The meeting was called to order by Mayor Bert'Jcellt at 5=52 p.m.

Guido J. Rozzi

City Attorney Noonan at this time briefly explained the matter of the amendment to
the Agreement with Caesar-Callan Homes, Inc., dba Westborough Homes as it affected
the bond which had been posted for the improvement of the Common Greens and park
sites within their development. He stated the~ holding agreement would place
property owned by the developer in escrow and would not be released hy the City
for building purposes until one of three conditions had been met~
1. that all areas would be improved to the satisfaction of the City;
2. that proper corporate surety bond would be posted to secure the performance of
the work;
3. or that an Assessment District would be formed and the property would not be
released until cash was on deposit with the City Treasurer.
Mr. Kenneth Jones, attorney for the Caesar-C;llan Homes, Inc., stated that the C~ty
Attorney had outlined very well what the amerding Agreement was to do. He briefly
cmmented on the "tight-money situation" and somewhat difficult bond market as well
as the petition for the formation of the Assessment District which would accomplish
the matter of the Common Green development. He then read excerpts fro~ the Agreement,
stating that no releases of property would be made to the developer until one of the
ti~ree methods mentioned by the City Attorney had taken place. He explained the
resolution which had been prepared after which the City Attorney brought to the
attention of the City Council and those present an area which had not been included
a~d which should have been, having been brought to the City's attention by John
Hoffman, the City's Landscape Specialist.
Discussion followed after which the area in cuestion was included in the amending
Agreement.
City Attorney Noonan at this time requested &n order from the chair that the records
show a receipt of letter dated September 12, 1966 as addressed to the City Attorney
concerning significance of sale to the State of property proposed to be included in
Special Assessment District as well as Trans~merican Title Insurance Company Prelimin-
ary Report No. 141435 dated September 7, 1966.
4ayor Bertucelli ordered that the records so indicate the receipt of the mentioned
c o cument s.
Mr. Kenneth Jones at this time stated that the owners had now executed the amendment
to the Agreement which provided forthe placing in escrow of certain properties which
would not be released by the City until one of the already mentioned methods took place
for the improvement of the Common Greens; that upon the execution by the City, release
of the bond presently held for the performance of this work could be made.
Ar. Jones likewise mentioned the partial release of lots as the Common Greens in the
areas were improved. He then explained the resolution which had been prepared after
which Councilman Rozzt introduced: "A RESOLUTION AUTHORIZING EXECUTION OF AMEND~RNT
TO AGREEMENT."
Roll call vote was as follows: Ayes, Councilmen Frank J. Bertucellt, Emilio Cortesi,
Andrew Rocca and Guido J. Rozzi. Noes, none, Absent, Councilman Patrick E. Ahern.
Discussion followed at this time concerning ~he Petition for Improvements by Special
Assessment and Assessment Bond Acts, and Waiver of Proceedings under Division 4 of
the Streets and Highways Code, Westborough-West Park Planned Community District Units
_ and 2, Common Green and Park Site Improvement Project, at which time the City Attorney
remarked that no Council action was required other than to have the records show
].eceipt of the document or its having been fi[ed with the City.
~ayor Bertucelli so ordered the records to i~dicate its receipt and filing.
Mr. Jones and the developer then expressed their thanks to the Mayor and members of
the City Council for their cooperation in concluding the matter; after which the Mayor,
on behalf of the Council, thanked the developers for their patience in concluding the
matter.

Mayor Bertucelli at this time offered for Council's confirmation the appointment of
Councilman Patrick E. Ahem, Mrs. Elizabeth Emerson and Mr. Louis Belloni to the
Retirement Advisory Committee as authorized by Resolution No. 4516.
Councilman Rocca moved, seconded by Councilman Rozzi and regularly carried that the
Mayor's appointment be confirmed.
There being no objections, Mayor Bertucelli adjourned the meeting to the next regular
meeting of September 19, 1966.
