The meeting was called to order by Mayor Bertucelli at 8106 The Pledge of Allegiance to the Flag was recited after which the Invocation was given by Councilman Andrew Rocca in the absence of Reverend Alfred Carson of St. Elizabeth's Episcopal Church. Presents Councilmen Frank J. Bertucelli, Patrick E. Ahem, F. Frank Mammint, Andrew Rocca and Warren Steinkamp Absents None Mayor Bertucelli asked if there was a motion approving the Minutes of the regular meeting of April 6, 1970. Councilmen Mammini moved, seconded by Councilmen Steinkamp and reGUlarly carried, that the Minutes of the regular meeting of April 6, 1970, be approved as submitted. Mayor Bertucelli then asked if there was a motion approving the regular claiIs as submitted for payment. Councilman Rocca moved, seconded by Councilman Mammini and regularly carried, that the r~ular claims, totaling $178,208.16, be approved for payment. Mayor Bertucelli then asked if there was a motion approving the claims for Parking District No. 1 as submitted for payment. Councilmen Ma~mini moved, seconded by Councilmen Steinkalp and regularly carried, that the claims as submitted for Parking District No. 1, in the amount of $60.00, be approved for payment. Cabot. Cabot & Forbes Industrial Park. Unit Moo 2 Claimas (a) McGuire and Hester claim dated March 31, 1970 in the amount of $68,563.94 for work performed during March. (b) Cooper-Clark& Associates claim dated March 26, 1970 in the amount of $652.05 for Soils Engineering Services, (c) Cooper-Clark.& Associates claim dated April 3, 1970 covering Invoices Nos. 3117, 3118 and 3119, totaling $5,212.27, for Soils Engineering Services. Councilman Rocca moved, seconded by Councilmen Mammini and regularly carried, that the claims as submitted for Cabot, Cabot & Forbes Industrial Park, Unit No. 2, be approved for payment. Mayor Bertucelli at this time introduced each of the fourteen students from the Los Cerritos School. Mayor Bertucelli thanked the youngsters for their attendance at this evening's meeting and urged the public to attend the Pancake Breakfast to be held on Sunday, April 26, 1970j which would rai~m~ tam send seventy-five children on a field trip to Washington, D.C., to meet the President'of the United States. There being no objections, Mayor Bertucelli so ordered. City Attorney Noonan stated that the Proclamation designating May 10 - 15, 1970 as NATIONAL POLICE WEEK comes at the request of Police Chief Rosario. Mayor Bertucelli so proclaimed. The next ttem was the Inter-Office Mamorandum dated April 7, 1970 from the Director of Public Works fo~arding proposed "AGREEMENT BEI'~EN TIiE COUNTY OF SAN MAlq~O AND TItE CITY OF SOUTH SAN FRANCISCO POR THE PREPARATION OF AN AREA-WIDE 'TOPICS' PLAN," and recommending adoption of a resolution authorizing the agreement. After an explanation by City Attorney Noonan, Councilman Ms,mini introduced the reso- lution entitleds #A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN R~ANCISCO RECRJESTING THAT THE'STATE DEPARTMENT OF PUBLIC ~ORK$ APPORTION ~JNDS FOR THE TOPICS PROGRAM." City Attorney Noonan explained that the next resolution which corrects certain clerical errors in sewer rental charges and approving refunds was requested by the City Clerk after which Councilman $teinkamp introduced the resolution entttled~ "A RESOLUTION CORRECTING GERTAIN CLERIGAL ERRORS IN SE~ER RENTAL CHARGES AND APPROVING REFUNDS.' City Attorney Noonan stated that the next resolution, while not listed on the evening's agenda, was similar to one adopted by the City of Morro Bay, which would prohibit dis- charge of pollutants into waters by vessel~ and was ready for introduction. Councilman Aborn introduced the resolution entitled~ "A RESOLUTIO~ RE~UES?ING LEGIS- LATION PROHIBITING DIS(~RGEOF SEWAGE FROM ALL SHIPS, BOATS, OR OTHER VESSELS INTO THE WATERS OF ANY BAY, H~RBOR OR NAVIGABLE STREAM." City Attorney Noonan explained the next resolution which was related to Item 2(a) unde~ New ~usiness and would accept dedications and authorize the installation of public im- provmaents and grant for the COmmon Greens after which Councilemn Rocca introduced the resolution entitleds "A RESOLUTION APPROVING THE FINAL ~ WESTBOROUGH-WEST PAi~ NO. 3A-F AND AUTHORIZING ACTS RELATED IltERETO." City Attorney Noonan explained that the next resolution was similar for Westborough-West Park No. 3A-G after which Councilman Steinkmep introduced the resolution entitled~ "A RESOLUTIONAPPROVING THE FINAL MAPRESTBOROUGH-WEST PARK NO. 3A-GANDAUTHORIZINGACT$ RELATED THERETO." The claim as filed by Mr. John Mendes alleging water-pipe damages as a result of pressure from the City-owned fire htairant at 115 Belmont Avenue on March 20, 1970 .was the next item. Councilmen Rocca moved, seconded by Councilman Mamtini and regularly carried, that the