Mayor Bertucelli asked if there was a motion a~provtng the minutes of the regular meeting of August 1, 1966. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the minutes of the regular meeting of August 1, 1966 be approved as submitted. Mayor Bertucelli then asked if there was a motion approving the regular claims as submitted for payment. Councilman Rocca moved, seconded by Councilman Cortesi and regularly carried, that the regular claims totaling $36,762.25 be approved for payment. Mayor Bertucelli asked if there was a motion a~provtng the claims for Parking District No. 1 as submitted for payment. Councilman Rozzt moved, seconded by Councilman Rocca and regularly carried, that the claims as submitted for Parking District No. 1 totaling $59.15 be approved for payment. The next item for Council's consideration was.=he Public Hearing on Resolution of Intention No. 4~05 to make changes and modifications, Industrial Park Unit 2-C Zore III. Accompanying was Inter-Office Memorandum dated December 9, 1965 from the Director of Public Works recommending acceptance of the subdivision imprevements and release of maintenance bond. Mayor Bertucelli declared the Public Hearing ooened, asking if any written protests had been received to which the City Clerk replied ~one had been received by his office. He then asked if anyone present in the audience wished to offer an oral protest. There be~ng none, Mayor Bertucelli declared the Public Hearing closed. Cocncilman Rocca then moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Director of Public Works be approved and accepted. The next item was the Public Hearing on Planning Commission Resolution No. 2080 entitled~ "A RESOLUTION OF THE PLANNING COmmISSION OF THE CITY OF SOUTH SAN FRANCISCO RECON~NDING TO THE CITY COUNCIL APPROVAL OF ~E A~NDNE!NT PETITION OF CAESAR-CALLAN HO~S INC., SO AS TO REZONE AN APPROXIN, qTELYISO-ACRE PARCEL OF LAND FROM A "U" DISTRICT TO A "PC" DISTRICT." (Set for August 22, 1966.) Thfls was only for Council's information at this time since the Public Hearing was scheduled for August 22, 1966. Proclamation designating August 20 - 27, 1966 as 'MATIONAL DRUM CORPS WEEK" was the next item for Council's consideration. Mayor BertuCelli so proclaimed. The next item was the Inter-Office Memorandum dated July 29, 1966 from the Director of Public Works recommending approval of specifications and authorization to advertise for bids. City Attorney Noonan explained the resolution after which Councilman Rozzi introduced~ "A RESOLUTION APPROVING PLANS AND SPECIFICATIGqS, AUTHORIZING THE WORK AND CALLING BIDS FOR DREDGING COL~L~ CREEK AND TRIBUTARIES - 1966." Councilman Rocca moved reading of the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Cortesi and passed by unanimous vote. Th~ next item was the communication dated June 30, 1966 from Dan Coleman Associates, accompanied by con~nunicatton dated July 5, 1966 from the Lowrie Paving Company, Inc., recuesting a blasting permit in the Stonegate ]idge Assessment DistriCt No. 1. The following represents excerpts of statements and comments made concerning the matter of the request for blasting in the Stonegate Ridge Assessment District. Mayor Bertucelli at this time asked if anyone oresent in the audience wished to speak on the subject matter. Mr=. Lucille Creamer, 529 Eucalyptus Avenue, s)oke, stating that she represented the Park Avenue Heights Home Owners Association. She briefly summarized on the statements mace by the developer when the matter came before Council at their meeting of July 18, 1966. She then quoted from the report as subm:tted by Lee.and Praszker, Soils Eningeers, which concerned the matter of blasting, stating that ~r. Young, the developer, made the promise that no blasting would take place and -~at Council had made the same promise. She also stated that Mr. Young wanted them to ;elieve the rock was a recent discovery when in effect it was known to exist when the ~romise was made. Mention was made by Mrs. Creamer that a verbal promise was in a sense an agreement. She remarked on the visit by Mr. Young to her home on August 1, 1966, at which time he requested that she attend the Council meeting that evening in order that his request for a test blast co%ld be acted onl at which time, she informed him that her group had not as yet met ant, therefore, she was in no position to make her report. She further remarked that the project could be comoleted by other means other than