Pledge of Allegiance to the Flag recited. Present: Councilmen Leo Padreddii, Emanuele N. Damonte, William A. Borba, Terry J. Mirri and Richard A. Battaglia. Absent: None. Councilman Borba stated, "Before the motion is made I would like to refrain on voting on the following due to the fact that I do business with the following companies." Berkey Photo, Inc. Cable Mayor Padreddii called for a motion to approve the claims deleted from the original list. Councilman Battaglia moved, seconded by Councilman Mirri and regularly carried. Councilman Borba stated, "Mr. Mayor I want the record to show that I did not participate in the vote." APPROVAL OF BILLS. (CONT ' D. ) NOVEMBER 17, 1976 Mayor Padreddii ordered the claims amended to delete the claims listed by Councilman Borba and called for a motion to approve the claims as amended. Councilman Damonte so moved, seconded by Councilman Mirri and regularly carried. APPROVAL OF MINUTES OCTOBER 20, 1976 OCTOBER 27, 1976 NOVEMBER 3, 1976 Mayor Padreddii asked if there was a motion approving the Minutes of the Regular Meeting of October 20, 1976; Special Meeting of October 27, 1976 and Regular Meeting of November 3, 1976. Councilman Borba nmved, seconded by Councilman Damonte and regularly carried that the Minutes'be approved as submitted. ADMINISTRATIVE SERVICES Staff Report, dated November 17, 1976, recommending Council BUSINESS LICENSE ORD. introduce and read for the first time an ordinance providing 1st Reading/Intro. for licensing of business, professions, trades, callings and occupations in the City of South San Francisco. At the request of Mayor Padreddii the Acting Finance Director discussed his staff report, the reports received from the League of California Cities which had been reviewed and the present ordinance now in effect. The Acting Finance Director also explained the fees to be charged which had been discussed with both the Chamber of Commerce and the Peninsula Manufacturing Association. Discussion followed between members of the City Council and staff after which Mayor Padreddii asked if there was anyone present who wished to speak on the matter. No one spoke in this regard. Mayor Padreddii ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for introduction. Councilman Mirri moved that reading of the ordinance in its entirety be waived and that the ordinance be introduced and read for the first time by reading title only, seconded by Councilman Damonte and passed by a unanimous vote. Councilman Damonte moved that the ordinance entitled, AN ORDINANCE PROVIDING FOR LICENSING OF BUSINESS, PROFESSIONS, TRADES, CALLINGS, AND OCCUPATIONS IN THE CITY OF SOUTH SAN FRANCISCO, the entire reading of which has been duly waived, be introduced, seconded by Councilman Mirri and passed by the following roll call vote. CITY CLERK CLAIM OF FRANCES WATKINS CLAIM OF RICHARD EUGENE BAUMGARTE Staff Report, dated November 17, 1976, recommending Council take separate action on each of the following claims: Claim of Frances Watkins, Redwood City, alleging damage to her vehicle which occurred while parked on "C" Street in South San Francisco. Councilman Battaglia moved, seconded by Councilman Borba and regularly carried that the claim be rejected and referred to the office of the City Attorney and the City's Insurance Carrier; and Notice be given to claimant in accordance with Government Code Section 913, 915.4 and other related sections of the Government Code. Claim of Richard Eugene Baumgarte, Union City, alleging false arrest and imprisonment by the South San Francisco Police Department. CITY MANAGER RESO. NO. 164-76 SCAVENGERRATES AND CHARGES FOR 1977 & 1978 Councilman Battaglia moved, seconded by Councilman Mirri and regularly carried that the claim be rejected and referred to the office of the City Attorney and the City's Insurance Carrier; and Notice be given to claimant in accordance with Government Code Section 913, 915.4 and other related sections of the Government Code. Staff Report, dated November 17, 1976, regarding South San Francisco Scavenger Company rate modification. A brief summary was made by the Acting City Manager after which in answer to the inquiry of Mr. John Falsarella the Acting City Manager explained the franchise fees. There being no one else to speak on the matter the Mayor declared the public hearing closed. Councilman Borba introduced a resolution entitled: A RESOLUTION ESTABLISHING SCAVENGER RATES AND CHARGES FOR 1977 AND 1978, AND AUTHORIZING AN AGREEMENT FOR SCAVENGER SERVICES AND RELATED MATTERS. NO. 165-76 WESTERN TV CABLE INCREASE 1/1/77 Staff Report, dated November 17, 1976, regarding Western TV Cable Company rate modification. The Acting City Manager explained his staff report and the meetings which had been held with the representatives of Western TV Cable. He then explained staff's recommendations relative to the rates. Speaking