claim be denied and referred to the City's insurance carrier. The next item was the Inter-Office Memorandum dated December 9, 1969 from the Planning Commission recommending approval of SA-13 final map of Westborough-West Park No. 3A-F representing the subdivision of 8.3075 acres of land, located at the northeasterly corner of Greendale Drive and Parker Way, in the Westborough-West Park No. 3 Planned Comaunity District, into 77 lots, subject to recomaendations of City depertmentsl~together with the comaunication dated February 16, 1970from the Director of Public Works as addressed to Theodore V. Tronoff, Engineers, concerning Review of Record Maps and Improvement Drawings for Westborough-West Park Units ~-F and 3AoG. Since this matter was acted upon earlier under Resolutions, no; ifurther Council action was necessary. The Inter-Office Memorandma dated December 9, 1969 from the Planning Comaission recommend- ing approval of SA-13 final map of Westborough-West Park No. 3A-G, representing the sub- division of 7.8368 acres of land, located at the northeasterly corner of Galway Drive and Westborough Boulevard, in the Westborough-West Park No. 3 Planned Community District, into 72 lots, subject to the recommendations of City departments; together with the co~munication dated February 16, 1970 from the Director of Public Works as addressed to Theodore V. Tronoff, Engineers, concerning Review of Record Maps and ImProvement Drawings for Westborough-West Park Units 3Aif. F and ~A-G was the next matter for Council's attention. This item was similsrly concluded under Resolutions and required no further action from City Council. Council received the followings (1) later-Office Memorandum dated March 31, 1970 to the City Manager from the Director of Public Works, Subjects Completion of Improvements in West Park units 1 and 2. (2) Letter dated March 23, 1970 to the Director of Public Works from Caesar Callan Homes, signed by Ichiro Susakio (3) Letter dated March 23, 1970 to Louis Goss from$. H. Snyder Company signed by Henry Richnmn. (4) Letter dated March 17, 1970 to Louis H. Goss from Theodore V. Tronoff, Res Survey No. 25/5600, West Park I and 2 Completion, with attached cost estimate, Completion of Improvements for Blocks 2, 3, 4, 5, and 6 (Area 8)and cost estimate Completion of Improvements, West Park I and 2 - remaining improvements outside of Area 8. The Director of Public Works and City Attorney further explained the documents received and the agreements previously executed, including Resolution No. 5087 passed May 19, 1969 and the agreements therein authorized which supplemented or amended prior agreements, and the corporate surety bond-" in the amount of $750,000. Councilman Steinkamp made the following motions that Council accept the recommendation of the Director of Public Works and that the $750,000 bond be released upon the con- tingencies mentioned by the City Attorney which are as follows, when Caesar Callan Homes, Imco, or their alternate corporate entity or successors and Michael Callan and Thomas Callan, as individuals, heve~ (1) Executed and filed with the City Clerk a corporate surety bond in the principal sum of $20,000 securing the preparation of plans and con- struction and tm tallation of median island landscape planting and other works as set forth in the Agreement deted May 19, 1969 by the City and Caesar Callan Homes, Imco, with the proviso that thereafter City may elect to accept a substitute of obligors with equivalent security and secuzing construction and installation of improvements outside of the Parcel 8 area, as set forth in the original Agreement of August 31, 1964 and detailed in the Agreement entitled, "Subdivision Improvement Westborough-West Park Units I and 2, Supplement 1, dated May 19, 1969' which improvements are to be described by the Director of Public Works in an Inter-Office Memorandum filed with the City Clerk. (2) Has executed and delivered to the City Clerk a corporate surety bond in the principal sum of $10,000 securing for two years, repair and maintenance of the public improvements installed pursuant to the Agreesmnt dated August 31, 1964 and amending agreements, all of which to be detailed by the Director of Public Works in the later-Office Memorandum to the City Clerk and filed with the City Clerk. (3) Has repaired the defects in the streets, referred to as #cracks,N estimate cost of which is recited as $2,000, same to be detailed by the Director of Public Works to the City Clerk and f/led with the City Clerk, (4) Director of Public Works has certified by Inter-Office Memorandum to the City Clerk that the items of work listed on the Punch List dated approxiaately one year ago have been completed, or completion secured. (5) City Attorney has filed with the City Clerk an Inter-Office Memorandum