Bertucelli at 8:07 p.m. Pledge of Allegiance to the Flag was recited, after which the invocation was given by Reverend A1Engelman of the Immanuel Baptist Church. Present: A~sent: Councilmen Frank J. Bertucelli, Patrick E. Ahern, Emilio Cortesi and Guido J. Rozzi. Andrew Rocca At this time, Mayor Bertucelli presented awards to the members of the E1 Casino Colts Championship Baseball team. After which, on behalf of the members of the City Council, he extended the congratulations of the City. Mayor Bertucelli at this time asked if there was a motion approving the minutes of the regular meeting of June 7, 1965. Councilman Rozzi moved, seconded by Councilm~n Ahern and regularly carried, t~at the minutes of the regular meeting of J%ne 7, 1965 he approved as s~3mitted. Ma~or Bertucelli then asked if there was a motion approving the regular claims as submitted for payment. Councilman Ahern moved, seconded by Councilman Rozzi and regularly carried, t~at the regular claims be approved for payment. N~yor Bertucelli then asked if there was a motion approving the claims for Parking District No. 1 as submitted for payment. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, t%at the claims for Parking District No. 1, ~otaling $73.77, be approved for payment. Hartford Insurance Group Claim: Hartford Insurance Group claim dated May 4, 1965, in the amount of $15,000.00 for Lewis et al v. City. Councilman Ahern moved, seconded by Councilman Rozzi and regularly carried, tuat the claim as submitted for the Hartford Insurance Group he approved for payment. Accom- panying this is letter of appeal, dated May ]1, 1965 from Miss Mary Lea Lantzy. Mayor Bertucelli declared the Public Hearing opened, asking if any written protests had been received, to which the City Clerk replied none had been received by his office. He then asked if any one present in the audience wished to register an oral protest. There being none, Mayor Bertucelli declared the Public Hearing closed. T~e next item for Council attention was the Public Hearing on Use P~rmit AD, ii cation of Foster & Kleiser (Planning Commission Resolution No. 1904) recommending denial for the request to erect an outdoor advertising structure 12' hy 25' on Airport Boulevard at the Southern Pacific overpass in an M-2-H district. Accompanying this is a letter of sppeal, dated May 11, 1965 from Foster & Kleiser. Mayor Bertucelli declared the Public Hearing opened, asking if any written protests/had been received, to which the City Olerk replied none had been received hy his office. Mayor Bertucelli then asked if anyone present in the a~dience had any protest they wished to offer. There being none, Mayor Bertucelli declared the Public Hearing cloaec. The next item for Council attention was the Public Hearing on Notice of Hearing on Amended Assessment - Littlefield ~nd Kimball Way -~Assessment District. Mayor Bertucelli declared the Public Hearing opened, asking if any written protests had been received, to which the City Clerk replied none had been r~ceived hy his office. He then asked if anyone present in the audience wished to register an oral protest. There being none, Mayor Bertucelli d~clared the Public Hearing closed. Mayor Bertucelli remarked that the first three'resolutions had~'~ been discussed earlier at the Study Meeting and that if there were ne objections, these would h~ continued to the next regular. City Council meeting on July 6, 1965. No oOjections being registered, it was so ordered. The resolutions continued are as follows: 1. "A RESOLUTION AUTHORIZING EXECUTION CF A CONTRACT WITH CABOT, CABOT & FORBES CALIFORNIA PROPERTIES, INC. FOR THE ACQUISITION OF THE PUBLIC IMPROVEMENTS TO BE NUkEE ON CABOT, CABOT & FORBES INDUSTRIAL PARK UNIT NO. 2." 2. "A RESOLUTION ACKNOWLEOGING ASSIGNMENT OF MONIES AND CONSENTING THERETO CABOT, CABOT & FORBES INDUSTRIAL PARK UNIT NO. 2." 3. Ci~y Attorney Noonan explained the next resolution, after which Councilman Rozzi introduced: "A RESOLUTION APPROVING PLANSAND SPECIFICATIONS, AUTHO- RZZING THE WORK AND CALLING BIDS FOR CIRCLE COURT AND CHESTNUT AVENUE IN?ERCEPTOR SEWERS." Accompanying this was an Inter-Office Memorandum, dated June 1, 1965, from the OLrector of Public Works transmitting Plans, Specifications and Cost Estimates for the Circle Court Interceptor Sewer and Chestnut Avenue INterceptor Sewer recommending approval and authorization to call the bids. City Attorney Noonan explained the next resolution, after which Councilman Rozzi introduced: "A RESOLUTION AUTHORIZING 2XECUTION OF AN AGREEMENT WITH TPE SOUTHERN PACIFIC COMPANY--IMPROVEMENT OF ~ROTECTIVE DEVICES AT LINDEN AVENUE