Rozzi Absent= None Mayor Ahern asked if there was a motion approving the minutes of the regular meeting of July 17, 1967, adjourned regular meeting of July 18, 1967 and adjourned regular meeting of July 25, 1967. Councilman Bertucelli moved, seconded by Councilman Rocca and regularly carried, that the minutes of the regular meeting of July 17, 1967, adjourned regular meeting of July 18, 1967 and adjourned regular meeting of July 25, 1967 be approved as submitted. Mayor Ahem then asked if there was a motion approving the regular claims as submitted for payment. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the regular claims totaling $92,972.32 be approvec for payment. Mayor Ahem then asked if there was a motion approving the claims for Parking District No. 1 as submitted for payment. Councilman Rocca moved, seconded by Councilman Bertucelli and regularly carried, that the claims as submitted for Parking District No. 1 totaling $64.90 be approved for payment. Cabot, Cabot & Forbes Industrial Park, Unit No. 1 Claim= Wilsey & Ham claim dated July 12, 1967 in the amount of $448.54 for engineering services in connection with Baldwin-Warre~ claim. Councilman Rocca moved, Seconded by Councilman Bertucelli and regularly carried, that the claim as submitted for Cabot, Cabot & Forbes I~dustrial Park, Unit No. 1 be approved for payment. Cabot. Councilman Rozzi moved, seconded by Councilman Bertucelli and regularly carried, that the claim as submitted for Stonegate Ridge Assessment District No. 1 be~.approved for payment. The next item was the continued Public Hearing on Planning Commission Resolution No. 2080 entitled~ "A RESOLUTION OF THE PLANNZNGCO~ISSION OF THE CITY OF SOUTH SAN FRANCIS(X) REGO~J~JENDING TO THE CITY COUNCIL APPROVAL OF THE A~ENDMENT PETITION OF CAESAR-CALLAN HOMES, INC., SO AS TO REZONE AN APPROXIMATELY 180-ACRE PARCEL OF LAND FROM A 'U' DISTRICT TO A 'PC' DISTRICT." At the request of the City Attorney and there being no objections, Mayor Ahern continued the Public Hearing. The continued Public Hearing on Appeal to Planning Commission's recommendation of denial for the resubdivision of property at the southeasterly corner of South Canal Street and South Maple Avenue - Grassi American Corporation - was the next item for Council's consideration. There being no objections, Mayor Ahern continued the matter. The next item was the continued Public Hearing on Appeal from Use Permit Order UP-39 of the South San Francisco Planning Commission - Westborough Square Shopping Center, Westborough Boulevard and Juntpero Serra Freew&y. At the request of the City Attorney and there being no objections, Mayor Ahern continued the Public Hearing. The next matter to be considered was the Public Hearing on Appeal to Planning Commission's recommendation of denial for the proposed servLce station at the northwesterly corner of Westborough and Gellert Boulevards. Mayor Ahem delcared the Public Hearing opened, asking if any written protests had been received to which the. City Clerk replied that ~ communication had been received from the West Park Home Owners' Improvement Association dated July 10, 1967 over the signature of Mr. Bruce Jacobs, President, registering a protest. At the request of Mayor Ahern, the City Clerk read the letter in full. Mayor Ahern then asked if there was anyone who wished to speak on the subject matter. Mr. Theodore Tronoff, Civil Engineer for the developer and applicant, spoke in favor of the application which was denied by the Planning Commission. He commented that the application was denied on the basis of three general categories which were the statement that service stations should be a minimum of 500 feet apart, that service stations in this location blight the area ~nd that there is no need for additional stations. These he discussed in detail, setting forth their reasons why these statements did not apply, illustrating to Council from photographs the type of service station which was proposed. He then commented on the analysis made relative to the location not becoming an economic problem. He remarked that on the same meeting night that their application was heard, the Planning Commission also had before them one for a building across the street which was granted. Discussion then followed between members of the Council and ~r. Tronoff relative to the matter after which a suggestion was made by Councilman Bertucelli for a replay of the tape recording made at the Planning Commission meeting. Mr. Edward Toby, 2570 Bantry Lane, spoke opposLng the granting of the Use Permit, com- menting that thmewas no need for