MALEPEAI: 8:00 p.m. Council Chambers, City Hall The meeting was called to order by Mayor Borba at 8:04 p.m. The Pledge of Allegiance to the Flag was recited and in the absence of Reveredd Carl Erickson of the Brentwood Orthodox Presbyterian Church, no Invocation was given. Present: Absent: Councilmen Patrick E. Ahem, Frank J. Bertuce-[li, William A. Borba, F. Frank Mamminl and Warren Steinkamp None Mayor Borba asked if there was a n~3tlon approving the Minutes of the regular meeting of October 4, 1971 and the regular meeting of October 18, 1971. Councilman STelnkamp moved, seconded by Councilman Bertucelli and regularly carried, that the Minutes of the regular meeting of October 4, 1971 and the regular meeting of October 18, 1971, be approved as submitted, Mayor Borba asked if there was a motion approving the regular claims as submitted for payment. Councilman Bertucelli moved, seconded by Councilman Ahern and regularly carried, that the regular claims, totaling $84,577.31, be approved for payment. In addition to the approval~ the regular claims, the claim of L. C. Smith in the amount of $2,000 which was a refund of a Trust Deposit retained to assure completion of certain pavement repairs on Westborough Boulevard was brought to the attention of the City Council. Councilman Steinkamp moved that the claim be denied, Discussion followed during which time City Attorney Noonan remarked that he understood the basis for Councilman Steinkamp's motion but that the claim of $2,000 was not in- cluded in the monies which were being held as a penalty for delays in the completion of the work. Director of Public Works Goss explained that certain patching work was necesary, that the $2,000 was retained until such time as the work had.been completed to the satisfaction of the Superintendent of Public Works, the work had been performed, was acceptable and these monies were due and owing to L. C. Smith Company. Councilman Steinkamp remarked that since the completion of Westborough Boulevard was delayed for over one year and that the delays were inexcusable, he had an automatic feeling concerning this matter. He then wlthdrew his original motion, moving that the claim of L. C. Smith be honored and paid. Councilman Bertucelli seconded the motion which was regularly carried. Mayor Borba asked if there was a motion approving the claims as submitted for Parking District No. I for payment. Councilman Ahern moved, seconded by Councilman Mammini and reaularly carried, that the claims as submitted for Parking District No. I, totaling $651.36, be approved for payment. City Attorney Noonan remarked that the first and second resolutions were both related but that it would be in order to introduce them individually. Mayor Borba then asked if Mr. Reynaldo Belmonte and Mr. Atiliai Malepeai were present. heir presence being acknowledged, Mayor Borba requested that they come forward to the podium. City Attorney Noonan explained the resolutions after which Councilman Steinkamp intro- duced the resolution entitled: "A RESOLUTION COMMENBING REYNALDO BELMONTE." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Frank J. Bertucelli, William A. Borba, F. Frank Mammini and Warren Steinkamp. Noes, none. Absent, none. Councilman Bertucelli Introduced the second resolution entitled: "A RESOLUTION COMMENDING ATILIAI MALEPEAI." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Frank J. Bertucelli, William A. Borba. F. Frank Mammini and Warren Steinkamp. Noes, none. Absent, none. Mayor Borba at this time presented to both Mr. Belmonte and Mr. Malepeai a framed copy of the resolutions which had just been introduced and adopted as well as the Mayor's Citizen Award to each, commending them for their quick action in saving the life of the:c~ild. RESOLUTION NO. 5709 AUTHORIZING CANCELLATION OF TAXES ~ KIESSLING PROPERTY: RESOLUTION NO. 5710 AUTHOR 1Z I NG AMENDMENT OF AGREEMENT - WEST PARK 3B COMMO!~.; GREENS: RESOLUTION NO. 5711 AWARD OF CONTRACT ATOMIC ABSORPTION SPECTROPHOTOMETER 1971: RESOLUTION NO. 5712 REGARDING INSURANCE OR INDEMNITY PURSUANT TO RESO. 5045: ORDINANCE NO. 624 DECLARING PRIMA FACIE SPEED LIMIT FOR MEMORIAL DRIVE AND TENNIS DRIVE: 2nd Reading/Adoption CLAIM AGAINST THE CITY AS FILED BY LEONARD E. CHASE, ESQ. ON BEHALF OF MARK JOHNSON: MILLER AVENUE EXTENSION ESTIMATE OF COST: After an explanation by City Attorney Noonan, Councilman Mammini introduced the reso- lution entitled: "A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO CONSENT TO CANCELLATION OF TAXES ON PROPERTY ACQUIRED FOR PUBLIC USE AND REQUESTING THE BOARD OF SUPERVISORS TO AUTHORIZE CANCELLATION OF COUNTY TAXES AND THE DISTRICT ATTORNEY TO CONSENT THERETO (KIESSLING PARCEL)." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahem, Frank J. Bertucelli, William A. Borba, F. Frank Mammini and Warren Steinkamp. Noes, none. Absent, none. City Attorney Noonan explained the next resolution after which Councilman Steinkamp introduced the resolution entitled: "A RESOLUTION AUTHORIZING AMENDMENT OF AGREEMENT ENTITLED, 'AGREEMENT - SUBDIVISION IMPROVEMENTS AND COMMON GREENS, WESTBOROUGH-WEST PARK UNIT 3B.'" Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Frank J. Bertucelli, William A. Borba, F. Frank Mammini and Warren STeinkamp. Noes, none. Absent, none. The next item for Council's attention was the compilation of bids for theAtomic Absorption Spectrophotometer. At the request of Mayor Borba, Director of Public Works Goss explained the piece of equipment which was being purchased by the City and the work which it was to do in examination of wa~e matter taken at the sewage treatment plant. At the request of the Director of Public Works, Superintendent of Sanitation John Collins in detail explained what the instrument would do, the analyses it was to make; and that it was at the request of the Water Pollution Control Board that the testings immediately take place. Discussion then followed concerning the recommendations by the Director of Public Works and the Superintendent of Sanitation in the acceptance of the higher bid which was explained by both who stated that one bid was not properly submitted in that the tax was not included. It was the suggestion of Councilman Steinkamp that inasumch as the Water Quality Control Board requested equipment and testing of waters, they should in some way contribute to the cost of the equipment. In answer to Mr. Donald Grimes, the Superintendent of Sanitation further explained the equipment and the work which was to be done. Councilman Ahem introduced the resolution entitled: "A RESOLUTION OF AWARD OF CONTRACT ATOMIC ABSORPTION SPECTROPHOTOMETER - 1971." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahem, Frank J. Bertucelli, William A, Borba and F, Frank Mammini. Noes, Councilman Warren Steinkamp. Absent, none. City Attorney Noonan briefly'explained the purpose of the ~ext resolution and its assurance to the bond holders in the event the pipes were damaged, the City would make the necessary repairs. Councilman Bertucelli introduced the resolution entitled: "A RESOLUTION REGARDING INSURAN~ OR INDEMNITY PURSUANT TO RESOLUTION 5045 PASSED FEBRUARY 17, Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, Frank J, Bertucelli, William A. Borba and F. Frank Mammini, Warren STeinkamp. Noes, none. Absent, none. Mayor Borba ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding pro- cedure for adoption and passage. Councilman Steinkamp moved reading of the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Bertucelli and passed by unanimous vote. Councilman Bertucelli moved that the ordinance entitled: "AN ORDINANCE DECLARING A PRIMA FACIE SPEED LIMIT FOR MEMORIAL DRIVE AND TENNIS DRIVE," the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Ahern and passed by the following roll call vote. Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahem, Frank J. Bertucelli, William A. Borba, F. Frank Mammini and Warren Stelnkamp. Noes, none. Absent, none. The next matter was the claim against the City as flied by Leonard E. Chase, Attorney at Law, on behalf of Mark Johnson alleging personal injuries and property damage as a result of graveling, non=posting of street work on Hemlock Avenue. Councilman Bertucelli moved, seconded by Councilman Mammlni and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Section 913915.4 and related sections of the Government Code. The next matter was the Report from the Director of Pubilc Works concerning the matter of the Miller Avenue Extension. Director of Public Works Goss at this time read from his Inter-Office Memoranda which he had submitted to Council concerning the subject matter after which Mrs. Maryann Cronin, 1033 Sunnyside Drive, commented on the school children who presently used other means of arriving at the schools. She stated that it would ~ot~be.'a~' inconvenience to them to continue in the present manner, suggesting that Miller Avenue, if improved~ be made in the form of a mall. She commented on the increased traffic which would be present if Miller Avenue were to be improved. MILLER AVENUE EXTENSION ESTIMATE OF COST: (CONTINUED) PHASE Il OF WESTBOROUGH PARK DEVELOPMENT: Mrs. iEsbe Mert. l~l, of WiI'I, oW Avenue, remarked on the trespass over ?heir property by s,uden?s at?ending Parkway School, commenting on ?he ma?