EK-12.8." City Attorney Noonan explained the next resolution, after which Councilman A~ern introduced: "A RESOLUTION CONFIRMING AN AMENDED ASSESSMENT - LITTLEFIELD AVENUE AND KIMBALL WAY." The next resolution for the attention of Council was accompanied by an Inter- Office Memorandum, dated June ~ 1965, from the D~rector of Public Works Office declaring the Bids received, stating that the low bidder was the Haleja Construction Company. Mr. Goss then further explained from the Memorandum of J. E. Mayor Bertucelli then asked the City Attorney if the City could award on the basis of the low bid to which he replied it could. This was recommended by the City Manager. Sity Attorney Noonan explained the ordinance which was ready for second reading and adoption, stating that a motion could be adopted by. Council if they so desired that reading of the ordinance in its entirety be waived and that it 3e passed and adopted by reading of the title only. Councilman Rozzi so moved, seconded by Councilman Ahem and regularly carried. 'Jity Attorney Noonan then remarked that a motion could be adopted by Council that the ordinance entitled: "AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO A~ENDING ORDINANCE NO. 353, AS AMENDED, ENTITLED 'ZONIN~ ORDINANCE OF THE ~ITY OF SOUTH SAN FRANCISCO' PASSED AND ADOFTED AUGUST 10, 1954, AND ESTABLISH- I~G ZONING DISTRICT CLASSIFICATION FOR THE PROPERTY HEREIN DESCRIBED." Accompanyin~ this is letter of appeal, dated ~ay 11, 1965 from Miss Mary Lea Lantzy. Mayor Bertucelli asked if the applicant was in the audience. Miss Lantzy of 114 "B" Street, South San Francisco, spoke stating that she had purchased che property from Mr. 3urado and that the accessory building in question had )een constructed by the former owner. Mayor Bertucelli then sta~ed that he understood that this was the reason the Planning Commission c enied the request as they under- stood that the garage would be used for living quarters. Co'~ncilman Rozzi moved, seconded by Councilman Ahem and regularly carried, t~at the building be allowed to remain with the stipulation and understanding t~at it is to be used only as a utility builcing and nothing more and further, that the garage is not to be used for living quarters. USE PERMIT Resolution No. 1904 received from the Planning Commission recom- mending denial for the request to erect an o~tdoor advertising structure 12' x 25' on Airport Boulevard at the Southern Pscific overpass in an M-2-H district. Mayor Bertucelli asked if there was anyone present in the audience who wished to speak on the matter. Ray Adams, representing Foster & Kleiser, staked he was present to answer any questions that the Council might have with regard to the matter. He, at this time, showed Council a photograph of the proposed sign after which Councilman Ahem commented that some one month ago, Council approved a similar request and that if it were in order to grant at that time, Council's policy should be the same in all cases. Councilman Ahern then moved, seconded by Councilman Rozzi and regularly carried, that the request as made he granted and approved. Councilman Cortesi voted No on the motion. The next item for Council's attention was Planning Commission's Resolution No. 1907 entitled: "RESOLUTION OF THE PLANNING CO~ISSION OF THE CITY OF S£~TH SAN FRANCISCO RECO~ENDING TO THE CITY COUN(~IL APPROVAL OF THE FINAL SLBDIVISION MAP OF WESTBOROUCdt UNIT NO. 3A." This matter having been taken care of earlier through the adoption of a Resolution, no further Council action was taken at this time. T~e next item for Council's attention was Planning Commission's Resolution Nc. 1908-A entitled: "A RESOLUTION OF THE PLANNING COMNISSION OF THE CITY OF SOUTH SAN FRANCISCO RESCINDING RHSOLUTION NO. 1908 AND RECOMMENDING TO TFE CITY COUNCIL APPROVAL OF THE CITY COUNCIL'S RESOLUTION OF INTENTION NO. 4201 SO AS TO REZONE 425 ft. x 140 ft. OF LAND LOCATED AT THE SW CORNER OF DRANGE AND CO~ERCIAL AVENUES, KNOWN AS TH8 MANTEGANI PARCEL FRO~ A R-1 DISTRICT TO A R-2 DISTRICT." Mayor Bertucelli asked if the applicant was present in the audience. Mr. Bert Mantegani stated that he wished to get t~e area zoned to R-2 and that he ~ad appealed before Council previously makin~ the same request. Mayor Bertucelli then set the Public Hearing for July 6, 1965 at 8:00 p.m. Soath San Francisco Lumber Use Permit Resolution No. 1909 received from the Planning Commission entitled: "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SOUTH SAN FRANCISCO TO THE CITY COUNCIL ON THE USE PERMIT APPLICATION OF SOUTH CITY LUbtBER AND SUPPLY GO. RECOMMENDING APPROVAL OF THEIR REQUEST TO ESTABLISH A DRIVE-IN THEATER IN A N~-I-H DISTRICT, GENERALLY LOCATED AT .