blasting, that the residents of her neighborhood could p~t up with the noise o~ Jackhammers but not blasting. She recuested Council to keep its promise and not allow blasting on Sign Hill. Mr. John Petrovitz, 443 Gardenside Avenue, spoce as a representative of the Hillside Chtrch of God Nursery School, stating that the.r concern was the safety of some sixty children who would be present all day long. He stated that if blasting were allowed, there would be no way of knowing what emotional disturbances would take place in the ch:ldren and requested Council to consider this before rendering its decision.' Mil,or Bertucelli, at this time, requested the City Clerk to read in full a communication which had been receivd from the Hillside Chur:h of God Nursery School, which was done. Mayor Bertucelli then asked if any member of t:~e Council had anything they wished to offer. REQUEST OF THE LOWRIE PAVING CO., INC., FOR BLASTING PERMIT IN THE STONEGATE RIDGE DISTRICT~ (CONTINUED) RESOLUTION NO. 4§~7~ There being none, he then asked City Attorney ~loonan for an explanation of the City's position in the matter. Mr. Noonan stated that the matter concerned both public and private parties in its makeup; that while the subdivision was being c~eveloped by a private owner, the public participation concerned the installation of public improvements and that the Council had a responsibility to see that the installations were completed. Mention was made by Mr. Noonan concerning the effects of erosio~ if an alternate method was to be employed other than blasting. He also stated that if the permit for blasting were no= to be granted, suggested that a report be ~tde by the Engineer of Work to the Director of Public Works concerning the protective measures which would be taken concerning erosion in the roadway areas, the paving which was to be done on portions of the roadway in order to prevent damage to t~e work already done. Mr. William Young stated that it was difficult to understand why with all the experts that were obtained for the work that a proble~ still existed. He remarked that they had gone to great lengths to get the best available men for the work and requested permission only to show how the work would be conducted. He stated to discuss the matter would only prolong the project. He remarked that present this evening was an engineering expert who would supervise the blasting work of Mr. Magistretti. Mr. Harry Kermin remarked that he could assure everyone that the blasting could be done in the heart of the City with no damage. He stated that the matter of blasting had been approached from an emotional standpoiut rather than a practical one and that there would be more noise coming from Jac<hammers' than there would be from blasting. He remarked that a sample blast would demonstrate to everyone that there would be less disturbance and that people woul~ be less apt to be startled if they knew of the exact times that blasting would race place. Mrs. Creamer stated that they objected to the demonstration blast inasmuch as it would only prove that the test blast worked an~ that as work progressed, powder charges could be increased, thereby creating a disturbance. She further remarked th=t after the meeting of July 18, 1966, she w~s approached by another individual other than Mr. Magistretti who advised her he would be the man doing the blasting an~ wondered why this was so. Mr. Young replied that Mr. ~agistretti was still the individual handling the blasting, that he did'not know who this third person was who represented himself to Mrs. Creamer. Mr. John Petrovitz stated that his group would not oppose blasting if it could be shown that it could be done with no emotional disturbance to the children and would agree to a test blast if it could be performed with absolute safety. At the request of the Mayor, Mr. Noonan explained the course of action which Council could take by the adoption of a resolution if ~t were to be granted which would spell out all the conditions under which the work was to be performedor by motion if Council were to deny it. Mayor Bertucelli at this time con~nented that a ?ter listening to those who spoke in opposition to the granting of a blasting permt= and to those who asked that blasting be allowed, requested that a resolution be introduced denying the request to allow bl~sting. CoLncilman Rozzi then introduced a resolution entitled~ "A RESOLUTION DENYING A BLASTING PERMIT FOR STONEGATE