LIC. 1st Reading/ Int roduct ion 8:00 p.m. Council Chambers, City Hall The meeting was called to order by Mayor Warren Steinkamp at 8:01 p.m. The Pledge of Allegiance to the Flag was recited after which the Invocation was given by Reverend David Miller of the Hillside Church of ~od. Present: Absent: Councilmen Patrick E. Ahern, William A. Borba,F. Frank Mammini, Terry J. Mirri and Warren Steinkamp None Mayor Steinkamp asked if there was a motion approving the regular meeting o~July 16, 1973; adjourned regular meeting of July 23, 1973; adjourned regular meeting of July 24, 1973; and adjourned regular meeting of July 30, 1973. Councilman Borba moved, seconded by Councilman Ahern and regularly carried, that the Minutes of the regular meeting of July 16, 1973; adjourned regular meeting of July 23, 1973; ad,iourned regular meeting of July 24, 1973; and adjourned regular meeting of July 30, 1973 be approved as submitted. Mayor Steinkamp asked if there was a motion approving the regular bills of August 6, 1973. Councilman Ahern moved~.seconded by Councilman Mirri and regularly carried, that the regular bills of August 6, t973 be approved as submitted. City Attorney Noonan explained the first resolution after which Councilman Ahern introduced the resolution entitled: "A RESOLUTION IN SUPPORT OF THE SPEEDY COMPLETION OF THE PAVEMENT OF A TWO THOUSAND FIVE HUNDRED FOOT EASTWARD EXTENSION OF RUNWAY 28-RIGHT AT THE SAN FRANCISCO INTERNATIONAL AIRPORT." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, William A. Borba, F. Frank Mammini, Terry J. Mirri and Warren Steinkamp. Noes, none. Absent, none. The next resolution for Council's consideration was entitled: "A RESOLUTION ACCEPTING AN EASEMENT DEED FROM THE COUNTY OF SAN MATEO FOR SANITARY SEWER PUPOSES." There being no objections, and at the request of Acting City Manager Edward Alario and Acting Director of Department of Ecological Develop- ment Michael Wilson, the resolution was continued. After an explanation by City Attorney Noonan, Councilman Ahern intro- duced the resolution entitled: "A RESOLUTION REGARDING COMPENSATION OF HOUSING AUTHORITY COMMISSIONERS." Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, William A. Borba, F. Frank Mammini, Terry. J. Mi#ri and Warren SteinkamD. Noes, none. Absent, none. Mayor Steinkamp ordered the title of the ordinance read. The title of the ordinance was read. ORD. AMENDING 261 - BUS. LIC. (CONTINUED) ,..:/U, City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for introduction. Councilman Borba moved that reading of the ordinance in its entirety be waived and that the ordinance be introduced and read for the first time by reading title only, seconded by Councilman Mirri and passed by a unanimous vote. Councilman Mammini moved that the ordinance entitled: "AN ORDINANCE AMENDING ORDINANCE NO. 261 ENTITLED-"AN ORDINANCE PROVIDING FOR LICENSING OF BUSINESS, PROFESSIONS, TRADES, CALLINGS AND OCCUPATIONS IN THE CITY OF SOUTH SAN FRANCISCO, AS AMENDED," the entire reading of which has been duly waived, be introduced, seconded by Councilman Ahern and passed by the following roll call vote. Roll call vote was as follows: Ayes, Councilmen Patrick E. Ahern, William A. Borba, F. Frank Mammini, Terry J. Mirri and Warren Steinkamp. Noes, none. Absent, none. CLAIM AGAINST CITY AS FILED BY KETCHUM & KETCHUM ON BEHALF OF LEAH ANDERSON: The next item was the claim against the City as filed by the law office of K~tchum & Ketchum on behalf of Leah Anderson for alleged personal injuries suffered in Brisbane. In answer to Council's inquiry as to why a claim would have been filed against the City for an incident which allegedly happened in the City of Brisbane, City Attorney Noonan stated that it might have been through Mutual Aid and that this was being checked. Councilman Mammini moved, seconded by C~uncilman Ahern and regularly carried, that the claim be rejected and referred to the City's in- surance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with C~vernment Code Sections 913, 915.4 and other related sections of the Government Code. CLAIM AS FILED BY KET6HUM & KETCHUM ON BE- HALF OF PETER ANDERSON: The next matter was the claim as filed by the law firm of Ketchum & Ketchum on behalf of Peter Anderson for alleged personal injuries sustained in Brisbane. Councilman Ahern moved, seconded by Councilman Mammini and regularly carried, that the claim be rejected and referred to theCity's in- surance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with C~vernment Code Sections 913, 915.4 and other related sections of the Government Code. CLAIM AS FILED BY KAREN BAKKEN: The claim against the City as filed by Karen Bakken for alleged per- sonal injuries sustained as a result of fall on the sidewalk was the next matter for Council's consideration. Councilman Ahern moved, seconded by Councilman Borba and regularly carried, that~ the claim be rejected and referred to the City's in- surance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. CLAIM AS FILED BY VAL BALBI: The next item was