ADJOURNED REGULAR MEETING OF THE CITY COUNCIL

The meeting was called to order by Mayor Padreddii at
7:25 PM.
Pledge of Allegiance to the Flag was recited.
Present: Councilmen Leo Padreddii, William A. Borba,
Terry J. Mirri and Richard A. Battaglia.
Absent: Councilman Emanuele N. Damonte.
Continued Item -- Staff Report, dated April 7, 1976
recommending Council by motion receive and approve UP-75-325
Richard J. Bocci - office complex on South Spruce Avenue
for the State Department of Economic Development - in
accordance with the approval granted by the Planning
Commission.
CoUncilman Battaglia stated "I'd like again for the
record to show that I did not participate in this discussion
nor did I vote on this item due to a possible conflict
of ~nterest."
Mayor Padreddii commented that this item had been continued
at the request of Councilman Borba who had asked for
further information regarding the matter of parking.
Through the use of a rendering of the proposed development
the City Planner gave a detailed explanation of the
on site parking which had been provided for and which
exceeded the City's requirements. He further commented
that the State did not allow its employees to park on
site but that they were required to park off site.
Mr. Hale continued by remarking that the State had said
that if the City had any further concerns they should
direct their letter directly to the State. Discussion
followed concerning input from the surrounding neighbor-
hoods regarding parking and other related matters. The
City Attorney then reported on the question which had

been raised by Mr. Amin at the earlier meeting relative
to the environmental impact report. He continued by
stating that in order to satisfy State environmental
impact review requirements, a Notice of Determination
with the City's negative declaration had been filed with
the County Clerk for a 30 day review period. Therefore,
no building permit would be issued for this project
until the expiration of the 30 day period.
Further discussion followed after which there being no
objections the matter was continued to the regular
meeting of May 5, 1976.
In answer to Councilman Borba's inquiry regarding the
effect on industries the Director of Public Services in
detail explained the appeal procedure and that the
industries through their representative William Hern
concurred with the City.
Mayor Padreddii ordered the title of the ordinance read.
The title of the ordinance was read.
City Attorney Noonan then explained the ordinance and
advised the Council regarding procedure for adoption
and passage. Councilman Battaglia moved reading of the
ordinance in its entirety be waived and that the ordinance
be passed and adopted by reading title only, seconded by
Councilman M~rri and passed by unanimous vote.
Councilman Battaglia moved that the ordinance entitled,
AN ORDINANCE ESTABLISHING SEWER SERVICE CHARGES AND
PROCEDURES RELATED THERETO AMENDING ORDINANCE NO. 396
AS AMENDED, the entire reading of which has been duly
waived be passed and adopted, seconded by Councilman
Borba and passed by the following roll call vote.
Roi1 Call Vote was as follows: Ayes, Councilmen Leo Padreddii,
William A. Borba, Terry J. Mirri, and Richard A. Battaglia.
Absent, Councilman Emanuele N. Damonte. Noes, none.
Staff Report, dated April 14, 1976, recommending approval
of final acceptance and Change Order No. 1 of the Public
Rest Area.
After an explanation by the Director of Parks and Recreation
regarding the inspection and change order as well as the
total cost Councilman Battaglia moved, seconded by
Councilman Mirri and regularly carried that the recommenda-
tion of the Director of Parks and Recreation be approved
and accepted.

ADJOURNMENT
The Director of Public Services explained through the
use of a rendering the proposed expansion of the Sewage
Treatment Plant. He stated that the firm of Grubb and
Ellis presently had a parcel of property adjacent to
the Sewage Treatment Plant which was available to the
City for the proposed development. He continued by
stating that the City had a parcel of property fronting
on Airport Boulevard which could be sold and the proceeds
from the sale used to buy the parcel from Grubb and
Ellis. He also explained how the property could be de-
veloped and the funds which were available from the
Federal and State agencies for the expansion of the
Sewage Treatment Plant.
After discussion the Director of Public Services stated
that the plan was to schedule the matter for the meeting
of May 5, 1976 and then proceed if Council concurs.
No objections were registered.
A recess was declared at 8:07 PM for recording tape
change.
The meeting was recalled to order at 8:09 PM with all
Council present. Absent, Councilman Emanuele N. Damonte.
The City Manager reported that the City of Brisbane had
requested another date for the joint meeting other than
May 18, 1976. The City Manager was requested to arrange
for a date convenient to both Councils.
There being nothing further to come before Council
Councilman Mirri moved, seconded by Councilman Borba and
regularly carried that the meeting be adjourned.
Time of adjournment was 8:15 PM.