additional service stations, remarking that what would btherw~se be a beautiful planned con~untty could turn into another E1Camino Real. He also stated that the residents of the area were not happy with the American Oil Station which is located there at the present time. Mr. Mary Ortner, 32 Escanyo Drive, spoke in favor of the applicant, stating that with the anticipated 20,000 cars which would be traveling over Westborough Boulevard, it seemed to her that there wouldn't be too many service stations. Discussion then followed concerning analyses as made by service stations prior to their locations. Mr. James Thompson, one of the developers in the area, spoke in favor of granting the Permit, remarking that this was a proper location, also stating that it would be a tax- producing revenue for the City. Ti-e'e being nothing further and there being no objections, Mayor Ahern continued the Public Hearing to August 21, 1967. City Manager Aiello declared the bids received after wh~h Mr. Dick Raymond of the office of Wilson, Jones, Morton & Lynch explained the resolution for adoption by Council. Councilman Rozzi introduced the resolution entitled: '~ RESOLUTION OF AWARD OF CONTRACT CABOT, CABOT & FORBES INDUSTRIAL PARK UNIT NO. 2 AND UNIT NO. 2-A ASSESSMENT DISTRICTS RECLAMATION AND GRADING STAGE NO. 2." RESOLUTION NO. 4719 AWARDING SALE OF BONDS C.G.&F. NO. 2 SECOND SALE: 7 The bids received were declared by the City Clerk after which Mr. Dick Raymond ex- plained the resolution which had been prepar,.,d for Council's consideration. Councilman Rocca introduced the resolution entitled: "A RESOLUTION AWARDING SALE OF BONDS CABOT, CABOT & FORBES INDUSTRIAL PARK UNIT NO. 2 ASSESSMENT DISTRICT SECOND SALE -- $500,000." RESOLUTION NO. 4720 City Clerk Arthur Rodondi declared the bids received. RESOLUTION NO. 4721 ESTABLISHING FEES FOR ANIMAL SHELTER SERVICES: The next item was the communication dated Ju_y 17, 1967 from the PeninsuLa Humane Society concerning animal control services. City Attorney Noonan explained that this res31utton would bring our fees in uniform with those of the County pursuant to their request, after which Councilman Rozzi introduced: "A RESOLUTION ESTABLISHING FEES FOR ANIMAL SHELTER SERVICES IN ACCORDANCE WITH SECTION XIX OF ORDINANCE NO. 564 OF THE CITY OF SOUTH SAN FRANCISCO." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahem, Frank J. Bertucelli, Emilio Cortesi, Andrew Rocca and Guido J. Rozzi. Noes, none. Absent, none. ORDINANCE NO. 566 ESTABLISHING REGULATIONS FOR REMOVAL OF POLES & ASSOCIATED OVERHEAD STRUCTURES AND POE UNDER- GROUND INSTALLATIONS OF WIRES AND FACILITIES: Mayor Ahern ordered the title of the ordinan:e read. The title of the ordinance was read. City A;torney Noonan then explained the ordinance and advised the Council regarding procedure for adoption and passage. Councilman Rozzi moved reading of the ordinance in its mttrety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Bertucelli and passed hy the following roll call vote: Roll call vote was as follows: Ayes, Councilmen Patrick E. Councilman Bertucelli moved that the ordinance entitled: "ESTABLISHING REGULATIONS AND PROCEDURES FOR THE REMOVAL OF POLES, OVE.~HEAD WIRES AND ASSOCIATED OVERHEAD STRUCTURES AND FOR THE UNDERGROUND INSTALLATION OF WIRES AND FACILITIES FOR SUPPLYING ELECTRIC, GO~NICATION OR SIMILAR OR ASSOCIATED SERVICE IN DESIGNATED DISTRICTS," the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Rozzi and passed by the foIlowing roll call vote. CHANGE ORDER NO. 11 STONEGATE RIDGE ASSESS- MENT DISTRICT= The next item was the communication dated J~ly 24, 1967 from Dan Coleman Associates concerning Change Order No. 11 in the Stone, ate Ridge Assessment District. Councilman Rozzi moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Director of Public Wozks approving Change Order No. 11 be approved and accepted. STREET(LOSING - WINSTON MANOR NO. 2: The communication dated April 5, 1967 from Don S. Wilson, County Engineer and Road Commissioner, together with communication fzom Mr. Joseph Cerrito, 100 Longford Drive, South San Francisco concerning the closing of the street previously known as "Farm's Road" in Winston Manor No. 2, was the next item for Council's attention. Accompanying was the Inter-Office Memorandue dated April 6, 1967 from Police Chief Fabbri submitting his recommendations. RESOLUTION NO. 4722 AUTHORIZING CLOSING OF INTERSECTION: City Attorney Noonan explained the resolution which had been prepared after which Councilman Rocca introduced: "A RESOLUTION AUTHORIZING CLOSING OF AN INTERSECTION." Roll call vote was as follews: Ayes, Councilmen Patrick E. Ahern, Frank J. Bertucelli, Emilio Cortest, Andrew Rocca and Guido J. Rozzi. Noes, none. Absent, none. SHELL OIL CO. PIPELINE The next item was the communication dated March 27, 1967 from Mr. H. B. Lemaire, SOUTH SAN FRANCISCO TERMINAL Chief Right of Way Agent, Wssk Coast Pipe Limes, Shell Oil Company concerning the TO SAN FRANCISCO INTER- proposed construction of a 6-inch pipe line from South San Francisco Projects Terminal NATIONAL AIRPORT: to the San Francisco International Airport, together with their letter of July 3, 1967 submitting legal description and proposed franchise rate. Accompanying was the Inter-Office Memorandum dated July 12, 1967 from the Director of Public Works submitting his recommendations. Mayor Ahern asked that in the event Council acted on the matter, were they in anyway setting a price to which the City Attorney replied that this was not to approve the request, hut to authorize the preparation of an agreement to he presented to Council and would not he setting a price. He further commented that it would be a motion to bring a draft of license hack to Council for further consideration. Councilman Bertucelli moved, seconded by Councilman Rozzi and regularly carried, that the City Attorney be instructed to prepare a draft of license for Council's considerati( CITY PLANNER'S REPORT: The next item was the City Planner's Report to the City Council with respect to Use Permttand Variance Requests considered on J'~ly.24, 1967. There being no objections, Mayor Ahern ordered the report accepted and placed on file. I69 P. C. RESO. NO. 2088 PARKING REGULATIONS OF H, C-2, G-3, M-1 AND M-2 DISTRICTS: SELECTION OF LANDSCAPE ARCHITECT - WESTBOROUGH PARK: TEMPORARY PARK SITE WESTBOROUGH AREA .' CHANGE OF HOURS OF WORK REQUEST - ORANGE MEMORIAL PARK ~ CHANGE ORDER NO. 1 1967 TRAFFIC SIGNAL PROJECT - LINDEN AND HILLSIDE BLVDS. ~ FINAL ACCEPTANCE GRAND-LOCUST STOR~ DRAIN- AGE CORRECTION - NOTICE OF COMPLETION ~ 5'o FINAL ACCEPTANCE SHAW ROAD VIKING TIDE GATE NOTICE OF COMPLETION: REVISIONS TO DRIVEWAY AGREEMENT-WORTENBERG ~ RESOLUTION NO. 4723 AUTHORIZING EXECUTION OF AGREEMENTs MONTHLY REPORTS~ The ne~item was the Planning Commission Resolution No. 2088 on proposed amendments to parking regulations: "RESOLUTION OF THE PLANNING CO~ISSION OF THE CITY OF SOUTH SAN FRANCISCO RECOMMENDING TO THE CITY COUNCIL THEREOF THAT THE PROPOSED AMENDMENTS TO THE PARKING REGULATIONS OF THE H. C-2, C-3, M-l, AND M-2 DISTRICTS BE ENACTED INTO ORDINANCE." There being no objections, Mayor Ahem set the Public Hearing for September 5, 1967. The next matter to be considered was the Inte~-Office Memorandum dated July 23, 1967 from the Recreation and Parks Commission submitting their recommendations in the selection of Landscape Architect for the West~orough Park. Brief discussion followed at which time City Manager Aiello commented that if Council acted on the recommendation, the motion could he to instruct and authorize the staff for the preparation ~ a standard architectural agreement for execution with Mr. David Mayes for this project. Councilman Rocca so moved, seconded by Councilman Bertucelli and regularly carried. The next item was the Inter-Office Memorandum dated July 23, 1967 from the Recreation Commission submitting their recommendations in the temporary park site in Westborough. Accompanying was the communication dated July 26, 1967 from David J. Friedenberg with the request to discuss the proposed temporary park. Discussion followed at which time Mr. David Friedenberg, 2395 Bourbon Court, reviewed the background and meetings held for the selection of a temporary park site, commenting that on mtification to the developer, he was to deliver such park site within thirty days. City Attorney Noonan at this time explained the contents of the agreement, particularly that paragraph which had to do with the temporary park site. Further discussion followed at which time Mr. Theodore Tronoff, engineer for the developer, remarked that because of the banks on the site, there was not ten acres as mentioned hut instead was approximately six. He at this time suggested other sites for use since a portion of the area would be ~tilized in the future development of the Westborough Boulevard. Further discussion followed between Mr. Friedenberg, developer and City Council concerning the matter of the site at which time the City Manager remarked that what had been pro- posed for improvement would fit in the area. Councilman Bertucelli then moved, seconded by ;ouncilman Rozzt and regularly carried that the recommendation of the Recreation