*er of rezoning which was men, loned by Councilman Mammini at a previous Study meeting. Discussion followed between Mrs. Mertlnl and Councilman Mammini concerning the interpre- tation of these statements after which Councilman Mammini read from ~he Memorandum of July 27, 1971 concerning the subject ma?,er. Further discussion followed a? which time, a? ?he request of Council, City Planner Pass explained the development of *he property and rezoning which could take place if Miller Avenue were extended. Men?ion was made ?hat ?he property owners in the area were willing ?o offer ?he land for ?his development but wl?h no cos? in its improvement ?o be borne by ?hem. Counci;Iman Mammini commented ?ha? Council a? one of ?heir previous meetings took action on ?he improvement of An*oine?te Lane and that, in this regard, the property owners were not only giving land but also participating in ?he assessment dis?tic? and ?hat Miller Avenue should be ?rea?ed in ?he same fashion. Further discussion followed after which there being no objections, Mayor Borba requested ?he ma?,er be continued ?o a Study session of Council. The next item was the Report from the Director, Parks and Recreation, regarding Phase'Il of Wes?borough Park. City Manager Dreisbach informed Council that there was no s?a?us change from the previous meeting in ?his matter; that the City was still awaitlng word from HUD, and that this information should be forthcoming within ?he next two weeks at?er which Council could proceed if ?hey so desired. Councilman Ber?ucelli then moved *hat *he matter be continued un?il ?he City heard from the HUD representatives. Councilman Mammini remarked ?hat regardless of whether or not the City Council passed on the mat*er tonight or wait for eno*her two weeks, a decision should be arrived a? within two weeks. Councilman Ahern, in seconding Councilman Bertucelli's motion, stated that the City Manager should be given the opportunity to look at the whole problem. Councilman Mammini replied ?ha? ?he City should keep its promise ?o ?he residents of Westborough in this regard. Further discussion followed et which time Mr. David Friedenberg, 2395 Bourbon Court, requested that Mr. David Mayes be allowed to proceed with the preparation of the necessary plans which Involved only a few thousand dollars at the most. Further discussion then followed among Members of the City Council and Mr. Friedenberg who again requested ?hat Council proceed with ?he prepare?ion of ?he plans, stating he saw no reason for *he delay. Mr. Donald Gamma, 3790 Cork Place, brought to the attention of the City Council the number of families who reslde in the Westborough area who were concerned regarding the development of parks and to whom questionnaires were sent requesting what they felt was of importance in their area, stating ?hat uppermost was the development of the parks. Mr. Thomas Fee, 2501 Donegal Avenue, stated ?hat the development of parks was long delayed, that children in ?he area were being denied the use of such park sites, that children had already had outgrown thelr use by the delay. Mrs. Ruth Sack, 2248 Shannon Drive, remarked that it was necessary to drive children back and forth to other facilities since they had no place to go for park purposes. Mr. Robert Albright, 2501Albright Way, stated that the residents in the area wanted a park and everything that went with it, requesting approval of the plans this evening so that the Recreation Department could proceed without further delay. Councilman Mammlni remarked that a motion was on the floor to continue the matter for two weeks, requesting Councilman Bertucelli to consider an amendment to his motion that, if at the end of two weeks, the Clty had not heard from HUD, the City proceed with the preparation of ?he plans and drawings. Mr. David Friedenberg commented that the residents on the south side of Westborough also favored the development of the park on the north side first. Mr. Wesley Slade, 2555 Donegal Avenue, Preslden? of the Westborough Homeowners' Improvemen Association, remarked that the residents on the south side of Wes?borough did not object to crossing Westborough Boulevard for park purposes and that they would favor the develop- ment on the north side first. Councilman Mammini again asked Councilman Bertucelli to consider the amendment to which he replied that he would like to follow the City Manager's recommendation and wait two weeks until word had been received from