the claim against the City as filed bv Val Balbi for alleged damages as a result of collision with City-owned vehicle. Councilman Mammini moved, seconded by Councilman Ahem and regularly carried, that the claim be rejected an.d referred to the City's in- surance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. CLAIM AS FILED The next item was the claim as filed by Mrs. T. Mathiesen on behalf BY MRS. MATHIESEN of her son, Gary Mathiesen, for alleged personal injuries sustained ON BEHALF OF SON: at Municipal Swimming Pool, Councilman Ahern moved, seconded by Councilman Mammini and regularly carried, that the claim be rejected and referred to the City's in- surance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with C~vernment Code Sections 913, 915.4 and other related sections of the Government Code. -2- 8/6/73 CLAIM AS FILED BY The next item was the claim as filed by California State Automobile CALIF. STATE AUTO-Association on behalf of their insured, June D. Beauchamp, for MOBILE ASSN. ON BEHALF OF INSURED BEAUCHAMP, JUNE alleged damages as a result of collision with City-owned vehicle. Councilman Mammini moved, seconded by Councilman Ahern and regularly carried, the the claim be rejected and referred to the City's in- surance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with C~vernment Code Sections 913, 915.4 and other related sections of the C~vernment Code. INI'~<ODUCi-ION OF GOVERNMENT CLASS AND INVITATION TO HEAR CONGRESS- MAN RYAN SPEAK: .5i53 Mayor Steinkamp at this time announced that there was a Government Class attending tonight's meeting and, at this time, introduced Mrs. Rogers, their teacher. Mrs. Rogers stated that there were two Government Classes at South San Francisco High School and extended an invitation to the members of the City Council and public to attend and hear Congressman Ryan speak at the High School at 8:45 a.m. the following day. ACCEPTANCE FOR The next matter was the Inter-Office Memorandum dated July 26, 1973 MAINTENANCE OF from Acting Director, Parks & Recreation, recommending acceptance WEST PARK COMMON for maintenance of West Park Common Greens 3-B and 3C; El Camino GREENS 3-B & 3C; Beautification Phase II, Braewood Unit~ Stonegate Ridge I Phase II EL CAMINO BEAUTI- FICATION PHASE II Brief discussion followed at which time Mr. Pinelli and Mr. Fee spoke BRAEWOOD UNIT I, concerning the matter of the Common Greens in Stonegate Ridge after STONEGATE RIDGE I which Councilman Mammini moved, seconded bv Councilman Ahern and PHASE II: FEUD^LE k~QUEST FOR HEARING ON REZON I NG APPEAL: regularly carried, that the recomme.~nd~tion of the Acting Director, Parks & Recreation, be approved and accepted. The next item was the letter dated July 9, 1973 from Mr. Victor Feudale requesting a hearing time for rezoning appeal on property located on Spruce Avenue. Brief discussion followed concerning the date for the Public Hearing after which, there being no objections, the Hearing was set for September 17, 1973. ITEMS FROM STAFF:~ DISCUSSION RE APPOINTMENT TO COLMA CREEK COMMITTEE: .50 APPOINTMENT OF COUNCILMAN MAMMINI TO COMMITTEE: J.5 O l o Acting City Manager Edward Alario at this time brought up the matter of the appointment of City Attorney Noonan by the City Council to the Co lma Creek Committee which had not been accepted by the County Board of Supervisors who, in place of the City Attorney, appointed Councilman Mammini. He stated that there would be the need for a motion authorizing the appointment of Councilman Mammini to this committee. Mayor Steinkamp stated that there would be no need for a motion, so ordering the appointment of Councilman Mammini. Discussion followed concerning this matter after which Mayor Steinkamp requested that Mr. Alario forward a letter to the County Board of Supervisors expressing the Council's feeling in this regard. Further discussion followed concerning both the City Attorney and Councilman Mammini serving on this committee for the City. Acting City Manager Alarb~ext brought up the matter of the paving work performed on Capay Circle. APPROPRIATION FOR WORK ON CAPAY CIRCLE: Acting Director of the Department of Ecological Development Stoppoloni stated that Piombo Construction Com0any, the contractor, was going to return to remove all the bad paving. He also stated that in order to do a better job, recommended the approoriation of $1,500 by the City to burm and remove the asphalt at the curb line which was not included in the original work. Brief discussion followed at which time Acting City Manager Alario requested a motion appropriating this amount from the unappropriated reserve account. -3- 8/6/73 CAPAY CIRCLE (CONT_LLq?En) ~ REQUEST FOR EXECUTIVE PER- SONNEL SESSION: DISCUSSION RE BUS SERVICE TO RECREATIONAL ACTIVITIES: Councilman Ahern moved, seconded by Counci man Borba and regularly carried, that the amount of $1,500 be transferred to the proper account. BefOre proceeding to Items from Council, Actin9 City Manager Alario requested an Executive Personnel Session at the conclusion of this