Mayor Pro Tem Battaglia called the meeting to order at 7:34 PM. Pledge of Allegiance to the Flag recited. Present: Councilmen Richard A. Battaglia, F. Frank Mammini, Leo Padreddii and Warren Steinkamp. Absent: Councilman Terry J. Mirri. Mayor Pro Tem Battaglia stated that Mayor Mirri was on military leave and it was for this reason he was absent. Mayor Pro Tem Battaglia asked if there was a motion approving the Minutes of the Regular Meeting, Monday, October 7, 1974 and the Minutes of Special Meeting, Thursday, October I0, 1974. Councilman Steinkamp moved, seconded by Councilman Padreddii and regularly carried that the Minutes of the Regular Meeting, Monday, October 7, 1974 and the Minutes of Special Meeting, Thursday, October I0, 1974 be approved as submitted. Mayor Pro Tem Battaglia asked if there was a motion approving the regular bills of November 6, 1974. Councilman Steinkamp moved, seconded by Councilman Mammini and regularly carried that the regular bills of November 6, 1974 be approved for payment. Staff Report, dated October 17, 1974, recommending approval of the resolution approving Agreement between the City and the San Mateo County Convention and Visitors Bureau. After a brief explanation by the Director of Administrative Services, Councilman Steinkamp introduced a resolution entitled: A RESOLUTION APPROVING AGREEMENT BETWEEN THE CITY AND THE SAN MATEO COUNTY CONVENTION AND VISITORS BUREAU. ADMINISTRATIVE SERVICES/FINANCE RESO. NO. 209-74 APPROVING AGREEMENT - CITY AND SAN MATEO COUNTY CONVENTION AND VISITORS BUREAU (CONT'D.) CITY CLERK CLAIM OF NICK GORSHEN CLAIM OF CARL AND JEAN CERVANTES CLAIM OF CHARLES GONZALES, SAM BERRY AND HENRY BATTLE Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, Councilman Terry J. Mirri. Staff Report, dated November 6, 1974, recommending City Council take separate action on each of the following claims: Claim of Premier Insurance Company on behalf of Nick Gorshen, South San Francisco, alleging damages to pickup and camper as a result of running into hanging fire alarm box wire on City street. Councilman Mammini moved, seconded by Councilman Steinkamp and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the~fice of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. Claim of Lester G. Sachs, Attorney at Law, on behalf of Carl and Jean Cervantes, San Jose, for their minor child, Christina Louise Cervantes, alleging physical and emotional injury as a result of accident on public facility. Councilman Mammini moved, seconded by Councilman Steinkamp and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. Claim of Leslie C. Nichols and Rubin Tepper, Attorneys at Law, Palo Alto, on behalf of Charles Gonzales, Sam Berry and Henry Battle claiming a refund of fine paid. Councilman Mammini moved, seconded by Councilman Steinkamp and regularly carried, that the claim be rejected and referred to the City's insurance carrier and to the office of the City Attorney; and Notice be given to claimant in accordance with Government Code Sections 913, 915.4 and other related sections of the Government Code. 11/6/74 Page 2 150 PARKS & RECREATION RESO. NO. 211-74 AWARD OF CONTRACT RE CERAMIC TILE FLOOR AT MUNICIPAL SWIMMING POOL 5'DO& RELEASE OF BONDS COMMON GREEN PARCEL A STONEGATE RIDGE Staff Report, dated November 6, 1974, recommending City Council approve the plans and specifications for the City Hall Arbor and authorize call for bids. A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING THE WORK AND CALLING BIDS FOR SOUTH SAN FRANCISCO CITY HALL PUBLIC REST AREA. At the request of the Director of Parks and Recreation and there being no objections this item was continued to the meeting of November 20, 1974 at which time plans and specifications would be ready. Staff Report, dated November 6, 1974, recommending City Council approve the plans and specifications to correct the drainage problem in a portion of Willow Gardens Common Greens, and authorize call for bids for the subject project. After a brief explanation by the Director of Parks and Recreation, Councilman Steinkamp introduced a resolution