RIDGE." Roll call vote was as follows~ Councilman. Rozzi, Aye. Councilman Rocca, prior to voting, stated that people had heard him say a= the earlier meeting that a great part of his life was spent as a mining engineer and that he was fully familiar with the matter ofblasting. He remarked that the reason people felt as they did was that they were not familiar with the work. He commented on the qualifications of Mr. ~agtstretti anc that in addition, a second engineer had been employed as a double check on the work of Mr. ~agtstretti. He remarked that in keeping with the promise made by the Council, woLld vote "Aye" on the resolution in accordance with the wish of the people. At the request of Councilman Rocca, City Attor~ey'Noonan explained Councilman Rocca's question to him earlier concerning the jurisdiction that the City had in this work ant that the developer did not have the authorflty to cease the operations with regard to the method by which the work was to be cond]cted. Councilman Cortesi voted "Aye." Mayor Bertucelli, prior to casting his vote, s:ated that Council had previously made a pledge that no blasting would take place, that Mr. Young had made the same statement; anc voted "Aye." He further remarked that Mrs. Creamer stated that there were no objections to the use of jackhammers and that he had received many calls from the residents asking that the request for blasting be denied. City Attorney Noonan then requested that a mot~on be considered by Council aS follows= Moved that the Works Engineer submit to Counci~ through the Director of ~ublic Works a report and recommendation as to whether protec=ive work is needed and if so, methods to be employed for the protection of road beds and other areas so as to prevent erosion an~ washing of fill from the road beds and sil~ into adjacent areas and sewer lines and th=t the report be filed with the City Council. Co'Jncilman Rocca moved, seconded by Councilmar, Rozzi and regularly carried, that the claim be denied and referred to the City's insurance carrier. The next item was the con~unication dated July 26, 1966 from Charles R. and Eugene P. Go~zales requesting permission to connect to City's sewer syStem in unincorporated area. There being no objeCtions, Mayor Bertucelli referred the matter to the office of the City Manager and City staff for a Study Meetirg w~th a report and recommendation to be submitted. VARIANCE Resolution No. 2078 received from the Planning Commission recommending permission be granted to enlarge a one-story, single-family dwelling, located on the southwesterly side of Theresa Drive, approximately 285' southwesterly of Romney Avenue (#617) to be enlarged to cover 43.7~ of its building site in the R-I District. Councilman Rocca moved, seconded by Councilman Rozzi and regularly carried, that the recommendation of the Planning Commission be approved and accepted. VARIANCE Resolution No. 2079 received from the Planning C~ission recommending permission be granted to enlarge a one-story, single-family dwelling with attached garage to cover 44.13~ of the lot on which it is located in the R-1 District. Councilman Rocca moved, seconded by Councilma~ Rozzi and regularly carried, that rye recomendation of the Planning Commission be approved and accepted. TYe next item was the Inter-Office Memorandum dated July 29, 1966 from the City Planner recommending that a pedestrian overpass between the southerly side of West- borough Boulevard and the recreational and sc%ool facilities on the northerly side tLereof be constructed and that the developers of Westborough and West Park, Caesar- C~llan Homes, Inc., be required to participate in the financing of the subject pedestrian overpass. Tr,ere being no objections, Mayor Bertucelli referred the matter to the City's staff to meet and submit a report as toW hat type of pedestrian overpass was to be con- structed, where it was to be located and who was to participate in its cost. The next item for Council's consideration was the Inter-Office Memorandum dated July 29, 1966 from Gity Planner Daniel Pass recommending approval of the final map of Bothin Subdivision Unit No. 2. Councilman Rocca moved, seconded by Councilma~ Rozzi and regularly carried, that the recommendation of the Planning Commission be approved and accepted. Tt,e next item was the Inter-Office Memorandum dated August 15, 1966 from the City ~nager forwarding a communication dated July 24, 1966 from the Library Board recommending