of the excellent service by Western TV Cable was Mr. Morton Dobrow. Discussion then followed between the members of the City Council and staff relative to the rates after which Councilman Damonte introduced a resolution entitled: A RESOLUTION APPROVING CATV SUBSCRIBER RATE INCREASES EFFECTIVE JANUARY 1, 1977. Swan & Associates of San Francisco, who submitted the lowest responsible bid in the amount of $6,858.69. NO. 716-76 the Fire Chief explained the amendment to the Fire Code. NO. 167-76 WEED ABATEMENT Mayor Padreddii called for a recess at 8:45 PM for the retaping of the television cameras. The meeting was recalled to order by Mayor Padreddii at 9:08 PM with all Council present. PublicHearing -- Adoption of National Electrical Code, 1975 Edition. Staff Report, dated November 17, 1976, recommending that Council open the public hearing on the proposed ordinance and proceed with adoption. The City Clerk read the communication, dated November 17, 1976 as received from Mr. Wayne K. Thomas, Business Manager for the International Brotherhood of Electrical Workers, Local 617, after which the Acting City Manager gave his staff report. Mayor Padreddii then declared the public hearing opened asking if there was anyone present who wished to speak. There being no one Mayor Padreddii declared the public hearing closed. Mayor Padreddii ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for adoption and passage. Public Hearing -- Weed Abatement of Certain Private Lots. Page 7 11117/76 PUBLIC SERVICES RESO. NO. 167-76 WEED ABATEMENT (CONT ' D. ) UP- 76- 349~VICTOR BRINCAT APPEAL Staff Report, dated November 17, 1976, recommending that 1) Council conduct a public hearing to receive objections to the weed abatement proceedings for certain private lots, and 2) upon closing the public hearing, Council adopt a resolution ordering the removal of weeds from parcels of private property and public places. The Acting Director of Public Services gave his staff report listing those parcels of property remaining to be cleaned by the respective property owner. In answer to Councilman Damonte's inquiry the City Attorney explained why the City and County of San Francisco's parcel was deleted and how this would be handled. Mayor Padreddii declared the public hearing opened, asking if there was anyone present who wished to speak. Mr. Victor Lonati, 254 Armour Avenue, South San Francisco, suggested that weeds not be sprayed but allowed to grow keeping dust from blowing about and the weed then be cut later. There being no one else to speak Mayor Padreddii declared the public hearing closed. Councilman Battaglia introduced a resolution entitled: A RESOLUTION ORDERING REMOVAL OF WEEDS FROM PARCELS OF PRIVATE PROPERTY AND PUBLIC PLACES. Roll Call Vote was as follows: Ayes, Councilmen Leo Padreddii, Emmnuele N. Damonte, William A. Borba, Terry J. Mirri and Richard A. Battaglia. Noes, none. Absent, none. Public Hearing -- Appeal of Victor Brincat of conditions imposed by the Planning Commission on UP-76-349. Staff Report, dated November 17, 1976, recommending that Council uphold the conditions imposed by the Planning Commission on UP-76-349. At the request of Mayor Padreddii the Acting City Planner in detail discussed his staff report and read the objections. Mayor Padreddii then declared the public hearing opened asking if there was anyone present who wished to speak. Mr. Allen Schnibben, Attorney at Law, 405 Grand Avenue, representing Victor Brincat reviewed in detail the conditions which had been imposed on the use permit. Page 8 11117176 PUBLIC SERVICES UP-76-349/VICTOR BRINCAT APPEAL (CONT'D.) Discussion followed between the members of the City Council, staff and Mr. Schnibben concerning the conditions as well as the possibility of a continuance of the matter until January 1, 1977 at which time Mr. Brincat would know the status of his option to purchase the property. Mr. Fred Lagomarsino, Deputy Fire Marshall, at this time spoke concerning the requirement for the installation of a sprinkler system, and a spray booth. Discussion then followed between the City Attorney and the Deputy Fire Marshall concerning the legal requirements for the installation of a spray booth, sprinkler system and other items for the operation of this business activity. Planning Commissioner Herbert Goldberg then commented on his personal observations of this activity. Further discussion followed between the City Attorney and the Deputy Fire Marshall after which there being no one else to speak Mayor Padreddii declared the public hearing closed. Councilman Battaglia then moved that the Council uphold the action of the Planning Commission. There being no second to the motion Mayor Padreddii declared the motion dead. After further discussion the City Attorney stated that staff had been discussing an alternate and requested that Council consider a