entitled: A RESOLUTION APPROVING PLANS AND SPECIFICATIONS, AUTHORIZING THE WORK AND CALLING BIDS FOR WILLOW GARDENS COMMON GREENS REMODELING, PROJECT NO. PR-74-7. Roll Call Vote was as follows: Ayes, Councilman Richard A. Battaglia, F. Frank Mammini, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, Councilman Terry J. Mirri. Staff Report, dated November 6, 1974, recommending the City Council award the tiling of the locker rooms at Orange Avenue Memorial Park pool to Cai Tile, Inc., 323 South Canal, South San Francisco, in the amount of $6,OO5. After a brief explanation by the Director of Parks and Recreation Councilman Steinkamp introduced a resolution entitled: A RESOLUTION OF AWARD OF CONTRACT FOR INSTALLATION OF CERAMIC TILE FLOOR, MUNICIPAL SWIMMING POOL, ORANGE AVENUE MEMORIAL PARK. Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, Councilman Terry J. Mirri. RELEASE OF BONDS WEST PARK 3E COMMON GREENS MARINA CONSULTANTS Councilman Steinkamp moved, seconded by Councilman Padreddii and regularly carried that the recommendation of the Director of Parks and Recreation be approved and accepted. Staff Report, dated November 6, 1974, recommending West Park 3E Common Greens Block 12 Lot 220 and Block II Lot 41 be accepted as complete and all bonds e released. Councilman Mammini moved, seconded by Councilman Steinkamp and regularly carried that the recommendation of the Director of Parks and Recreation be approved and accepted. Staff Report regarding Marina Consultants, dated November 6, 1974, recommending the City Council retain firms to provide technical information and final preparation of the Environmental Impact Report. Councilman Mammini moved, seconded by Councilman Steinkamp and regularly carried that the recommendation of the Director of Parks and Recreation be approved and accepted. POLICE DEPARTMENT RESO. NO. 212-74 YELLOW LIMOUSINE SERVICE PUBLIC SERVICES PUBLIC HEARING -- U.P. 290 J.C. PENNEY CO. Staff Report, dated November 6, 1974, recommending approval of application for permit to operate Yellow Limousine Service upon receipt of properly executed PUC permits and insurance coverage papers. After a brief explanation by the City Manager, Councilman Steinkamp introduced a resolution entitled: A RESOLUTION GRANTING PERMIT TO OPERATE LIMOUSINE SERVICE (YELLOW LIMOUSINE SERVICE). Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, Councilman Terry J. Mirri. Public Hearing -- to consider the recommendation of the Planning Commission on Use Permit No. 290, as submitted by the J.C. Penney Company for a discount department store in the PCM District. Staff Report, dated November 6, 1974, recommending approving Use Permit No. 290 subject to all of the conditions and limitations established by the Planning Commission. Mayor Pro Tem Battaglia declared the public hearing opened, asking if there was anyone present who wished to speak on the matter. David Kerr from the Associated Construction Company stated he was present in the event there were any questions to be answered. 11/6/74 Page 4 152 PUBLIC SERVICES PUBLIC HEARING -- U.P. 290 J.C. PENNEY CO. (CONT'D.) PUBL I C HEAR I NG -- GENERAL PLAN AMENDMENT David Hale, City Planner, reviewed the staff report followed by discussion after which Mr. Walter Beardon, Architect with the Associated Construction Company stated he was also present to answer any questions which may arise. There being no further discussion, the Mayor Pro Tem declared the public hearing closed. Councilman Steinkamp then moved, seconded by Councilman Padreddii and regularly carried that the recommendation approving Use Permit No. 290 be approved subject to all of the conditions and limitations established by the Planning Commission. The Staff Report, dated November 6, 1974, from the Director of Public Services and the Staff Report, dated September 12, 1974, from the City Planner containing all the terms and conditions are herewith made a part of the minute entry on U.P. 290. Public Hearing -- to consider an amendment of the General Plan by deleting the extension of Miller Avenue between Chestnut Avenue and Willow