El Camino High School (Little Theatre). Meeting called to order by Mayor Mirri at 8:10 PM. Pledge of Allegiance to Flag recited. Present: Councilmen Richard A. Battaglia, Terry J. Mirri, Leo Padreddii, and Warren Steinkamp. Absent: Councilman F. Frank Mammini. Mayor Mirri asked if there was a motion approving the Minutes of the Regular Meeting of May 20, 1974. Councilman Steinkamp moved, seconded by Councilman Battaglia and regularly carried that the Minutes of the Regular Meeting of May 20, 1974 be approved as submitted. Mayor Mirri then asked if there was a motion approving the regular bills of June 3, 1974. Councilman Steinkamp moved, seconded by Councilman Padreddii and regularly carried, that the regular bills of June 3, 1974 be approved for payment. Proposed rezoning of parcels designated as 10.365 acres MOL SWLY corner of Westborough Boulevard and Oakmont Drive (R-3 to R-I). Mayor Mirri declared the public hearing opened asking if anyone present wished to comment on the matter. Thomas B. Adams, attorney representing Tom Callan, spoke on his behalf requesting a continuance on the matter stating that Mr. Don Lang, an attorney, was also present representing Mr. Mike Callan. Mr. Adams stated that the two brothers were presently negotiating with Reverend Leonard Lee of the Westlake Southern Baptist Church for the sale of the nropert¥. He requested a 60-day continuance in order that the negotiations might be worked out. Mr. Don Lang, representing Mr. Mike Callan, joined in Mr. Adams' motion for a continuance. PUBLIC HEARING: REZONING 10.365 ACRES AT WESTBOROUGH ANI] OAKMONT - CALLAN PROPERTY (CON' TD. RESO. NO. 97-74 CALLING BIDS FOR 1973-74 STREET RESURFACING PROGRAM PROJECT ST-73-2: S-O O RESO. NO. 98-74 AMENDING CLASSiFICA- TION PLAN BY ADDING FINANCE OFFICER/ AUDITOR (U) AND A~IN. SECT. (U): P O00 ORD. RE CONDUCT IN PARKS: 2nd Reading/ Adoption "! Discussion followed during which time the Reverend Lee explained how they proposed to develop the property after which Mr. Frank Addiego, Director of Public Services, explained his staff report and the reasons for the City's recommendation for rezoning. Councilman Padreddii then moved that the continuance of 60 days be granted in order that the Reverend Lee could submit the necessary plans to the City. Discussion followed concerning the need for a motion after which Councilman Padreddii withdrew his motion. Further discussion followed at which ti~ Councilman Steinkam~ stated that he had no objection to a continuance after which there being no further comments Mayor Mirri declared the public hearing closed. Councilman Padreddii then restated his original motion after which Mayor Mirri stated that a motion would not be necessary Councilman Battaglia voiced objection to the continuance. Brief discussion followed after which Mayor Mirri stated that a continuance of 60 days would be granted to the request. Director of Public Services explained the resolution after which Councilman Steinkamp introduced the resolution entitled: ~'A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING THE WORK AND CALLING BIDS FOR 1973-74 STREET RESURFACING PROGRAM - PROJECT ST-73-2." Roll Call vote was as follows: Ayes, Councilmen Richard A. Battaglia, Terry J. Mirri, Leo Padreddii, an~ Warren Steinkamp. Noes, none. Absent, Councilman ~. Frank Mammini. After an explanation by the City Manager Councilman Battaglia introduced the resolution entitled: "A RESOLUTION AMENDING THE SOUTH SAN FRANCISCO EMPLOYEE CLASSIFICATION PLAN BY ADDING THE CLASSES OF FINANCE OFFICER/AUDITOR (U) AND ADMINISTRATIVE SECRETARY (U)." Roll Call was as follows: Ayes, Councilmen Richard A. Battaglia, Terry J. Mirri, Leo Padreddii,. and Warren Steinkamp. Noes. none. Absent, Councilman F. Frank Mammini. "AN ORDINANCE REGULATING CONDUCT IN PARKS; PROVIDING FOR ENFORCEMENT AND PRESCRIBING PENALTIES FOR VIOLATIONS.~' Mayor Mirri ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised Council regarding procedure for adoption. 613174 Page 2 RECESS: RECALL TO ORDER: ORD. The meeting was recalled to order by Mayor Mirri at 9:15 PM with all Council present. Absent, Councilman F. Frank Mammini. Councilman Steinkamp moved reading of the ordinance in its entirety be waived and that the ordinance be passed and adopted by reading title only. Lengthy discussion followed during which time the following spoke: Jan~s Schwirian, 448 Hemlock Avenue, who objected to provisions of the ordinance requesting that it be referred back to the Park and Recreation Commission for a public hearing; Paul Brownlee, 107 Alta Mesa, who likewise objected to provisions of the ordinance; Bob Anderson, Fairfax Way, who inquired as to whether or not the common greens in Westborough were effected by this ordinance. During discussions Mayor Mirri suggested a motion be adopted that the matter be held over and referred back to the Park and Recreation Commission. Discussion followed in this regard after which Councilman Padreddii moved, seconded by Councilman Battaglia, that the ordinance be continued for 30 days and during the interim it be referred to staff. Motion as made and seconded was regularly carried. Councilman SteinkamD