continuance until December 1, to let staff go further into this matter and report back with something more organized and conclusive. Councilman Borba so moved, seconded by Councilman Damonte and regularly carried. The Chief Building Inspector then asked Mr. Brincat if he was leasing the office area of that building or if that office area was part of his own operation with the auto repairs. Mr. Brincat replied it was his office. SA-76-33/MAURICE Public Hearing -- Appeal of Maurice Brosnan Construction BROSNAN CONSTRUCTION CO. Company of the conditions imposed by the Planning Commission on SA-76-33. Staff Report, dated November 17, 1976, recommending that Council uphold the conditions imposed by the Planning Commission on SA-76-33. Page 9 11/17/76 PUBLIC SERVICES SA- 76- 3 3 /MAURICE BROSNAN CONSTRUCTION CO. (CONT' D. ) At the request of the Mayor the Acting City Planner gave his staff report and further explained from a plat the area for the proposed walkway. Mayor Padreddii then declared the public hearing opened asking if there was anyone who wished to speak. Maurice Brosnan, 607 Poplar Avenue, the applicant, discussed the adverse conditions this would create as well as an area for the congregation of school children which would result in vandalism to property as well as physical harm. He voiced objection to this pathway. Mr. Floyd Parma, Attorney at Law, 405 Grand Avenue, South San Francisco, representing Mr. Brosnan further commented on the pathway the financial burden it imposed on the property owners, as well as the effect on the marketability of the property. Comments were also offered in this regard by Mrs. Joan Doane, 1043 Miller Avenue. At the request of Council, Acting Police Chief James Swinford, commented on this matter. The Acting City Manager commented on the reasons for the pathway. John Falsarella, 282 Westview Drive, stated that the pathway would invite problems for school children. Allen Weinstein suggested a continuance and bring the matter up as a change to the General Plan. There being no one further to speak Mayor Padreddii declared the public hearing closed. Councilman Borba then moved, seconded by Councilman Mirri that the decision of the Planning Commission be rejected and the appeal of the property owner be upheld. Discussion followed at which time the City Attorney suggested that Council declare its intention to delete Condition No. 9 requiring the dedication of a public access easement and request the Commission to institute proceedings to amend the General Plan to delete it from the General Plan and upon that action by the Commission this matter stand concluded or approved. Page 10 Zl/27/76 PUBLIC SERVICES SA-76-33/MAURICE BROSNAN CONSTRUCTION CO. (CONT'D.) ORD. NO. 719-76 AMENDING ORD. #353, MAURICE BROSNAN CONSTRUCTION CO. RZ-76-34 2nd Reading/Adoption Councilman Borba amended his motion to include the City Attorney's suggestion. Councilman Mirri seconded the amended motion. After some further discussion the suggested motion was restated "to delete Condition 9 of SA-76-33 and that part of Condition No. 8 described on Page 3 of the Inter-Office Memorandum of the City Engineer as a pedestrian easement 1 and 2. Same to stand deleted upon approval of a General Plan amendment." Discussion followed between the City Attorney and Mr. Floyd Parma after'which the City Attorney stated a newmotion would be needed. Councilman Borba withdrew his motion and Councilman Mirri withdrew his second. The City Attorney then suggested the following motion: Condition and Limitation No. 9 of SA-76-33 be deleted and that part of Condition and Limitation No. 8 set forth on Page 3 of the City Engineer's Inter-Office memorandum same being labeled pedestrian easement 1 and 2 be deleted. Councilman Borba so moved, seconded by Councilman Mirri and regularly carried. Councilman Battaglia voted "no". Mayor Padreddii ordered the title of the ordinance read. The title of the ordinance was read. City Attorney Noonan then explained the ordinance and advised the Council regarding procedure for adoption and passage. Councilman Borba moved that the ordinance entitled, AN ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO AMENDING ORDINANCE NO. 353, AS AMENDED, ENTITLED "ZONING ORDINANCE OF THE CITY OF SOUTH SAN FRANCISCO" AND ESTABLISHING AN R-3 RESTRICTED MULTIPLE FAMILY ZONE DISTRICT (PORTION OF ASSESSOR'S PARCEL 011-262-020), the entire reading of which has been duly waived, be passed by the following roll call vote. AND REFERRAL CENTER NOTICE OF INTENTION TO SERCDC FROM P.G. & E. TO CONSTRUCT A POWER PLANT/OYSTER POINT Staff Report, dated November 17, 1976, recommending Council accept the "C" Street Widening - Orange Avenue to Housing Authority Property - as complete in accordance with the approved plans and specifications. Councilman Borba moved, seconded by Councilman Battaglia and regularly