Bertucelli at 5:40 p.m. Pledge of Allegiance to the Flag was reciteC. :resent: ADsent: Councilmen Frank J. Bertucelli, Patrick E. Ahem, Andrew Rocca, and Guido J. Rozzi. Councilman Emilio Cortesi. Mayor Bertucelli at this time declared the Public Hearing opened on the following PLanning Commission resolutions: PLanning Commission Resolution No. 1773 entitled: "A RESOLUTION OF THE PLANNING CONFLISSION OF TH2 CITY OF SOUTH SAN FRANCISOD RECOMMENDING APPROVAL OF THE 'FIND- _-NGS OF FACT' ON THE AMENDMENT PETITION OF .~YER & YOUNG CORPORATION TO REZONE 57.9 ACRES OF LAND (ON SIGN HILL) FROM AN R-1 DISTRICT TO A PLANNED GO~RJNITY". Planning Commission Resolution No. 1774 entitled: "A RZSOLUYION OF THE PLA~3NING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO RECOff~IENDING APPROVAL:OF THE AMEND- ~ENT OF THE MEYER & YOUNG CORPORATION TO REZONE 57.9 ACRES OF LAND (ON SIGN HILL) FROM AN R-1 DISTRICT TO A PLANNED COMMUNITY DISTRICT". Planning Commission Resolution No. 1862 entitled: "A RESOLUTION OF /HE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO RECOMMENDING APPROVAL OF THE R~SO- LEIION OF INTENTION OF THH CIIY COUNCIL OF SOUTH SAN FRANCISCO TO REZONE 57.9 ACRES OF LAND (ON SIGN HILL) FROM AN R-1 DISTRICT TO A PLANNED COMMUNITY DISTRICT". Accompanied by Summary of Hearings and Planning Officer's Report. Planning Commission Resolution No. 1863 entitled: "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO RECOMMENDING APPROVAL~OF THE 'FIND- INGS OF FACT' ON THE RESOLUTION OF INTENTION OF THE CITY COUNCIL OF.THE CITY OF SOOTH SAN FRANCISCO TO REZONE 57.9 ACRES OF LAND (STONEGATH RIDGE) FRO~ AN R-1 DISTRICT TO A PLANNED COMMUNITY". City Attorney Noonan commented that the resolutio~had been received from the Planning Commission and that a resolution hag been prepared to complete the matter if Council so desired. Mayor Bertucelli asked if any written protests had been received, to which the Cizy Clerk replied none had been received by his office since receipt of the Plan- ning Commission documents. Mayor Bertucelli then asked if anyone present wished to register an oral protest. None were registered. Brief discussion followed concerning the matter of streets, street piatterns and sCreet widths, after which Mayor Bertucelli declared the Public Hearing closed. City Attorney Noonan then explained the resolntion, after which Coun,cilman Rozzi introduced: "CITY COUNCIL, CITY OF SOUTH SAN FRANCISCO, STATE OF CALIFORNIA - A RESOLUTION GRANTING A VARIANCE AS RECOMMENDED BY PLANNING COMMISSION RESOLUTION NO. 1772, PASSED AUGUST 24, 1964, AND APPROVING THE REPORTS AND RECOMMENDATIONS SET FORTH IN PLANNING COMMISSION RESOLUTION NOS. 1862 AND 1863 AND ORDERING DORSEMENTS AFFIXED TO SAID REPORTS AND RECOMMENDATIONS". Roll call vote was as follows: Ayes, Councilmen Frank J. Bertucelli, Patrick E. AHem, Andrew Rocca, and Guido 3. Rozzi. Noes, none. Absent, Councilman Emilio Certesi. City Attorney Noonan next explained the ordinance which had been prepared concern- ir~ the rezoning for Stonegate Ridge, after which the Director of Public Works re- qrested that the ordinance contain no parking of vehicles on the 22 foot wide streets. The City Attorney replied that this would be incorporated in the ordi- nance. City Attorney Noonan then stated the ordinance was ready for its first reading and introduction and if Council wished a motion ceuld be adopted that reading of the ozxJinance in its entirety be waived and that ~t have its first reading and intro- duction by the reading of title only. Councilman Rocca so moved, seconded by Councilman Ahem and regularly carried. City Attorney Noonan then stated that a motior could be adopted that an ordinance entitled: "AN ORDINANCE ~STABLISHING A PLANNED COMMUNITY DISTRICT (REFERRED TO AS STONEGAT~ RIDGE); PROVIDING REGULATIONS THTREFOR FOR THE DISTRICTS THEREIN CON- TAIUED AND AMENDING ORDINANCE ~. 