and Parks Commission that the site indicated as Westborough Unit No. 5 (Area 12) be approved and accepted and that such site he designated and the developer notified as to delivery under the terms of the agreement. The Inter-Office Memorandum dated June 12, 1967 from the Superintendent of Recreation and Parks requesting change of hours of work to permit scheduling of full-time park man to be on duty at Orange Memorial Park on Saturdays and Sundays was the next matter to be considered by Council. Pending further information on the matter, Mayor Ahem continued the request. The next item was the Inter-Office Memorandum ~ated July 12, 1967 from the Director of Public Works recommending approval of Change Order No. 1 to the Traffic Signal Project at Linden and Hillside Boulevards. There being no objections, Mayor Ahern continued the matter. The Inter-Office Memorandum dated July 21, 1967 from the Director of Public Works advising of the completion of work in the Grand-Locust Storm Drainage Correction in accordance with plans and specifications and requesting authorization to file a Notice of Completion was the next item for Council's attention. Councilman Rocca moved, seconded by Councilman Bertucelli and regularly carried, that the recommendation of the Director of Public Works he approved and accepted and that the Notice of Completion filed. The next item was the Inter-Office Memorandum ~rom the Director of Public Works advising of the completion of work in the "Shaw Road-Vi~ing Tide Gate, Construct Headwall and Repair Gate" 1967 Project and requesting authorization to file a Notice of Completion. Councilman Rozzi moved, seconded by Councilman Bertucelli and regularly carried, that the recommendation of the Director of Public Works be approved and accepted and that the Notice of Completion filed. The next item was the agreement concerning revisions to the driveway of Mr. Frank Wortenberg, 437 Alta Vista Drive. City Attorney Noonan explained the resolution which would authorize execution of the agreement after which Councilman Rocca introduced: '~ RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT WITH FRANK WORTENBERG AND THELMA P. Department of Alcoholic Beveraqe Controls Application as filed by Baruh Liquors, Inc., 543 Forbes Boulevard, for Wholesalers-Importers Distilled Spirits - Beer and Wine. There being no objections, Mayor Ahern ordered the report filed. These being nothing further, Mayor Ahem asked if any member of the City Council had anything they wished to offer. In answer to Councilman Rocca's question on the progress of the CATV, City Attorney Noonan replied that there were no recent reports but that the initial payment of franchise had been made and that he would further check as to progress in the morning. Councilman Bertucelli remarked that he had received a call from Mrs. Pierina Ambrosio on Hillside Boulevard who complained to him of the settling of her house which she a~rihuted to heavy trucks going up and down Hi41stde Boulevard. He suggested the matter he referred to the Building Department, Engineers and Chief of Police for a full report, suggesting also that a seismograph test he considered. He at this time called on Mrs. Ambrosio, 600 Hillside BouZevar¢, who in detail explained to the City Council what was taking place in so far as the sinking of foundations, cracks appearing in the walls, as well as doors being stuck tight or not being able to be opened or closed. She likewise mentioned to Council her home as well as others which were being jacked up in order to correct the situation. She suggested Council initiate some survey for a s61utton to the problem as well as the enforcement of trucks in the area. Director of Public Works Louis Goss remarked tPat Mr. Neville of his office made an inspection but that it was difficult to determine if trucks were causing the problem of if some other factor was contributing to the problem. Mr. Arthur Maguire, 114 Drake Avenue, stated that he was one of the signers of the petition which had been circulated by Mrs. Ambrosto, further commenting on the increased truck traffic, suggesting likewise that the City institute a study of the matter. Police Chief Fabbri explained that Hillside Boulevard was the designated route and remarked on the number of citations which had been issued for violations which occur. Discussion then followed with regard to the futJre development of the Hillside Express- way which would, upon completion, eliminate the problem. Mr. Robert Martyn, 624 Hillside Boulevard, substantiated Mrs. Ambrosio's statements, likewise describing the work which