AUTH. TRANSFER OF FUNDS FROM PARKING DIST. FUNDS TO GENERAL FUND RESO. DIRECTING FILING OF EMINENT DOMAIN PROCEEDINGS - 427 GRAND AVENUE 7:30 PM. West Orange Avenue Library Auditorium. The meeting was called to order by Mayor Damonte at 7:39 PM. The Pledge of Allegiance to the Flag was recited. .Present: Councilmen Richard A. Battaglia, William A. Borba, Emanuele N. Damonte, Terry J. Mirri and Leo Padreddii. Absent: None. Staff Report, dated May 25, 1977, recommending that Council adopt the two following resolutions: 1) Authorizing the transfer of $50,000 from the Parking District Fund to the General Fund; and 2) Authorizing eminent domain proceedings to acquire property at 427 Grand Avenue. A RESOLUTION AUTHORIZING TRANSFER OF FUNDS FROM THE REVENUE FUND OF THE PARKING PLACE COMMISSION TO THE CITY GENERAL FUND. At the request of the City Manager the Director of Finance explained to Council the acquisition of the Grand Avenue property and recommended that eminent domain proceedings be instituted. Councilman Borba requested the matter be held over, commenting that he opposed eminent domain proceedings. Councilman Padreddii concurred with Councilman Borba, recommending a re-appraisal of the property. Discussion followed, after which Councilman Mirri also suggested a re-evaluation of the property. No Council action was taken and staff was instructed to re-evaluate the property and negotiate again with the property owner. A RESOLUTION DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN LANDS AND DIRECTING THE FILING OF EMINENT DOMAIN PROCEEDINGS. '195 ADMINISTRATIVE SERVICES RESO. DIRECTING FILING OF EMINENT DOMAIN PROCEEDINGS - 427 GRAND AVENUE (CONT ' D. ) STATUS OF CUSTOMER ' S ACCOUNTS AT THE MARINA ITEMS FROM COUNCIL JOINT MEETING WITH LIBRARY BOARD RE GRAND AVENUE LIBRARY MODERNIZATION APPROPRIATION FOR FINANCING LITIGATION No Council action was taken on the suggested resolution. Staff Report, dated May 25, 1977, regarding the status of customer's accounts at the Marina. The Director of Finance explained the delinquent accounts, the interest charged and small claims actions instituted. Councilman Borba suggested colhecting the first and last month's rent in advance to which the Director of Finance stated that it was not in the ordinance but was being considered. Councilman Mirri, commenting on the advance payment of fees, requested a report from other cities in this regard. Discussion followed concerning the matter of live aboards, after which the City Manager stated he would check with other communities and report to Council. No further action was taken. Councilman Borba requested a meeting with the Library Board and staff concerning the matter of the Grand Avenue Library remodeling which recently appeared in the Enterprise-Journal. The City Manager briefly commented in this regard and the meeting held in February with the Library Board at which time funds were appropriated for some remodeling to be done. After some discussion by Council and staff, Mayor Damonte requested that the City Manager arrange a meeting with the Library Board. The City Manager at this time requested an appropriation of $2,500 for financing litigation in the National Institute of Municipal Law Officers Association suit concerning unemployment insurance. Council approved and authorized the appropriation of $2,500. 5/25/77 Page 2 ADJOURNMENT There being nothing further to come before Council, Councilman Borba moved, seconded by Councilman Padreddii and regularly carried that the meeting be adjourned.
