Rozzi Absent: None Maydr Bertucelli at this time asked if there w&s a motion approving the minutes of ~he adjourned regular meeting of August 10, 1965, the regular meeting of August 16, 1965 and the adjourned regular meeting of August 24, 1965. Councilman Ahern moved, seconded hy Councilman Rocca and regularly carried, th~ the minutes of the adjourned regular meeting of August 10, 1965, the regular meeting of August 16, 1965 and the adjourned regular meeting of AugUst 24, 1965 he approved as submitted. MayOr Bertucelli then asked if there was a motion approVing the regular claims as submitted for payment. Councilman Rocca moved, seconded hy Councilman Ahern and regularly carried, that the regular claims totaling $118,301.61 he approved for payment. MayOr Bertucelli then asked if there was a motion approving the claims for ParMing District No. 1 as submitted for payment. Cotncilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that thelclaims for Parking District No. 1, totaling $125.38 he approved for payment. Councilman Ahern moved, seconded by Councilman Rozzi and regularly carried, that thelclaim as submitted for the South San Francisco Marina be approved for payment. Butler Road Assessment District Claim: Chemical Weed & Pest Control Co. claim, dated August 1, 1965 in the amount· of $48.00 for weed control. Councilman Rocca moved, seconded by Councilman Ahern and regularly carried, that theiclaim as submitted for the Butler Road Assessment District he approved for payment. CabSt, Cabot & Forbes Industrial Park, Unit No. 1 Claims: (a) Wilsey, Ham & Blair claim dated August 4, 1965 in the amount of $3,034.10 for Contract Administration, Resident Engineering and Inspection Services. (b) Wilsey, Ham & Blair claim dated August 4, 1965 in the amount of $1,686.41 for Construction Staking. (c)I Robert S. Cooper & Associates claim dated August 9, 1965 in the amount of $1,939.20 for Site Grading and Trench Backfill. Councilman Rocca moved, seconded by Councilman RozZi and regularly carried, that theiclaims as submitted for Cabot, Cabot & Forbes Industrial Park, Unit No. 1, be approved for payment. Lowrie-Bothin-Swanson Assessment District Claim~ California Water Service Company claim dsted August 6, 1965 in the amount of $2,317.96 for installing 7 fire hydrarts in Lowrie Avenue. PUBLIC HEARING CHESTNUT AVENUE 5/7? PUBLIC HEARING - JOHNNY'S CLUB DANCE PERMIT.' South San Francisco Public Library Claim.. Markling and Yamasaki, Architects, claim dated August 10, 1965, in the amount of $1,607.89 for Architectural Services on Library and Emergency Operating Center. councilman Rocca moved, seconded by Councilmar Cortesi and regularly carried, that thei claim as submitted for the South San Francisco public Library he approved forI payment. Thei first item for Council attention was the continued Public Hearing of the 1964 Edition Uniform Plumbing Code. MayOr Bertucellt asked if any protests had been received since the continuance, to ~htch the City Clerk replied none had been received hy his office. He then asked if anyone present wished to register any protests. There being none, MayOr Bertucelli declared the Public Hearing closed. The: next item for Council attention was the P~hlic Hearing on the widening of CheStnut Avenue. MayOr Bertucelli declared the Public Hearing opened asking if any written protests had;been received to which the City Clerk replied none had been received by his office. He then asked if anyone present in t~e audience had any protest they wished to offer. Mr. iRobert Sheldon representing Safeway Stores inquired concerning access to their store. At this time, the City Clerk read a letter dated August 10, 1965 from the firm of George S. Nolte over the signature of Louis H. Larson, Chief Engineer which read as follows.. Mr. Eugene Aiello City Manager, South San Francisco City Hall South San Francisco, California Re: Chestnut Avenue Alignment Study Our Job No. 40-64 Dear Gene~ At the Planning Commission hearing last night a repre- sentative of Safeway Stores asked f~r a median opening on Chestnut Avenue when the street is improved. Mr. Charles Petrocchi, a property owner at E1Camino Real and Chestnut Avenue, asked concerning the type of street this was to be; =o which he was told, it was to he a major city street. Further discussion followed between Mr. Petrocchi and the members of the City Council during which time he spoke on the present traffic conditions at the intersection of E1Camino Real and Ches=nut Avenue and the increase in this traffic by larger roadway. Also if egress and ingress to their business locations wotfd he provided to which he was informed the7 would he. Mr. Petrocchi also asked if Chestnut Avenue was the best route or would Oak Avenue have been the better route. Mr. ~Martno Donati expressed concern in the mat=er of ingress and egress to his place of business. There being nothing further, Mayor Bertucelli declared the Public H~aring closed. The next item for Council attention was the communication from Thomas L. Bocci, attorney at law, requesting