carried that the recommendation of the Director of Public Services be approved and accepted. Staff Report, dated November 17, 1976, recommending that Council accept the 1976-77 Seal Coating Program as complete in accordance with the approved plans and specifications. Councilman Battaglia moved, seconded by Councilman Borba and regularly carried that the recommendation of the Director of Public Services be approved and accepted. Staff Report, dated November 17, 1976, regarding the activities of the Information and Referral Center. Mr. Angelo Mitchner, Executive Director of the Information and Referral Center distributed to the members of the City Council a booklet containing the activities of the Information and Referral Center, commenting on the housing survey made in the City stating that he would answer any questions Council might have. After brief discussion Mr. Allen Weinstein, Treasurer for the Information and Referral Center commented that the audit would soon be completed and that this information would be provided as well. No further action was taken. Staff Report, dated November 17, 1976, recommending that 1) Council direct staff to obtain the services of a qualified land planner/financial consultant for the purposes of reviewing P.G. & E.'s impact on the City of South San Francisco with the costs of these proposed services to be borne by the fund established by the Commission; 2) Council direct staff to attend the hearing scheduled for December 2, 1976, at San Mateo City Hall for the purpose of representing the interests of the City of South San Francisco; and 3) Council direct staff to prepare a letter of protest to be signed by the office of the City Manager and directed to SERCDC, the purpose of the letter being to inform SERCDC of the City's dissatisfaction with the limited aount of time allowed prior to this initial hearing for a review of the proposed project. TO CONSTRUCT A POWER PLANT/OYSTER POINT (CONT ' D. ) The Acting City Planner gave his staff report requesting additional help due to the shortness of time and lack of adequate personnel. ITEMS FROM STAFF PUBLIC SAFETY FACILITY AND DEVELOPMENT OF SOUTH SLOPE SAN BRUNO MOUNTAIN Request for Study Session to discuss the Public Safety Facility. The Acting City Manager commented that in addition to a study session to discuss the Public Safety Facility one was being requested to discuss with Visitacion Associates the development of the south slope of San Bruno Mountain. After brief discussion and there being no objections the following special study meetings were scheduled. December 7, 1976, 7:30 PM, West Orange Avenue Library, to discuss the development of the south slope of San Bruno Mountain with Visitactio Associates. January 12, 1977, 7:30 PM, Conference Room, City Hall, to discuss the Public Safety Site. HISTORICAL PHOTO AND DOCUMENT DISPLAY Reproduction - Historical photo and document display. The Acting City Manager commented that the request was for $100.00, funds were available and recommended that the request be granted. GOOD AND WELFARE COPIES OF MARINA FEASIBILITY STUDIES There being nothing from Council Mayor Padreddii asked if anyone present had anything they wished to offer under Good and Welfare. Page 13 11/17/76 GOOD AND WELFARE COPIES OF MARINA FEASIBILITY STUDIES (CONT' D. ) Mr. John Falsarella, 282 Westview Drive, inquired as to what monies the Marina had lost to date. He commented that he had varied figures in this regard. Mr. Falsarella also inquired why feasibility studies which were presented to the Commissioners at last night's meeting were not available to the public. The Acting City Manager stated that Mr. Falsarella would be forwarded a copy and copies forwarded to the City Council as well. RECESS: There being nothing further under Good and Welfare Mayor Padreddii recessed the meeting at 12:03 AM to an Executive Personnel Session. The City Clerk was excused from attending. RECALL TO ORDER: The meeting was recalled to order by Mayor Padreddii at 12:39 AM with all Council present. Mayor Padreddii requested that the record show that Council discussed two legal matters, no action and no roll call vote was taken. ACCEPTANCE OF REPAIRS OF SEWER FORCE MAIN ADJACENT TO RTE. 101 kS/J/ The City Attorney at this time brought to Council's attention a communication, dated October 26, 1976, from the Department of Transportation over the signature of W.K. Hashimoto, Deputy District Director, relative to repairs of the sewer force main adjacent to Route 101 which were in the amount of $20,407.29. He recommended a motion of acceptance. Councilman Damonte so moved, seconded by Councilman Mirri and regularly carried. COMMENTS RE BUSINESS LICENSING OF APT. BLDGS. ADJOURNMENT The City Attorney and Acting City Manager briefly commented on the inquiry of Councilman Borba relative to the business licensing of apartment houses.