that the $42,000 on deposit with the title insurance company is subject to release only for the construction of improvements in Parcel 8 as detailed in the Resolution and escrow instructions requiring that deposit, Then the $750,000 corporate surety bond previously filed to secure the performance of the Agreement dated August 31, 1964 may be released. In seconding the notion, Councilman Rocca inquired if there would be a clarification of the $42,000 which was deposited in the title company to which Councilman Steinkamp stated that this was in the motion. Motion as made and seconded was regularly carried. The next item was the Inter-OfficeMemorandumdated April 1, 1970 to the City Manager from the Director of Public Works forwarding and recommending approval of Change Order No. 1 in the E1Comino Underground Fire Alarm Project. Councilman Steinkamp moved, seconded by Councilman Mas~ini and regularly carried, that the recommendation of the Director of Public Works be approved and accepted. The Inter-Office Memorandum dated April 6, 1970 as addressed to the City Manager from the Director of Public Works submitting and rec~nending approval of Change Order No. § in Cabot, Cabot & Forbes Industrial Park' Unit No. 2 was the next matter for Council% attention. Councilman Rocca.moved, seconded by Councilman Mammini and regularly carried, that the recommendation of the Director of Public Works be approved and accepted. The next item was the Inter-Office Memorandum dated April 10, 1970 to the City Manager from the Landscape Specialist advising of work completion, recommending acceptance and processing of the final payment of $1,I07.17{ and requesting authorization to file Notice of Completion of Maintenance of West Park Common Greens. Councilman Mannini moved, seconded by Councilman Rocca and regularly carried, that the recommendation of the Landscape Specialist be approved and accepted. Monthly Reports were received from the followings Library - March 1970 Building Inspection Department - March 1970 Fire. VIRGINIA ROGCA: COMMENTS BY COUNCILMAN ANDREW ROCCA: The next item was the communication dated April 20, 1970 from Theodore V. Tronoff, Civil Engineer & Surveyor, Inc., as addressed to Director of Public Works Louis N. Goss, forwarding Change Orders Nos. 1 and 2 in the Westborough Boulevard Improvement Project and requesting City Councilts approval. Councilman Stetnkamp moved, seconded by Councilman Ahem and regularly carried, that the Change Orders Nos. 1 and 2 in the Westborough Boulevard Improvement Project, with the concurrence of the Director of Public Works, be approved and accepted. The next ttem was th® communication dated April 9, 1970 from the City of Pacifica forward- ing their Resolution No. ~0-70 urging early construction of a State College in Redwood City. There being no objections, Mayor Bortucelli ordered the communication and resolution accepted and placed on file. Under Good and Welfare, Mayor Bertucelli at this time read the Memorandum fromM r. John H. Jenks, of the firm of Jenks & Adamson, Consulting Sanitary Civil Engineers, dated April 10, 1970, Subject: Enforcement Actions - Regional Water ~uality Control Board. City Manager McKenzie remarked that; as Council was aware, they had recently authorized llr. Senks to proceed with plans for the expansion and improvement of the sewage treatment plant, also preparation of the plans for the deep water outflow line. He explained the orders issued against the City and County of San Francisco and other cities by the Regional Water Quality Control Board and stated that the City of South San::Francisco may be faced with similar prohibitions of any future connections and he would keep Council informed of that. Mayor Bertucelli m~nou~ced to those present that the new Kaiser Hospital's construction on E1Camine was to be started on May I of this year and that the property was an incorporated area. City Manager McKenzte stated that since there was not a quorum at the previous City Council Study Session, if Council desired, the following items could be considered. The first of the items were the reports from City Staff recommending against a mobile lubrication business which would operate on a house-to-house basis and City Manager McKenzle stated that it was Cttyms intention to so advise the applicant. City Manager McKenzie remarked that the next item concerned the proposals from the landscaping of railroad rights of way and advised Council of the meeting of the Public Utilities Commission held April 14, 1970 at which City Planner Daniel Pass and Landscape Specialist John Bellman attended. Ne at this time read the proposals to be submitted to the Public Utilities Co~ission which were contained in the Inter-Office Memorandum dated April 15, 1970 as addressed to the City Manager from John