The meeting was called to order by Mayor Pro Tem Damonte
at 7:36 PM.
The Pledge of Allegiance to the Flag was recited.
Present: Councilmen Richard A. Battaglia, William A. Borba,
Emanuele N. Damonte and Terry J. Mirri.
Absent: Councilman Leo Padreddii.
Councilman Borba introduced a resolution entitled: A

FRANCISCO COMMENDING JACK JONES FOR SERVICES TO THE CITY OF
SOUTH SAN FRANCISCO.
Roll call vote was as follows: Ayes, Councilmen Richard A.

Terry J. Mirri. Noes, none. Absent, Councilman

Councilman Borba introduced a resolution entitled: A

Councilman Borba introduced a resolution entitled: A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTH SAN
FRANCISCO COMMENDING HOMER V. HALE FOR SERVICES TO THE CITY
OF SOUTH SAN FRANCISCO.
Roll call vote was as follows: Ayes, Councilmen Richard A.
Battaglia, William A. Borba, Emanuele N. Damonte and
Terry J. Mirri. Noes, none. Absent, Councilman
Leo Padreddii.
Upon the conclusion of the introduction of the resolutions
Mayor Pro Tem Damonte read the contents of the resolutions,
after which he presented resolutions to each of those persons
in attendance.
Chairman Wallace Pettigrew summarized the fund raising events
sponsored by the Bicentennial Committee, after which he
presented to Council a check for $5,342.79 as proceeds from
these events. He expressed his thanks to the Council for
the financial assistance given the Committee.
Mayor Pro Tem Damonte thanked Mr. Pettigrew for the Committee
work.
Chairman Pettigrew concluded by introducing those members
of the Committee present.
Councilman Borba stated, "Before the motion is made I would
like to refrain on voting on the following due to the fact
that I do business with the following companies."

Councilman Borba stated, "Mr. Mayor I want the record to
show that I did not participate in the vote."
Mayor Pro Tem Damonte ordered the claims amended to delete
the claims listed by Councilman Borba and called for a
motion to approve the claims as amended. Councilman Borba
so moved, seconded by Councilman Battaglia and regularly
carried.
Mayor Pro Tem Damonte asked if there was a motion approving
the Minutes of the Regular Meeting of December 1, 1976 and
the Adjourned Regular Meeting of December 8, 1976.
Councilman Mirri moved, seconded by Councilman Battaglia
and regularly carried that the Minutes of the Regular
Meeting of December 1, 1976 and the Adjourned Regular
Meeting of December 8, 1976 be approved as submitted.
Staff Report, dated January 5, 1977, recommending that
Council introduce and read for the first time an ordinance
amending the Business License Ordinance to delete employ-
ment agencies from the Professional Class of businesses,
amend the definition of Average Number of Persons Employed
and repealing Ordinance Nos. 336 and 650.
Mayor Pro Tem Damonte ordered the title of the ordinance
read. The title of the ordinance was read.
City Attorney Noonan then explained the ordinance and
advised the Council regarding procedure for introduction.
Councilman Borba moved that reading of the ordinance in its
entirety be waived and that the ordinance be introduced and
read for the first time by reading title only, seconded by
Councilman Mirri and passed by a unanimous vote.
Councilman Battaglia moved that the ordinance entitled, AN
ORDINANCE AMENDING THE SOUTH SAN FRANCISCO BUSINESS LICENSE
ORDINANCE NO. 720-76, AS AMENDED, AND REPEALING ORDINANCE
NO. 336 AND NO. 650, the entire reading of which has been
duly waived, be introduced, seconded by Councilman Borba
and passed by the following roll call vote.
Roll call vote was as follows: Ayes, Councilmen Richard A.
Battaglia, William A. Borba, Emanuele N. Damonte and
Terry J. Mirri. Noes, none. Absent, Councilman
Leo Padreddii.

Claim filed by Joseph Franco of P. W. Supermarket, Inc.,
San Jose, alleging damage to supermarket vehicle by South
San Francisco Police auto.
Councilman Borba moved, seconded by Councilman Battaglia
and regularly carried that the claim be rejected and
referred to the office of the City Attorney and the City's
insurance carrier; and Notice be given to claimant in
accordance with Government Code Section 913, 915.4 and
other related sections of the Government Code.
Claim filed by Joel M. Pressman, Attorney at Law, on
behalf of Marie Caruso, alleging personal injuries
sustained from fall on City street.
Councilman Battaglia moved, seconded by Councilman Borba
and regularly carried that the claim be rejected and
referred to the office of the City Attorney and the City's
insurance carrier; and Notice be given to claimant in
accordance with Government Code Section 913, 915.4 and
other related sections of the Government Code.
Staff Report, dated January 5, 1977, recommending that
Council authorize a budget, by resolution, which provides
for temporary positions funded by Public Works Employment
Act, Title II funds.
City Manager C. Walter Birkelo briefly commented on the
matter. He then called on the Assistant to the City Manager
who in detail explained the funds available and how these
funds were to be dispersed. He also commented that these
positions were temporary in nature.
Discussion followed between Council and staff. Councilman
Mirri suggested that twenty-five percent be placed in
field positions.
Further discussion followed, after which Councilman Mirri
moved, seconded by Councilman Borba that twenty-five percent
of these positions be held for other types of positions
other than clerical. Councilman Borba and Mirri voted aye.
Councilman Battaglia and Damonte voted no.
Councilman Damonte introduced a resolution entitled: A
RESOLUTION APPROVING A BUDGET FOR FUNDS RECEIVED PURSUANT
TO THE PUBLIC WORKS EMPLOYMENT ACT OF 1976, TITLE II.
Roll call vote was as follows: Ayes, Councilmen Richard A.
Battaglia, William A. Borba and Emanuele N. Damonte. Noes,
Councilman Terry J. Mirri. Absent, Councilman Leo Padreddii.

