The meeting was called to order by ~yor Patrick E. Ahern at
3:0? p.m.
Pledge of Allegiance to the Flag was recited. The invocation
was given by Reverend Carl E. Curtright of First Assembly of
God Church in place of Reverend A1Bugelmauu of the Immanuel
Baptist Church.
Present:

Mayor Ahem at this time asked if there was a motion approvin~
~he minutes of the adjourned regular meetin~ of August !31, 19~4,
and the regular meeting of September 8, 196~.
Councilman Rozzi moved, seconded by Councilman Bertucelli and
regularly carried, that the minutes of the adjourned regular
meetin~ of August 31, 1964, and the regular meeting of September
8, 196~, be approved as submitted.
Mayor Ahern then asked if there was a motion approving the regu-
lar claims as submitted for payment.
Councilman Bertucelli moved, seconded by Councilman Rocca and
regularly carried, that the regular claims totaling $25!,645.70
be approved for payment.
Mayor Ahern then asked if there was a motion approving the claims
for Parking District No. 1 as submitted for payment.
Councilman Rozzi moved, seconded by Councilman Rocca and regu-
Larly carried, that the claims as submitted for ParkingI District
No. l, totaling $4,168.55, be approved for payment.
Butler Road Assessment District Claims:

Southern Pacific Company claim dated September 16,1964,
iu the amount of $13,500.00 for right of way acquisition -
Butler Road.

Enterprise-Journal claim dated September 9, 1964, iu the
amount of $19.40 for legal adve?tising.
~Councilman Bertucelli moved, seconded by Councilman RozZi and
regularly carried, that the claims as submitted for the~Butler
Road Assessment District be approved for payment.
Cabot, Cabot & Forbes Industrial Parx, Unit No. 1 Claim:
Enterprise-Journal claim dated September 2, 1964, in the
amount of $12.50 for legal advertising.
Councilman Rocca moved, seconded by ~ouncilman Bertucelli and
regularly carried, that the claim as submitted for Cabot, Cabot
& Forbes Industrial Park, Unit No. 1 be approved for payment.
The City Clerk announced that a Proclamation had been prepared
declarin~ the week of September 26 to October 4, 1964, as
"NATIONA~ PUBLIC WORKS WEE~'.
The Mayor so proclaimed.
City Attorney Noonan explained the first resolution which had
been prepared for Council action, after which Councilman Rozzi
introduced: "CITY COUNCIL, CITY OF SOUTH SAN FRANCISC0~ STATE
OF CALIFORNIA - A RESOLUTION SUPPORTING THE UNITED BAY AREA
CRUSADE 1964".
Roll call vote was as follows: Ayes, Councilmen Patrick E.
Ahem, Frank Bertucelli, Emilio Cortesi, Andrew Rocca, and
Guido J. Rozzi. Noes, ~oue. Absent, none.
City Attorney Noonan explained the next resolution, after which
Councilman Bertucelli introduced: ".DITY COUNCIL, CITY OF SOUTH

THE ADVANCE FROM THE SEWER RENTAL RESERVE FUND TO THE SOUTH SAN

He stated an agreement for each property owner had been prepared
for execution and would be accompanied by their depositl. He
further commented that it was his understanding these would be
filed with the City the following day, Tuesday, September 22,
2964, and should precede the second meadiug and adoption of the
respective ordinances. He requested that these items be con-
tinued to au adjourned meeting at 7:30 p.m. ou Tuesday, Septem-
ber 22, 1964.

mending permission be granted for the request for a fence 2 feet
in excess of the 3 foot height limit within the front and side
setback at 793 Alta Loma Drive iu an R-1 district, subject to

City Attorney Noonan remarked that the Variance could be granted
with the provision that Mr. and Mrs. Varo execute an agreement
holding the City harmless, ~ud that should it be necessary to
service or replace the public utilities located underneath the
fence such removal of the fence be made at the expense iof the ap-
plicant.
Councilman Rozzi so moved, seconded by Councilman BertUcelli and
regularly carried.
~laim against the City in the amount of $40.50 as filed by Mrs.
Barbara Gomez of 880 Schweriu Street, Raly City, alleging in-
Juries as a result of a fall at the Oyster Point Marina.
Councilman Rocca moved, seconded by Councilman Bertucelli and
regularly carried, that the claim be denied and referred to the
insurance carrier for the City.
Council next took up the following Eesolutious and Memorandums
as received from the Planning Commission, all of which concerned
the same subject matter:

Resolution No. 1774 - A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITg OF SOUTH SAN FRANCISCO P~COMMENDING APPROVAL OF THE
AMENDMENT OF THE MEYER & YOUNG CORPORATION TO REZONE 57.9 ACRES
OF LAND (ON SIGN HILL) FROM AN R-1 DISTRICT TO A PLANNED COMMU-
NITY DISTRICT. (Inter-Office Memorandum dated September 16,
196~, from the Planning Commission regarding transmittal of all
material regarding the Meyer & Young rezoning; and Inter-Office
.~emorandum dated September 16, 1964, from the Planning Commission
regarding summary of hearings and PLanning Officer's report as
contained in the complete transcript of hearings submigted.
Mayor Ahem asked City Attorney Noonan for an opinion on the
three resolutions and the memorauduns received.
City Attorney Noonan commented that the three items concerned re-
zoning, that they came iu the form of a report and notlas a rec-
ommendation, and that his opinion was still that it needed four
Planning Commission votes as three was not sufficient, i He re-
marked ou the requirements of the setting of a Public Hearing if
it was in order to do so iu accordance with the Zoning'0rdiuance.
He then stated there was nothing before Council at this time and
that it was his recommendation that the resolutions beireceived
and filed and no hearing set.
Mayor Ahem then remarked that in view of the City AttOrney's
opinion it appeared that the City Council could not take further
action ou this rezouing and suggested that Council therefor con-
sider a motion to receive ~nd file nhe report from thelPlauning
Commission and uo public hearing be set.
Councilman Rocca so moved, seconded by Councilman Rozzi and reg-
ularly carried. Councilman Cortesi commented that the!people
had been subjected to this long enough, that he was fo~ the
people and was voting "no" ou the matter.
Brief discussion followed, at which time Mayor Ahem explained
to Councilman Cortesi the Council's earlier action ou She matter.
Mayor Ahem then made the following statement: "Members of the
Council, ladies and gentlemen - This matter has been under con-
sideration for many months at a great deal of expense,'with a
loss to the City and developer. We don~t want to repeat this
kind of a situation in the future and we know that some day we
are going to face some kind of development on the hill, I sug-
gest, therefore, that our staff, under the direction of the City
Manager, confer with the developers and residents regarding de-
velopment on the hill and at the s~ue time review the Master Plan
objectives and this plan. After the conferences are completed,
I would like to have a report filed with the Council.

Mr. Arthur Andreas, Attorney at Law ~ith offices at 633 Battery
Street, San Francisco, representing the opponents to the plan,
asked if he understood Council's action in that no action was
being taken ou the application. The Mayor replied thatlCouncil
had received and filed the report with no action to be taken but
further study. Mr. Andreas then asked that he be advised by the
City Clerk of any meeting and that iaformation be forwarded to
him.
VARIANCE Resolution No. 1775 was received from the Planning Com-
uissiou recommending permission be g~auted for the request to
erect five dwelling units on a 4,800 sq. ft. lot instead of the
required 5,000 sq. ft. lot at 659 Commerdial Avenue, subject to
the following conditions: (1) Careful review of building plans
by Architectural Committee to insure new construction will not
tend to downgrade the area; (2) Garage doors on street and lane.
Councilman Bertucelli moved, seconded by Councilman Rozzi and
regularly carried, that the recommendation of the Planning
Commission be approved and accepted.
VARIANCE Resolution No. 1776 was received from the Planning Com-
w.ission recommendin~ permission be g~anted for the request to
w.aiutain 45-1/3% lo~ coverage instead of permitted 40%, and a
£½ foot encroachment into the required 20 foot rear yard at 371
Catherine Drive.
Councilman Bertucelli moved, seconded by Councilman RozZi and
regularly carried, that the recommendation of the Planning
Commission be approved and accepted.
VARIANCE Resolution No. 1777 was received from the Planning Com-
w.ission recommending permission be g~anted for the request to
encroach 15 feet into required 15 foot rear yard in an indus-
trial district at 136 South Maple Avenue, subject to the follow-
in~ conditions: (1) Metal building be painted or enamel finished;
(2] Plans be presented to 'the Architectural Committee showing
landscaping on the frQnt of the property.
Councilman Bertucelli moved, seconded by Councilman Rozzi and
regularly carried, that the recommendation of the Planning
Commission be approved and accepted.
USE PERMIT Resolution No. 1778 was received from the Planning
Comm~issiou recommending permission be granted for the request to
construct a convent on church proper:y at Willow and Miller Ave-
~ues.
Councilman Bertucelli moved, seconded by Councilman Rozzi and
regularly carried, that the recommendation of the Planning
Commission be approved and accepted.
USE PERMIT Resolution No. 1779 was received from the Planning
Commission recommending permission be granted for the request
to expand use in a P.C.M. district so as to allow the addition
of a sugar tank at 513 Mayfair Avenue, subject to the following
conditions: (1) The loading of the sugar tank be confined to
the hours between 8:00 a.m. and 8:00 p~m.; (2) That theltank
~ot exceed 32 feet overall height from the ground level.
Councilman Bertucelli moved, seconded by Councilman Rozzi and
regularly carried, that the recommendation of the Planning
Commission be approved and accepted.
USE PERMIT Resolution No. 1780 was received from the Planning
Commission recommending oermission be granted for the request
to maintain existing directional si~n 3 feet by 2 feet, and to
renew Use Permit No. 1634 for sign ~z Memorial Drive and Orange
Avenue, subject to the followiu~ conditions: (1) That red and
white Vacancy sign be removed; (2) Use Permit granted for a
one year period only with right to renew.
Councilman Bertucelli moved, seconded by Councilman Rozzi and
regularly carried, that the recommendation of the Planning
Commission be approved:.and accepted.

Monthly Reports for the month of August, 1964, were received
from the following:

Police Department
City Garage Work Schedule for the months of
September, October, November,
and December, 1964.
There being no objections, Mayor Aheru ordered the reports
accepted and placed on file.
There being nothing further, Mayor A.~ern asked if any m~mber of
the Council had anything they wished to offer under Good and
~'elfare. There being none, he then asked if anyone in the aud-
ience had anything they wished to offer. Nothing was offered
from the audience.
Councilman Rozzi then moved, seconded by Councilman Bertucelli
and regularly carried, that the meeting be adjourned to Tuesday,
September 22, 1962, at 7:30 p.m.
