Mayor Mirri called the meeting to order at 8:10 PM. El Camino High School (Little Theatre). Pledge of Allegiance to Flag recited. Present: Councilmen Richard A. Battaglia, F. Frank Mammini, Terry J. Mirri, Leo Padreddii, and Warren Steinkamp. Absent: None. Mayor Mirri asked if there was a motion approving the Minutes of the Regular Meeting of April I, 1974; the Regular Meeting of April 15, 1974; and the S~ecial Meeting of April 19, 1974. Councilman Battaglia requested the Minutes of the Regular Meeting of April 15, 1974 under the public hearing on the appeal of the use permit regarding the Drug King Sign be corrected. The motion made by Councilman Mammini reflected the second as having been made by former Councilman Borba. Councilman Steinkamp then moved, seconded by Councilman Mammini and regularly carried that the Minutes of the Regular Meeting of Monday, April I, 1974, the Regular Meeting of Monday, April 15, 1974 as corrected, and the Special Meeting of April 19, 1974 be approved. The motion on the Minutes of April 15, 1974 have been corrected to show "Councilman Mammini then moved, seconded by Councilman Battaglia and regularly carried that the letters be filed and the matter referred back to the Planning Commission." Mayor Mirri then asked if there was a motion approving the regular bills of May 6, 1974. Councilman Steinkamp moved, seconded by Councilman Mammini and regularly carried, that the regular bills of April 15, 1974, be approved for payment. PUBLIC HEARING: GRUBB & ELLIS PROPOSED CONDOMINIUM CONVERSION - SUB- DIVISION APP. #29 SUBDIVISION APPLICATION NO. 29 - GRUBB AND ELLIS PROPOSED CONDOMINIUM CONVERSION (CONTINUED FROM APRIL 15, 1974). Staff Report, dated May 6, 1974, submitting background information on the Grubb and Ellis proposed condominium conversion with recommendation that the appeal to SA-29 be denied. Letter, dated April 19, 1974, from the law offices of Davis, Craig and Bartalini - Petition for Exception of Condominium Moratorium, Ordinance No. 663. Notice of Hearing: Petition for relief from the provisions of Ordinance No. 663, an interim ordinance suspending condominium conversions -- Grubb and Ellis Development, Westborough 4A. Director of Public Services, Frank Addiego, read his staff report after which he commented that the matter before Council was only a tentative ma0 and that Council would have to later approve the final map. Brief discussion followed after which Mayor Mirri asked if Mr. Donald Gamma, who appealed the decision of the Planning Commission, or his representative was present in the audience. No response was received. Mayor Mirri then asked if anyone present in the audience wished to register an objection. No objections were registered. Councilman Mammini then moved that the appeal be denied and that we proceed on the basis of continuing along the conversion. Further discussion followed by the members of the City Council, City staff, Mr. McEIroy of Grubb and Ellis, and Mr. Fernando Teglia of 378 Altamont Drive, concerning the matter after which Councilman Steinkamp seconded the motion which was regularly carried. Councilman Battaglia voted no. City Attorney Noonan stated that this item was divided into two matters and that action had been taken on the first by the denial of the appeal, that the second was related to it but different. He remarked that the second matter was the petition for relief from Ordinance No. 663 based on Sections A, B, C and D of the ordinance which was subject to granting or denial. Discussion then followed after which the City Attorney stated that he assumed that the feeling of Council was one of granting relief within correspondence with Council's first motion passed on affirmative findings of the sections of the ordinance and based on the conditions set forth in the staff report. Roll Call vote was as follows: Ayes, F. Frank Mammini, Terry J. Mirri, Leo Padreddii, and Warren Steinkamp. Noes, Richard A. Battaglia. Absent, none. USE PERMIT ORDER 269 OF THE SOUTH SAN FRANCISCO PLANNING COMMISSION GRANTING APPLICATION TO ESTABLISH A ROLLER SKATING RINK AT 213 EAST GRAND AVE., SOUTH SAN FRANCISCO. Letter, dated April 4, 1974, received from six industrialists appealing the decision of the Planning Commission. Staff Report, dated May 6, 1974, submitting recommendation that the appeal of UP-269 be denied. Director of Public Services, Frank Addiego, read the staff report commenting that it was the recommendation of staff to approve the request and deny the appeal. Mayor Mirri recessed the meeting at 9:10 PM for the retaping of the television cameras. The meeting was recalled to order by Mayor Mirri at 9:23 PM with all Council present. Lengthy discussions followed at which time the following spoke offering their comments: Mr. Raphael Louis Rosingana, Attorney, representing the industrialists appealing the decision who were concerned with the development of industrial areas rather than commercial areas, reciting sections of the Zoning Ordinance for permitted uses. Further, the pedestrian danger at the railroad c~ossing, the industrialists concern with problems which might arise out of