-HE CORNER OF RAILROAD AND SPRUCE AVENUES, ASSESSORS PARCEL NO. 14-061-1, 2, 3." The City Attorney requested deferment of this ~atter for study and report. Mayor Bertucelli then deferred it to the meeting of July 6, 1965 at 8:00 p.m. Sou~h San Francisco Lumber Variance Resolution No. 1910 received from the Planning Commission recbmmed4ing permissio~ he granted to he allowed a screen for the proposed drive-in theater to he 75' 6" instead of permitted 65' in a M-1-H district (Railroad & Spruce Avenues). The City Attorney requested deferment of this matter for study and report. Mayor Bertucelli then deferred it to the meeting of July 6, 1965 at 8~00 p.m. Inter-Office Memorandum, dated May 28, 1965, from the Recreation Commission recommending joint Recreation program with the City of San Bruno at the Morte Verde Park School. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Recreation Commission he approved and accepted. Con-nunication, dated June 7, 1965, from the Utah Construction & Mining Co., requesting acceptance of street improvements ir Industrial Park Unit No. 1 and release of any further responsibility. Cougcilman Rozzi asked Director of Public Works Goss if the acceptance was in order. To which he replied that it was, that the sewer damages caused hy settlement had now been repaired satisfactorily. VARIANCE Resolution No. 1912 received from t~e Planning Commission recommending permission be granted to allow a 10 ft. rear yard instead of required 20 ft. rear yard at 305 Alta Loma Drive in an R-1 district.. Councilman Rozzi moved, seconded by Councilman Ahem and regularly carried, that the recommendation of the Planning Commissio~ be approved and accepted. USE PERMIT Resolution No. 1913 received from the Planning Commission recommending cenial to operate a nursery for 1 to 6 mentally retarded infants at 3375 Oakmont Drive. This was accomanied by: (1) Letter pf appeal, dated May 26, 1965, from Mrs. Geraldine Lockhart (2) Inter-Office Memorandum, dated May 21, 1965, from Captain Fox, Bureau of Fire Prevention (3) Planning Officer's report, dated May 10, 1965. Ptrsuant to the letter of appeal as filed by the applicant, Mrs. Geraldine Lockhart, Mayor Bertucelli scheduled the mat~er for Public Hearing at the regular Council meeting to be held 3uly 6, 1965 at 8:00 p.m. t SE PERMIT Resolution No. 1914 received from the Planning Commission recommending permission be granted to construct an addition to an apartment at 536 Fourth Lane in an R-3 district. Oouncilman Rozzi moved, seconded by Councilman Ahem and regularly carried, that the recommendation of the Planning Commission be approved and accepted. USE PERMIT Resolution No. 1915 received from the Planning Commission recommending permission be granted to use the building at 505 Railroad Avenue, located ir an M-1-H district, for an aluminum brazing rod company, subject to conditions: (1) Meet all safety recommendations of the Fire Chief (2) Install furnace to meet standards of the Air Pollution Control 3card of the Bay Area (3) The rear of the lot to be cleared of open storage and used for parking (4) The building to be repaired and painted (5) The entire yard to be cleaned up. Councilman Rozzi moved, seconded by Councilman Ahem and regularly carried, that the recommendation of the Planning Commission be approved and accepted. LSE PERMIT Resolution No. 1916 received from the Planning Commission recommending permission be granted to move a house from the Westborough model homes area to the corner of Arroyo Drive and 3unipero Serra Blvd., Parcel 1, Block 41, Euri Buri Subdivision , in an R-1 district. Inter-Office Memorandum dated June 10, 1965 received from the Planning Commission recommending denial to the request of Peninsul~ Master Builders (American Housing Guild) for resubdivision of various 19ts in Foxridge. Accompanying this is communication dated May 27, from the Peninsula Master Builders appealing the decision of the Planning Commission. Pursuant to the letter of appeal as filed by 5he applicant, Peninsula Master Builders, Mayor Bertucelli scheduled the matter for Public Hearing at the regular Council meeting to be held July 6, 1965, at 8:00 p.m. USE PERMIT Resolution No. 1926 received from zhe Planning Commission recommending permission be granted to construct 20-room addition to Church of God for school purposes. Councilman Rozzi moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Planning Commission be approved and accepted. Morthly Reports for the month of May, 1965, were received from the following: Building Inspection Department