as a street, but for the us of the Park and nothing else. At this time City Attorney Noonan dis- tributed for Council's attention a memorandum concernin~ the manner in which Memorial Drive was dedicated to the City. At the request of Mayor Rozzi, further discussion was delayed durSnE which time Council read the memorandum which was submitted by the City Attorney. Further discussion followed, after which Mayor Rozzi stated that the second paragraph of the indenture granted the property to the City with an easement for the con- struction and maintenance of a public street or highway over and upon the described parcels of land. Further discussion followed, at which time Mr. Sani spoke, stating that he was of the impression as well that the street was for Park purposes only. Council then a~ain indicated that the street, having been dedicated for the purposes mentione~, did not limit the usage of the street and that public street or highway was definitely in- dicated in the indenture.