hearing on the denial of dance permit application to Franlklin John Faraudo. Mayor Bertucelli declared the Public Hearing opened asking if any written protest had been received to which the City Clerk replied none had been received hy his office. He co,~ented that similar husiness's in the area already had permits to allow dancing a3d that his client's place of business was better suited for dancing. Also that unless it did not meet the requirements, there should be no reason for denial. Discussion followed at which time Mayor Ber~ucelli called on Police Chief Fahbri for his comments. Police Chief Fahbri remarked that their denial was not on the adequacy hut because of the number of police actions at the establishment. He also stated that the applicant was only an agent for the owner. DiscUssion followed concerning violation of Johnny's Club and other like establish- menz$ in the area. After which there being not~ing further, Mayer Bertufelli declared the Public Hearing closed. CounCilman Cortesi suggested that the permit be issued and if any violations occurred, the permit he revoked. City Attorney Noonan thm explained to Council the right of the applicant to the permit if he met the requirements of the Ordinance, commenting tha~!a Use Permit was not necessary. After discussion, and it being agreeable to Mr. Bocci and his client, action was deferred until the adjourned meeting to he held!Monday, September 13, 1965 at 7:30 p.m. City:Attorney Noonan explained the first resolution which had been prepared for the attention of Council, after which Councilma~ Rozzi introduced: "A RESOLUTION APPROVING THE TERMINATION OF A CONTRACT WITH TH2 UNITED STATES OF AMERICA PROVIDING FOR SEWAGE SERVICE TO CAPE ESPERANCE." City Attorney Noonan then explained the next resolution, after which Councilman Aherni'introduced: "A RESOLUTION ENDORSING A BOiD ISSUE FOR THE ENLARGEMENT AND IMPRD~EMENT OF SAN MATEO COUNTY GENERAL HOSPITAL." City Attorney Noonan explained the Ordinance which had been prepared and was ready for its first reading and introduction, stating that if Council wished a motion could he adopted that reading of the Ordinance in its entirety he waived and that it have its first reading and introduction hy the readirg of title only. Noes, none. Absent, none. The next item for Council's attention was the communicated from Mrs. H. M. Robinson of 382 Dorado Way, Country Club Park, requestirg permission to connect to the City's sewer lines. Mayor Bertucelli asked Mr. Neville of the Engireering Department if he had any comments on the request. Mr. Neville stated that ~% would he the recommendation of the Engiheering Office that they he allowed to conrect when a request for annexation were~made, also that the connection he made at their own expense. Mayor Bertucelli then referred the matter to the Director of Public Works'Office. VARIANCE Resolution No. 1945-A (This rescinds the previous Resolution No. 1945) received from the Planning Commission recommencing permission he granted to permit a 17 fi. encroachment into required 20 ft. rear yard for a distance of 11 ft., then from!this point permitting a 17 ft. to a 15 ft. encroachment for 22 ft., running on an angle so that a 5 ft. yard area to the rear of the addition is maintained on Del Monte Avenue at 363 Del Monte Avenue in an ~-1 district. Accompanying is Inter-Office Memorandum, dated July 30, 1965 from the Planning Commission Secretary recommending approval. CounCilman Rocca moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Planning Commission be approved and accepted. VARIANCE Resolution No. 1949 received from the Planning Commission recommending permission be denied to encroach 4 ft. 4 in. into required 5 ft. side yard to construct 6 ts, 6 in. high carport at 520 Magnolia Avenue. CounCilman Rocca moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Planning Commission be approved and accepted. VARIANCE Resolution No. 1950 received from the ~lanning Commission recommending permission be granted to encroach 2 ft. into reguired 5 ft. side yard to allow for an addition to their home at 338 Newman Drive iL an R-1 district. CounCilman Rocca moved, seconded by Councilman Ahern and regularly carried, that the recommendation of the Planning Commission he approved and accepted. SIGN!USE PERMIT Resolution No. 1951 received frJm the Planning Commission recommending permission be granted to rebuild an existing sign on Bayshore Boulevard - Parcel 6, Block 141 - just South of International Inn. Accompanying were Inter-Office Memorandum, dated August 13, 1965, from the Planning OffiCer submitting Exhibits A, B, C & D and communication, dated August 18, 1965 froniRohert M. Inter-Office MemOrandum, dated August 13, 1965, received from the Planning Commission Secretary recommending refund of Use Permit Fee due to rezoning from "U" to C-1. Couacilman Rocca moved, seconded by Councilman Ahern and regularly carried, that thelrecommendation of the Planning Commission 3e approved and accepted. In~er-Office Memorandum, dated August 12, 