CALL TO ORDER: TIME: 7:00 P.M. ROLL CALL: PRESENT: Councilmembers Gupta Matsumoto and Normandy, Vice Mayor Addiego and Mayor Garbarino. ABSENT: None. PLEDGE OF ALLEGIANCE: Led by Mayor Garbarino. AGENDA REVIEW PRESENTATIONS • Presentation by the San Mateo County Elections Office regarding AB 2028 (Mullin) All- Mailed Ballot Elections Pilot in San Mateo County for the November 2015 Election. The Honorable San Mateo County Assessor, Clerk-Recorder and Chief Elections Officer Mark Church provided background information concerning AB 2028, which authorizes an all-mailed ballot elections pilot program in San Mateo County. The County Elections Office proposed to apply the pilot program to the November 3, 2015 Election. Mr. Church explained the program was designed to measure the cost savings from all-mail ballot elections. The state legislature would use this information to weigh the benefits of all-mail ballot elections state-wide. Mr. Church noted that in the 2013 Election nearly 80% of South San Francisco's registered voters voted by mail. Meaghan Hassell Shearer of the Elections Office provided details of the logistics of the proposal. She noted that every registered voter would receive a ballot in the mail along with a postage paid return envelope. At least one polling place would be open in every city on Election Day and County residents could vote at these centers in any city regardless of their respective city of residence. Mr. Church closed the presentation by stating the potential benefits of the program, including increased participation, faster results, cost reduction and reduced risk of human error. Council expressed interest in the AB 2028 pilot program, provided that two (2) polling places would be open within City limits on Election Day. PUBLIC COMMENTS None. COUNCIL COMMENTS/REQUESTS Councilmembers discussed various upcoming events and programs. The following meeting adjournment requests were made: Vice Mayor Addiego requested that the meeting be adjourned in honor of Former San Mateo County District Attorney Keith C. Sorenson Mayor Garbarino requested that the meeting be adjourned in honor of longtime resident, Bruno Pera. Councilwoman Matsumoto requested that the meeting be adjourned in honor of David Ranals, the brother of the City's Parks and Recreation Director, Sharon Ranals and Louise Mediati, the mother of Greg Mediati, Management Analyst II. CONSENT CALENDAR 1. Motion approving the Minutes of meetings of May 12, 2015 and May 13, 2015. 2. Motion confirming payment registers for May 27, 2015. 3. Motion to accept the Police Department Electronic Video Security Camera System as complete in accordance with the plans and specifications (Total Project Cost $112,841.36). (Jeff Azzopardi, Police Chief). 4. Resolution No. 45-2015 approving the Memorandum of Understanding for the South San Francisco Police Association Unit, Dated July 1, 2014 Through June 30, 2017. (LaTanya Bellow, Human Resources Director). Item 2: Councilwoman Matsumoto inquired about the City's responsibility for an abandoned sailboat removal fee listed in the payment registers as against the Harbor District's potential liability. City Attorney Mattas replied that the Harbor District does not have jurisdiction further out in the water where the removal occurred, and that the owners of the boats will be fined upon identification. Councilwoman Matsumoto questioned the function of Employee Benefits Specialists ("EBS"), to whom a payment was made. Finance Director Lee explained that EBS is the Administrator of the City's health plans. Item 3: Councilwoman Normandy asked for clarification on the retention funds released to Vast Security. Finance Director Lee explained that this procedure is standard with Public Works projects, where 5%of the funds are held back until final acceptance of the project. REGULAR CITY COUNCIL MEETING MAY 27,2015 MINUTES PAGE 2 Mayor Garbarino expressed concern over the four change orders mentioned in the report. Staff elaborated that the unanticipated additional hardware listed was for a bracket system needed to increase accessibility between cameras and the main server room in the department. The conduit was not anticipated due to age-related complications of the Municipal Services Building("MSB"), and the purchase and installation of an additional camera in the MSB garage was due to visual obstruction. Motion—Councilwoman Normandy/Second—Councilwoman Matsumoto: to approve the Consent Calendar. Unanimously approved by roll call vote. ADMINISTRATIVE BUSINESS 5. Resolution No. 46-2015 authorizing the City Manager to execute Plan Review and Inspection Services Agreements with 1) CSG Consultants Inc. in the amount of$240,000 and 2) West Coast Code Consultants Inc. in the amount of$240,000. (Alex Greenwood, ECD Director). Director of Economic and Community Development Greenwood presented the staff report. He advised that staff took Council's comments and concerns from the previous presentation of this item and made corresponding changes to the process. Accordingly, City staff was removed from the RFP process. A new all-external panel of outside sources convened on May 13, 2015 and held the second interview. In the meantime, a new Interim Chief Building Official has been appointed. With all these considerations and safeguards in place, staff was recommending following the direction of the panel to execute Plan Review and Inspection Services Agreements with CSG Consultants Inc. and West Coast Code Consultants Inc. The CEO of WC3, Giyan A. Senaratne, S.E., P.E., LEED AP, CASp, introduced himself to Council and expressed that he is very pleased and honored to work with the City of South San Francisco. Cyrus Kianpour, CEO of CSG advised of the services CSG would offer the City. He stated that he was very proud to be working with the City of South San Francisco. Motion—Councilwoman