E. Noffman, Landscape Specialist, and Daniel M. Pass, City Planner. The next item regarding the Southern Pacific parcel adjacent to the Orange Avenue Park and which is to be used for parking for the new municipal swiee~ing pool had been referred to the office of the City Attorney for a report to be submitted at the next meeting. The last item was the proposal for the landscaping of the Westborough Fire,Station which was continued to the April 29, 1970 Study Session. City Manager McKenzie stated that he had received two communications, the first, a request and cost estimate from the Redwood City Tribune concerning advertising for the City in the Floral Fiesta County Fair in which the City participated last year; and the other communication concerning parking meters which was sent to Mr. Davis of the Chamber of Commerce fr~m Mr. David Simons, 3901 Colby Way, San Bruno, dated April 15, 1970 and which he read in full. Mayor Bertucelli at this time invited all of the residents of South San Francisco to attend the dedication of the Westborough Fire Station on Saturday, May 9, 1970, at 10:00 a.m. In honor of retiring Councilman Andrew Rocca, Mayor Bertucelli introduced Mrs. Virginia Rocca to those present in the audience. Councilman Rocca remarked that he felt' pretty much like a fellow who had gone to school for a long length of time and was ready to graduate and which would be the end of his activities for awhile. Ne stated that on this coming September 17th, he would have been a member of the City Council for sixteen years and felt that anyone on the Council this length of time should be able to look back on accomplishments other than just the routine City b~siness. Councilman Rocca stated that there were two things that he was quite pleased to have accomplished. He commented that shortly after being appointed Mayor of South San Francisco, he had declined the invitation to preside over the Marth County Council of Mayors in order to devote his time and energy to the .~ask of obtaining suitable compensation for Mayors and Members of Councils in the State of California by the basis of population. He described the many meetings and trips to Sacramento and the invoking of help of Assembly- man Leo Ryan and Senator Richard Dolwig. He stated that the passage of the bill required five years" efforts on his part and he stayed with it until it was a reality. Councilman Rocca statedthat the other benefit to the City was the South San Francisco Marina. He commented on his experiences in the obtaining of a State loan at a low interest rate for the Marina facility. He told of his guiding Lt. Governor Glenn Andersen and Mrs. Andersen on a tour of the proposed Marina site and of Lt. Governor Anderson's state- ment, #When you remarked about using a little imagination, that was the understatement of the year.~ This resulted in the obtaining of a 15-year loan at ~.7~ interest and $575,000 to build, with protective clauses for the City in the agreement, with eventual ownership by the City of South San Francisco. ROCCA 5/3-3 AD~OURNMHNT s Councilman Rocca at this time expressed his appreciation to the Department Heads and to all of the employees of the City and stressed that there was good management with good employees and to keep it that way. Mayor Bertucelli remarked that when Councilman Rocca was active in the banking business, through a legal procedure, money was printed with his name on it after which Councilman Rocca explained the buy/ng of US counsels to help finance the Panama Canal construction and money was issued in like amount with the purchaser's name printed on it. He at this time passed a $20 bill around for all to inspect. Mayor Bertucelli invited Councilman Rocca to attend any meetings he may wish and to offer his comments. Councilman Mammini extended his congratu}ations t° Councilman Rocoa,~,by stating that it has been a privilege to have served on the Council with him, a Gentleman of his caliber. Councilman Ahem extended his congratulations to Councilman Rocca, commenting that he has been a great stabilizer. Councilman Steinkamp added his congratulations by stating that Councilman Rocca's ,knowledge had guided the City towards financial stability and he considered it a real honor to have served with Councilman Rocca on the City Council. Mayor Bertucelli a this time intorduced the succefful candidate, Mr. William Borba, and the other candidates, Mr. Edward Rickenbacher and Mr. Gordon Boblitt. City Manager McKenzle offered a word on behalf of the staff, stating the he admired the manner in which Councilman Rocca conducted himself and he, the Department Heads and City staff would miss him very much. In response to Mayor Bertucelli's invitation to speak, kLrs. Rocca briefly remarked about the bank notes bearing Councilman Rocca*s name.