1965, received from the Planning Officer submitting Report and Transcript of Hearing on Council's resolution regarding widening of Chestnut Avenue. Councilman Rocca moved, seconded by Councilman Ahern and regularly carried, that the,recommendation of the Planning Commission ~e approved and accepted. Monthly Reports were received from the following: Public Library - July, 1965 Police Department - July, 1965 City Clerk - June, 1965 Parking District - June, 1965 Building Inspection Department - July, 1965 Garage Department - Work Schedule There being no objections, Mayor Bertucelli ordered the reports accepted and placed on file. Department of Alcoholic Beveraqe Control: Notice of Withdrawal of Application 3y Cai-Wide Enterprises, Inc. for New On Sale Beer at 609 West Orange Avenue. Application as filed by Gus and Toula Speridon for Off-Sale General at 142 Hazelwood Drive. Application as filed by B. A. David for Distilled Spirits Importers General at 291 Utah Avenue. There being no objections, Mayor Bertucelli ordered the reports placed on file. There being nothing further, Mayor Bertucelli ~nder Good and Welfare offered for Council confirmation the appointment of Frank ~osati to the Planning Commission. Ma¥~r Bertucelli cor~nented that Mr. Rosati was a resident of the Westhorough sub- division and that in keeping with his earlier statements, was making his appointment from all areas within the City so that each area would be represented. Councilman Rocca moved, seconded by Councilman Rozzi and regularly carried, that theiMayor's appointment he confirmed. Councilman Ahern at this time stated that he would like to present for Council adoption, a Resolution expressing sympathy to the family of John Md~anus on his passing, remarking that the City had lost a person dedicated to the betterment of his community. Councilman Ahern then introduced: "A RESOLUTIDN IN MEMORY OF JOHN FRANCIS MoV~NUS, DECEASED, AND EXPRESSING SYMPATHY TO HIS FAMILY." Ro41 call vote was as follows: Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahem, Emilio Cortesi, Andrew Rocca and Guido J. Rozzi. Noes, none. Absent, none. Councilman Cortesi then asked if there was any more contact with the Crocker Company concerning the matter of the area which they owned to the North of Randolph Avenue. MayOr Bertucelli stated that he had talked to Hr. Morton of that company, that they had.no plans at this time concerning development hut that when they did, would advise the~City. Councilman Cortesi urged that the City keep in constant contact with them. There being nothing further, Mayor Bertucelli asked if anyone present in the audience had anything they wished to offer under Good a~d Welfare. Johm Pene of 116 Dunman Way commented that in June of this year, the City sold to thelCounty the City Park in West Winston Manor, giving the County a Deed to the property. He asked if the Council were familiar with this area to which Mayor Bertucelli replied these were the Tot Lots. Mr. Pene asked that the Mayor's definition he entered into the Minutes after Wjich he gave a definition of a park as contained in the dictionary. Mr. Pene asked if the City was aware of the laws which governed the sale of parks, citing the sections concerning the sale or abandon- men% of park property, asking why the City did not follow these sections. 812 SALE OF PARK PROPERTY WINSTON MANOR 2A (CONTINUED) DISCUSSION DANCE PER/~IT TAX RATE ~ ! ~ 0 EXCESSIVE SPEED /o5 MayOr Bertucelli remarked that the money which had been received from the sale was to be used to create a new park. City Attorney Noonan commented that he would review the sections as cited by Mr. Pene and submit his report to Council. Further discussion followed by Mr. Pene conceraing the City having given the park property away to which Councilman Rocca answered that park property was not given away but that it had been sold for $22,500.00 and that the monies had been set aside for another park in the area. MayOr Bertucelli then referred the matter to the City Attorney for review and report. Mr. !Boido of 515 Orange Avenue then asked if the Police Officers could go in and out of establishments that were having dances to which the Police Chief replied that the~ had the right to go in and out at reasonable hours. Mr. Boido then said that if the applicant did nothing wrong, could not see why he could not get a permit. MayOr Bertucelli stated that the applicant was to come in at the adjourned meeting forla hearing and Council action. Chief of PoLice Fahhri remarked that when this place of business was given its first permit, Mr. Boido was a member of the Council ancthat at that time, the permit had been reveked. Councilman Ahern remarked that no one had yet nade a compliment to Council for lowering the tax rate hut that complaints were heard. MayOr Bertucelli referred to the Police Chief complaints received of motorcycles traveling at excessive speeds on Palm Avenue. Police Chief Fahhri stated his depart- mert was aware of this, had issued several citations and had impounded one motorcycle.
