The meeting was called to order by Mayor Bertucelli at 5s08 p.m. Presents Absents Councilmen Frank J. Bertucelli, Patrick E. Ahern, F. Frank Mameini and Andrew Rocca Councilman Warren Steinkamp The first item for Council's consideration was Resolution No. 25173 entitleds "BOARD OF SUPERVISORS, COUNTY OF SAN MATEO RESOLUTION DESIGNATING AN ADDITIONAL PORTION OF WESTBOROUGH BOULEVARD AND PORTIONS OF GELLERT BOULEVARD, OLYMPIC DRIVE, GALWAY PLACE, OAKMONT DRIVE, CALLAN BOULEVARD AND FLEETWOOD DR~VE, ALL WITHIN THE CITY OF SOUTH SAN FRANCISCO, AS A COUNTY HIGHWAY," together with the resolution consenting to the establishment of said proposed areas as County Highway of the County of San Mateo. City Attorney Noonan commented that the City's staff had not received all of the tn- formation from Caesar Callan Homes, Inc.,; that it was necessary for that firm to deposit deeds with the title company and remove all liens which had not been.B~neas yet; and requested that the matter be continued to the next regular meeting. There being no objections, Mayor Bertucelli so ordered. Brief discussion followed concerning whether or not the deadline would be met as a result of this delay. The next ttem was the Inter-Office Memorandum dated June 20, 1968 from the Assistant Public Works Engineer submitting bid and recon~nendation for Lomitas Slope Stabilization Proposal. Director of Public Works Louis Goss stated that he had met with Mr. Haskins and had worked out the revised plans which would expedite the work to be done. He stated that the additional work to be done would not exceed the bid submitted and recommended the award of contract to Arthur "Buzz" Haskins. Councilman Rocca then introduced the resolution entitleds "A RESOLUTION OF AWARD OF CONTRACT 1968 LOMITAS SLOPE STABILIZATION." Roll call vote was followss Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahern, F. Frank Ma~mint and Andrew Rocca. Noes, none. Absent, Councilman Warren Steinkamp. The authorization of the County of San Mateo to proceed with Eminent Domain Proceedings was the next matter for Council's consideration. Brief discussion followed concerning the Cityts paying some extra cost which would be samll in amount after which Councilman Ahern moved, seconded by Councilman Rocca and regularly carried that the County of San Mateo be authorized to proceed with ~ninent Domain Proceedings on the fill of the rear yards as it affects the Wes,borough Extension. The next item was the Inter-Office Memorandum dated July 5, 1968 from the City Manager concerning negotiations with the owner of house and lot at 822 West Orange Avenue. Brief discussion followed at which time City Manager Atello :equeSted:~that authorization be given to the City Clerk to draw a check in the amount of $1,000 to Title Insurance & Trust Company for escrow purposes and further that authorization for the expenditure of the additional $20,500, plus necessary incidental costs, be approvedl this draft to be prepared at the time the escrow is ready to be closed. Councilman Ahern then moved, seconded by Councilman Rocca and regularly carried, that the City Clerk be authorized to prepare a check ~.n the amount of $1,O(X) as escrow deposit and further, that he be authorized to prepare the additional check of $20,500 at such time as the sale is to be concluded. Director of Public Works Louis Goss at this time brought to Council's attention a communication dated July 8, 1968 as received from George S. Nolte Consulting Civil Engineers, Inc., and which concerned the matter of the proposed Spruce Avenue drainage improvements as they were related to the Francisco Terrace Subdivision. He stated that Mr. Larson of the Nolte firm was present in the audience to answer any questions Council wished to make. Discussion then followed at which time Mr. Larson was asked if the recomeendation as contained in their letter would alleviate thesituation and remove the problem of flooding to which he replied that it would provided there were no upstream developments. Discussion then followed concerning the type of culvert to be constructed, the work to be performed by the firm of Nolte as well as work to be done by the City forces wherever possible with credit to be allowed for the work performed and the schedule of construction and completion time. PROPOSED SPRUCE AVENUE DRAINAGE IMPROVEMENTS s (CONTINUED) DISCUSSION CONC NI.G OVERPASS - WESTBOROUGH BOULEVARD EXTENSIONs RESOLUTION NO. 4880 REGARDING LOCATION OF PEDESTRIAN OVERPASS WESTBOROUGH BLVD. EXTENSION ~ PETITION BY RESIDENTS FOR LANDSCAPING OF ~N GREEN 109 WEST PARK NO. 2~ DISCUSSION CONCERNING AB 1465 - POVERTY PROGRAMS ~ ATTENDANCE REQUEST FOR NO. COUNTY COUNCIL OF C~TIE$~ Councilman Rocca moved that the City accept the proposal of George S. Nolte Consulting Civil Engineers, Inc., pursuant to the provisions and conditions as contained in their letter dated July 8, 1968 with the understanding that wherever required, the City staff be called on to perform work on the project with credit to be given to this cost. Brief discussion followed after which Councilman Ahern seconded the motion