HUD. Councilman Steinkamp then moved that the motion be amended to include that, if within two weeks a reply had not been received concerning funding for the development of this park, the City then authorize monies be spent for the preparation of plans for ?he development of the park. Councilman Mammini seconded the motion. The amendment to the motion was regularly carried. PHASE II OF WESTBOROUGH PARK DEVELOPMENT: (CONTINUED) ITEMS FROM STAFF: DISCUSSION CONCERNING TRAFFIC CONDITIONS AT INTERSECTION OF KING DR. & JUNIPERO SERRA BLVD. PETITION SUBMISSION: RECESS STATEMENT: APPEAL FOR ASSISTANCE FOR COLLUM FAMILY: COMMENTS CONCERNING TRAFFIC HAZARD AT BAY- SHORE FREEWAY ENTRANCE: INFORMATION REQUESTED RE: SO. AIRPORT BLVD. WIDENING & WESTBOROUGH EXPRESSWAY: DISCUSSION CONCERNING DEPOSIT OF NON-RETURNABLE BOTTLES AND CANS: Discussion then followed concerning the original motion as made at which time City Attorney Noonan stated that Council's action by their voting on the amendment had been taken, but they could take a confirming vote to clear the record on the principal motion as amended. Motion as made by Councilman Bertucelli and seconded by Councilman Ahern was regularly carried. There being nothing further, Council then proceeded on to Items from Staff. City Manager Dreisbach brought to the attention of the City Council the matter of the proposed traffic signal at King Drive and Junipero Serra Boulevard, explaining in detail its improvement through the TOPICS program. He further explained to the City Council and those present in the audience the temporary measures which were being taken and had already been taken by the City at this intersection to correct the traffic hazards which existed. He suggested to Council that, if they wished, they could entertain a motion that the City approve the plans and specifications and authorize the calling ferbids for the work pending the approval of the State and Federal concerning funds which would then allow the City to move more quickly in this work. Councilman Bertucetli so moved, seconded by Councilman Mammini. Discussion followed at which time Miss Linda Kelley, 342 Arbor Drive, read from the petition which she had circulated or caused to have circulated and which contained 473 signatures requesting im~dlate action. She further commented on the traffic hazards which existed and continue to exist after which she requested Council that Mr. Homer Hale be permitted to speak in this regard. The petition was then presented to Council. Mr. Homer Hale, 381 Arroyo Drlve, stated that he was speaking as President of the Country Club Homeowners' Association who, at their last meeting, had instructed him to forward a letter to the Clty Council concerning this matter which he read in full, requesting that the City Council install signals at once, pointing out the dangers which existed because of hot-rod drag racing and increased speed by vehicles. Further discussion followed concerning the matter after which Mr. Preston Kelley, 342 Arbor Drive, requested information concerning the TOPICS program which was explained by the Director of Public Works and its function in providing necessary funds for such work. After discussion, the motion as made and seconded was regularly carried. Before proceeding ~o Good and Welfare, Mayor Borba remarked that at the conclusion of this evening,s meetlng, Council would recess to a Study Session for the selection of an architect after which the meeting would stand adjourned to Wednesday, November 3, 1971 at 7:30 p.m. Councilman Bertucelli brought to the attention of those present the plight of the Collum family in their need for adequate housing since they would have to move soon from their present location, stating that the City and the residents should do all they could to assist this family. He appealed to the civic groups to do what they could!to lend their assistance in this regard. He stated any information should be forwarded to Miss Lynette Bielanski, 456 Peninsula Avenue, San Mateo, telephone number: 347-767I. Mayor Borba remarked that a golf tournament, sponsored by the Chamber of Commerce, was to be held, proceeds from which would be given to the Collum family. Councilman Steinkamp brought to the attention of the City Council the traffic problem which he had encountered this afternoon on the Bayshore Freeway to the most northerly entrance to the City, stating that traffic was backed up at the stop sign on the Freeway, presenting a very hazardous condition. He suggested that some corrective measures be taken in this regard. City Manager Dreisbach was