had been don~ to repair damages to foundations and to interior and exterior portions of the house as well. Mr. William Marlow, 617 Hillside Boulevard, briefly commented on the matter, concurring in the previous statements as to damages suffered. Further discussion followed concerning when the area was first developed and homes built, as well as whether or not the ground upon which the homes were built was solid or fill. Mayor Ahern at this time requested that the Director of Public Works, together with other departmental agencies concerned, make a s~udy and report to Council. Mrs. Mary Ortner, 32 Escanyo Drive, at this time brought to Council's attention the matter of dust damage to her home which occurred as a result of grading operations on the Westhorough Boulevard, illustrating from photographs and samples of dust taken from various rooms of her home. She then mentioned to Council having gone upon the site area where Guy F. Atkinson was doing work, having taken pictures and having been escorted out of the area hy Guy F. Atkinson's enployees because of this activity. She asked as to what controls the City had over this matter, citing violations of the commencement of hauling times. City Attorney Noonan explained that the operation was one controlled by other agencies and not the City, that the City did not have too much control over the matter but suggested the City do whatever it could in this regard. DISCUSSION CONCERNING TRUCK TRAFFIC AND DAMAGES OF HOUSES ON HILLSIDE BOULEVARDs Councilman Bertucelli remarked that he had received a call from Mrs. Pierina Ambrosio on Hillside Boulevard who complained to him o£ the settling of her house which she attributed to heavy trucks going up and down Hillside Boulevard. He suggested the matter he referred to the Building Department, Engineers and Chief of Police for a full report, suggesting also that a seismograph test he considered. He at this time called on Mrs. Ambrosio, 600 Hillside Boulevard, who in detail explained to the City Council what was taking place in so far as the sinking of foundations, cracks appearing in the walls, as well as doors being stuck tight or not being able to be opened or closed. She likewise mentioned to Council her home as well as others which were being jacked up in order to correct the situation. She suggested Council initiate some survey for a s61ution to the problem as well as the enforcement of trucks in the area. Director of Public Works Louis Goss remarked that Mr. Neville of his office made an inspection but that it was difficult to determine if trucks were causing the problem of if some other factor was contributing to the problem. Mr. Arthur Magutre, 114 Drake Avenue, stated that he was one of the signers of the petition which had been circulated by Mrs. Amhrosto, further commenting on the increased truck traffic, suggesting likewise that the City institute a study of the matter. Police Chief Fabbrt explained that Hillside Boulevard was the designated route and remarked on the number of citations which had been issued for violations which occur. Discussion then followed with regard to the future development of the Hillside Express- way which would, upon completion, eliminate the problem. Mr. Robert Martyn, 624 Hillside Boulevard, substantiated Mrs. Ambrosio's statements, likewise describing the work which had been done to repair damages to foundations and to interior and exterior portions of the house as well. Mr. William Marlow, 617 Hillside Boulevard, briefly commented on the matter, concurring in the previous statements as to damages suffered. Further discussion followed concerning when the area was first developed and homes built as well as whether or not the ground upon which the homes were built was solid or fill. Mayor Ahern at this time requested that the Director of Public Works, together with other departmental agencies concerned, make a study and report to Council. DISCUSSION CDNCERNING DUST CONTROL IN GRADING OF WESTBOROUGH BLVDs Mrs. Mary Ortner, 32 Escanyo Drive, at this time brought to Council's attention the matter of dust damage to her home which occurred as a result of grading operations on the Westhorough Boulevard, illustrating from photographs and samples of dust taken from various rooms of her home. She then mentioned to Council having gone upon the site area where Guy F. Atkinson was doing work, having taken pictures and having been escorted out of the area by Guy F. Atkinson's employees because of this activity. She asked as to what controls the City had over this matter, citing violations of the commencement of hauling times.