the appointment of Dr. Robert AlVarez as Library Administrator. Councilman Rozzt moved, seconded by Councilma~ Rocca and regularly carried, that tls recoe~nendation of the City Manager and Li3rary Board be approved and accepted and Dr. Robert Alvarez be appointed as Library Administrator. The next item for Council's attention was the Inter-Office Memorandum dated July 28, 1966 from the Recreation Gbmmission submitting a do~Jment regarding park and recreation areas in Westborough. Tt,ere being no objections, Mayor Bertucelli ordered the report accepted and placed on file. Monthly Reports were received from the follow/ng~ Fire Department - July, 1966 Building Inspection Department - July, 1966 Police Department - June, 1966 San Mateo County Public Health - Sanitation Section - June, 1966 City Clerk's Report - June, 1966 Parking District No. 1 - June, 1966 There being no objections, Mayor Bertucelli ~rdered the reports accepted and placed on file. ~ere being nothing further, Mayor Bertucellt asked if any member of the City Council had anything they wished to offer under Good and Welfare. ~ere being none, he then asked if anyone present wished to offer something under Good and Welfare. ~. Quentin Childs, representing the Winston ~anor Home Owners Association, commented o~ the easements to the rear of Arlington anc Bradford Avenues as well as Arlington a~d the cemetery. He further remarked that he had contacted the San Francisco Water Department concerning the improvement of these easements, reading from a letter which he had received in reply and which indicated that these easements were already under permit to the City of South San Francisco. ~e requested a meeting with the City Council a~d their Board of Directors concerning the i~provement and beautification of these easements, stating that his association woulc be pleased to cooperate. GOOD AND WELFAREs (CONTINUED) There being no objections, Mayor Bertucelli referred the matter to the office of the City Manager to arrange for a meeting date at which time the Superintendent of Parks and Recreation Bob ~axey was to be p~esent. ~ayor Bertucelli at this time made the followLng statements REGISTRATION DRIVE TO NON-REGISTERED VOTERS~ "At the last meeting, I issued a Proclamation, designating August 15 to September 15 as Register to Vote Month in South San Francisco. Tonight I would like to launch a registration drive to get all of the non- registered in South San Francisco to vote. Within the next week, I will name a non-partisan committee to assist ir the drive." DISCUSSION CONCERNING DEBRIS AT PROPERTY ASPEN AND LINDEN AVES.: Joseph Sacco brought to Council's attention a vacant piece of property at the corner of Aspen and Linden Avenues which was in need of cleaning, stating that it contained a great deal of debris. He further commented that he owned property ir, the area and requested that the property i~ question be cleaned. Cj. ty Manager Aiello stated that Mr. Sacco had spoken to him on this and that it had been referred to the Building Department wh° made a survey and that the property w~s presently owned by an indigent person. M&yor Bertucelli informed ~r. Sacco that the City staff would again check the matter. EXPRESSION OF GRATITUDE BY TONY MONTOYA FOR AVAILABILITY OF FIELD FOR SOCCER PRACTICEg Tony Montoya, 1125 Miller Avenue, remarked that at an earlier meeting he had requested of Council the availability of a field to be used by their soccer teams in practicing for their 9ames. He stated that the Alta Loma School had been made available and while full use had not been made of this area since a portion of O~ange Avenue Park was made available to thee when not in use by practicing base- ball teams, wished to express his thanks to t~e Council for their attention to their request. DISCUSSION BY ~R. ~ONTOYA k[~. Montoya at this time mentioned to Council that his tenure as a member of the CONCERNING HIS APPOINTMENT Human Resources Committee was about expired, discussed the work which had been done TO HUMAN RESOURCES COMMITTEE:a~d expressed his thanks to the City ~anager for having submitted his name for aopointment to Supervisor Fitzgerald. He further stated that he Would be pleased ~ / ~ ~ to serve again since there were a number of projects yet to be completed. Mayor Bertucelli at this time thanked Mr. Mortoya for his comments concerning the p=actice field, stating that full credit for having a field made available went to the City's staff.