such activity, traffic during the peak hours, and the proposed parking lot which was in the Cabot, Cabot, and Forbes area and subject to covenants and restrictions. Discussion followed during which time Mr. Rosingana read the memorandum from the Police Department concerning the requested use. Further discussion followed concerning parking and the number of parking stalls. Mr. Louis Poletti, 333 El Camino Real, stated that he was here on behalf of the Park Association and represented not only himself but also Mr. and Mrs. Mazzanti, who ~ere joint property owners in the area. He expressed concern as to the problems which might be created in the area by the attendance of large groups of people. Page 3 5~6~74 41 RECESS:, RECALL TO ORDER: PUBLIC HEARING: USE PERMIT 269 RE ROLLER SKATING RINK (CON'TD.) Mayor Mirri recessed the meeting at 10:20P~4 for the retaping of the television cameras. The meeting was recalled to order by Mayor Mirri at 10:42 PM with all Council present. Mr. Del Vecchio read from a prepared statement giving his background in operating a roller skating rink, the number of signatures on petitions urging the use to be allowed, the traffic which would be generated by the City's Marina expansion, in addition to that which was stated would be generated by his operation and the manner in which the operation would be conducted. Discussion followed concerning the matter of pedestrian traffic as well as vehicular traffic, after which the Council requested of the City Attorney information as to whether or not the use permit could be granted if adequate parking were not possible. It was indicated by the City Attorney that there would be a need to read the covenants and restrictions in this regard. Further discussion followed after which the City Attorney stated that if Council were thinking of approving the matter, he would like to word a motion which would say '~stand granted when the parking areas have been provided which includes proof thereof and then subject to the conditions contained in the staff report and the Police Department's report.'~ Further discussion followed after which the City Attorney suggested that the Council consider studying the matter rather than a motion, but that if Council desired a motion, one could be adopted. Councilman Mammini then moved that the City Attorney be given an opportunity to investigate it. In answer to Councilman Steinkamp's inquiry as to the need for a motion, the City Attorney replied that it might be well to use a motion so that it was definite that it was continued, but that the Chair could order the continuance if it desired. Motion as made was seconded by Councilman Steinkamp and regularly carried. At the request of Councilman Steinkamp, the City Attorney explained that the motion adopted continued the matter for two weeks to permit the staff to review deed covenants and restrictions and make a recommendation regarding the parking. Discussion continued at which time the following persons spoke: Mr. Clinton Murphy, who presented Council with petitions signed by 1,236 adults, 757 students, and 91 others whose status Page 4 5/6/74 PUBLIC HEARING: USE PERMIT 269 RE ROLLER SKATING RINK (CON'TD.) NO. 8!-74 INDENTURE OF LEASE - 409 GRAND AVENUE was unknown, recommending the establishment of a skating r. ink for recreational use by the youngsters. Mr. Eugene Amato, who urged that the use be allowed to provide recreational facilities. Claire D'Amico, who also urged that the use be granted, which would be of benefit to the community. Betty Burney, who stated that this use would not only be for children, but for adults who enjoyed skating as well. Barbara Shovig, who remarked that in contacting some of the industrialists their concern was with regard to traffic. Mayor Mirri recessed the meeting at 11:40 PM for the retaping of the television cameras. ___The meeting was recalled to order by Mayor Mirri at 11:48 PM with all Council present. Council also heard comments from three students who requested that the establishment of a roller skating rink be allowed. There being no further comments, Mayor Mirri declared the public hearing closed after which he stated that the meeting this evening would be adjourned to Monday, May 13, at 7:00 PM, at City Hall, at which time the matter would again come before the City Council. Councilman Padreddii requested that the resolution concerning the Indenture of Lease with Mr. and Mrs. Price be taken up at this time, since the hour was growing late and they were present in the audience. Dick Milkovich, Director of Parks and Recreation, briefly explained the size of the building and cost per square foot, after which Councilman Mammini introduced the resolution entitled: "A RESOLUTION AUTHORIZING EXECUTION OF INDENTURE OF LEASE WITH EMILE PRICE AND HELEN PRICE -- 409 GRAND AVENUE, SOUTH SAN FRANCISCO, CALIFORNIA". City Manager Alario explained the resolution and recommended the award of contract, after which Councilman Battaglia introduced the resolution entitled: ~'A RESOLUTION OF AWARD OF CONTRACT FOR PAINT STRIPEW~. The City Attorney explained the next resolution, after which