Matsumoto/Second—Councilwoman Normandy: to approve Resolution No. 46-2015. Unanimously approved by roll call vote. 6. Resolution No. 47-2015 confirming South San Francisco Scavenger Company Rate Increase for Fiscal Year 2015-16. (Richard Lee, Finance Director). Director of Finance Lee presented the staff report recommending that Council confirm the South San Francisco Scavenger rate increase for Fiscal Year 2015-16. Director Lee advised the rates increase every three (3) years, and are based upon 95% of the average of a survey of 32 cities. The proposed rates were increasing based upon this survey. Doug Button of the South San Francisco Scavenger Company provided Council with an update on the Company's programs and services, including substantial sustainability initiatives at the Scavenger's Plant. Study Session: Parking Issues, City-wide. (Jeff Azzopardi, Police Chief and Brian McMinn, Public Works Director). Public Works Director McMinn introduced Chief of Police Azzopardi who summarized recent parking trends, neighborhood impacts, parking studies, and potential solutions to ameliorate parking concerns. Director McMinn elaborated on the possibility of expanding residential permit parking citywide, which would require additional staffing and software to manage the 10,000+permits, additional enforcement staffing and vehicles, as well as installation and maintenance of necessary signage. Chief of Police Azzopardi emphasized utilizing officers' best judgement in more complicated situations where limited parking and an abundance of cars might create unsafe conditions for traffic and pedestrians. Councilwoman Matsumoto noted that BART's ridership is oversubscribed in South San Francisco. She asked staff to look at the permit parking system's effects on surrounding neighborhoods. Additional logistics questions were posed by Councilmembers, including inquiries related to plate readers, oversubscribed permits, traffic flow and parking permit auditing. Chief Azzopardi stated that there are nineteen (19) streets permitted for this study, adding that there is no limit to the number of vehicles as long as they are registered to a house in South San Francisco. Council directed staff to continue enforcement, pursue more studies in priority areas, and to perform further in depth analysis for consideration by Council. PUBLIC HEARING 8. Ordinance Regarding Massage Establishments City of South San Francisco-Owner/Applicant Citywide P07-0136:ZA15-0003 Zoning Text Amendments to modify regulations related to Massage Establishment uses, citywide, ("Amendments to Zoning Ordinance and Map") and a determination that no further environmental review under CEQA is required, in accordance with South San Francisco Municipal Code Chapters 20.460 and 20.550, and related revisions to Chapter 10.16 ("Regulation for Massage Parlors and Massage Services") of the South San Francisco Municipal Code pertaining to the operational requirements of Massage Establishments. Public Hearing opened: 9:13 P.M. Sergeant Plank presented the staff report detailing proposed amendments to the Municipal Code which would require new and existing massage businesses to maintain possession of a California Massage Therapy Council (CAMTC) Certification and a Massage Registration Certificate, limit operating hours to 7:00 A.M. — 9:00 P.M., include Planning, Building, and Code Enforcement Divisions in the inspection process, and allow certificates to be suspended or revoked if violations of state, local or federal laws occur. Proposed amendments to the Zoning Ordinance would: require REGULAR CITY COUNCIL MEETING MAY 27,2015 MINUTES PAGE 4 the"massage establishments" definition to be changed to "massage businesses," eliminate "massage establishments" from the "personal services" definition, enforce new performance standards and necessitate either Multiuse Permits (MUP) or Conditional Use Permits (CUP) to operate. Sgt. Plank addressed the potential benefits of maintaining consistency with San Mateo County's Model Ordinance, discouraging illegal activities with enhanced enforcement, protecting legitimate massage business owners, and preventing overconcentration and neighborhood blight. Public Hearing closed: 9:17 P.M. Councilwoman Normandy asked how the City aims to confirm legitimate licenses. Sgt. Plank replied that the California Massage Therapy Council website allows users to enter the name of the business or license into the search engine for verification. He noted that the businesses would have 96 hours upon expiration to report any changes to the Police Department, otherwise their licenses would be suspended or revoked. Sgt. Plank also clarified that Code Enforcement would have assistance from the Police Department for inspections. City Attorney Mattas assured Council that the Police Department would have an active regulatory role with periodic investigations prompted by complaints, otherwise one inspection would be carried out each year. Motion: Councilman Gupta/Second: Councilwoman Matsumoto: to waive reading and introduce an ordinance repealing and replacing chapter 10.16 (regulations for massage parlors and massage services) of the South San Francisco Municipal Code and making modifications to the South San Francisco Zoning Code related to massage business uses citywide. Unanimously approved by roll call vote. ITEMS FROM COUNCIL—COMMITTEE REPORTS AND ANNOUNCEMENTS Councilwoman Normandy advised that the HEART Board committed 1.2 Million to the Brookwood Equities project. Councilwoman Matsumoto announced a possible change in the South San Francisco Ferry Service affecting return time form Alameda was being considered by the Water Transit Authority. ADJOURNMENT Being no further business, Mayor Garbarino adjourned the meeting at 9:49 P.M. in honor of Bruno Pera, Louise Mediati, David Ranals and Former San Mateo County District Attorney Keith C.