evening's meeting. The next item was the Inter-Office Memorandum dated July 18, 1973 from Acting Director, Parks and Recreation, concerning the request for bus service from the West Park Homeowners Association. Accompanying was the Inter-Office Memorandum from Parks and Recreation Commission dated July 29, 1973, same subject. Acting City Manager Alario read the recommendation of the Parks and Recreation Commission after which a lengthy discussion followed among the Members of the City Council, Staff and the following who spoke: Mrs. Ruth Fee, 2501 Donegal Avenue. RECESS:_.. Mayor Steinkamp declared a recess at 9:00 p.m. for the retaping of TV cameras. RECALL TO ORDER: The meeting was recalled to order by Mayor Steinkamp at 9:06 p.m., with ...... all Council present. Further discussion followed. Speaking on the subject was Mr. Thomas Fee, 2501 Donegal AVenue, Mrs. Antoinette Fraschieri, 478 Avalon Drive, Mr. Nick Manue~ 144 Dundee Drive, and Mrs. Roberta Teglia. Councilman Ahern then moved that Council go on record and a letter be forwarded to the Public Utility Commission that they help the process of the Northgate Transit applicatbn as soon as possible, the City being in ne~d of transportsflon and we would like to see that application facilitated. Councilman Borba seconded the motion which was regularly carried. Further discussion followed after which Councilman Borba then moved, seconded by Councilman Miiri to support the $1,300 for the four weeks of transportation. Roll call vote was as follows: Ayes, Councilmen William A. Borba and Terry J. Mirri. Noes, Councilmen Patrick E. Ahern, F. Frank Mammini and Warren Stelnkamp. Councilman Mammini stated he voted "No't because it did not serve all segments of the City. Councilman Mammini then suggested a Staff study on transportation for next year to take care of the City as a whole, utilizing school buses and working jointly with the school to provide transportation and use of school recreational facilities as well. Councilman Mammini then moved that the City instruct Staff to do an immediate study on this. Councilman Ahen seconded the motion Which was regularly carried. RECESS:- Mayor Steinkamp then recessed the meeting at 10:06 p.m., for TV retaping. RECALL TO ORDER; The meeting was recalled to order at 10:12 p.m., with all Council members present. GOOD AND WELFARE: Tl~re being nothing further.from Council, Mayor Steinkamp asked if anyone in the audience had anything they wished to offer under C~od and Welfare. DISCUSSION RE LESKO PROPERTY DRA I NAGE: Mrs. Inez Lesko, 211 Orange AVenue, stated that she had discussed her drainage problems recently with Mr. Bennett, the Environmental Analyst employed by the Government. She again asked as to what remedial steps the City was going to take. -4- 8/6/73 DISCUSSION RE LESKO PROPERTY DRAINAGE: (CON~!NUED)~ REQUEST FOR BREAKDOWN OF LUNCHEON BILLS & VTN SERVICES: DISCUSSION RE REZONING IN AREA - REAR OF WINSTON MANOR 2: BREAKDOWN VTN BILLS: REMARK RE APPT, TO OOLMA CREEK OOMMITTEE: COMMENT RE LESKO PROPERTY: RECESS TO EXECUTIVE PER- SONNEL SESSION: RECALL TO ORDER: ADJOURNMENT: Mrs. Lesko was informed that this item was part of the Capital Improvement Budget but that the Budget or items had not been discussed or adopted as yet. Mr. Robert Polzoni, President of the Citizens for Responsible Govern- ment, read a resolution recently adopted by this organization, re- questing the City to furnish a breakdown on luncheon bills and bills for the services of VTN. Mr. Richard Heath, 134 Dundee Drive, Winston Manor No.2 Association, brought to Council's attention an area to the rear of their subdivision in the City of Daly City for which a rezoning was being sought. He requested City's support that the development in the area be to the best environment of the City Discussion followed after which Acting City Manager Alario stated a meeting could be arranged with Mr. Heath and the City's Acting City Planner in this regard. Mr. Tom Frank, 333 Alta Loma Drive, spoke on the resolution adopted by the Citizens for Responsible Government of which he is a member, reading the resolution to Council as it concerned the breakdown for luncheon bills and VTN bills. Mr. Theodore Pretzer, 254 Grand Avenue, complimented Council on their stand regarding the appointment to the Colma Creek Committee and their reaction to the County Board of Supervisors' action in this regard. Mr. Thomas Fee remarked on Mrs. Lesko's earlier discussion on drainage problems, supporting her in her plea. City Attorney Noonan briefly commented on Mrs. LeSko's problem and the position of the City in this regard. He stated he would contact Mr. Bennett and report back. There being no one else to speak under Good and Welfare, Mayor Steinkamp recessed the meeting to an Executive Personnel Session at 11:02 p.m. The meeting was recalled to order by Mayor Steinkamp at 11:48 p.m., with all Council Members present. Mayor Steinkamp stated that during the Executive Personnel Session, the matter of labor negotiations and other items were discussed.