which was regularly carried. The next item was the matter of the overpass with relation to the Westborough Boulevard Extension which was to be located in the vicinity of West Orange Avenue. Discussion followed at which time mention was made that the County Engineer's office was to meet with the California Golf Club on Wednesday night on the matter and to discuss with them the item of location and severance damages. Mention was also made that the offi, of the District Attorney had informed the County Ebglbeer's office that there would be no conflict in doing the work in two stages, Lengthy discussion then followed concerning the use of the overpass by school children, making its location so that it would be convenient for them to use it for their safety. Further discussion followed concerning the location during which time the City Attorney explained to the members of the City Council the City's rights with regard to the West- borough Boulevard Extension and the need to preserve these rights by including the ramps with a right to delete. Further discussion followed concerning the inclusion of certain properties within the plans in order that the City would not have to acquire these properties later. After discussion and a suggested motion by the City Attorney, City Attorney Noonan commented that it would be well to introduce a resolution concerning this matter. He explained the form of resolution after which Councilman Rocca introduced the resolution entttleds "A RESOLUTION REGARDING LOCATION OF PEDESTRIAN OVERPASS AT THE PROPOSED INTERSECTION OF WESTBOROUGH BOULEVARD EXTENSION AND CAMARITAS ~ND WEST ORANGE AVENUES." Roll call vote was as follows~ Ayes, Councilmen Frank J. Bertucelli, Patrick E. Ahern, F. Frank Ma~mini and Andrew Rocca. Noes, none. Absent, Councilman Warren Steinkamp. Councilman Mae~nini at this time presented to the Mayor and members of the City Council a Petition dated July 6, 1968 which had been received from the residents of West Park No. 2 and carried fifty-seven signatures requesting that the landscaping plans as previously approved for West Park No. 2 be executed promptly. At the request of Mayor Bertucelli, the City Clerk read the Petition after which Councilman Mammini requested that the Caesar Callan Homes, Inc., be instructed to proceed immediately with the work and should they not proceed, the City undertake the work itself, the cost of which was to be born by the bond which had been posted in the amount of $7,500. Discussion followed concerning the firm which had already estimated the work to be done as well as another firm which was to submit an estimate of cost at which time mention was made that the work could be performed in a matter of two weeks. Mayor Bertucelli stated that nothing further was to proceed in the Westborough area until this work was performed by the developer, stating that the developer be instructed that the Council demands the performance of this work. Both Councilman Rocca and Councilman ~ammint agreed in the Mayor's statement at which time Councilman Mammtni stated that it was his desire that the work be done which was originally promised. A resident of the area stated that for three years, residents of West Park No. 2 have been paying taxes for improvements which had not been made and were becoming tired of it. They requested the installation of the original plans. A resident present in the audience stated that letters had been sent to the developer by the City giving him sixty days in which to perform and that still nothing had been done, concluding that for three years, there has been no action in this regard. The resident further remarked that the people in the area were becoming quite tired of this lack of performance. Mayor Bertucelli then stated that the developer would be notified if the work were not commenced by the 15th of July, 1968, the City would proceed to have the work done, the payment of which would be made from the bond which had been posted by the developer. He requested the Director of Public Works to immediately notify the developer of this fact. There being nothing further, City Manager Aiello brought to Council's attention a call which he had received from the City of San Mateo concerning a telegram which they had received from ~r. Don Benninghoven of the League of California Cities with regard to Assembl Bill 1465 concerning poverty programs which requested cities to contact their representativ, in the Assembly and Senate for the support of this bill. Brief discussion followed as to the nature of the bill, the amount of ~oney whic~ was to be made available to each of the cities in the State which would not be a great amount. Since sufficient information was not available concerning the matter, no action was taken by the City. City Manager Aiello then remarked that the City of Daly City requested a good attendance at the next meeting of the North County Council of Cities at which time Congressman Paul McCloske¥ would be the speaker. Mayor Bertucelli asked the City Manager if so~e of these supplies could be made avail- able to which he replied that so~e could.