353 AS AMENCED ENTITLED 'ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO' ADOPTED AUGUST lC, 1954" be introduced~ reading in its entirety having been duly waived. Councilman Ahem so moved, seconded by Councilman Rocca. Roil call vote was as follows: Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahem, Andrew Rocca, and Guido 3. Rozzi. Noes, none. Absent, Councilman Emilio Co~5esi. 74: RESOLUTION NO. 4187 AWARD OF CONTRACT LIBRARY SITE: TWO PER G~RNT GROSS TAX LEVY - T~LEPHONE COMPANIES: RESOLUTION NO. 4188 OPPOSING ASSEMBLY BILL NO. 346 - GRADE CROSSING PROT£CIION: DISCUSSION - TAX LBVY FOR T~LEPHONE COMPANIES: R£SOLUTION NO. 4189 /WO PER CENT GROSS /AX LEVY - TELEPHONE COMPANIES: VICE-~AYOR APPOINTMENT GUIOO J. ROZZI: ADJOURNMENT: Souncil next took up the matter of the Awarc of Contract for the construction of the Public Library building and Emergency Overating Center. Zity Manager Aiello declared the bids which had been received, giving the total of each bidder. Mr. Paul Markling, Architect, then requested the computation of bids which his office had prepared be corrected to show the bid of Herman Christensen & Sons in the total amount of $545,900.00 instead of $545,000.00 since this was a cypographical error. It was recommended by the City Manager that the award be made ~o Herman Christensen & Sons, the low bidder. City Attorney Noonan then explained the resolution, after which Councilman Rozzi introduced: "CITY COUNCIL, CITY OF SOUTH SA.~ FRANCISCO, STAT2 OF CALIFORNIA - A RESOLUTION OF AWARD OF CONTRACT - PUBLIC LIBRARY BUILDING AND EMERGENCY OPERATING C£NT~CR''. Roll call vote was as follows: Ayes, CounciLmen Frank J. Bertucelll, Patrick ~. Ahem, Andrew Rocca, and Guido 3. Rozzi. Noes, none. Absent, CounCilman Emilio Cortesi. City Attorney Noonan then brought up the matter of the resolution which had been prepared which would allow cities to levy a two per cent (2%) gross receipts tax on telephone companies doing business within the City. He commented that the ~ana- get of the local telephone office stated tha~ he would appear to presen± arguments in opposition to the matter. He suggested tPat if Council so desired the matter could be held over'provided the time element for presentation of the resolution did not expire. Discussion concerning a motion was then held, after which Councilman Rozzi moved, seconded by Councilman Rocca and regularly ca~ried, that if a hearing is to be held prior to the next Council meeting a letter be authorized registering the City's in- tent to the proposed tax. City Attorney Moonan next brought to Council's attention the matter .of Assembly BiLl No. 346 concerninq the cos% of grade crossing protection by the cities which was to be heard by the Public Utilities Committee ~of the State Senate on April 14, 1965. He explained the resolution which had Peen prepared to be sent to the Interim Committee along with the copy of the resolution of the City of Fresno which opposed this cost. Director of Public horks Louis Goss explained the matter~ also recom- merding that the City oppose passage of this 3i11. Councilman Rozzi then introduced a resolution entitled: "CITY COUNCIL, CITY OF SC[/H SAN FRANCISCO, STAT2 OF CALIFORNIA - A RESOLUTION DECLARING TH~ CITY COUNCIL'S OFPOSITION TO ASSEMBLY BILL NO. 346 RHGARDING GRADE CROSSING PROTECTION WORKS AND DHVICES". Roll call vote was as follows: Ayes, Council,'en Frank J. Bertucelli, Patrick E. Ahem, Andrew Rocca, and Guido J. Rozzi. Noes, none. Absent, Councilman Emilio Cortesi. At this time Mr. Phil Raineri, Manager of the Pacific Telephone and Telegraph Com- pany appeared present and registered oppositicn to the adoption by the Council of a resolution which would impose a two per cent gross receipts tax, stating this was unfair to both the telephone company and the telephone users. Further discussion followed, at which time Mr. Raineri asked for Council support in opposition to this bi.iL. Mention was made by the Council members that it was the City'sl feeling that the telephone company was being asked to assist in paying their fair share. After discussion, Mayor Bertucelli asked if a motion was necessary to rescind Council's earlier motion, to which the City Attorney replied that the introduction of a reso- lution would supercede the motion. Cit:y Attorney Noonan then explained the resoluEion, after which Councilman Rozzi introduced: "CITY COUNCIL, CITY OF SOU/H SAN 3RANCISCO, STATf OF CALIFORNIA - A RHSCLUTION URGING SUPPORT OF A CONSTITUTIONAL AMENDMENT WHICH WILL PERMIT CITIES IN CALIFORNIA TO LEVY A /~0 PERCENT GROSS R£CHZP/S TAX ON THLEPHONH COMPANIES DOING BUSINHSS THEREIN". Roll call vote was as follows: Ayes, Councilmen Frank J. Bertucelli, Patrick Ahem, Andrew Rocca, and Guido 3. Rozzi. Noes, none. Absent, Councilman Emilio Cortesi. There being nothing further, Mayor Bertucelli altered for Council confirmation the appointment of Councilman Guido J. Rozzi as Vice-Mayor. Councilman Rocca moved, seconded by Councilman Ahem and regularly carried, that the Mayor's appointment be confirmed.