Fire Department Library Tkere being no objections, Mayor Bertucelli ordered the reports accepted and placed on file. There being nothing further, Mayor Bertucelli asked if any member of the Council had anything they wished to offer under Good and Welfare. There being none, he asked if anyone present in the audience had anything they wished to offer under Good and Welfare. Mr. John Rich, 761 Circle Court, made mention of the City Manager's letter recently sent to him and which concerned certain improvements on Tennis Drive to the rear of their properties. He commented on the discussion the previous year concernin~ the covering of the open drive stating that he felt this was a City problem and not that of the residents. He further remakked that he could not recall any prior mention of an assessment, and issuance of bonds for the performance of the street improvement and the covered drain. He likewise mentioned that he was the only one notified hy letter. Mayor Bertucelli replied that when Mr. Rich appeared at the last Council meeting, he acted as spokesman for his neighbors and it was for this reason, since he represented them, that he was forwarded the Manager's reply and that it was his duty to advise his neighbors. City Manager Aeillo then explained the two methods that could be followed. One of which was on a cash payaent basis and the other through the assessment district proceedings. He further explained the methods which could be followed in each of the cases and the costs which would be involved. He likewise remarked on the time the City would allow the residents to pay in the event that they wished to pay by cash, indicating that the City would be receptive to a form of extended payment period. Councilman Rozzi also commented on the costs of widening Teaais Drive and the drain installation which would be a share cost between the City and the property owners. Further, that the City could never expect to obtain payment from the Southern Pacific Railroad Company for this work. Furzher discussion then followed, at which time, Mr. Rich again mentioned the City's obligation in the matter rather than that of the residents. City Ma%ager Aeillo explained the difference between the installations in a new subdivision as against those in an area already developed such as Circle Court. James Claar cited the number of homes which would benefit by this work, stating tha~ he was in disagreement with the City since Tennis Drive was not a street necessary to the residents but one which was used by the general public and mainly, by City equipment going to the recreation facilities and corporation yard. City Manager Aeillo answered that the letter was sent at the request of Mr. Rich and that this was updating the figures which were compiled previously. Mr. Claar stated that he opposed the formation of an assessment district. GOOD AND WELFARE: ADJOURNMENT: Phiilip Scannel mentioned the catch basins which existed from Eucalyptus Avenue and which were not adequate to drain off the heavy waters received during the winter periods. Mrs. Florence Scannel commented that she felt all of the property owners should have been notified and Further, that the City should perform the work. Councilman Ahem then asked Mr. Rich if the property owners wotld not stand to gain by the improvements to be made, to which he replied, that they would not. Councilman Ahem then remarked that when the project was worked up, it was the feeling that it was prepared in such a manner that was fair to both the City and the property owners affected. At the request of Councilman Ahern, City Manager Aeillo then compared the work which was done on Madrone Avenue at the request of the property owners, the cost of which was borne sole~'by the property owners and that this was similar to the request as made by the Circle Court residents. Councilman Rozzi then requesned that the Director of Public Works again study the matter submitting his firdings to the Council for further attention. Further discussion followed, after which, the Mayor stated that the ~ity would make the installation of the covered drain, requesting the Director of Public Works to prepare a Plan and Cost Estimate for the drain only. M~ Rich at this time brought to Council's attertion the fact that on the previous Sunday around 3:00 p.m., the rest-rooms at Orange Avenue Memorial Parc were locked up and not accessible to the public. The City Manager commented that he would check on the matter. There being nothing further, Councilman Rozzi moved, seconded by Councilman Ahe:ra and regularly carried, that the meeting he adjourned to July 6, 1965.
