Council Conference Room, City Hall.
The meeting was called to order by Mayor Damonte at
3:37 PM.
The Pledge of Allegiance to the Flag was recited.
Present: Councilmen Emanuele N. Damonte and Terry J. Mirri.
Absent:
Councilmen William A. Borba, Richard A. Battaglia
and Leo Padreddii.
Councilman Borba appeared present at 4:30 PM and remained
for the duration of the meeting.
Councilman Padreddii appeared present at 4:45 PM and
remained for the duration of the meeting.
The City Manager announced that this meeting would be a
continuation of the meeting held September 22, 1977
regarding the problems that exist with the Spruce Avenue
Drive-In Theatre.
Dan Modena, Attorney representing Syufy Enterprises,
explained in detail what he and his client have been
doing since the last meeting in regard to solving the
existing problems. He then requested additional time
for this purpose before Council takes formal action.
Discussion followed between Mr. Modena, Mr. Ray Svanosio,
Mr. Louis Tambini and the owners of an apartment building
located on Railroad Avenue, who all stated that the
problems had .not been remedied.
Discussion continued between the Police Chief, Councilman
Mirri, Mr. Jack Haigh, owner of the theatre and Mr. Ernie
Ferman relative to possible solutions.
Councilman Borba appeared present at 4:30 PM and remained
for the duration of the meeting.

ADJOURNMENT
William Costanzo, City Planner, then commented that the
theatre did constitute a public nuisance and a revocation
hearing was being held by the Planning Commission on
Tuesday, October 11, 1977. In response to Mr. Modena's
request for a continuation of the revocation hearing, the
City Planner explained that he did not have such authority
and that a continuance could only be granted by the Planning
Commission.
Councilman Padreddii appeared present at 4:45 PM and
remained for the duration of the meeting.
Discussion followed between Mr. Modena, Mayor Damonte,
Councilman Mirri and the City Planner regarding the length
of time the problems have existed and the course of
action open to the City and Syufy Enterprises.
There being nothing further to come before Council, the
meeting was adjourned to Thursday, October 13, 1977, at
5:30 PM in the Council Conference Room, City Hall.
Time of adjournment was 5:10 PM.