Councilman Steinkamp introduced the resolution entitled: '~A RESOLUTION ACCEPTING GRANT DEED FROM SUN CHEMICAL CORP. The City Manager explained the resolution, the amounts involved and the agreements between cities, after which Councilman Steinkamp introduced the resolution entitled: "A RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT PROVIDING FOR ADVANCES OF FUNDS AND REPAYMENT THEREFOR CONCERNING THE COLMA CREEK FLOOD CONTROL PROJECT'~. NO. 89-74 REMEQIAL WORK Al OYSTER POINT MARINA LANDFILL The Director of Public Services explained the work and the estimate of cost, after which Councilman Padreddii introduced the resolution entitled: '~A RESOLUTION APPROVING PROPOSED REMEDIAL WORK AT OYSTER POINT MARINA LANDFILL". Councilman Steinkamp moved reading of the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only, seconded by Councilman Mammini and passed by unanimous vote. Councilman Battaglia moved that the ordinance entitled: "AN ORDINANCE CREATING A REVOLVING FUND~ the entire reading of which has been duly waived, be passed and adopted, seconded by Councilman Steinkamp and passed by the following roll call vote. Page 8 5~6~74 91 ITEMS FROM STAFF (CON ' TD. ): OF'POSIIION I0 SENATE BILL NO. 1930 PUBLIC REST AREA AT CITY HALL ITEMS FROM COUNCIL: ANNEXATION OF PONDEROSA SCHOOOL & INSTALLATION OF SIDEWALKS ALONG WESTBOROUGH BLVD. 5161 PEDESTRIAN COUNT CONFERENCE IN TAIPEI 5/53 DOUBLE PARKING ALONG SOUTH LINDEN AVENUE The Assistant Personnel Officer recommended opposition to passage of Senate Bill No. 1930, an amendment to Section 2231 of the Revenue and Taxation Code relating to reimbursement of State mandated local agency and school district costs, after which Councilman Steinkam? moved, seconded by Councilman Battaglia and regularly carried that the recommendation be aoproved and accepted. Director of Parks and Recreation, Dick Milkovich, explained to Council from an architectural rendering the tYOe of construction and the estimate of cost. Discussion followed at which time Councilman Padreddii suggested that the proposal be reviewed with the senior citizens who would be using the facility and obtain their input in this regard. There being no objections, the Director of Parks and Recreation stated he would check with them. There being no further items from staff Mayor Mirri asked if any member of the City Council had an item he wished to submit. Councilman Stei'nkamp inquired as to what steps were being taken to bring into the City the Ponderosa School and also what was being done for the installation of sidewalks along Westborough Boulevard between Orange Avenue and Junipero Serra Boulevard. The City Manager reported that at the present time the City would not benefit by the annexation of the Ponderosa School. As far as the sidewalks along Westborough Boulevard, negotiations could be started with the County. At the present time there was no available space for such an improvement and it would be necessary to ourchase the area. The Director of Public Services stated that he would contact the County in this regard. Councilman Steinkamp likewise requested a pedestrian count in the area. Mayor Mirri at this time brought up the matter of a conference which was to be held in Taipei, Taiwan. He stated that he could not see the benefit to the City and, therefore, could not support a request for attendance. Councilman Padreddii brought to the attention of the City Council complaints which had been received of the double parking of large trucks along South Linden Avenue between Victory Avenue and the railroad crossing creating a traffic hazard. He requested that the Police Department check this matter. Page 9 5/6/74 10 ITEMS FROM COUNCIL -(CON'TD.): T--~'A'F'FIC COUNT AND INSTALLATION OF STOP SIGN IN BRENTWOOD AREA Councilman Battaglia remarked that he met with some of the homeowners in the Brentwood area who brought to his atten- tion the matter of traffic in the area and the narrowness of the street requesting a traffic count and the investiga- tion of the installation of a stop sign at Rosewood and Northwood. The Director of Public Services stated that he was familiar with the area and would investigate. ENCROACHMENT PERMIT REQUESTED BY MR. RAFFIN The City Attorney at this time brought to the attention of the City Council a request from Mr. Raffin, 216 Baden Avenue, for a permit to encroach in the right-of-way. He stated that the City could grant such a permit due to the nature of the request, The Director of Public Services stated that he would check the matter out. COUNCILMAN PADREDDII'SCouncilman Padreddii reported that he would be unable to SUPPORT OF SKATING attend the adjourned meeting of the Council to be held Monday, RINK May 13, at which time the matter of the skating rink would come before the City Council. He stated that he wished to voice his support in favor of the granting of such a permit if they complied with the conditions. GOOD & W£EFARE: There being no one to speak under Good and Welfare, Mayor Mirri adjourned the meeting to Monday, May 13, 1974, at 7:00 PM.. ADJOURNMENT: The meeting was adjourned by Mayor Mirri at 12:50 AM.