Avenue and providing instead for a pedestrian and bicycle way, and by establishing new boundaries for proposed waterfront park and open space areas at Oyster Point. Staff Report, dated November 6, 1974, recommending approving resolution adopting amendments to the General Plan of the City of South San Francisco. A RESOLUTION APPROVING GENERAL PLAN AMENDMENT PURSUANT TO PLANNING COMMISSION RESOLUTION NOS. 2156 AND 2157. The Mayor Pro Tem declared the public hearing opened, asking if there was anyone present who wished to speak on the matter. Mrs. Celia Murphy and Mary Ann Cronin commented on the matter of the pedestrian and bicycle way on Miller Avenue between Chestnut and Willow. David Hale, City Planner, reviewed the staff report stating the Planning Commission had received a letter from Healy Tibbt~s, one of the property owners in the proposed waterfront park and open space area at Oyster Point, who requested Council action be deferred until the next regular meeting. William Everts, an attorney representing the American Bridge U.S. Steel Company, stated his clients made no decision concerning the granting of any easements nor offers to dedicate. There being no other comments, Mayor Pro Tem Battaglia closed the public hearing. There being no objections Mayor Pro Tem Battaglia deferred action and continued the matter to the next regular meeting of November 20. 11/6/74 Page 5 153 PUBLIC SERVICES (CONT'D.) PUBLIC HEARING -- ORD. TO REZONE THE SHORELINE REGIONAL PARK AT OYSTER POINT TO OPEN SPACE PUBLIC HEARING -- ORD. REZONING PROPERTY FROM R-2 TO R-3 AND C-3 Ist Reading/ Introduction Public Hearing -- proposed rezoning of parcels Open Space District, said parcels being more specifically described herein and for reference designated as a strip I00 feet in depth paralleling the bay, measured inland from high tide line of 6.1 feet above mean sea level, including City's Marina and an additional strip of I00 feet on the eastern side of the Healy-Tibbitts property. Staff Report, dated November 6, 1974, recommending the City Council approve Resolution No. 2158 of the Planning Commission and introduce for first reading an ordinance designating the Shoreline Regional Park at Oyster Point in the Open Space Zone District. AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO AMENDING ORDINANCE NO. 353, AS AMENDED, ENTITLED "ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO" PASSED AND ADOPTED AUGUST I0, 1954, AND ESTABLISHING ZONING DISTRICT CLASSIFICATION FOR THE PROPERTY HEREIN DESCRIBED OPEN SPACE DISTRICT. The Mayor Pro Tem declared the public hearing opened, asking if there was anyone present who wished to speak on the matter. The Staff Report was reviewed by David Hale, City Planner. There being no other comments, Mayor Pro Tem Battaglia closed the public hearing. There being no objections Mayor Pro Tem Battaglia deferred action and continued the matter to the next regular meeting of November 20. Public Hearing -- to rezone 0.731 acres of land located at the northerly side of Armour Avenue and Linden Avenue from R-2, Duplex Family Residential District, to R-3, Restricted Multiple Family District, and C-3 Heavy Commercial District. Staff Report, dated November 6, 1974, recommending the City Council approve Resolution No. 2152 of the Planning Commission and introduce for first reading the ordinances rezoning the subject property from R-2 to R-3 and C-3. REPEALING SECTION 3.15(a) OF ZONING ORD. - LOT COVERAGE IN R-I ZONE Ist Reading/ Introduction The Staff Report was reviewed by David Hale, City Planner. Comments were also made by some of the interested property owners, Dennis Lema and Leo Lombardi. There being no one else to speak on the matter, Mayor Pro Tem Battaglia closed the public hearing. Mayor Pro Tem Battaglia ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for introduction. Councilman Steinkamp moved that reading of the ordinance in its entirety be waived and that the ordinance be introduced and read for the first time by reading title only, seconded by Councilman Padreddii and passed by a unanimous vote. Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, Councilman Terry J. Mirri. Public Hearing -- proposed amendment of Zoning Ordinance No. 353, as amended - Lot coverage in R-I zone. Staff Report, dated November 6, 1974, recommending the repeal of Section 3.15(a) of Zoning Ordinance No. 353 be introduced for first reading. The Mayor Pro Tem declared the public hearing opened, asking if there was anyone present who wished to speak on the matter. The Staff Report was reviewed by David Hale, City Planner. Frank Mammini, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, Councilman Terry J. Mirri. The Mayor Pro Tem declared a recess at 8:45 PM. Mayor Pro Tem Battaglia recalled the meeting to order at 9:00 PM. Staff Report, dated November 6, 1974, recommending the City Council adopt a resolution accepting the bids and award the contract for resurfacing parking lots at Oyster Point Marina to Lowrie Paving Company - $18,725. The Staff Report was reviewed by the Director of Pu~ic Services, after which he requested a delay to the meeting of December 4 in order that the City might ascertain if funding would be obtained from the Harbor District. Councilman Steinkamp moved that the City award the contract to the Iow bidder contingent upon receiving funds from the Harbor District, seconded by Councilman Mammini and regularly carried. Staff Report, dated November 6, 1974, recommending the City Council adopt the resolution ratifying execution of a Compromise and Settlement Agreement between the City of South San Francisco, a municipal corporation, David Arata and Others (Colma Creek Right-of-Way and Related Matters). After a brief explanation by the Director of Public Services, Councilman Steinkamp introduced a resolution entitled: A RESOLUTION RATIFYING EXECUTION OF COMPROMISE AND SETTLEMENT AGREEMENT, AUTHORIZING RECORDATION THEREOF AND RELATED ACTS. Roll Call Vote was as follows: Ayes, Councilmen Richard A. Battaglia, F. Frank Mammini, Leo Padreddii and Warren Steinkamp. Noes, none. Absent, Councilman Terry J. Mirri. Staff Report, dated November 6, 1974, recommending setting date of public hearing for November 20, 1974 to consider the appeal of Home Savings and Loan Company on Use Permit No. 294 for an off-site subdivision directional sign. After a brief explanation by the Director of Public Services, he requested Council action be deferred until the meeting of December 4. SETTING HEARING DATE - OROWEAT BAKING COMPANY U.P. 156 Staff Report, dated November 6, t974, recommending setting date of public hearing for November 20, 1974 to consider the recommendation of the Planning Commission on Use Permit No. 156 as submitted by the Oroweat Baking Company for the storage of silos and related items in the PCM District. After a brief explanation by the Director of Public Services, he requested Council action be deferred until the meeting of December 4. Mayor Pro Tem Battaglia so ordered. COMMUNICATIONS PURCHASE OF 20 ACRE SITE Letter, dated October II, 1974, from John R. Penna, Penna Realty, requesting purchase by City of 20 acre site. After some brief comments by John Penna and there being no objections the Mayor Pro Tem referred the matter to the Parks and Recreation Director with a request that a report be submitted. PETITION TO COMMENCE RECALL MOVEMENT Letter, dated October 30, 1974, fro~ Ron Acosta, Vigilant Voters Committee, presenting petition supporting move to commence a recall movement in the City of South San Francisco. Mr. Ron Acosta, President of the Vigilant Voters Committee, read his statement in the matter after which he filed with the City a petition containing 2,011 signatures. Mayor Pro Tem Battaglia then read a statement concerning the City's reason for proceeding ahead with the Public Safety Complex. GOOD AND WELFARE COMMENT RE PET I T I ON TO COMMENCE RECALL ADJ OU RNMENT_ Mr. Alan Weinstein commented on the petitions which were presented by the Vigilant Voters Committee. There being nothing further to come before Council, Councilman Mammini moved, seconded by Councilman Steinkamp that the meeting be adjourned. The meeting adjourned at 9:30 PM.
