Ahem at 8:05 p.m. Pledge of Allegiance to the Fla$ was recited. Due to the ab- sence of Reverend Charles Hobson of First Southern Baptist Church, no invocation was given. Present: Absent: Councilmen Patrick E. Ahevn, Emilio Cortesi, Andrew Rocca, G. J. Rozzi, and Fv. ankBertucelli. None. Mayor Ahem asked if there was a motion ~pproving the minutes of the regular meeting of January 23, 196~. Councilman Rozzi moved, seconded by Councilman Bertucelli and regularly carried, that the minutes of the regular meeting of January 20, 1964, be approved as suomitted. Mayor Ahem then asked if there was a motion approving the regular claims as submitted for payment. Councilman Rocca moved, seconded by Councilman Bertucelli and regularly carried, that the regular claims totaling $29,498.70 be approved for payment. Mayor Ahem then asked if there was a motion approving Parking District No. 1 claims as submitted for payment. Councilman Rozzi moved, seconded by Councilman Rocca and regu- larly carried, that the claims as submitted for Parking Dis- trict No. 1, totaling $18.91, be approved for payment. Cit2 of South San Francisco Municipal Improvement Bonds of 196~ -- Construction Fund Claims: (a) Dean C. Buehler, Inc. claim dated December 31, 1963, in the amount of $300.00 for modifications to Industrial Sewage Pumping Plant No. 4 (extra work). Councilman Bertucelli moved, seconded by Councilman Rocca and regularly carried, that the claims as submitted for the City- of South San Francisco Municipal Improvement Bonds of 1963 -- Construction Fund be approved for payment. South San Francisco Marina Claims: Sacrameuto Landscapers, Inc. claim in the amount of $2~077.30 for amount due as of December 21, 1963' less~ 10% retention, leaving a balance of $1,377.30 to be dis- bursed as follows. George McParland, $800.00 and Sacra- mento Landscapers, Inc. $577.30. Payment approved in accordance with assignment of monies and agreement exe- cuted by and between Sacramento Landscapers, Inc. and George E. McFarland Company. The next item to come to the attention of the Council was the Baden Crossing Lot Annexation which had been continued from the meeting of January 20, 1964. There being no objections, Mayor Ahem continued the Public Hearing to the next regular meeting. Mayor Ahem declared the Public Heaming opened on the annexa- tion of the Lands of Mazzauti, et aL, asking if any written protests had been received, to which the City Clerk replied none had been received by his office. He then asked if anyone present wished to register an oral protest. There being none, Mayor Ahem declared the Public Hea~ing closed. City Attorney Noonan explained the first resolution wh~h had been prepared and was ready for Council action, after ~hich R , !1 Councilman coca introduced. NO. 1631: ACCUMULATED SICK LEAVE: · .~ 000 DISCUSSION -- CITY PARK IMPROVEMENT CLUB: 5o ~o The next item for Council's attention was Planning Commission Variance Resolution No. 1631 as applied for by Denis T. Murphy and continued from the previous meeting, requesting permission for three uncovered required parking spaces on a sewer easement on the Northeast portion of Parcel No. 11-311-05 on Oak Avenue, subject to certain condlbions. City Attorney Noonan suggested the following motion for Council consideration: Move that the variamce as set forth in.Resolu- tion No. 1631 of the Planning Commission adopted on the 29th of July, 1963, be approved except for 0ondition 3 which is amended to read as follows: "Owner in lieu of presently constructing and installing curb, gutter, sidewalk and lighting improvements along the front of his property on ~ak Avenue agrees to parti- cipate in an assessment district fo? the installation ef curb, gutter, sidewalk and lighting improwements when such an assess- ment district is formed for the purpose of constructing and in- stalling said improvements on Oak Awenue. Should the improve _ ments be installed by some public agency or financed in ways other than by property owner's partUcipating through an assess- ment district, then owner shall be ~eleased from this obligation". Councilman Bertucelli so moved, seconded by Councilman Rocca and regularly carried. City Manager Aiello next brought to Council's attention the consideration of adoption of policy paying to employees re- tiring upon reaching retirement age, or length of service, a portion of accumulated sick leave. Councilman Rocca moved, seconded by Councilman Bertucelli and regularly carried, that the 0ity Manager be instructed to have a resolution or ordinance prepared leaving the amount open un- til decided upon by Council. Letter dated January 28, 196~, was received from the City Park Improvement Club requesting permission to discuss the follow- ing three items concerning City Parx: (1) The S. P. spur track on Tennis Drive presenting a weed a~atement problem and to fur- ther investigate the necessity of t~ack back of homes; (2) Circle Court street repair work and loose gravel problem; and (3) Request for a Jet decibel ratine in order to determine what noise level is a nuisance to residemtial areas and to review copy of Congressional Hearing recom.~endations. Mayor Ahern asked if there was anyone present who wished to speak on the matter. James Claar, president of the City Park Improvement Club, com- mented on the recent street resurfacing on Circle Court done by City forces, stating loose gravel existed and people tracked tar and oil into their homes. He asked that the City do a Job of street surfacing as was done on Miller Avenue. At the request of Mayor Ahem, Director of Public Works Louis Goss stated this was the most econcmical method to do the street resurfacing and that the reason gravel existed was because the sweeper could not'sweep due to the parked cars in the area. He further commented that the street ~ould be posted requesting the residents not to park on a particular day so the street could be completely swept. Mayor Ahern stated that Mr. Olaar ~ould assist the City by notifying the residents as well. Mr. Claar then commented on the railroad track behind a portion of the residences which was not used to its full extent by the Southern Pacific Railroad Company and was becoming overgrown- with weeds. He requested the City take some action on the re- moval of the weeds. City Manager Aiello stated the City could request the Southern PaCific Compaey to clear these weeds and if not complied with the City would perform the work and bill the company. Mr. Claar then stated that the matter of Jets would be commented on by Mrs. Scanuel and Mrs. Lesko. Mrs. Scannel stated that She had s~oken to Mr. Noonan regard- ing the Congressional Hearing whichhad been held, stating that while recommendations~had been made the situatio~ was as bad as before if not worse. She then asked Mr. Noona~ if the government had made any decibel noise level rating, to which the City Attorney replied he had no knowledge of such a rating but could discuss this with the F.A.A. and explore the matter further. N0. 