voted "NoT'. Director of Parks and Recreation, Dick Milkovich, brought to the attention of the City Council the numerous acts of vandalism which were taking place in the City's parks. He requested that Council establish the operating hours in the parks from 6:00 AM to 9:00 PM in order that these acts of vandalism could be controlled. Discussion followed in this regard. Mayor Mirri recessed the meeting at 10:15 PM for the retaping of the television cameras. The meeting was recalled to order by Mayor Mirri at 10:32 PM with all Council present. Absent, Councilman F. Frank Mammini. Mayor Mirri requested that the matter of operating hours in the parks be considered by the Park and Recreation Commission at the time the ordinance regulating Conduct is being considered. Director of Parks and Recreation, Dick Milkovich, then stated the next meeting of the Park and Recreation Commission would be June 27 at which time the residents could meet with the Commission and staff. 6~3/74 Page 3 ORD. No Council action was taken on this matter. Staff Report, dated June 3, 1974, from the Director of Public Services recommending the City Council support, by motion, Senate Bill No. 1868 amending the Business and Professions Code for condominium conversions. Councilman Battaglia moved that the recommendation of the Director of Public Services be approved and accepted, seconded by Councilman Steinkamp and regularly carried. Staff Report, dated May 24, 1974, from the Director of Administrative Services recommending the City contract with Warranty Processing Service to provide customary billing services for the Oyster Point Marina services, and other City accounts receivable purposes as may be desirable; including the preparation of payment reports, age-dated accounts receivable reports, statement preparation and follow-up analysis as required at per-unit costs proposed March I, 1974. Councilman Steinkamp moved that the recommendation of · the Director of Administrative Services be approved and accepted, seconded by Councilman Battaglia and regularly carried. The City Council was requested at this time to consider two additional staff items. Staff Report, dated June 3, 1974, from the Director of Public Services requesting the setting of a public hearing on the South Spruce Avenue Rezoning from C-3 and R-3 to PCM. Director of Public Services, Frank Addiego, requested that the public hearing be scheduled for July I, 1974 instead of June 17, 1974. There being no objection Mayor Mirri so ordered. Staff Report, dated June 3, 1974, from the Director of Public Services requesting the setting of a public hearing on the Roman Catholic Church Rezoning - RZ-28. NEWSLETTER WIDENING OF A,B, AND C STREETS EMPLOYEE SERVICE AWARD p-O00 ADDITIONS TO STATUS REPORT GOOD AND WELFARE: MEETING AT BURl BURl SCHOOL RECESS: RECALL TO ORDER: CASE OF SMITH VS. CITY OF S.S.F. Councilman Padreddii at this time requested that the Street Department check out and clean the unpaved alley known as Tamarack Lane between Orange and Eucalyptus Avenues which had a growing amount of debris creating a fire hazard. Director of Public Services stated this matter would be attended to. Councilman Battaglia'commended the staff for the first newsletter which was recently mailed with the request that the public make known their comments and submit their input. In answer to Councilman Steinkamp concerning the status of A, B, and C Streets widening as well as negotiations with the School District and Housing Authority, Director of Public Services, Frank Addiego, stated that the City Engineer had contacted the School District, met with the Housing Authority and was also working with the City and County of San Francisco. Mayor Mirri at this time requested that some form of service award program to City employees be initiated. The City Manager stated that this program would be looked into and a report submitted. At the r'equest of Mayor Mirri, the City Manager stated that inquiries received at meetings and follow-up reports and conclusions would be made a part of the Status Report. There being nothing further Mayor Mirri asked if anyone present had anything they wished to offer under Good and Welfare. Mr. ,lake Jones, representing the Vigilant Voters Committee, invited the Council and the public to a meeting on June 6, 1974 at the Buri Buri School, at which time State officials would be present to discuss tax matters. Mayor Mirri recessed the meeting at 10:55 PM to an Executive Personnel Session. Mayor Mirri recalled the meeting to order at 11:15 PM with all Council present. Absent,. Councilman F. Frank Mammini. City Attorney Noonan at this time requested a motion authorizing the City Attorney to compromise and settle the case of Smith vs. the City as set forth in his memorandum of June 3, 1974. 6/3/74 Page 5 GOOD AND WELFARE: CASE OF SMITH VS. THE CITY OF S.S.F. (CON'TD.) ADJOURNMENT He explained this matter after which Councilman Steinkamp so moved, seconded by Councilman Battaglia and regularly carried. There being no one else to speak under Good and Welfare Mayor Mirri adjourned the meeting to Tuesday, June II, 1974, at 5:00 PM in the Council Chambers.