instructed to investigate and report to Council. Councilman Stelnkamp then requested information concerning the completion of South Airport Boulevard Widening and Westborough Expressway. Director of Public Works Goss stated that the contracts were proceeding on time and that both should be completed by the end of November. Councilman Stelnkamp then brought to the attention of the City Council that the catch basins on the Westborough Expressway were full of debris and that they shoald be cleaned out prior to the coming winter rains; further, that one of the catch basins on Junipero Serra Boulevard presented a problem In that the gra~ing was level with it and that dirt could enter the catch basins causing some problems. Director of Public Works Goss was requested to investigate and report to Council. Councilman Mammini then mentioned that the islands on South Airport Boulevard had been completely paved and that it was his understanding that some landscaping was to have been done. The Director of Public Works was requested to check and advise in this regard. Mr. Kenneth Bishop, 536 Yosemite Drive, speaking as Chairman of the Ecology Class in the South San Francisco High School and Sierra Club, remarked on the legislation which Council had initiated some time previously concerning the banning of non-returnable bottles and cans, the legislation which had since rescinded this action. He stated that Community Pride, to which location these non-returnables would be deposited, was no longer in existence, asking City Council what they should do with these non-returnable bottles and cans. ON OFFER OF HELP TO CALLUM FAMILY BY FIRE FIGHTERS' UN 0N , o7: REQUEST FOR STUDY MEETING IN SUNSHINE GARDENS SUBDIVISION: STATEMENT CONCERNING ATTENDANCE AT WESTBO- ROUGH PARK: ,~ INQUIRY CONCERNING STANDING IN COUNCIL CHAMBERS : S l STATEMENT RECYCLING: SUGGESTION FOR LOCATION OF HOUSING FOR COLLUM FAMILY: DISCUSSION CONCERNING CROSS CONNECTIONS FOR SEWAGE: COMMENT CONCERN I NG TRUCKS' PARKING ON A I RPORT BLVD.: RECESS: ADJOURNMENT: It was suggested by Councilman Bertucelli that they be placed by their garbage cans for pickup by the Scavenger Company. Mr. Carl Hill, representing the Fire Fighters' Union 1507, stated that the men of his local were concerned with the Collum family, reading a letter which had been addressed to them and that they would offer their services of manpower to paint and clean any residence which could be found for this family. Mr. Tony Montoya, 1125 Miller Avenue, speaking on the matter of the Miller Avenue Extension, requested that a Study meeting be conducted in the Sunshine Gardens Sub- division, stating that, if he were advised as to when it was to take place, he would see that adequate hall facilities would be made available. Mr. Steven Tonegato, 404 Wildwood Drive, explained the reasons why the Westborough Park was not in full attendance on Sunday -due:~to no organized programs being available on that day, but that the parks were widely used during the week. Mr. Tonegato requested information as to why standing was not allowed in the Council Chambers thls evening to which Mayor Borba replied that this was a requirement by law. Mayor Borba, in answer to Mr. Tonegato, explained the facilities which were available to receive bottles and cans for recycling within the City. Mr. Tonegato suggested that, If at all possible, the location of housing for the Cullum family be near a park so that the youngsters might have these facilities readily available. Mr. David Friedenberg then requested Information of the Director of Public Works as to the number of cross connections for sewage which existed within the City. Director of Public Works Goss stated the major portion of sewage goes through the pump statlon but that due to the heavy rains, some of the sewage does flow into Colma Cree~ In answer to Mr. Friedenberg, as to whether or not these by passes have alarm systems installed, Director of Public Works Goss r~eplied that they did not but that they were checked daily by the City Staff. Mr. Donald Grimes, 123 Francisco Drive, broughti'~ot'the attention of the City Council that large trucks were parking on Airport Boulevard, blocking traffic and creating a traffic hazard to which City Manager Dreisbach replied that this matter had already come to the attentlon of the City and that it had already been taken care of. Mr. Grimes then commenting on the matter of sewage overflow on Westborough Boulevard, asked if the Health Department had been contacted to which the Director of Public Works replied that they had been contacted.