1677: Mrs. Scannel then stated that a study should likewise be made regarding the matter of a health factor, commenting on an arti- cle that was recently published regarding this. She remarked that since the Congressional Hearings were not adopted the City should carry on where it left off. Mayor Ahem stated that the City wa~ constantly keeping informed of developments in the matter and checking all recent cases to see where the Cityts position would be the strongest. Further discussion followed, after ~hich Mayor Ahem requested the City Manager and the City Attorney to check the matter out with the F.A.A. and report back to .~ouncil. Mrs. Scannel asked for a report at the next Council meeting. Discussion followed on the recent case in the City of Millbrae. Mrs. Lesko remarked that on Saturdays and holidays there seems to be an excessive amount of noises from the aipport which seem to be engine testing noises. She farther stated that the City was p~ised by the aipport that th£s would not take place. John Siacotos of 138 Clay Avenue stated that he also heard the noises from where he lives and that he felt they were test cells. Letter dated January 22, 196~, received from Leukemia Society,~ Inc., Peninsula Chapter, requesting permission to conduct door- to-door solicitation for funds. There being no objections, Mayor Ahem referred this to the City Manager and the Chief of Police for checking and report. Letter dated January 23, 196~, received from Aiding Leukemia Stricken American Children, St-~ Jude Research Hospital, request- ing permission to conduct door-to-door solicitation for funds. There being no objections, Mayor Ahem referred this to the City Manager and the Chief of Police for checking and report. Letter dated January 22, 1964, received from the Polish Commu- nity Service Center requesting permission to conduct door-to- door solicitation for funds. Claim against City in the amount of $15,000.00 as filed by Mrs. Janet Satariano of 924 Opan Drive, San Jose, California, for alleged personal injuries as the result of a fall at the Oyster Point Marina. VARIANCE Resolution No. 1678 was received from the Planning Commission recommending permission ~e granted for the request to encroach into 10 foot side yard and 15 foot setback from lane to construct a 6 foot fence and covered patio at 400 Acacia Avenue (Lot 10, Block 85), s~bJect to the condition that the easement area between the sidewalk and proposed fence on Acacia Avenue be planted and maintained by the applicant. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Planning Commission be approved and accepted. VARIANCE Resolution No. 1679 was received from the Planning Commission recommending permission ~e granted for the request for a 3 foot encroachment into required 5 foot side yard to maintain existing building line for proposed addition to home at 133 LaCrosse Avenue. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Planning Commission be approved and accepted. USE PERMIT Resolution No. 1680 was received from the Planning Commission recommending permission be granted for the request to operate an auto towing storage yard on Third Lane to the rear of 206 Baden Avenue in a 0-2 district, subject to the following conditions: (1) the a~to washing business be removed from the premises within 60 days, (2) that the storage area for the towing operations be enclosed behind an 8 foot solid fence; (3) the main building on the property be painted; (4)!that this permit be issued for one year, witk the provision of renewal upon review by the Planning Commission. Councilman Rozzi moved, seconded by 0ouncilman Rocca and regularly carried, that the recommendation of the Planning Commission be approved and accepted. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Plan~ing Commission be approved and accepte~. City Manager Alello declared the bids received, stating that he concurred in the recommendation of the Fire Chief that the award be made to the low bidder. Councilman Bertucelli remarked that he noticed a number of new people in attendance at tonight's ~eeting. He thanked them for their attendance and invited t~em back to future meetings. There being nothing further from any member of the Council, Mayor Ahem asked if anyone present; had anything they wished to offer. Mr. John Siacotos of 138 Clay Aven~e brought to Council atten- tionthe hazardous crossing of Junipero Serra Highway at Clay Avenue, stating that Just a few days previously a 5-year old boy was struck and killed by an auto. He asked Council's help in obtaining an overcrossing at that intersection for the pro- tection of the people in the area. City Manager Aiello explained that the City had no control over the area since this was a Sta~e Highway and that Just re- cently the City made a request to ~heDivision of Highways for a decrease in the speed limit. Councilman Rozzi stated that the Cuty would one day be taking the Highway over due to the reroutung of the freeway. He suggested the City Manager explore the possibility of the City contacting the State for some imme4iate relief. Mr. Siacotos asked the City to advise them of anyone they could contact to seek the necessar2 relief. City Attorney Noonan at this time mentioned a letter he had received from the NatiOnal Institute of Municipal Law Officers concerning Proposed Tax Legislation Affecting UtilityRate- payers designated as Bill HR 8363. He suggested the Mayor address a letter registering the Cuty~s opposition to the bill and amendments. Mayor Ahern stated that if there were no ob- Jections, he would address such a Letter. No objections were registered.