Staff Report, dated January 5, 1977, recommending that
Council introduce an ordinance which establishes the bonds
required of officers or employees of the City and repeals
Ordinance No. 1, adopted October 5, 1908.
Mayor Pro Tem Damonte ordered the title of the ordinance
read. The title of the ordinance was read.
City Attorney Noonan then explained the ordinance and
advised the Council regarding procedure for introduction.
Councilman Battaglia moved that reading of the ordinance
in its entirety be waived and that the ordinance be
introduced and read for the first time by reading title
only, seconded by Councilman Borba and passed by a
unanimous vote.
Councilman Battaglia moved that the ordinance entitled,
AN ORDINANCE ESTABLISHING BONDS REQUIRED OF OFFICERS OR
EMPLOYEES OF THE CITY OF SOUTH SAN FRANCISCO AND REPEALING
ORDINANCE 1, ADOPTED OCTOBER 5, 1908, the entire reading
of which has been duly waived, be introduced, seconded by
Councilman Borba and passed by the following roll call
vote.

Battaglia, William A. Borba, Emanuele N. Damonte and
Terry J. Mirri. Noes, none. Absent, Councilman

Staff Report, dated January 5, 1977, recommending that
Council introduce an ordinance which requires City officers
and employees to take a Constitutional Oath of Office as
set forth in Article XX, Section 3, of the State
Constitution, and appeals Ordinance No. 302, entitled, "An
Ordinance Requiring All Persons Holding or Occupying
Appointive Offices or Positions in the Service of the City
of South San Francisco to Take and Subscribe to a Loyalty
Oath.
After a brief explanation by the City Attorney as to what
this ordinance did, Mayor Pro Tem Damonte ordered the title
of the ordinance read. The title of the ordinance was read.
City Attorney Noonan then explained the ordinance and
advised the Council regarding procedure for introduction.
Councilman Borba moved that reading of the ordinance in
its entirety be waived and that the ordinance be introduced
and read for the first time by reading title only, seconded
by Councilman Battaglia and passed by a unanimous vote.

Councilman Borba moved that the ordinance entitled, AN
ORDINANCE REQUIRING OATH OF OFFICE FOR OFFICERS AND
EMPLOYEES, the entire reading of which has been duly
waived, be introduced, seconded by Councilman Battaglia
and passed by the following roll call vote.
Roll call vote was as follows: Ayes, Councilmen Richard A.
Battaglia, William A. Borba, Emanuele N. Damonte and
Terry J. Mirri. Noes, none. Absent, Councilman
Leo Padreddii.
Staff Report, dated January 5, 1977, recommending that
Council establish a policy to reimburse employees who use
their private vehicles on City business at a rate of 15ยข
per mile.
The Assistant to the City Manager explained the item and
the reason for its approval. Brief discussion followed,
after which Councilman Battaglia moved, seconded by
Councilman Borba and regularly carried that the recommen-
dation of the City Manager be approved and accepted.
Staff Report, dated January 5, 1977, recommending that
Council read for the second time and adopt an ordinance
which amends the animal license fees and shelter service
fees charged by the Peninsula Humane Society and requires
that dogs be vaccinated against rabies.
Mayor Pro Tem Damonte ordered the title of the ordinance
read. The title of the ordinance was read.
City Attorney Noonan then explained the ordinance and
advised the Council regarding procedure for adoption and
passage. Councilman Borba moved reading of the ordinance
in its entirety be waived and that the ordinance be passed
and adopted by reading title only, seconded by Councilman
Mirri and passed by unanimous vote.
Councilman Borba mvoed that the ordinance entitled, AN
ORDINANCE AMENDING ORDINANCE 564, AS AMENDED, PROVIDING
FOR LICENSE FEES, RABIES VACCINATION AND SHELTER SERVICE
FEES, the entire reading of which has been duly waived,
be passed and adopted, seconded by Councilman Mirri and
passed by the following roll call vote.

RECALL TO ORDER:.
CoUncilman Battagliaexplained his no vote stating that
he wished to see higher fees. He also requested staff to
check the ordinances of other cities relati,ve to the
matter of loose dogs.
Mayor Pro Tem Damonte at this time introduced the new
City Manager, and on behalf of the City Council expressed
thanks to Mr. Addiego for his services as the Acting City
Manager.
CoUncilman Mirri brought to Council's attention numerous
pieces of concrete dumped at the Marina for riprap from
which reinforcing iron protruded creating a dangerous
condition. He suggested that these be burned off. The
Director of Public Services stated he would check the
matter and take the corrective steps necessary.
Councilman Battaglia commented on the matter of licensing
of apartment houses discussed at a prior meeting by reading
from a prepared statement, a copy of which was filed with
the City Clerk and made a part of these proceedings.
The City Manager briefly explained the request of the Police
Department to submit an application for CETA Special Program
funds. He stated that Captain McKeon was present to explain
this matter.
Prior to continuing with the matter Mayor Pro Tem Damonte
declared a recess at 8:32 PM for the retaping of the TV
cameras.
The meeting was recalled to order at 8:46 PM with all
Council present. Absent, Councilman Padreddii.
Captain McKeon then explained the funds available, that
application must be made by January 10, 1977, and that
Officer Tognetti was present to comment if Council desired.
Further discussion followed, after which there being no
objections Mayor Pro Tem Damonte ordered staff to proceed
with the application.

ADJOURNMENT
There being nothing under Good and Welfare Mayor Pro Tem
Damonte adjourned the meeting.
